Communication and Public Relations Department [email protected] Τηλ : 210 6505600 fax : 210 6511895 Athens, May 30, 2011 Press Release Suspension of Cadastral Data begins in 33 regions of the country "We go through, we verify, we correct" The following announcement was issued by Ktimatologio S.A.'s Communication and Public Relations Department: National Cadastre compilation enters its final stage for another 33 regions of the country, with the Suspension of cadastral data following the processing of property declarations filed by citizens in 2008. This entails 6 municipalities in the district of Thessaloniki, 10 prefecture capitals and 17 municipalities of Attiki prefecture. Suspension will start on June 14 for the six Thessaloniki municipalities, and the remaining areas will gradually follow suit. The Suspension of cadastral data (tables and charts) is a particularly important point in the process of drafting the National Cadastre. It is through this posting that the recording of property declared during the first stage of the survey, and subsequently processed by lawyers and topographers, is made public. This way, everyone is given the opportunity to verify, confirm or even correct possible errors. Consequently, citizen participation is necessary, in order for them to avoid any unnecessary future inconvenience. In view of the Suspension commencement, prof. Apostolos Arvanitis , Chairman and Managing Director of Ktimatologio S.A. made the following statement: July 14, we start Suspension of cadastral data we collected under the cadastral program we started in 2008, concerning six municipalities of northwestern Thessaloniki. Until next September, Interim Cadastral Data concerning 33 out of the program's total of 107 regions will gradually be suspended, concerning a total of 1.4 million rights and 700,000 beneficiaries approximately. Through this process we actualize transparency, since everyone is given the opportunity to check and - in case of error - correct their property's registration in the Cadastre. It is necessary for citizens to participate in this stage of the cadastral survey too, because this way they ensure the proper registration of their rights, which will lead to the final cadastral data, meaning the Initial Registrations of the Cadastre and the operation of Cadastral Offices. At the same time, we are moving with accelerated pace into the third-generation cadastral survey, starting with 268 new regions already under consultation, aiming for completion of National Cadastre compilation for the whole country by the year 2020. At first, the Suspension includes those who already have submitted a Declaration, but at the same time, property rights holders who, for whatever reason, had not yet submitted a Declaration, have yet another chance to record their rights. It is noted that for the first time, this land survey program's Suspension of cadastral data will take place in two ways: apart from the comprehensive posting of Cadastral Tables and Charts in each region's Cadastral Office and the simultaneous mailing of Cadastral Tables and Charts Excerpts to each beneficiary, there will also be an Electronic Suspension in Ktimatologio S.A.'s website ( www.ktimatologio.gr). Specifically, through the e-ktimatologio online services portal, each beneficiary will - after having created his own personal account - be able to access the data that concerns him. Upon completion of the Suspension for each individual region , which includes the process of filing and examination of Appeals and Correction Requests as well as the corresponding corrections to the Cadastral Tables and Charts, interim cadastral data become final , the cadastral survey is completed and the National Cadastre begins to operate in place of the Land Registry. Information Note for the Suspension Procedure The Suspension of the interim cadastral data (tables and charts) takes place in each region’s Cadastral Office for a period of two months. The starting date for this two-month period is individually set for each region, and interested parties are duly informed through the Press by Ktimatologio S.A. The Suspension consists of: a) The Cadastral Table, which includes all property rights for a region, as substantiated by deeds and other data collected during the survey process. The table is organized according to “KAEK” (National Cadastre Code Number), which is a number unique to each property. b)The Cadastral Chart, where the geometrical data of properties is shown (position, limits). What will citizens receive Beside the Suspension of Cadastral Data in Cadastral Offices, to better serve beneficiaries, excerpts of Cadastral Tables and Charts will be delivered by mail to each beneficiary’s stated mailing address. This way, everybody is duly informed about the registration of his rights and the geographical depiction of his property and as far as one is in agreement with these data he does not need to take any kind of action. In case one disagrees with any of the recorded data, he or she may submit either a correction request or an appeal. Specifically, each beneficiary will receive an envelope containing: Form A : Beneficiary Data – Property Codes. The form contains: ¤¤¤¤¤¤ The beneficiary’s personal data, as recorded by the National Cadastre. ¤¤¤¤¤¤ The property codes corresponding to the rights for which the beneficiary has submitted a property declaration. Those property codes are the ones shown on the “Submission of Declaration Receipt”, which the beneficiary obtained upon submitting the property declaration. Form A1 : Suspension Table Excerpt. This form includes the Cadastral Table’s data for the property or right relative to the beneficiary’s property. Form A2 : Suspension Chart Excerpt. This form shows the position and limits of the property concerning the beneficiary, as recorded in the Cadastre. Special cases ¤¤¤¤¤¤ In case of properties which were declared but were either impossible to locate or the information provided for them was deemed insufficient, the beneficiary will only receive Form A. ¤¤¤¤¤¤ Moreover, some beneficiaries may possibly discover (in their "A" Form) property rights having been recorded – on their behalf – for which they have not submitted a declaration . Those will have come up through the processing of other data collected. As far as such rights are concerned, if the beneficiary still owns those rights, he has to submit a declaration in accordance with law 2308/95, subsequently paying the anticipated fixed fee (of either 35 or 20 euro). In such cases, beneficiaries should go to the Cadastral Office, in order to be provided with specific instructions. What should a citizen do ¤ The most critical part of the process is the careful control of the documents which each beneficiary is going to receive by mail. Note that the number of extracts each beneficiary will receive will be equal to the number of rights he/she declared in the specific municipality where a Suspension is held. ¤ Anyone who has submitted a declaration but does not receive the relevant mail must contact the Cadastral Office in charge of the region where his property lies. ¤ Beneficiaries who, for whatever reason, have not submitted a Property Declaration, have yet another chance to go to the Cadastral Office and record their right, thus avoiding any unnecessary future inconvenience. Deadlines for filing Correction Requests and Appeals A beneficiary who is dissatisfied with any of the elements of the Suspension, as well as anyone with an interest in bringing an action, may file an application for correction of land registration or an appeal before the relevant Cadastral Office, within a period of two (2) months if he/she resides in Greece, or within a period of four (4) months if he/she resides abroad. The starting date for this two-month period (or four-month period, respectively) is set by Ktimatologio S.A. through public announcement (in the Press). Correction requests and appeals are to be submitted in person or by proxy to the Cadastral Office responsible for the region of the property involved, at a cost of 5 euro. A pre-requisite for submitting them is the submission of a declaration in accordance with law 2308/1995, as well as the payment of the standard land registration fee. Correction requests are examined and processed by the Cadastral Office, whereas appeals are judged by a three-member committee chaired by a judge. After examination of all Correction Requests and Appeals, cadastral tables and charts are corrected and interim cadastral data become final, under the term Initial Registrations of the Cadastre. Electronic Suspension of cadastral data For the first time, cadastral information is to be electronically suspended through Ktimatologio S.A.'s web-site (www.ktimatologio.gr) , in the e-ktimatologio online services portal. After creating his personal access code, every beneficiary will be able, through e- ktimatologio, to access the Suspension information that concerns him/her. In order to access this service, beneficiaries will need three “keys” which are recorded on the Submission of Declaration receipt: Declaration Registration Number, Personal Code Number, Property Code Number. Following Suspension, what changes in Property Declaration Procedure? One month after the beginning of Suspension for a region, attaching a Certificate of Declaration Submission becomes mandatory for all transactions involving property of this region. This certificate is issued by the region’s Cadastral Office, and notaries have to require it upon drafting of
