5 years OBI Foreword
The years 2007 and 2008 were marked by intense activity by our Organisation with the constant and focused aim of contributing to the development of innovation in Greece. In the years 2005 - 2008, the increase in the filings of national patents increased by more than 60% (2004: 514; 2005: 631; 2006: 709; 2007: 788; 2008: 825). There was also an upward trend in protected designs and models, the number of which in 2005 was 1,673, whereas in 2008 it was 3,195 (a 90% increase). The increase in protected designs and models applications is also clearly perceptible in the 2007 - 2008 annual variation, where the increase approaches 26% (2007: 2,523; 2008: 3,195).
Greece has a fundamental need for the social cultivation of an Intellectual Property mentality, and the develop- ment of a culture of the registration, protection and exploitation of invention. It is with this as a criterion and aim that OBI focused its activities during both these years. On the completion of 20 years of operation, OBI awarded its third series of prizes for inventions in Greece, and for the first time made awards for the best ideas in children’s creativity. The selection of these young people’s inventions and designs was a continuation of an educational programme which was inaugurated in 2007, addressed to students in the last class of primary school students. This programme is continuing with great success. As a part of the IP EuropAware Community Programme, actions were initiated in order to draw attention to the problem of counter of products with wide-ranging briefing of small and medium-sized enterprises so that they can protect themselves. Research into the needs of SMEs in matters of intellectual property, visits by OBI personnel to companies, specialised scientific printed matter, and development of the services of OBI are some of the areas of activity included in the IP EuropAware Programme. Furthermore, a large number of events, such as day conferences, exhibitions, the observance of World Intellectual Property Day, and the continuing visits by OBI to various productive units and agencies complemented its efforts for constant and comprehensive briefing of the public on intellectual property matters. Steps were taken for the harmonisation with European Union legislation and the modernisation of law in the field of industrial property, for example by the extension of the term of the Supplementary Protection Certifi- cates for paediatric pharmaceuticals, the amendment of the convention on the granting of European patents, and the introduction of the new search report with a written opinion. This will increase the real value of the patents granted.
The dynamic presence of OBI during this two-year period, apart from its improved services, was always directed towards contributing to the development of innovation by support of SMEs and patents and the encouragement of inventiveness and creativity in Greece. Enterprises, research centres, and the universities have great potential for contributing to the country’s sci- ence, technology, and economy through research, and the registration and exploitation of inventions. In this field, Greece is capable of significant progress.

6 Η διετία 2007-2008 χαρακτηρίστηκε από μία έντονη δράση του Οργανισμού με διαρκή σκοπό την συμβολή του στην ανάπτυξη της καινοτομίας στην Ελλάδα. Τα έτη 2005-2008 η αύξηση των καταθέσεων των Εθνικών Διπλωμάτων Ευρεσιτεχνίας ξεπέρασε το 60% (2004: 514, 2005: 631, 2006: 709, 2007:788, 2008: 825). Αυξητική τάση παρουσιάστηκε επίσης και στα προστατευόμενα σχέδια και υποδείγματα, ο αριθμός των οποίων το 2005 ήταν 1.673 ενώ ο αντίστοιχος το 2008 είναι 3.195 (αύξηση 90%). Η αυξητική πορεία των αιτήσεων των προστατευόμενων σχεδίων και

Η Ελλάδα έχει πρωταρχική ανάγκη για την καλλιέργεια νοοτροπίας Διανοητικής Ιδιοκτησίας, την ανάπτυξη κουλτούρας κατοχύρωσης και εκμετάλλευσης της εφευρετικότητας. Με αυτόν τον γνώμονα και στόχο ο ΟΒΙ δραστηριοποιήθηκε και τα δύο αυτά χρόνια. Συμπληρώνοντας τα 20 χρόνια λειτουργίας του, πραγματοποίησε την Γ’ Βράβευση εφευρέσεων στην Ελλάδα και για πρώτη φορά βράβευσε τις καλύτερες ιδέες παιδικής δημιουργικότητας. Η επιλογή των νεανικών αυτών εφευρέσεων και σχεδίων αποτέλεσε συνέχεια ενός εκπαιδευτικού προγράμματος που εγκαινιάστηκε το 2007, απευθυνόμενο σε μαθητές της ΣΤ’ τάξης του Δημοτικού Σχολείου. Το πρόγραμμα αυτό συνεχίζεται με μεγάλη επιτυχία. Συμμετέχοντας στο Κοινοτικό Πρόγραμμα IP EuropAware, ξεκίνησαν δράσεις για την ανάδειξη του προβλήματος της αντιγραφής προϊόντων με ευρεία ενημέρωση των Μικρομεσαίων Επιχειρήσεων ώστε να μπορέσουν να προστατευθούν. Έρευνα για τις ανάγκες των Μικρομεσαίων Επιχειρήσεων για θέματα Διανοητικής Ιδιοκτησίας, επισκέψεις στελεχών του ΟΒΙ σε εταιρείες, εξειδικευμένο επιστημονικό έντυπο υλικό και ανάπτυξη των υπηρεσιών του ΟΒΙ, είναι κάποιες από τις ενέργειες που περιλαμβάνονται στο Πρόγραμμα IP EuropAware . Επιπλέον, ένας μεγάλος αριθμός εκδηλώσεων, όπως ημερίδες, εκθέσεις, εορτασμός της Παγκόσμιας Ημέρας Διανοητικής Ιδιοκτησίας και η συνέχεια των επισκέψεων του ΟΒΙ σε διάφορες παραγωγικές μονάδες και φορείς, συμπλήρωσαν την προσπάθειά του για διαρκή και πληρέστερη ενημέρωση του κοινού σε θέματα Βιομηχανικής Ιδιοκτησίας. Έγιναν βήματα για την εναρμόνιση της ελληνικής νομοθεσίας με την κοινοτική και τον εκσυγχρονισμό δικαίου στον τομέα της Βιομηχανικής Ιδιοκτησίας, όπως η παράταση της διάρκειας των Συμπληρωματικών Πιστοποιητικών Προστασίας για παιδιατρικά φάρμακα, η τροποποίηση της σύμβασης για τη χορήγηση Ευρωπαϊκού Δ.Ε. και η εισαγωγή του θεσμού της νέας έκθεσης έρευνας με αιτιολογημένη γνώμη. Αυτό θα αυξήσει το κύρος των χορηγουμένων Διπλωμάτων Ευρεσιτεχνίας.
Η δυναμική παρουσία του ΟΒΙ σ’ αυτή τη διετία, εκτός από την ουσιαστική παροχή των βελτιωμένων υπηρεσιών του, είναι πάντα προς την κατεύθυνση της συμβολής στην ανάπτυξη της καινοτομίας με στήριξη των Μικρομεσαίων Επιχειρήσεων και των ευρεσιτεχνιών και την ενθάρρυνση της εφευρετικότητας και της δημιουργικότητας στην Ελλάδα. Οι επιχειρήσεις, τα Ερευνητικά Κέντρα και τα Πανεπιστήμια έχουν μεγάλες δυνατότητες συμβολής στην επιστήμη, την τεχνολογία και την οικονομία της χώρας μας μέσα από την έρευνα, κατοχύρωση και εκμετάλλευση των εφευρέσεων. Η Ελλάδα στον τομέα αυτό μπορεί να προχωρήσει σημαντικά!

7 Services provided to the public
OBI is exclusively responsible in Greece for registering inventions and industrial designs and models and for issues of technological information provision and technology transfer.
Against this background:
1. It registers inventions in Greece by granting: • Patents • Utility Model Certificates and other protection titles such as supplementary protection certificates for medicinal products and plant protection products. 2. It registers the topographies of integrated circuits. 3. It protects industrial designs and models. 4. It operates as a receiving office for applications for: • European Patents (to protect an invention in any of the 35 signatories to the Munich Convention) • The PCT procedure (where with one action the application is valid in any of the 141 signatory states) • International registration of industrial designs • Community designs and models in the context of implementation of Council Regulation (EC) No 6/2002 of 12 December 2001 (since 1 April 2003). 5. It provides technological information to the public obtained from patents registered in leading countries worldwide using state-of-the-art IT systems which provide access to OBI databases, European Patent Office databases (EPOQUE) and those of external commercial distributors. 6. It also runs regional electronic patent libraries which seek to provide technological information services throughout all of Greece. Three such regional electronic libraries are already in operation in Iraklio on Crete, in Thessaloniki and in Patra. 7. It registers technology transfer contracts in a special register. 8. It provides advice and information: • On the legal system applicable to its field of competences • To inform the public about registering inventions and the appropriate policy for protecting them. 9. It also provides a new one-stop-shop service to the public offering direct responses to queries falling within its remit. 10. It offers the public a free help line (8001108108) to ensure better service and information dissemination. 11. It publishes printed material such as: • The Industrial Property Bulletin • Other bulletins and informative leaflets. 12. It has a non-lending technical and legal library for the public. 13. It participates in exhibitions and organises events to inform the public at large about its work. 14. It provides opinions on matters within its competences. 15. It is active internationally: • Cooperating with similar organisations abroad and at international level and represents Greece in these organisations • Preparing and inspecting the implementation of international treaties on matters of protection of inventions, technology transfer and industrial designs and models.
8 Ο ΟΒΙ έχει την αποκλειστική αρμοδιότητα στην Ελλάδα για την κατοχύρωση των εφευρέσεων και την καταχώριση των βιομηχανικών σχεδίων και υποδειγμάτων, καθώς επίσης για θέματα τεχνολογικής πληροφόρησης και μεταφοράς τεχνολογίας.
Στο πλαίσιο αυτό:
1. Κατοχυρώνει τις εφευρέσεις στην Ελλάδα, χορηγώντας • Διπλώματα Ευρεσιτεχνίας (ΔΕ) • Πιστοποιητικά Υποδείγματος Χρησιμότητας (ΠΥΧ) και άλλους τίτλους προστασίας, όπως συμπληρωματικά πιστοποιητικά προστασίας για φάρμακα και φυτοπροστατευτικά προϊόντα. 2. Κατοχυρώνει τις τοπογραφίες ολοκληρωμένων κυκλωμάτων. 3. Προστατεύει τα βιομηχανικά σχέδια και υποδείγματα. 4. Λειτουργεί ως γραφείο παραλαβής αιτήσεων • για Ευρωπαϊκό Δίπλωμα Ευρεσιτεχνίας (για προστασία της εφεύρεσης σε οποιαδήποτε από τα 35 κράτη - μέλη της Σύμβασης του Μονάχου). • για τη διαδικασία κατάθεσης PCT (όπου με μία ενέργεια ισχύει η αίτηση σε οποιεσδήποτε από τις 141 χώρες - μέλη). • για τη διεθνή καταχώριση των βιομηχανικών σχεδίων. • για τα κοινοτικά σχέδια και υποδείγματα στο πλαίσιο της εφαρμογής του Κανονισμού (ΕΚ) αριθμ. 6/2002 του Συμβουλίου της 12ης Δεκεμβρίου 2001 (από 1ης Απριλίου 2003). 5. Έχει τη δυνατότητα παροχής τεχνολογικής πληροφόρησης προς το κοινό μέσα από διπλώματα ευρεσιτεχνίας των σημαντικότερων χωρών του κόσμου με τη χρήση προηγμένων πληροφοριακών συστημάτων πρόσβασης, τόσο στις βάσεις του ΟΒΙ, όσο και σε βάσεις δεδομένων του ΕΓΔΕ (EPOQUE) και εξωτερικών εμπορικών διαθετών. 6. Διαθέτει περιφερειακές ηλεκτρονικές βιβλιοθήκες ΔΕ, με σκοπό να παρέχει τις υπηρεσίες της τεχνολογικής πληροφόρησης και στον ευρύτερο ελλαδικό χώρο. Ήδη λειτουργούν τρεις περιφερειακές ηλεκτρονικές βιβλιοθήκες, στο Ηράκλειο Κρήτης, στη Θεσσαλονίκη και στην Πάτρα. 7. Καταχωρεί Συμβάσεις Μεταφοράς Τεχνολογίας σε ειδικό μητρώο. 8. Παρέχει συμβουλές και πληροφορίες • για το ισχύον νομοθετικό σύστημα στο χώρο των αρμοδιοτήτων του • για την κατατόπιση του κοινού στην κατοχύρωση των εφευρέσεών του και τη σωστή πολιτική προστασίας. 9. Παρέχει τη νέα υπηρεσία «Μιας Στάσης» για την εξυπηρέτηση του κοινού, για άμεση απάντηση σε ερωτήματα, στο πλαίσιο των αρμοδιοτήτων του. 10. Παρέχει για το κοινό τηλεφωνική γραμμή επικοινωνίας χωρίς χρέωση (800-11-081-08), με στόχο την καλύτερη εξυπηρέτηση και ενημέρωσή του. 11. Εκδίδει έντυπα όπως: • το Ειδικό Δελτίο Βιομηχανικής Ιδιοκτησίας (ΕΔΒΙ) • ενημερωτικά και διευκρινιστικά φυλλάδια. 12. Διαθέτει για το κοινό του τεχνική και νομική μη δανειστική βιβλιοθήκη. 13. Συμμετέχει σε εκθέσεις και διοργανώνει εκδηλώσεις για την ευρύτερη πληροφόρηση του κοινού. 14. Γνωμοδοτεί για θέματα των αρμοδιοτήτων του 15. Ενεργεί δυναμικά στο διεθνή χώρο: • συνεργάζεται με ομοειδείς Οργανισμούς άλλων χωρών και αντίστοιχους διεθνείς και εκπροσωπεί την Ελλάδα σ’ αυτούς. • προετοιμάζει και ελέγχει την εφαρμογή των διεθνών συνθηκών σε θέματα προστασίας εφευρέσεων, μεταφοράς τεχνολογίας και βιομηχανικών σχεδίων και υποδειγμάτων.
Προσφερόμενες Υπηρεσίες στο κοινό
9 Industrial property titles provide their holders with the exclusive right to exploit the protected invention or protected industrial design in Greece for such time as they are in effect. In other words they provide a right to exploit the invention or industrial design on a monopolistic basis.
The main protection titles issued by OBI are: • Patents • Utility Model Certificates • Protection certificates for designs and models.
More specifically:
A patent is a title of protection valid for 20 years issued to the patentee for an invention which is new and involves an inventive step and is capable of industrial application.
The Utility Model Certificate is a title of protection valid for 7 years issued to the proprietor for three- dimensional objects with a predetermined shape and form which provide a solution to a technical problem.
An industrial design is an externally visible image of all or part of an industrial or handicraft product which results from its specific features such as shape, outline, colour. The conditions for protecting an industrial design are that it is new and of individual character.
The procedure for having a patent or Utility Model Certificate granted is both short and simple:
For patents the procedure is as follows: 1. Filing of an application with all the necessary particulars 2. A 4-month term for any corrections or additions to be made 3. Preparation of a search report (done by OBI) 4. A deadline of 3 months for comments to be made on the report by the applicant 5. Preparation of the final search report 6. Grant of the patent
For Utility Model Certificates the procedure is as follows: 1. Filing of an application with all the necessary particulars 2. A 4-month term for any corrections or additions to be made 3. Granting of the Utility Model Certificates
The procedure for granting protection certificates for industrial designs is as follows: 1. Graphic or photographic representation of the design or model 2. Payment receipt by OBI to indicate that filing and registration fees have been paid 3. 10 Οι τίτλοι βιομηχανικής ιδιοκτησίας παρέχουν στον κάτοχό τους το αποκλειστικό δικαίωμα να εκμεταλλεύεται την προστατευόμενη εφεύρεση ή το προστατευόμενο βιομηχανικό σχέδιο στην Ελλάδα για όσο καιρό είναι σε ισχύ. Παρέχει δηλαδή δικαίωμα μονοπωλιακής εκμετάλλευσης της εφεύρεσης ή του βιομηχανικού σχεδίου.
Οι κυριότεροι τίτλοι προστασίας που χορηγεί ο ΟΒΙ είναι: • Δίπλωμα Ευρεσιτεχνίας (ΔΕ) • Πιστοποιητικό Υποδείγματος Χρησιμότητας (ΠΥΧ) • Πιστοποιητικό Προστασίας για Σχέδια ή Υποδείγματα
Αναλυτικότερα:
Το ΔΕ είναι τίτλος προστασίας με διάρκεια 20 χρόνων, που χορηγείται στο δικαιούχο για επινοήματα νέα που εμπεριέχουν εφευρετική δραστηριότητα και είναι επιδεκτικά βιομηχανικής εφαρμογής.
Το ΠΥΧ είναι τίτλος προστασίας με ισχύ 7 χρόνων, που χορηγείται στο δικαιούχο για τρισδιάστατα αντικείμενα, με καθορισμένο σχήμα και μορφή που δίνουν λύση σε τεχνικό πρόβλημα.
Το Βιομηχανικό Σχέδιο είναι η εξωτερικά ορατή εικόνα του συνόλου ή μέρους ενός βιομηχανικού ή βιοτεχνικού προϊόντος, η οποία προκύπτει από τα ιδιαίτερα χαρακτηριστικά που έχει (πχ. σχήμα, γραμμή, χρώμα). Οι προϋποθέσεις για την προστασία ενός βιομηχανικού σχεδίου είναι να είναι νέο και να έχει ατομικό χαρακτήρα.
Η διαδικασία για τη χορήγηση ΔΕ ή ΠΥΧ, είναι απλή και σύντομη.
Για ΔΕ είναι η ακόλουθη: 1. Κατάθεση αίτησης με όλα τα απαραίτητα στοιχεία 2. Προθεσμία 4 μηνών για τυχόν διορθώσεις ή προσθήκες 3. Σύνταξη Έκθεσης Έρευνας (γίνεται από τον ΟΒΙ) 4. 3μηνη προθεσμία για τυχόν παρατηρήσεις του καταθέτη σχετικά με την Έκθεση Έρευνας 5. Σύνταξη τελικής Έκθεσης Έρευνας 6. Έκδοση ΔΕ
Για ΠΥΧ είναι η ακόλουθη: 1. Κατάθεση αίτησης με όλα τα απαραίτητα στοιχεία 2. Προθεσμία 4 μηνών για τυχόν διορθώσεις ή προσθήκες 3. Έκδοση ΠΥΧ
Η διαδικασία για τη χορήγηση Πιστοποιητικού Προστασίας για Σχέδια ή Υποδείγματα: 1. Γραφική ή φωτογραφική παράσταση του σχεδίου ή υποδείγματος 2. Απόδειξη είσπραξης από τον ΟΒΙ του τέλους κατάθεσης και καταχώρησης 3. In 2007 the scheduled actions and objectives which had been set were completed.
More specifically, the following were carried out:
• Receipt, checking, and forwarding of international applications to the International and European Office, respectively (up to 15/04/2007).
• Receipt, checking, and forwarding of European applications to the European Office (up to 15/04/2007).
• Receipt, checking, and forwarding of international industrial designs to the International Office (up to 15/04/2007).
• Receipt, checking, and forwarding of Community industrial designs.
• Compilation of expert opinions.
• Publication of all the acts of certificate changes for all industrial property titles.
• Publication of all the acts on rejections, partial rejections, withdrawals and waivers (from 03/2007) for all industrial property titles.
• Dispatch of ‘A guide to good practice as to Technology Transfer’ to individuals and various agencies.
• Replies to e-mails or to applications of clients or lawyers.
• Keeping and processing of a file of Conventions (up to 18/04/2007, when these were delivered to the Legal Directorate).
• Keeping of a file of competitions (up to 18/04/2007, when these were delivered to the Finance Directorate).
• Reports to the Council of State in connection with court cases.
• Preparation of a draft Presidential Decree on the ‘Harmonisation of Greek legislation with the corresponding Community legislation in the field of taking measures for the protection and securing of industrial property rights in compliance with Directive 2004/48/EC of the European Parliament and the Council of 29 April 2004, in connection with the enforcement of intellectual property rights’. More specifically, we would report that by Directive 2004/48/EC of the European Parliament and of he Council of 29 April 2004 in connection with the enforcement of intellectual property rights, the harmonisation of national provisions as regards means of enforcing respect for intellectual property rights is being sought. This harmonisation is necessary in order to combat effectively tampering with/imitation, and piracy of products, a phenomenon which is spreading on a daily basis by exploiting the differences between national legislations
32 Kατά το 2007 ολοκληρώθηκαν οι προγραμματισμένες ενέργειες και στόχοι που είχαν τεθεί.
Συγκεκριμένα πραγματοποιήθηκαν:
• Παραλαβή, έλεγχος και διαβίβαση διεθνών αιτήσεων στο Διεθνές και στο Ευρωπαϊκό Γραφείο αντίστοιχα (μέχρι 15/4/2007) .
• Παραλαβή, έλεγχος και διαβίβαση ευρωπαϊκών αιτήσεων στο Ευρωπαϊκό Γραφείο (μέχρι 15/4/2007).
• Παραλαβή, έλεγχος και διαβίβαση διεθνών βιομηχανικών σχεδίων στο Διεθνές Γραφείο (μέχρι 15/4/2007).
• Παραλαβή, έλεγχος και διαβίβαση Κοινοτικών βιομηχανικών σχεδίων .
• Σύνταξη γνωμοδοτήσεων.
• Έκδοση όλων των πράξεων και πιστοποιητικών μεταβολών για όλους τους τίτλους βιομηχανικής ιδιοκτησίας.
• Έκδοση όλων των πράξεων για απορρίψεις, μερικές απορρίψεις, αποσύρσεις και παραιτήσεις (από 3ο/2007) όλων των τίτλων βιομηχανικής ιδιοκτησίας.
• Αποστολή «Οδηγού καλής πρακτικής για τη Μεταφορά Τεχνολογίας» σε ιδιώτες και διάφορους φορείς.
• Απαντήσεις σε e-mail ή και σε αιτήσεις πελατών ή δικηγόρων.
• Τήρηση και διεκπεραίωση αρχείου Συμβάσεων (μέχρι 18/4/2007 όπου και παραδόθηκαν στη Δ/νση Δικαστικού).
• Τήρηση αρχείου διαγωνισμών (μέχρι 18/4/2007 όπου και παραδόθηκαν στην Οικονομική Δ/νση).
• Εκθέσεις στο ΣτΕ σχετικά με δικαστικές υποθέσεις.
• Προετοιμασία σχεδίου ΠΔ για την “Εναρμόνιση της ελληνικής νομοθεσίας προς την αντίστοιχη κοινοτική στον τομέα λήψης μέτρων προστασίας και διασφάλισης των δικαιωμάτων της βιομηχανικής ιδιοκτησίας σε συμμόρφωση με την Οδηγία 2004/48/ΕΚ του Ευρωπαϊκού Κοινοβουλίου και του Συμβουλίου της 29ης Απριλίου 2004 σχετικά με την επιβολή των δικαιωμάτων της διανοητικής ιδιοκτησίας”. Ειδικότερα, αναφέρουμε ότι με την Οδηγία 2004/48/ΕΚ του Ευρωπαϊκού Κοινοβουλίου και του Συμβουλίου της 29ης Απριλίου 2004 σχετικά με την επιβολή των δικαιωμάτων διανοητικής ιδιοκτησίας, επιδιώκεται η εναρμόνιση των εθνικών διατάξεων όσον αφορά στα μέσα επιβολής του σεβασμού των δικαιωμάτων διανοητικής ιδιοκτησίας. Η εναρμόνιση αυτή είναι απαραίτητη για να καταπολεμηθεί αποτελεσματικά η παραποίηση /απομίμηση και η πειρατεία προϊόντων, φαινόμενο το οποίο εξαπλώνεται καθημερινά εκμεταλλευόμενο τις διαφορές μεταξύ των εθνικών νομοθεσιών για τη βιομηχανική ιδιοκτησία και ειδικότερα για τα διπλώματα ευρεσιτεχνίας. 33 on industrial property and more particularly as to patents. By the draft of the Presidential Decree in question, the incorporation of Directive 2004/48/EC is achieved by the addition of Articles 17A, 17B, 17C, 17D, 17E, and 17F toArticle 17 of Law 1733/1987, currently in force.
• Preparation of a draft of amended Presidential Decree 77/1988 ‘Amendment of Presidential Decree 77/1988 (Official Journal of the Hellenic Republic 33, A’) in implementation of Act of Revision of the Convention on the granting of European patents of 20 November 2000, which was ratified by Law 3396/2005’. More specifically, we would report that after the ratification by Greece of the Act of Revision of the Convention on the granting of European patents (Convention on the European patent of 5 October 1973, which was amended on 17 December 1991) of 29 November 2000 (Law 3396/2005, Official Journal of the Hellenic Republic 246 A’), the provisions on adaptation to national law of the new provisions of the Act of Revision must be adopted by Presidential Decree. The provision authorising the issuing of the Presidential Decree in question is based both on Article 23, para. 10 of Law 1733/1987 ‘Transfer of technology, inventions, technological innovation, and setting up of an Atomic Energy Committee’ (Official Journal of the Hellenic Republic 171 A’) and on the second article of ratifying Law 3396/2005. By the proposed draft Presidential Decree, certain provisions of Presidential Decree 77/1988 (Official Journal of the Hellenic Republic 33, A’) are adapted and amended, and more recent 07 regulations are added where needed.
• Preparation of a draft Ministerial Decision in connection with the ‘Procedure for lodging applications with OBI for a six-month extension of the force of the supplementary protection certificate for paediatric pharmaceuticals’. More specifically, we would report that Regulation (EC) No. 1901/2006 of the European Parliament and of the Council of 12 December 2006 on paediatric pharmaceuticals and on the amendment of Regulation (EEC) No.1768/92, of Directive 2001/20/EC, of Directive 2001/83/EC, and of Regulation (EC) No. 726/2004 (EU EC No. L 378/1) introduced into Article 36 the possibility of extending the term of a supplementary protection certificate for paediatric pharmaceuticals. As regards paediatric pharmaceuticals, Regulation (EC) No. 1901/2006 establishes extra prerequisites for the issuing of a marketing permit, for the encouragement of the carrying out of studies of pharmaceuticals suitable for paediatric use and the avoidance of pointless clinical tests on children. As a consideration for the carrying out of studies, a six-month extension of the supplementary protection certificate which has been granted for a paediatric pharmaceutical is provided. Article 36 of Regulation (EC) No. 1901/2006 contains the relevant regulation.
The Industrial Property Organisation (OBI) as the authority competent as to industrial property in ac- cordance with Article 9 of Regulation (EEC) 1768/92 on the granting of supplementary protection certifi- cates extends its confirmation to the holder of the supplementary protection certificate as to the exten- sion of the force of the supplementary protection certificate in accordance with Article 8 of the Ministerial Decision provided that the prerequisites for protection are fulfilled, or, otherwise, rejects it, and publishes the relevant act in the special Industrial Property Bulletin (EDBI) which it publishes. 34 Με το σχέδιο του εν λόγω Προεδρικού Διατάγματος πραγματοποιείται η ενσωμάτωση της Οδηγίας 2004/48/ΕΚ με προσθήκη των άρθρων 17Α, 17Β, 17Γ, 17Δ, 17Ε και 17ΣΤ στο ισχύον άρθρο 17 του Ν. 1733/1987.
• Προετοιμασία σχεδίου τροποποιημένου ΠΔ 77/1988 “Τροποποίηση του Π.Δ. 77/1988 (ΦΕΚ 33, Α’) κατ’ εφαρμογή της Πράξης Αναθεώρησης της Σύμβασης για τη χορήγηση των ευρωπαϊκών διπλωμάτων ευρεσιτεχνίας της 29ης Νοεμβρίου 2000 που κυρώθηκε με το Ν. 3396/2005”. Ειδικότερα, αναφέρουμε ότι μετά την κύρωση από την Ελλάδα της Πράξης Αναθεώρησης της Σύμβασης για τη χορήγηση των Ευρωπαϊκών διπλωμάτων ευρεσιτεχνίας (Σύμβαση για το ευρωπαϊκό δίπλωμα ευρεσιτεχνίας της 5ης Οκτωβρίου 1973, η οποία τροποποιήθηκε στις 17 Δεκεμβρίου 1991) της 29ης Νοεμβρίου 2000 (Ν. 3396/2005, ΦΕΚ 246, Α’) πρέπει να υιοθετηθούν με Προεδρικό Διάταγμα οι διατάξεις εφαρμογής στο εθνικό δίκαιο των νέων προβλέψεων της Πράξης Αναθεώρησης. Η εξουσιοδοτική διάταξη για την έκδοση του εν λόγω Προεδρικού Διατάγματος βασίζεται τόσο στο ισχύον άρθρο 23 παρ. 10 του Ν. 1733/1987 «Μεταφορά τεχνολογίας, εφευρέσεις, τεχνολογική καινοτομία και σύσταση Επιτροπής Ατομικής Ενέργειας» (ΦΕΚ 171, Α’) όσο και στο δεύτερο άρθρο του κυρωτικού Νόμου 3396/2005. Με το προτεινόμενο σχέδιο Προεδρικού Διατάγματος προσαρμόζονται και τροποποιούνται ορισμένες διατάξεις του ισχύοντος ΠΔ 77/1988 (ΦΕΚ 33, Α’) και προστίθενται νεότερες ρυθμίσεις, όπου απαιτείται. 07 • Προετοιμασία σχεδίου Υπουργικής Απόφασης σχετικά με “Διαδικασία κατάθεσης αίτησης στον ΟΒΙ για εξάμηνη παράταση της διάρκειας ισχύος του συμπληρωματικού πιστοποιητικού προστασίας για παιδιατρικά φάρμακα”. Ειδικότερα, αναφέρουμε ότι ο Κανονισμός (ΕΚ) αριθ. 1901/2006 του Ευρωπαϊκού Κοινοβουλίου και του Συμβουλίου της 12ης Δεκεμβρίου 2006 για τα παιδιατρικά φάρμακα και για την τροποποίηση του κανονισμού (ΕΟΚ) αριθ. 1768/92, της οδηγίας 2001/20/ΕΚ,της οδηγίας 2001/83/ΕΚ και του κανονισμού (ΕΚ) αριθ. 726/2004 (ΕΕ ΕΚ αρ. L 378/1) εισήγαγε στο άρθρο 36 τη δυνατότητα παράτασης της διάρκειας ενός συμπληρωματικού πιστοποιητικού προστασίας για παιδιατρικό φάρμακο. Όσον αφορά στα παιδιατρικά φάρμακα ο Κανονισμός (ΕΚ) αριθ. 1901/2006 θεσπίζει επιπλέον προϋποθέσεις για την έκδοση αδείας κυκλοφορίας, για την ενθάρρυνση της διεξαγωγής μελετών φαρμάκων κατάλληλων για παιδιατρική χρήση και την αποφυγή άσκοπων κλινικών δοκιμών σε παιδιά. Ως ανταμοιβή για τη διεξαγωγή μελετών παρέχεται η εξάμηνη παράταση του συμπληρωματικού πιστοποιητικού προστασίας που έχει χορηγηθεί για ένα παιδιατρικό φάρμακο. Το άρθρο 36 του Κανονισμού (ΕΚ) αριθ. 1901/2006 περιέχει τη σχετική ρύθμιση.
Ο Οργανισμός Βιομηχανικής Ιδιοκτησίας (ΟΒΙ) ως η αρμόδια αρχή βιομηχανικής ιδιοκτησίας κατ’ άρθρο 9 του Κανονισμού (ΕΟΚ) 1768/92 για τη χορήγηση των συμπληρωματικών πιστοποιητικών προστασίας χορηγεί και τη βεβαίωση στον κάτοχο του συμπληρωματικού πιστοποιητικού προστασίας για την παράταση της ισχύος του συμπληρωματικού πιστοποιητικού προστασίας κατά το άρθρο 8 της Υπουργικής Απόφασης, εφόσον συντρέχουν οι προϋποθέσεις προστασίας ή την απορρίπτει στην αντίθετη περίπτωση και δημοσιεύει την σχετική πράξη στο Ειδικό Δελτίο Βιομηχανικής Ιδιοκτησίας (ΕΔΒΙ) που εκδίδει. In 2008, the scheduled activities and goals that had been set were implemented.
Specifically, the following were accomplished:
• Issuing of all the acts and certificate changes for all industrial property titles.
• Issuing of all the acts for rejections, partial rejections, withdrawals, and waivers of all industrial property titles.
• Drawing up of opinions on legal issues relating to industrial property.
• Sending the “Technology Transfer Good Practice Guide” to individuals and various bodies.
• Responding to questions from clients and lawyers.
• Issuing and publication in the Government Gazette of Ministerial Decision (no. 11475 EFA 2388) on the ‘Procedure for applying to OBI for a six-month extension of the validity of the supplementary protection certificate for paediatric pharmaceuticals’ (Government Gazette B 1165/25 June 2008).
This Ministerial Decision defines the details for implementing Regulation (EC) No. 1901/2006 of the European Parliament and Council of 12 December 2006 ‘on medicinal products for paediatric use and amending Regulation (EEC) No. 1768/92, Directive 2001/20/EC, Directive 2001/83/EC, and Regulation (EC) No. 726/2004 (EU EC No. L 378/1)’. This Regulation established the possibility of extending the validity of a supplementary certificate of protection for paediatric medicines for six months.
The Industrial Property Organisation (OBI), as the competent authority for industrial property, in accordance with Article 9 of Regulation (EEC) 1768/92 on granting supplementary protection certificates grants certification to the holder of a supplementary protection certificate for the extension of the validity of the supplementary protection certificate if all the conditions for protection are satisfied (Article 8 of the Ministerial Decision). The relevant act is published in the Industrial Property Bulletin (EDBI).
• Preparation of a draft Ministerial Decision for the ‘Procedure for compiling the search report or the final search report by OBI’. This Ministerial Decision implements the collaboration agreement between the European Patent Office and the Greek Industrial Property Organisation, signed in Monaco on 22 October 2008 and ratified by the OBI Administrative Council at its meeting No. 13/2008 on 31 October 2008. The Ministerial Decision was issued on the authorisation of Article 8, para. 10 of Law 1733/1987 ‘Technology transfer, inventions, technological innovation and formation of the Atomic Energy Commission (Government Gazette 171, A’) and is accompanied by a set of points for its application on both a legal and technical level. These points were developed through discussions between EPO and OBI experts. They are drawn from EPO’s Guidelines for Search as well as the International Search and Preliminary Examination Guidelines and are used during the compilation of a search report and supporting opinion for Greek applications for patents from the European Patent Office (EPO). • Participation and representation at the WIPO General Assembly, the EPO Management Committee, the EPO patent legal group, and other working groups.
36 Kατά το 2008 ολοκληρώθηκαν οι προγραμματισμένες ενέργειες και στόχοι που είχαν τεθεί.
Συγκεκριμένα πραγματοποιήθηκαν :
• Έκδοση όλων των πράξεων και πιστοποιητικών μεταβολών για όλους τους τίτλους βιομηχανικής ιδιοκτησίας.
• Έκδοση όλων των πράξεων για απορρίψεις, μερικές απορρίψεις, αποσύρσεις και παραιτήσεις όλων των τίτλων βιομηχανικής ιδιοκτησίας.
• Σύνταξη γνωμοδοτήσεων για νομικά θέματα βιομηχανικής ιδιοκτησίας.
• Αποστολή «Οδηγού καλής πρακτικής για τη Μεταφορά Τεχνολογίας» σε ιδιώτες και διάφορους φορείς.
• Απαντήσεις σε αιτήματα πελατών ή δικηγόρων.
• Έκδοση και δημοσίευση στο ΦΕΚ της Υπουργικής Απόφασης (αριθμ. 11475 ΕΦΑ 2388) σχετικά με τη “Διαδικασία κατάθεσης αίτησης στον ΟΒΙ για εξάμηνη παράταση της διάρκειας ισχύος του συμπληρωματικού πιστοποιητικού προστασίας για παιδιατρικά φάρμακα”. (ΦΕΚ Β’ 1165/25 Ιουνίου 2008)
Με την ενλόγω Υπουργική Απόφαση ορίζονται οι λεπτομέρειες εφαρμογής του Κανονισμού (ΕΚ) αριθ. 1901/2006 του Ευρωπαϊκού Κοινοβουλίου και του Συμβουλίου της 12ης Δεκεμβρίου 2006 «για τα παιδιατρικά φάρμακα και για την τροποποίηση του Κανονισμού (ΕΟΚ) αριθ. 1768/92, της Οδηγίας 2001/20/ΕΚ, της Οδηγίας 2001/83/ΕΚ και του Κανονισμού (ΕΚ) αριθ. 726/2004 (ΕΕ ΕΚ αρ. L 378/1)». Με τον Κανονισμό αυτό θεσπίσθηκε η δυνατότητα παράτασης της διάρκειας ενός συμπληρωματικού πιστοποιητικού προστασίας για παιδιατρικό φάρμακο για έξι μήνες.
Ο Οργανισμός Βιομηχανικής Ιδιοκτησίας (ΟΒΙ) ως η αρμόδια αρχή βιομηχανικής ιδιοκτησίας κατ’ άρθρο 9 του Κανονισμού (ΕΟΚ) 1768/92 για τη χορήγηση των συμπληρωματικών πιστοποιητικών προστασίας προβαίνει στη χορήγηση βεβαίωσης στον κάτοχο του συμπληρωματικού πιστοποιητικού προστασίας για την παράταση της ισχύος του συμπληρωματικού πιστοποιητικού προστασίας, εφόσον συντρέχουν οι προϋποθέσεις προστασίας (άρθρο 8 της υπουργικής απόφασης). Η σχετική πράξη δημοσιεύεται στο Ειδικό Δελτίο Βιομηχανικής Ιδιοκτησίας (ΕΔΒΙ).
• Προετοιμασία σχεδίου Υπουργικής Απόφασης για τη “Διαδικασία Κατάρτισης της Έκθεσης Έρευνας ή της Τελικής Έκθεσης Έρευνας από τον ΟΒΙ.” Η εν λόγω Υπουργική Απόφαση υλοποιεί τη Συμφωνία συνεργασίας μεταξύ του Ευρωπαϊκού Οργανισμού Διπλωμάτων Ευρεσιτεχνίας και του Ελληνικού Οργανισμού Βιομηχανικής Ιδιοκτησίας που υπογράφηκε στο Μόναχο στις 22 Οκτωβρίου 2008 και εγκρίθηκε από το Διοικητικό Συμβούλιο του ΟΒΙ κατά τη συνεδρίαση Αρ. 13/2008 της 31ης Οκτωβρίου 2008. Η Υπουργική Απόφαση εκδίδεται κατ’ εξουσιοδότηση του άρθρου 8 παρ. 10 του Νόμου 1733/1987 «Μεταφορά τεχνολογίας, εφευρέσεις, τεχνολογική καινοτομία και σύσταση Επιτροπής Ατομικής Ενέργειας (ΦΕΚ 171, Α’)» και συνοδεύεται από λεπτομέρειες εφαρμογής σε νομικό και σε τεχνικό επίπεδο οι οποίες διαμορφώθηκαν μετά από συζητήσεις μεταξύ εμπειρογνωμόνων του ΕΓΔΕ και του ΟΒΙ. Οι λεπτομέρειες αυτές είναι οι διατάξεις Εφαρμογής των Οδηγιών Εξέτασης του ΕΓΔΕ καθώς και των Οδηγιών Διεθνούς Έρευνας και Προκαταρκτικής Εξέτασης κατά τη Σύνταξη Εκθέσεων Έρευνας και Αιτιολογημένων Γνωμών για τις Ελληνικές Αιτήσεις Χορήγησης Διπλωματών Ευρεσιτεχνίας από το Ευρωπαϊκό Γραφείο Διπλωματών Ευρεσιτεχνίας (ΕΓΔΕ).

37 Various 07 Events Communication with the public
The main characteristics of the year 2007 for the communications section of OBI were undoubtedly the major outreach of the Organisation by the holding of a great variety of programmes and events, the major response of the Press, and the staffing of the section with the necessary personnel to enable it to deal with the scheduled communication programme.
An important part of the events which were held fell within the framework of the ‘Competitiveness’ Operational Pro- gramme.
Of these events, it is worth mentioning a series of day conferences:

In addition, within the framework of the ‘Competitiveness’ Operational Programme, important exhibitions were held: 1. ‘Epiplo’ House Style, 3 - 5 February at ‘EXPO ATHENS’ exhibition centre. 2. ‘ENERGY RES’, 8 - 11 March at the eastern airport, Elliniko. 3. ‘FETEC - Industrial Equipment’, 12 - 15 October at MEC, Paiania. 4. Energy 2007, 18 - 21 October at HELEXPO, Athens.
The year 2007 also marked the end of the specific programme in the two-year duration of which as regards the Com- munications Section, substantive work was done: support of the policy of OBI in briefing the general public with a relevant advertising campaign in the periodical and daily Press, 12 issues of CD-ROMs with briefing, information and procedural documents and forms of OBI, and participation in eight branch exhibitions and 19 day conferences.
38 Τα κύρια χαρακτηριστικά του έτους 2007 για τον Τομέα της επικοινωνίας του ΟΒΙ υπήρξαν αναμφισβήτητα, η μεγάλη εξωστρέφεια του Οργανισμού με την υλοποίηση πολυποίκιλων προγραμμάτων και εκδηλώσεων, η μεγάλη ανταπόκριση του Τύπου και η στελέχωση του σχετικού Τμήματος με το απαραίτητο προσωπικό, προκειμένου ν’ αντεπεξέλθει στα σχεδιασμένα προγράμματα Επικοινωνίας.
Σημαντικό μέρος των εκδηλώσεων που πραγματοποιήθηκαν, υπάγονται στο πλαίσιο του προγράμματος ΕΠΑν (Επιχειρησιακό Πρόγραμμα «Ανταγωνιστικότητα ”).
Από αυτές αξίζει ν’ αναφερθεί μια σειρά ημερίδων:

Επίσης, στο πλαίσιο του προγράμματος ΕΠΑν πραγματοποιήθηκαν σημαντικές εκθέσεις: 1. House Style Έπιπλο, στις 3-5 Φεβρουαρίου στο εκθεσιακό κέντρο “EXPO ATHENS”. 2. “ENERGY RES” στις 8-11 Μαρτίου στο ανατολικό αεροδρόμιο Ελληνικού. 3. “FETEC - Βιομηχανικός εξοπλισμός” στις 12-15 Οκτωβρίου στο MEC Παιανίας. 4. Ενέργεια 2007, στις 18-21 Οκτωβρίου στην HELEXPO των Αθηνών.
Το 2007 σήμανε και τη λήξη του συγκεκριμένου προγράμματος στη διετή διάρκεια του οποίου όσον αφορά στον Τομέα της Επικοινωνίας, πραγματοποιήθηκε ουσιαστικό έργο: υποστήριξη της ενημερωτικής πολιτικής του ΟΒΙ στο ευρύτερο κοινό του με σχετική διαφημιστική καμπάνια σε περιοδικό και ημερήσιο Τύπο, 12 εκδόσεις CD-ROM με ενημερωτικά -πληροφοριακά και διαδικαστικά έγγραφα και έντυπα του ΟΒΙ, συμμετοχή σε 8 κλαδικές εκθέσεις και 19 ημερίδες.

39 However, apart from the events included in the ‘Competitiveness’ Operational Programme, OBI in 2007 took many other forms of action, always with the informing and support of the public as its aim. Of these, it is worth mentioning:
• Observance of World Intellectual Property Day (26 April): Apart from the exhibition held in the events hall at Gazi, together with the other Organisations which make up the world of Intellectual Property, OBI held an ‘Open Day’ in its building. From 09.00 to 18.00, the public were able to obtain information on all matters falling within the competence of OBI from specialist staff with two work-stations available. The same day, OBI’s pilot educational programme, addressed to children in the sixth class of primary school, was inaugurated. The programme was planned by OBI in collaboration with a specialist educator and included plentiful visual and printed material, an inter-active teaching method, and a creative part in which the young people were called upon to produce their own ideas, so that prizes could be given for the best of these. On that day, two schools from the Marousi area took part, as well as the Georgios & Aikaterini Hatzikonsta Boys’ Orphanage. The success 07 of the programme resulted in its continuation with visits of the Marousi schools, with the support of the Municipality of Marousi, on its proposal. • As a follow-up to World Intellectual Property Day, educational visits to OBI by another three primary schools from the Municipality of Marousi followed. • Participation in the Thessaloniki International Trade Fair (08-16/9/2007). • Participation in the PATRA TEC ‘07 exhibition (07-08/12/2007). • Educational visit of students from the National School of Public Administration to the OBI building. • Visits of delegations from the Patent Offices and of other groups with an interest in OBI. • Open meeting with industrial property lawyers, with a view to improving the services of OBI and the Industrial Property system. • Briefing of the mass media on industrial property issues. • Installation of an ‘Infokiosk’ on the premises of the DEMOKRITOS research centre with a view to informing researchers on issues within the competences of OBI. • Participation in the ‘ERA-MORE’ project, which concerns the mobility of researchers at a European level, with a view to support for the project gratis. • Participation in the new European project ‘IP Awareness and Enforcement: Modular Based Action for SMEs’, which has the purpose of briefing and support of small and medium-sized enterprises chiefly on issues of copying and the relevant means of protection by the Industrial Property system.
Apart from the actions described above, the strengthening of the Communications Section of OBI, mainly by its new personnel, is a springboard for even more ambitious communications policy plans, with a view to supporting OBI’s public. Various events Communication with the public
40 Εκτός όμως των εκδηλώσεων που περιλαμβάνονται στο “ΕΠΑν” ο ΟΒΙ το 2007 πραγματοποίησε πολλές άλλες ενέργειες με στόχο πάντα την ενημέρωση και στήριξη του κοινού του. Από αυτές αξίζει ν’ αναφερθούν:
• Εορτασμός της Παγκόσμιας Ημέρας Διανοητικής Ιδιοκτησίας (26 Απριλίου): Εκτός από την έκθεση που διοργανώθηκε στο χώρο εκδηλώσεων στο Γκάζι μαζί με τους υπόλοιπους φορείς που απαρτίζουν το χώρο της Διανοητικής Ιδιοκτησίας, ο ΟΒΙ πραγματοποίησε στο κτίριό του “Ανοιχτή Ημέρα” (“Open Day”). Από τις 09.00 μέχρι τις 18.00, το κοινό μπορούσε να ενημερώνεται για όλα τα θέματα αρμοδιοτήτων του ΟΒΙ από εξειδικευμένο προσωπικό με 2 διαθέσιμους σταθμούς εργασίας. Την ίδια ημέρα εγκαινιάστηκε το πιλοτικό εκπαιδευτικό πρόγραμμα του ΟΒΙ που απευθύνεται σε παιδιά της έκτης τάξεως του Δημοτικού. Το πρόγραμμα σχεδιάστηκε από τον ΟΒΙ με τη συνεργασία εξειδικευμένου παιδαγωγού και περιείχε πλούσιο οπτικό και έντυπο υλικό, διαδραστική μέθοδο διδασκαλίας και δημιουργικό μέρος, στο οποίο τα παιδιά κλήθηκαν να δημιουργήσουν τις δικές τους ιδέες, με σκοπό να βραβευτούν οι καλύτερες από αυτές. Την ημέρα εκείνη έλαβαν μέρος 2 σχολεία της περιοχής του Αμαρουσίου καθώς επίσης 07 και το Ορφανοτροφείο αρρένων Χ. και Α. Χατζηκώνστα. Η επιτυχία του προγράμματος είχε σαν αποτέλεσμα τη συνέχισή του με επισκέψεις των σχολείων του Αμαρουσίου, με τη συνδρομή του Δήμου Αμαρουσίου, μετά από πρότασή του. • Σε συνέχεια της Παγκόσμιας Ημέρας Διανοητικής Ιδιοκτησίας ακολούθησαν εκπαιδευτικές επισκέψεις στον ΟΒΙ από άλλα 3 Δημοτικά Σχολεία του Δήμου Αμαρουσίου. • Συμμετοχή στη Διεθνή Έκθεση Θεσσαλονίκης (8-16/9/2007). • Συμμετοχή στην έκθεση PATRA TEC ’07 (7-8/12/2007). • Εκπαιδευτική επίσκεψη σπουδαστών της Εθνικής Σχολής Δημόσιας Διοίκησης στο κτίριο του ΟΒΙ. • Επισκέψεις αντιπροσωπειών από Γραφεία Διπλωμάτων Ευρεσιτεχνίας ή άλλων ομάδων ενδιαφερόντων του ΟΒΙ. • Ανοιχτή συνάντηση με δικηγόρους βιομηχανικής ιδιοκτησίας με στόχο τη βελτίωση των υπηρεσιών του ΟΒΙ και του συστήματος Βιομηχανικής Ιδιοκτησίας. • Ενημέρωση των ΜΜΕ για θέματα βιομηχανικής ιδιοκτησίας. • Τοποθέτηση “Infokiosk” στο χώρο του ερευνητικού κέντρου ΔΗΜΟΚΡΙΤΟΣ με στόχο την ενημέρωση των ερευνητών για θέματα των αρμοδιοτήτων του ΟΒΙ. • Συμμετοχή στο πρόγραμμα “ERA-MORE”, που αφορά στην κινητικότητα των ερευνητών σε ευρωπαϊκό επίπεδο, με σκοπό την άνευ ανταλλάγματος ενίσχυση του έργου. • Συμμετοχή στο νέο ευρωπαϊκό πρόγραμμα ”IP Awareness and Enforcement: Modular Based Action for SMEs” που έχει σκοπό την ενημέρωση και στήριξη των Μικρομεσαίων Επιχειρήσεων κυρίως σε θέματα αντιγραφής και σχετικής προστασίας μέσα από το σύστημα της Βιομηχανικής Ιδιοκτησίας.
Εκτός από τις προαναφερόμενες ενέργειες, η ενδυνάμωση του Τμήματος Επικοινωνίας του ΟΒΙ, κυρίως με το νέο προσωπικό του, αποτελεί εφαλτήριο για ακόμη πιο μεγαλεπήβολα σχέδια επικοινωνιακής πολιτικής, με στόχο τη στήριξη του κοινού του ΟΒΙ. Διάφορες Εκδηλώσεις Επικοινωνία με το κοινό

A large number of events and other activities was held during 2008, with the goal of informing the public of the services of the Industrial Property Organisation (OBI), improving its services, encouraging and supporting inventors, and the constant improvement of the Organisation’s profile.
Of these activities, the following deserve special mention:
• Celebration of ΟΒΙ’s 20th anniversary and the 3rd Invention Awards. The completion of 20 years of OBI was celebrated with the 3rd Invention Awards, made to distinguished inventors and the creative ideas of elementary-school children. This was held at a special ceremony co-hosted by OBI and the General Secretariat of Research and Technology at the Zappeion Megaron Hall on 30 November 2008. The Awards honouring inventors were made for the first time in 2002, on an initiative of the Industrial Property Organisation. Awards were made to a total of 8 inventions at the ceremony, for patents relating primarily to new technologies:
1st Prize: New method for the production of NZP ceramic bodies having high porosity and and high flexural strength. Inventor: Constantine Stournaras, Christos Dedelousis, Paraskevi Economou

The prizes given to the first four inventions were accompanied by financial support (€ 10,000 for the 1st prize, € 6,000 for the 2nd prize and € 3,000 for each 3rd prize), awarded by the Industrial Property Organisation. The prizes and honourable mentions were awarded by the Speaker of Hellenic Parliament, Mr Dimitris Sioufas, the Minister of Development, Mr Christos Folias, the General Secretary for Research and Technology Professor Philippos Tsalides, the Director of the Central Administration of the Foundation for Research and Technology (FORTH), Mr Alkivi- ades Pagiatakis, the President of the Judges’ Panel, Mr Petros Marangos, the former Chairman of the OBI Administrative Council, Professor Athanasios Kaisis, and the OBI General Director, Serafeim Stasinos.
42 Μέσα στο 2008 πραγματοποιήθηκε ένας μεγάλος αριθμός εκδηλώσεων, αλλά και άλλων δράσεων που σκοπό είχαν πάντα την ενημέρωση του κοινού για τις υπηρεσίες του ΟΒΙ, τη βελτίωση των υπηρεσιών του, την ενθάρρυνση και στήριξη των δημιουργών και τη διαρκή βελτίωση της εικόνας του Οργανισμού. Από αυτές τις ενέργειες κάποιες αξίζει να αναφερθούν:
• Εορτασμός των 20 χρόνων του ΟΒΙ και Γ’ Βράβευση Εφευρετών. Η συμπλήρωση των 20 χρόνων λειτουργίας του ΟΒΙ εορτάστηκε με την τρίτη Βράβευση διακεκριμένων εφευρετών αλλά και δημιουργικών ιδεών παιδιών του Δημοτικού, σε ειδική τελετή που συνδιοργάνωσε ο ΟΒΙ με τη Γενική Γραμματεία Έρευνας και Τεχνολογίας, στο Ζάππειο Μέγαρο, στις 30 Νοεμβρίου 2008. Ο θεσμός της βράβευσης των εφευρετών εγκαινιάστηκε για πρώτη φορά το 2002, μετά από πρωτοβουλία του Οργανισμού Βιομηχανικής Ιδιοκτησίας (ΟΒΙ). Στην τελετή του εορτασμού βραβεύτηκαν συνολικά 8 εφευρέσεις που αφορούσαν Διπλώματα Ευρεσιτεχνίας, κυρίως με αντικείμενο νέων τεχνολογιών:

Στις 4 πρώτες εφευρέσεις η τιμητική διάκριση συνοδεύτηκε από χρηματική ενίσχυση (10.000 Ευρώ στο πρώτο βραβείο, 6.000 Ευρώ στο δεύτερο βραβείο και από 3.000 Ευρώ σε κάθε τρίτο βραβείο), την οποία προσέφερε ο Οργανισμός Βιομηχανικής Ιδιοκτησίας. Τα βραβεία και τους επαίνους απένειμαν ο Πρόεδρος της Βουλής κ. Δημήτρης Σιούφας, ο Υπουργός Ανάπτυξης κ. Χρήστος Φώλιας, ο Γενικός Γραμματέας Έρευνας και Τεχνολογίας Καθηγητής Φίλιππος Τσαλίδης, ο Διευθυντής της Κεντρικής Διεύθυνσης του Ιδρύματος Τεχνολογίας & Έρευνας (Ι.Τ.Ε.) κ. 43 Awards were also given to elementary-school pupils for their creative ideas, which were selected through a children’s creativity competition held by OBI at a special event during the celebrations for World Intellectual Property Day:
1st prize, Patent and Industrial Design: Double content feeding bottle for infants. Antonis Dimitropoulos, Dimitris Iliades, Isaak Vasilis, Vasilis Melanitis, a team of pupils from the Hadjikonstas Foundation.
2nd prize, Patent: Chocolate spoon. Dimitris Petrichos, pupil from the 7th Amarousion Elementary School
3rd prize, Patent: Steel-plated wheel. Christos Tsirakis, pupil from the 1st Amarousion Elementary School.
The speakers at the ceremony included the Minister of Development, Mr Christos Folias, the Speak- er of Hellenic Parliament, Mr Dimitris Sioufas, the General Secretary for Research and Technology, Philippos Tsalides, the former Chairman of the OBI Administrative Council, Professor Athanasios Kaisis, and the OBI General Director, Serafeim Stasinos. The event was attended by over 400 people.
• Educational school visits. A pilot study of the educational programme, aimed at pupils in the 6th grade of elementary school, was started in celebration of the 2007 World Intellectual Property Day. There was a competition for 08 the top creative ideas of children participating in the programme and the three selected were given awards at the Zappeion Megaron on 30 November 2008, as part of the celebrations for OBI’s 20th anniversary. This programme was widely welcomed by pupils and a request was made from the schools and the Municipality of Amarousion that the local elementary schools be able to participate. The programme thus continued throughout 2008, with great success. The creative ideas of the children who took part will also compete and be given awards at the next event.
Miscellaneous important events and participation in exhibitions As part of its outward-looking policy and efforts to provide information to the public at large, OBI held a number of events and took part in exhibitions:
• Participation in the Triton Blue Water World Economy and fishing event at the Piraeus Port Authority on 28 and 29 January. • Participation in the 4th International Greek Biotechnology Forum and its accompanying exhibition at the Zappeion Megaron, on 2 and 3 February. • One-day conference on ‘Industrial Property and Innovation Production’ in Greece and the EU, in Thessaloniki on 23 February. • One-day conference on ‘Protection and Technological Information’, in Thessaloniki on 2 April. • One-day conference on ‘Protection and Technological Information’, in Larissa on 14 April. • Celebration of World Intellectual Property Day with an exhibition in the Syntagma Square metro station on 6 May in collaboration with other organisations in the intellectual property field. • Participation in the conference ‘Novelties and Industrial Design’, with a speech and participation in the accompanying exhibition at the Zappeion Megaron on 15 and 16 May. • Participation in the 5th Young Inventors exhibition, part of the Technomathia programme, at the Thessaloniki Technical Museum on 11 and 13 October. • Seminar on ‘Community Design’, in the G. Koumantos Hall at OBI on 24 November. The seminar was aimed at legal experts, judges, and lawyers and was organised in collaboration with the Office for the Harmonisation in the Internal Market in Alicante. • One-day conference on ‘Inventions and Protections in Technological Information’ at the Aristotle University of Thessaloniki on 28 November.
In addition to the numerous events, of which a selection has been mentioned, OBI has other impor- tant activities in its communications efforts to report: the new OBI website; new, improved publica- tions and other printed matter; promotion in the press; info-kiosks at prime spots in other organisa- tions; participation in various EU programmes; visits by foreign delegations to its offices. These are just some of OBI’s activities as part of its efforts to be outward-looking, which is a constant goal of the Organisation. Various events Communication with the public

Στην εκδήλωση παρευρέθησαν περισσότερα από 400 άτομα.
• Εκπαιδευτικές επισκέψεις σχολείων. Το εκπαιδευτικό πρόγραμμα που απευθύνεται σε μαθητές της Έκτης τάξης των Δημοτικών Σχολειών, ξεκίνησε πιλοτικά για τον εορτασμό της Παγκόσμιας Ημέρας Διανοητικής Ιδιοκτησίας το 2007. Οι πρώτες δημιουργικές ιδέες των παιδιών που συμμετείχαν στο πρόγραμμα διαγωνίστηκαν και οι 3 επιλεγμένες βραβεύτηκαν στο Ζάππειο Μέγαρο, στις 30 Νοεμβρίου 2008, στο πλαίσιο του εορτασμού των 20 χρόνων του ΟΒΙ. Μετά τη μεγάλη αποδοχή που σημείωσε το Πρόγραμμα αυτό στις μαθητικές κοινότητες και μετά από αίτημα τόσο των σχολείων όσο και του Δήμου Αμαρουσίου για συνεργασία, ώστε να συμμετέχουν τα Δημοτικά σχολεία του Δήμου, το Πρόγραμμα συνεχίστηκε καθ’ όλη τη διάρκεια του έτους 2008 και σημείωσε μεγάλη επιτυχία. Οι δημιουργικές ιδέες των παιδιών που έλαβαν μέρος, θα διαγωνιστούν και αυτές που 08 θα διακριθούν θα βραβευθούν σε επόμενη εκδήλωση.
Διάφορες σημαντικές εκδηλώσεις και συμμετοχή σε εκθέσεις. Στο πλαίσιο της πολιτικής εξωστρέφειας του ΟΒΙ και της προσπάθειάς του για ευρύτερη ενημέρωση του κοινού, πραγματοποιήθηκαν διάφορες ενημερωτικές εκδηλώσεις, καθώς επίσης και συμμετοχές σε εκθέσεις: • Συμμετοχή στην έκθεση της εκδήλωσης «TRITON BLUE WATER WORLD ECONOMY» και αλιεία», στον ΟΛΠ, στις 28 και 29 Ιανουαρίου • Συμμετοχή στο 4ο Διεθνές Συνέδριο Βιοτεχνολογίας και στην αντίστοιχη έκθεση, στο Ζάππειο Μέγαρο, στις 2 και 3 Φεβρουαρίου. • Ημερίδα με θέμα «Βιομηχανική Ιδιοκτησία και Παραγωγή Καινοτομίας σε Ελλάδα και ΕΕ», στη Θεσσαλονίκη, στις 23 Φεβρουαρίου. • Ημερίδα με τίτλο «Προστασία και Τεχνολογική Πληροφόρηση» στη Θεσσαλονίκη, στις 2 Απριλίου. • Ημερίδα με τίτλο «Προστασία και Τεχνολογική Πληροφόρηση» στη Λάρισα, στις 14 Απριλίου. • Εορτασμός της Παγκόσμιας Ημέρας Διανοητικής Ιδιοκτησίας με έκθεση στο Μετρό Συντάγματος στις 6 Μαΐου, σε συνεργασία με τους υπόλοιπους φορείς που απαρτίζουν το χώρο της Διανοητικής Ιδιοκτησίας. • Συμμετοχή στο Συνέδριο «Novelties and Industrial Design”, με ομιλία και συμμετοχή στην αντίστοιχη έκθεση, στο Ζάππειο Μέγαρο, στις 15 και 16 Μαΐου. • Συμμετοχή στην 5η Έκθεση «Νέων Ερευνητών» του Προγράμματος «ΤΕΧΝΟΜΑΘΕΙΑ», στο Τεχνικό Μουσείο Θεσσαλονίκης, στις 11 και 13 Οκτωβρίου. • Σεμινάριο με τίτλο «Κοινοτικά Σχέδια και Υποδείγματα», στην αίθουσα Γ. Κουμάντου του ΟΒΙ, στις 24 Νοεμβρίου. Το Σεμινάριο απευθυνόταν σε νομικούς, Δικαστές και Δικηγόρους και οργανώθηκε σε συνεργασία με το Γραφείο Εναρμόνισης Εσωτερικής Αγοράς του Αλικάντε. • Ημερίδα με τίτλο «Εφευρέσεις-Προστασία και Τεχνολογική Πληροφόρηση», στο ΑΠΘ, στις 28 Νοεμβρίου.
Εκτός από τις πολυάριθμες εκδηλώσεις που επιλεκτικά αναφέρθηκαν, ο ΟΒΙ στο χώρο της επικοινωνίας έχει να παρουσιάσει και άλλες σημαντικές δραστηριότητες: Η νέα ιστοσελίδα του ΟΒΙ, οι νέες βελτιωμένες εκδόσεις και άλλο έντυπο υλικό, η προβολή στον Τύπο, η λειτουργία «Inffokiosks», σε κομβικά σημεία άλλων φορέων, η συμμετοχή σε διάφορες κοινοτικά προγράμματα, επισκέψεις ξένων αντιπροσωπειών στα γραφεία του, είναι μερικές μόνο από αυτές που συμβάλλουν στην εξωστρέφεια του Οργανισμού η οποία αποτελεί διαρκή στόχο του. Section for Technological Information and Dissemination of Innovation - In 2007, within the framework of the ‘Competitiveness’ Operational Programme sub-project, eight day conferences and five visits were successfully held. In addition, OBI took part in 11 day conferences organised by other agencies and in teams working on industrial property issues.
- The Directorate for Technological Information continued to take part in the team working on Technological Information of the European Patent Office, as well as in: (a) the NPO network (IP-Base) Community programme; (b) the Patlib conference held by the European Patent Office (Seville, Spain); (c) the EPIDOS 2007 conference held by the European Patent Office (Riga, Latvia).
- In the year 2007, 159 preliminary searches were completed (it should be noted that in 2006 there were 199 of these, in 2005, 190, in 2004, 153, and in 2003, 172).
- In 2007, after the training of new associates of OBI who were engaged to operate the regional libraries in Thessaloniki, Patra, and Crete, OBI has been re-activated in these places.
- In 2007, the Technological Information Directorate made 28 visits to the country’s Technology Parks and had a total of 75 contacts with universities / companies.
One-Stop Shop Those interested in obtaining information on the procedures for lodging an application for a patent or for an industrial design or for any other title protecting industrial property can apply to this service, which has been operating since 2005. Information can also be obtained in connection with technological information matters. It operates daily from 08.30 a.m. to 13.30 p.m. and is staffed by experienced technical and legal professionals.
According to the data recorded, the number of those interested who got in touch with this service has been constantly increasing. We give a comparative table for the years 2006 - 2007, as well as the relevant graph showing weekly monitor- ing for the same years.
46 Τομέας Τεχνολογικής Πληροφόρησης και Διάδοσης Καινοτομίας - Το 2007 στο πλαίσιο του υποέργου ΕΠΑν1 πραγματοποιήθηκαν επιτυχώς 8 ημερίδες και 5 επισκέψεις. Επίσης, υπήρξε συμμετοχή του ΟΒΙ σε 11 ημερίδες που διοργανώθηκαν από άλλους φορείς καθώς και σε ομάδες εργασίας, συναντήσεις για θέματα βιομηχανικής ιδιοκτησίας.
- Η ΔΤΠ συνέχισε να συμμετέχει στην ομάδα εργασίας Τεχνολογικής Πληροφόρησης του ΕΓΔΕ, καθώς επίσης και: α) στο κοινοτικό πρόγραμμα NPO network (IP-Base), β) στο συνέδριο Patlib 2007 που οργάνωσε το ΕΓΔΕ (Σεβίλλη, Ισπανία) γ) στο συνέδριο EPIDOS 2007 που οργάνωσε το ΕΓΔΕ (Ρήγα, Λετονία).
- Κατά το έτος 2007 διεκπεραιώθηκαν 159 προέρευνες.(Σημειώνεται ενδεικτικά ότι το 2006 είχαν γίνει 199 προέρευνες, το 2005 - 190 προέρευνες, το 2004 – 153 προέρευνες και το 2003 – 172 προέρευνες).
- Το 2007 μετά την εκπαίδευση των νέων συνεργατών του ΟΒΙ που προσελήφθησαν για τη λειτουργία των περιφερειακών βιβλιοθηκών Θεσσαλονίκης, Πάτρας και Κρήτης, ο ΟΒΙ ενεργοποιήθηκε εκ νέου στους συγκεκριμένους χώρους.
- Το 2007 η ΔΤΠ πραγματοποίησε 28 επισκέψεις στα Τεχνολογικά Πάρκα της χώρας και είχε συνολικά 75 επαφές με Πανεπιστήμια/εταιρείες.

47 08 Technological Information Technological Information Services In 2008 three one-day conferences were successfully held at institutions of higher education, and a total of 183 visits were made to companies in Attica, Thessaloniki and Northern Greece, Ioannina, Crete, and the Peloponnese. The visits were made by OBI’s staff and their goal was to increase awareness on Industrial Property issues and provide specialised information to the companies on issues of protecting their products/processes. Eleven visits were also made to Technological Parks in Greece, during which ΟΒΙ had a total of 34 contacts with universi- ties and companies. ΟΒΙ also participated in 11 one-day conferences held by other organisations as well as in working groups and meetings on industrial property issues. • Participation in the EPO’s Working Party of Technical Information continued, as well as in: a) the EU programme IPeuropAware (IP Awareness and Enforcement: Modular Based Actions for SMEs), b) the EPO’s ‘Innovation Support Training Programme’ (ISTP) – Module 7: Consultation Skills, market analysis and licensing negotiation – Module 8: Presenting IP Management for Innovation In 2008, 178 prior art searches were completed (2007: 159 prior art searches , 2006: 199 prior art searches, 2005: 190 prior art searches, 2004: 153 prior art searches, 2003: 172 prior art searches). A comparative diagram of the prior art searches carried out for the years 2003-2008 is shown below: As part of its mission to provide technological information through its expert staff, OBI satisfied in 2008 the request for prior art searches filed by 178 individuals/companies, in return for a nominal sum. The requests were related either to a search on the state of the art of a specific subject and technological field or to a search of the respective filing in Greece of a specific Industrial Property title issued from another country. Of the prior art searches completed in 2008, the most common requests can be divided into the following categories, according to their technological field (IPC: International Patent Classification), as shown below:
One Stop Shop The One Stop Shop (OSS), which was established in 2005, is a service provided to the public. It gives information on procedures for filing an application for a patent or an industrial design or any other industrial protection title issued by OBI, as well as on technological information from published industrial property titles. The One Stop Shop is open daily from 8.30 am until 13.30 pm. Its experienced staff, with the additional support of OBI’s technical (examiners) and legal experts contribute to the provision and dissemination of industrial property information and knowledge. The statistical data show that the number of interested parties seeking the services of the One Stop Shop is constantly rising. More specifically in 2008, the OSS has dealed with 3501 cases, of which 1003 involved visits to the One Stop Shop.

48 Υπηρεσία Τεχνολογικής Πληροφόρησης Το 2008 οργανώθηκαν με επιτυχία 3 ημερίδες σε Ανώτερα και Ανώτατα Εκπαιδευτικά Ιδρύματα, πραγματοποιήθηκαν συνολικά 183 επισκέψεις σε εταιρείες της Αττικής, Θεσσαλονίκης και Βόρειας Ελλάδας, Ιωαννίνων, Κρήτης και Πελοποννήσου. Οι επισκέψεις πραγματοποιήθηκαν από στελέχη του ΟΒΙ και είχαν ως στόχο την εξειδικευμένη ενημέρωση των εταιρειών σε θέματα προστασίας προϊόντων βιομηχανικής ιδιοκτησίας, σε συνάρτηση με τον κλάδο τους. Παράλληλα έγιναν 11 ενημερωτικές επισκέψεις στα Τεχνολογικά Πάρκα της χώρας στα πλαίσια των οποίων ο ΟΒΙ είχε συνολικά 34 επαφές με Πανεπιστήμια / εταιρείες. Επίσης υπήρξε συμμετοχή του ΟΒΙ σε 11 ημερίδες που διοργανώθηκαν από άλλους φορείς καθώς και σε ομάδες εργασίας, συναντήσεις για θέματα βιομηχανικής ιδιοκτησίας . Συνεχίστηκε η συμμετοχή στην Ομάδα εργασίας Τεχνολογικής Πληροφόρησης του ΕΓΔΕ, καθώς επίσης και: α) στο κοινοτικό πρόγραμμα IPeuropAware (IP Awareness and Enforcement: Modular based Actions for SMEs), β) στο εκπαιδευτικό Σεμινάριο του ΕΓΔΕ “Innovation Support Training Programme (ISTP) – Module 7: Consultation Skills, Market analysis, licensing negotiation” – Module 8: Presenting IP Management for Innovation” Κατά το έτος 2008 διεκπεραιώθηκαν 178 προέρευνες (2007 – 159 προέρευνες, 2006 – 199 προέρευνες, 2005 - 190 προέρευνες, 2004 – 153 προέρευνες, 2003 – 172 προέρευνες). Στα πλαίσια της παροχής τεχνολογικής πληροφόρησης από το εξειδικευμένο προσωπικό του ΟΒΙ, έναντι συμβολικού τιμήματος, ικανοποιήθηκε το αίτημα προέρευνας που υπεβλήθη από 178 άτομα/εταιρίες, κατά το 2008, και παρεδόθησαν στους ενδιαφερόμενους τα αποτελέσματα που αφορούσαν είτε έρευνα για την στάθμη της προηγούμενης τεχνικής συγκεκριμένου αντικειμένου προέρευνας είτε εξέταση ενδεχόμενης κατάθεσης στην Ελλάδα συγκεκριμένου τίτλου Βιομηχανικής Ιδιοκτησίας. 52 Μία από τις βασικές υπηρεσίες που παρέχει ο ΟΒΙ Πιο συγκεκριμένα και σύμφωνα με το διεθνές σύστημα είναι η διεξαγωγή ερευνών και η σύνταξη εκθέσεων ταξινόμησης κατά IPC, οι πέντε τομείς στους οποίους για τις εθνικές αιτήσεις διπλωμάτων ευρεσιτεχνίας και συντάχθηκαν οι περισσότερες εκθέσεις έρευνας ήταν τροποποίησης. Στο πλαίσιο λοιπόν αυτής της προσπάθειας, για το 2008 ο μέσος χρόνος ολοκλήρωσης της έρευνας από τον ΟΒΙ και κοινοποίησης της στον καταθέτη ήταν 10,7 μήνες από την ημερομηνία κατάθεσης της αίτησης, αφήνοντας έτσι ένα χρονικό περιθώριο 1,3 μηνών στον Έλληνα καταθέτη για να αξιολογήσει τα αποτελέσματα και να αποφασίσει σε σχέση με την περαιτέρω πορεία της αίτησής του στο εξωτερικό.
Μέσω του τμήματος Ελέγχου και Προώθησης Καινοτομιών του ΟΒΙ σημειώνεται όπως και κάθε χρονιά βελτίωση της ποιότητας των δεδομένων των αρχείων του Οργανισμού. Έτσι, μέσα στο 2008 ελέγχτηκαν και διορθώθηκαν στο πληροφοριακό σύστημα του ΟΒΙ συνολικά 19.606 εγγραφές που αφορούσαν αιτήσεις και χορηγηθέντα διπλώματα ευρεσιτεχνίας παλαιοτέρων ετών.
