Kenya Bribery Index 2019 II BACKGROUND Transparency International Kenya (TI-Kenya) was founded in 1999 in Kenya as a not-for-profit organization with the aim of developing a transparent and corruption-free society through good governance and social justice initiatives. TI-Kenya is one of the autonomous chapters of the global Transparency International movement that is bound by a common vision of a corruption- free world. TI-Kenya envisions a corruption-free Kenya The organisation has 20 years of extensive experience in governance work at the national and county levels. These include direct engagement with the government, the private sector, individuals and groups. TI-Kenya uses advocacy as its signature approach; this is complemented by other approaches such as partnerships’ development, research, capacity building and civic engagement. Data collection was done in November 2019. The survey considered representation across all groups based on their age, income and gender. Citizens’ Experience with Bribery The study established that Education, Huduma Centres and Civil Registration Services were the most sought services. Majority (77%) of the respondents indicated that they accessed services without encountering bribery incidents compared to 63% in 2017. This was a 14 percentage points increase in proportion of citizens who accessed services without encountering bribery in 2017. Out of the participants who encountered bribery incidents, majority (63%) paid bribes representing Eight points decrease in the proportion of citizens who paid bribes in 2017. Males comprised a larger proportion of those who paid bribes while seeking services in 2019. However, the proportion of females who paid bribes increased by 11 percentage points compared to the 2017 level. Majority (52%) of those who paid bribes while seeking services were citizens aged above 35 years. Citizens that were self-employed comprised the largest (45%) proportion of those who indicated that they paid bribes while seeking services. Aggregate Index Judiciary was ranked as the most bribery prone institution at 69% above the Police which topped the list in 2017. Although the Police was the second most bribery prone institution at 64%, it was equally the most improved with a reduction of 19.3 percentage points compared to the 2017 level. Tax Services was the least improved (0.5 points) while Business Licensing remained the same at 20.5% compared to 2017. Reasons for paying bribes For those who paid bribes to access services, the highest proportion (35%) did so to hasten the process, 34% said it was the only way to access the service while 18% paid to avoid problems with the authorities. Kenya Bribery Index 2019 X Reporting of bribery incidents Majority (87%) of participants who encountered bribery incidents while seeking services did not report it compared to 2017 where 94% stated that they reported. There was a seven points increase in the proportion of respondents who said that they reported corruption in 2019, compared to 2017. On why they failed to report the bribery incidents, 26% stated that they felt no action would be taken, 20% indicated they were beneficiaries with an equal proportion fearing intimidation while 19% indicated that reporting the incident did not occur to them. Corruption perception Sixty-six percent of the respondents felt corruption had increased in the past one year while 55% opined that corruption would increase in the next one year. Twenty-eight percent of participants felt that the government is committed to fighting corruption. On why they felt the government is committed, the highest proportion (44%) of the participants cited the intensified arrests of perpetrators and prosecution efforts. Anti-corruption performance of various government agencies When asked to rate the performance of various agencies in the fight against corruption, the Office of the Auditor General (OAG), Ethics and Anti-Corruption Commission (EACC) and the President were still rated as average by respondents, although there was a slight improvement in the scores compared to 2017. The Judiciary’s rating in the fight against corruption improved from poor to average. Anti-corruption performance of non-state actors The media’s performance in the fight against corruption was rated as good, a rating also given in 2017. The rating of the religious institutions decreased from good to average while the rating of the performance of the civil society organisations remained average as in 2017. The citizens rated their own performance in the fight against corruption as poor compared to 2017 when they rated their performance as average. Suggestions on ways to stop corruption When asked to give proposals to stop corruption, 44% of the participants were in favour of XI Kenya Bribery Index 2019 prosecuting and jailing those involved in corruption. Twenty percent proposed the removal of corrupt individuals from office while 13% stated that members of the public should be sensitized on the effects of corruption. Recommendations 1. The Office of the Attorney General should prioritize the completion, gazettement and adoption of the Bribery Regulations and Guidelines to ensure full implementation of the Bribery Act 2016. This would allow for immediate implementation of key provisions such as setting up of mechanisms to prevent bribery at private and public institutions 2.

Many international organizations such as the United Nations have tried to find and create solutions on how to eliminate the existence of corruption but they have bared no fruits due to the secretive nature of how corruption is conducted. Corruption takes place or rather is conducted under very secretive rules and environment, mostly between two individuals. It‟s rather very hard to see it in action unless one is very keen and sometimes by the help of a tip off.

    By Mutegi Njau To ordinary Kenyans, the reports were horrific: people being beheaded and skinned around the country — crimes attributed to maverick gangs called Mungiki (masses of people). The police retaliated by randomly raiding the suspected gang’s hideouts and by indiscriminately killing alleged gang members. To Kenyans aged 45 and over, the incidents were reminiscent of Mau Mau period (1952-60), when Kenyan freedom fighters brutally killed colonialists and their collaborators and drank their blood. For most of 2007, the dreaded Mungiki gangs have disrupted public transport and killed and maimed civilians in Nairobi and other major towns and villages in the Central and Rift Valley provinces. Corruption in the police and within the political circles has allowed Mungiki to thrive. The gangsters, who extort money from public transporters and commandeer public utility facilities, such as electric power and water with impunity, have police and political patronage. Indeed, even to a casual observer, there is irony in the way Mungiki operates. It was created to clean up corruption, yet Mungiki is itself corrupt and has grown and flourished because of a corrupt environment. The outlaw group was founded by youths outraged at economic decline, runaway corruption and the near collapse of family values in the late 1980s. Extortion became its modus operandi, and as it sought to bring back order, it used police officers it paid handsomely to protect its turf and businesses. Mungiki is reminiscent of the Italian organized crime operation, the Mafia, which enlisted police, judiciary, and even the political elite. Now Mungiki is the new face of corruption in Kenya.

    SANCTIONS AS A TOOL FOR ASSET RECOVERY: KENYA CIFAR RESEARCH PAPER CIFAR.EU KEY MESSAGES • Kenya has been relatively successful in recent years in concluding modest asset recovery agreements and has shifted its strategy from purely pursuing corruption prosecutions and convictions to also tracing and locating the proceeds of corruption. • The UK, the EU and the US have sanctioned several Kenyan nationals and residents of Kenya on the grounds of support for terrorism and corrupt conduct. • Sanctions imposed by other countries have though been portrayed within Kenya as politically motivated and designed to preserve geopolitical or business advantage. • The use of Magnitsky-style, ‘smart’ sanctions may present some advantages and opportunities in Kenya, especially in tackling past cases. • Care needs to be taken when imposing these international sanctions that they address primarily cases where national progress is stalled. Corruption has undergone a metamorphosis over the years. In the 1960s and 1970s, corruption was referred to in terms of “ten percent” whereby senior government officials allegedly used to demand a ten percent of the cost or value of any government project or tender from the successful bidders. However, since the 1990s corruption in the country has reached unprecedented high levels. This has been evident in mega corruption scandals such as the Goldenberg and the Anglo-Leasing, among others, in which the Government lost billions of Kenya shillings in fraudulent and fictitious business deals. Corruption in the country has become a culture and it permeates all aspects of life. The government over the years seems to have lost steam in the fight against corruption. The anti-corruption structures and institutions which have been established over the years have not achieved much. With the enactment of the new constitution in 2010, corruption has been devolved to the counties with the emergence of ‘eating chiefs’ in all parts of Kenya and not only in Nairobi as was previously the case. Many Kenyans seem to have accepted corruption as fait accompli. Most studies on corruption have focused on the financial and economic losses countries incur due to the menace. Very few studies have focused on the changing nature of corruption which is the focus of this article.

    TRANSPARENCY INTERNATIONAL-KENYA CORRUPTION IN KENYA: FINDINGS OF AN URBAN BRIBERY SURVEY INTRODUCTION Bribery, private payments to public and/or private officials to influence decision-making, is the most prevalent manifestation of corruption. In Kenya as indeed elsewhere, there is a critical dearth of concrete information on the nature and incidence of corruption in general, and bribery in particular. Consequently, anti-corruption efforts tend to be informed primarily by perceptions and anecdotal evidence. This report presents preliminary analysis of a study by Transparency International-Kenya on the magnitude of bribery in Kenya. Based on a survey in which ordinary Kenyans report their daily encounters with corruption - who they bribe, how much, and for what, the study is part of TI-Kenya’s effort to inform the anti-corruption effort in with objective, rigorous research. This study seeks to go beyond perceptions of corruption to provide benchmarks of integrity based on the actual incidence of corruption. The survey conducted in March and April 2001 in Nairobi, Mombasa, Kisumu, Eldoret, Nyeri and Machakos and responded to by 1164 individuals, has been used to estimate the magnitude, incidence and direct financial cost of bribery and produce the Kenya Urban Bribery Index (KUBI) - a league table of the incidence of bribery. METHODOLOGY SURVEY DESIGN The survey was designed to capture citizens’ interaction with the government institutions primarily, but the survey itself sought information on both the public and private sector. However, limited research has focused on the relationship between government control of corruption and individual-level acceptance of bribery within society. This study uses the World Values Survey and other observed data from a total of 55 countries to test whether high levels of corruption cause individuals to be more accepting of bribery among public officials. A Generalized Least Square Model was applied to test the effect of government corruption on control and individual-level tolerance for bribery between 1996 and 2015.
