TIF - Article 370, Federalism and the Basic Structure of the Constitution FAIZAN MUSTAFA July 5, 2019 Photo credit: Saktishree DM | Flickr (CC BY-ND 2.0) Article 370 is a permanent and not temporary provision of the Constitution that assures Jammu and Kashmir autonomy. Its content may have been hollowed out but it remains important for the people of Kashmir. Calls to scrap it are based on a misinterpretation. The Article 370 debate is back centre-stage. The new Union Home Minister, Amit Shah, has made a detailed statement on Article 370 after his return from Kashmir. In tune with his party’s ideological position, he has yet again termed this constitutional provision as “temporary”. At the same time he has been candid enough to confess for the first time that most elections in Kashmir had been rigged. The importance of Article 370 to Kashmir and the significance it holds in our Constitution are issues that need to be constantly reiterated to dispel the considerable misinterpretation and misunderstanding about this provision in the Constitution of India History of Article 370 The most important feature of federalism in the United States of America (USA) was the ”compact” between the Page 1 www.TheIndiaForum.in July 5, 2019 erstwhile 13 British colonies that constituted themselves first into a confederation and then into a federal polity under the 1791 constitution of the USA. Murali Kumar The Balakot bombings that followed the terror strike in Pulwama have given an edge to the Bharatiya Janata Party’s (BJP)’s election plank of muscular nationalism and has, for the moment, at least, taken the spotlight off the failures of the Narendra Modi government. In this interview, former Information and Broadcasting Minister Manish Tewari — who is also a Distinguished Senior Fellow at The Atlantic Council’s South Asia Centre — talks to Smita Gupta, Senior Fellow, The Hindu Centre for Politics and Public Policy, New Delhi,about the impact of the BJP’s nationalism card in the upcoming general elections, the role of the media in amplifying the BJP’s message, why the Congress has been circumspect on the subject and whether it is appropriate to use national security as an election issue. He also points out that while the Balakot bombings appeased public opinion to some extent, it has also created a new strategic dynamic on the sub-continent that will make it tougher for future governments to deal with incidents of terror. Excerpts: ill the Pulwama attack, the opposition’s narrative of unemployment being at a 45-year high, rural distress, the negative impact of T demonetisation, etc appeared to be gaining ground in the public discourse. But after the Balakot air strikes, that narrative appears to have changed. Pakistan, war, terrorism appear to be the preferred subjects. Does this not give the advantage back to the BJP? There are two parallel discourses: there is a discourse in the ether which is about Pakistan, Kashmir and war hanging low over the subcontinent. -

Speech of Dr. Manmohan Singh, Former Prime Minister at the Sansmaran Sabha to pay tribute to Shri Jaipal Reddy at the Dr. Ambedkar International Centre New Delhi on 3rd September, 2019 We gather here today to pay tribute to my dear friend, colleague and great leader Shri Jaipal Reddy ji. He was a treasure house of wisdom and knowledge. For ten years he was my colleague in UPA Cabinet and a law-maker for forty five years. It is no exaggeration to say that in his death, Indian politics has lost an excellent orator, a very good administrator, an outstanding Parliamentarian and a great leader. He had an excellent leadership quality. His leadership quality was a mix of a lot of things, the first and foremost was about having faith in his beliefs. He had solid faith in his ideas. As in the case of a true leader he was a very good communicator, listening to others and setting examples for others to follow. A politician with a difference he was an eloquent orator, a writer, a scholar and a witty speaker. His speeches were packed with wit, criticism and in-depth information. Jaipal ji started as a student activist, rose to become president of the Indian Youth Congress from Andhra Pradesh, and then plunged into national politics braving polio among a host of other challenges. He went on to play an active role in national affairs for over four decades. His popularity and followings grew tremendously in Andra Pradesh which made him victorious four times to the Andhra Assembly polls and five times in Lok Sabha elections. -
