(P) No. 8/2017/Tran. dated 23rd March, 2017 and published as SRO No. 151/2017 in the Kerala Gazette Extraordinary No. 582 dated 25th March, 2017 by modifying the notification issued under G.O. (P) No. 42/2009/Tran. dated 14th July, 2009 and published as S.R.O. No. 608/2009 in the Kerala Gazette Extraordinary No. 1272 dated 14th July, 2009;. AND WHEREAS, the Hon’ble High Court of Kerala in its judgment dated 20th August, 2018 in WP(C) No. 11825/2017 and connected cases has quashed clause 4 of the scheme in the notification issued under G.O. (P) No. 8/2017/Tran. dated 23 rd March, 2017 and published S.R.O. No. 151/2017 in the Kerala Gazette Extraordinary No. 582 dated 25th March, 2017 and thereby the said clause of the scheme became inoperative and it has become necessary to publish a Draft modification on the basis of the said judgment. AND WHEREAS, the Government of Kerala are of opinion that the scheme of Road Transport Service as approved by them in notifications issued under G.O.(P) No. 42/2009/Tran. dated 14th July, 2009 and published as S.R.O No. 608/2009 in the Kerala Gazette Extraordinary No. 1272 dated 14th July, 2009 and G.O.(P) No. 8/2017/Tran. dated 23rd March, 2017 and published as S.R.O. No. 151/2017 in the Kerala Gazette Extraordinary No. 582 dated 25th March, 2017 require modification; the modification proposed along with the approved Scheme is here by published for general information. Any person likely to be affected by the modified scheme may file objection before the Principal Secretary to Government, Transport Department, Government Secretariat, Thiruvananthapuram within thirty days from the date of publication of the scheme in the Kerala Gazette, in the manner prescribed in rule 246(b) of the Kerala Motor Vehicles Rules, 1989..
