Public Hearing – Should the Board of Trustees approve an application for a Tavern Liquor License for Good Behavior, LLC dba The Slammer The Board will consider issuing a liquor license to Good Behavior, LLC dba The Slammer, 412 E. Main Street, Lucas Ross, owner. (Estimated time - 5 minutes) B. Public Hearing – Should the Board of Trustees approve an application for a Retail Marijuana Store License for Ascend II, LLC dba Ascend Cannabis Company The Board will consider issuing a Retail Marijuana Store License to Ascend II, LLC dba Ascend Cannabis Company located at 204 E. Main Street, Scott Embree, Scott Embree Jr. and Steven Embree, owners. (Estimated time - 10 minutes) VIII. STAFF REPORTS – (Estimated time – 30 minutes) 1. Town Administrator 2. Town Treasurer 3. Police Chief 4. Recreation Director IX. BUSINESS ITEMS A. Chaffee County Housing Authority Intergovernmental Agreement Adoption of Resolution No. 32, Series 2021 entitled, “A RESOLUTION OF THE BOARD OF TRUSTEES FOR THE TOWN OF BUENA VISTA, COLORADO, APPROVING AN INTERGOVERNMENTAL AGREEMENT FOR THE FUNDING OF THE CHAFFEE COUNTY MULTIJURISDICTIONAL HOUSING AUTHORITY.”? The Board will consider approving an Intergovernmental Agreement for funding the Chaffee County Multijurisdictional Housing Authority. (Estimated time – 5 minutes) B. Short-Term Rentals Policy Discussion Staff will present a policy framework to address the expressed desires of the Board. (Estimated time – 20 minutes) X. TRUSTEE/STAFF INTERACTION The Board discusses items with staff, and staff can bring up matters, not on the agenda. XI. EXECUTIVE SESSION A. An executive session to determine positions relative to matters that may be subject to negotiations, develop a strategy for negotiations, and/or instruct negotiations, pursuant to C.R.S. 24-6-402(4)(e), concerning the potential annexation and master planning of the Triview property adjacent to the Town Rodeo grounds. B. An executive session to determine positions relative to matters that may be subject to negotiations, develop a strategy for negotiations, and/or instruct negotiations, pursuant to C.R.S. 24-6-402(4)(e), concerning the potential acquisition of water rights. XII. ADJOURNMENT This Agenda may be Amended Posted at Buena Vista Town Hall, Post Office, and www.buenavistaco.gov on Friday, July 9, 2021 3 MINUTES OF THE BUENA VISTA BOARD OF TRUSTEES REGULAR MEETING TUESDAY, June 22, 2021 MINUTES OF THE MEETINGS OF THE BOARD OF TRUSTEES ARE A TRANSCRIPT OF THE GOVERNING BODY'S ACTIONS RATHER THAN A VERBATIM RECORD OF DELIBERATIONS. Work Session – Short Term Rentals – (STR) Review and Policy Discussion In attendance for the Work Session were Mayor Duff Lacy, Trustees Amy Eckstein, Libby Fay, Norm Nyberg, Devin Rowe, Cindie Swisher, and David Volpe. Also present were Town Administrator Phillip Puckett, Town Attorney Jeff Parker, Special Projects Manager Joel Benson, Principal Planner Mark Doering, Code Enforcement Officer Grant Bryans, Deputy Town Clerk Lillian Simpson, and Town Clerk Paula Barnett. Town Administrator Phillip Puckett reviewed several months ago the Board tabled the discussion on short-term rentals (STRs). However, throughout the past few months, staff has received comments from the public expressing concern that the number of STR’s is growing out of control, resulting in a shortage of homes for families to purchase, lack of long-term rentals, and workforce housing constraints. Puckett stated staff is very aware that many aspects of housing need to be addressed, and the STR policy presented at the June 7th meeting had no direct correlation to an immediate problem. The goal was to see if the Board feels a real problem(s) exists and should be addressed. Puckett stated that creating a policy that is not needed and/or staff cannot manage may create more problems than being solved. Mayor Lacy reviewed that the Board has established filtering questions to pass potential strategies, policies, etc. However, the process was not utilized at the June 7th meeting to determine if and what problems STR’s are creating and the draft STR policy. Mayor Lacy asked each of the Trustees to share their thoughts and concerns on short-term rentals. Trustee Volpe stated he questions why we are creating a policy for a problem that has not been fully identified. He feels a cap should not be set on STR’s until the problem(s) has been identified and a policy drafted related to the issues(s). Trustee Volpe shared at the June 7th meeting it was expressed that the price of housing, the housing shortage, and community feel are tied to a short-term rental problem. Volpe has been brainstorming to determine the problem, has not reached a definitive answer yet, and that STR’s may be a symptom, not the disease that needs to be cured. Trustee Rowe stated he sees STR’s as a source of income for people living and working in the valley. BOARD OF TRUSTEES OF THE TOWN OF BUENA VISTA Page 1 of 8 Regular Meeting June 22, 2021 4 Rowe noted if he could purchase a home, he would explore short-term rentals as an option to help defray the cost of the monthly mortgage. Rowe agrees with Trustee Volpe that putting a cap on STR’s does not resolve the challenge of people working in the service industry to buy or rent a house. Rowe favors no cap if the property owner lives on the property, zero, or a higher cap if the owner of the STR owner lives in the county. Feels setting a cap at 8% is shooting in the dark, unsure what it will fix, and also places an income cap on businesses and their employees. Trustee Rowe shared he feels STR’s are filling a void for people staying in Buena Vista since there is a limited number of hotels/motels. Rowe stated the number of STR’s could become a problem in the future, be you cannot prevent people who do not live here from buying property. Trustee Fay shared when the property owner of the STR lives on-site, they have more control and oversight of the guest's activities. Trustee Fay has received comments from residents who have STR’s in their neighborhoods, including speeding, disregard for full-time residents, leaving trash out that attracts bears, a higher level of noise, and trespassing. Fay stated houses are being purchased by buyers paying above the asking price and sight unseen, making it highly challenging if near impossible for the local workforce i.e., law enforcement and teachers, to buy homes. Trustee Eckstein shared she would like to focus on maintaining community character and limit the number of STRs in residential zones to avoid displacing families. Trustee Nyberg stated he agrees with Trustees Fay and Eckstein that STR’s contribute to the loss of community, increased traffic speeding, and trash. In addition, Trustee Nyberg stated that the minimal housing inventory has impacted the school districts' ability to hire teachers and support staff. Trustee Swisher shared that she, too, has concerns about community and the loss of affordable housing, impacting businesses due to a lack of employees. Mayor Lacy reviewed the consistent concerns among the Trustees: housing inventory and costs, which the Board has no control over, loss of community, traffic speeds, bears, and trash.
