Respondent: The Assistant Executive Engineer Electrical Sub Division, Veliyam. ORDER 1. Grievance of the petitioner is as follows. The petitioner is a consumer under Electrical Section, Nallila. He stated in the petition that an 11kV line was drawn through the property of the petitioner and it is dangerous to the inhabitants nearby. The complaint of the petitioner is that to shift this 11kV line to the public road. Hence he submitted an application before the Grama Panchayath, for forwarding a letter to the Assistant Engineer, Electrical Section, Nallila for shifting the same. As per this letter, an estimate was sanctioned for shifting of this line and forwarded to the secretary, Grama Panchayath, Nedumpana. But the petitioner argued that the said line would be shifted by receiving the labour charge only. The KSEB Ltd authorities rejected this request and demanded material cost to shift the line. Hence the petitioner prays the forum to direct the respondent to shift the said line after collecting labour charge only.

2. The opposite party filed a version as follows. The petitioner Sri. Yohannan Vattavila, Geomandiram, Nallila East is a registered consumer with Consumer No.1145867001189 under Electrical Section, Nallila. The petition is about shifting of 11kVline from Kizhanguvila to Vayanashala passing through the properties owned by the petitioner and others to the public road. Necessary statutory clearance maintained in the case of the existing line. As per the letter from Nedumpana Grama Panchayath dtd.17/09/2014, an estimate was sanctioned for shifting 700 mtr 11KV from Kizhanguvila to Vayanashala Junction from the existing route to the public road for an amount of Rs.4,47,217/-(Rupees Four lakh Forty Seven Thousand Two Hundred Seventeen only). Demand notice was given to the Secretary, Nedumpana Grama Pancheyath for this amount. This estimate contains both material and labour charges. Based on their complaint to the Kerala State Regulatory Commission it was directed from the office of the Director (Distribution & Safety) to consider the case based on the BO(FTD)No.3276/2014(KSEB/TRAC/Scode/R3/2014)/15-12-2014. This Board order is formulated as per the direction of Kerala State Electricity Regulatory Commission vide letter No.965/Com.Ex/KSERC/2014/1073 dated 9/10/2014 of Secretary, KSERC, based on Reg.63 of CEA reg.2010 and Reg.95 of the Kerala Electricity Supply Code,2014. As per clause 4(a) of the above mentioned Board order , if the owner of the land applies for shifting the line to any other portion of his land for genuine purpose , the same may be carried out by recovering the labour charged only. But in this case, the petitioner requested to shift the line to the nearby public road which required the alteration of route and additional materials. Hence clause 4(b) of the above Board Order is applicable which states that, “When the work involved is alteration of over head line, necessitating additional construction of line using additional material which is not covered under provision to 4(a), then such person shall remit the charges - 4 –

including cost of materials“. When Sri. Yohannan approached the officials of the Electrical Section , Nallila, they replied as per the Board Order dated 15/12/2014 under references (2) above and directed to remit the labour charges and cost of materials for the shifting of the line. Based on the revision of rates for distribution works for 2016- 17 vide BO (CMD)No.185/2016(KSERC/TRAC/Cost data/R3/2015- 16)Tvpm dtd 22-6-16, the estimate can be revised to an amount of Rs.4,44,695/-(Rupees Four Lakhs forty four thousand six hundred and ninety five only). 3. This case was posted for hearing on 21.07.2016. Both the petitioner and respondent were present for hearing and heard the matter in detail. On going through the petition and the statement given during hearing it is seen that the petitioner requested to shift the line drawn through his property to the nearby public road. The respondent stated that as per the request of the Secretary Nedumpana Grama Panchayath, an estimate prepared after inspection and intimated the secretary to remit Rs.4,47,217(Rupees Four Lakh Forty Seven Thousand Two Hundred and Seventeen only). The estimate included both material & labour charges. But the petitioner or Secretary of Nedumpana Grama Panchayath did not remit the amount. The work is an alteration work it requires additional materials for shifting the line to the public road. Here clause 4(b) of the Board Order BO(FTD)No.3276/2014(KSEB/TRAC/Scode/R3/2014)/15-12-2014 is applicable, which states that “When the work involved is alteration of over head line, necessitating additional construction of line using additional material which is not covered under provision to 4(a), then such person shall remit the charges including cost of materials“. But as per cause 4(a) of the above mentioned Board order , if the owner of the land applies for shifting the line to any other portion of his land for genuine purpose , the same may be carried out by recovering the labour charged only. In this case the forum views that this is an alteration work and additional materials required for the line shifting. This work can be done only after remitting the required charges including material cost and labour charges. 4. Considering the above facts and circumstances the forum decided that the respondent shall shift the line after collecting the required charges. i. The petitioner shall remit the required estimate amount for shifting the line. ii. The respondent shall shift the line within one month from the date of receipt of the required charges. iii. No order as to cost. If the petitioner is not satisfied with the above order of this Forum, he is at liberty to prefer appeal before the Electricity Ombudsman within 30 days from the date of receipt of this order.
