Nevada Constitution, Article 2, Sec. 1 Residency. After the United States Supreme Court issued its opinion in Dunn v. Blumstein, 405 U.S. 330 (1972), the Nevada Attorney General opined that the six month residency requirement in Article 2, Sec. 1 of the Nevada Constitution was preempted by the Fourteenth Amendment to the United States Constitution. See Nevada Attorney General Opinion 85 (6/19/72). Thereafter, the Nevada Legislature enacted NRS 293.485. That statute provides, in relevant part, that a person is a qualified elector upon residency in Nevada for at least 30 days prior to the election. Age. Some public offices have a minimum age requirement other than eighteen. For example, members of the Nevada Legislature must be at least 21 years old. NRS 218.010. The Governor, Justices of the Nevada Supreme Court and District Judges must be at least 25 years old.
