I. EXECUTIVE SUMMARY

A. Brief of the VCICDP:

1. ADB supported the preparation of a conceptual development plan (CDP) and a regional perspective plan (RPP) for the VCIC, which included an infrastructure strategy to drive economic growth and the identification of nodes for industrial development, high- potential industrial sectors, and a set of priority projects. The CDP indicated that VCIC, with its long coastline and strategically located ports, provides multiple international gateways to connect India with vibrant global production networks. The proposed Visakhapatnam– Chennai Industrial Corridor Development Program (VCICDP) will complement the ongoing efforts of the Government of Andhra Pradesh (GoAP) to enhance industrial growth and create high-quality jobs. The VCICDP comprises: (i) a proposed multi tranche financing facility (MFF), (ii)a proposed policy-based loan (PBL), and (iii)a proposed administration of a grant to be provided by the Urban Climate Change Resilience Trust Fund (UCCRTF) under the Urban Financing Partnership Facility.

2. The proposed investment program will involve development of infrastructure in selected industrial clusters; improve transport infrastructure, such as connectivity of nodes to ports, urban areas, other nodes and critical hinterland areas; develop and improve power infrastructure, such as establishing substations, strengthening of transmission and distribution system; and improving critical urban infrastructure in selected urban areas. VCICDP will complement the on-going efforts of the Government of Andhra Pradesh (GoAP) to enhance sector growth and create high quality jobs in the state of Andhra Pradesh. The envisaged outputs of VCICDP include: (i) ease of doing business improved; (ii) Visakhapatnam-Chennai Industrial Corridor (VCIC) infrastructure strengthened; and (iii) institutional capacities and program management strengthened.

B. Scope of Work

3. The State of Andhra Pradesh acting through its Department of Industries and Commerce, the executing agency, and Andhra Pradesh Road Development Corporation (APRDC), Andhra Pradesh Industrial Infrastructure Corporation Limited (APIIC), Greater Visakhapatnam Municipal Corporation (GVMC), and Transmission Corporation of Andhra Pradesh (APTransco), the project implementing agencies, are wholly responsible for the implementation of ADB-financed projects.

4. Detailed components of MFF investment are as under: (i) Investment in Industrial Infrastructure; (ii) Urban Investments: Water Sector for GVMC; (iii) Investments in Connectivity- Roads; and (iv) Investments in Power Sector.

C. Resettlement Framework

5. A Resettlement Framework has been prepared conforming to the National laws, the State laws and the Asian Development Bank’s (ADB’s) Safeguard Policy Statement (SPS), 2009. The policy framework describes the principles and approach in avoiding, minimizing and mitigating adverse social impacts that may arise during implementation of subprojects proposed under VCICDP.

6. The Resettlement Framework also describes the process for: (i) screening subprojects; (ii) assessment of involuntary resettlement impacts; (iii) categorization of subject based on significance of involuntary resettlement impact; (iv) structure and process for consultations; (v) approach and methodology in undertaking census and socio-economic surveys; and (vi) preparation and implementation of resettlement plans.

7. All sub-projects proposed under Tranche-I of VCICDP have been screened for social impacts, in compliance with this framework. The VCCIDP Tranche -1 project is classified as Category “A” for involuntary resettlement impact in accordance with ADB's Safeguard Policy Statement (SPS). ADB’s SPS covers both temporary and permanent impacts to both titled and non-titled persons, which includes both physical and economic displacement. This Resettlement Framework will be reviewed and updated from time to time to reflect the changes in applicable State and/or National laws. PIU wise Social Safeguard documents for Tranche –I are mentioned in table-2.

D. Public participation and consultation

8. Total 99 consultations has been conducted during the reporting period with 2716 participants (male 1251 and female 1465) where civil works are in progress, with gender inclusive and responsive, and tailored to the needs of disadvantaged and vulnerable groups; and enables the incorporation of all relevant views of affected people and other stakeholders into decision making, such as project design, mitigation measures, the sharing of development benefits and opportunities, and implementation issues.

E. Grievance Redressal Committee (GRC)

9. GRC has been established at three-levels1, one at project (PIU) level, one at district level and another at State (PMU) level, to receive, evaluate and facilitate the resolution of displaced persons concerns, complaints and grievances. The GRC is providing an opportunity to the affected persons to have their grievances redressed prior to approaching the jurisdictional sub court. The GRC’s aim is to provide a trusted way to voice and resolve concerns linked to the project, and to be an effective way to address affected person’s concerns without allowing it to escalate, which may result in delays in project implementation. Particular attention has been paid to the need of the disadvantaged or vulnerable groups, especially those who are under BPL, the landless, the elderly, female-headed households, women and children, Indigenous People/ Scheduled Tribes (if any), and those without legal title to land.

10. During this reporting period 14 grievances were recorded. The grievances were mainly related to seeking information related to compensation, demanding compensation and worksite inconveniences. The issues were resolved at PIU level and reported to PMU. However, the process of payment of compensation has been initiated regarding the issues related to delay in compensation payment in project areas of APTransco/01 and APRDC /01 and will be completed at the earliest.

F. Institutional Arrangement

11. The State of Andhra Pradesh acting through its Department of Industries (DoI) is the executing agency. The Project Management Unit (PMU), established under the Directorate of Industries with the Commissioner / Director of Industries as Project Director, is responsible for planning, implementation, monitoring and supervision, and coordination of all activities under the Program and the MFF. The PMU is being supported by Project Management and Xonstruction Supervision Consultant. The Project Implementation Units (PIUs) are established in APIIC, APRDC, APTransco, and GVMC, and iare responsible for implementing the MFF. The respective PIUs are responsible for screening subprojects, categorisation based on involuntary resettlement and indigenous peoples impacts, conducting the social assessment, preparation and implementation of Resettlement Plans and Indigenous Peoples Plan as required, and as outlined in the Resettlement Framework.

12. A full-time Social Safeguard and Gender officer (SSGO), takes care of social safeguards and gender at PMU level and each PIU has a Social Safeguard and Gender officer. The Resettlement and Rehabilitation Specialist and Social Development and Gender Specialist who were positioned in the PMSC assist the concerned officers of PMU and PIUs.

G. Monitoring Results – Findings

• Approval of Resettlement Framework and Entitlement Matrix is being debated at the GoAP level and after the finalization, the Resettlement Framework will be disclosed in the ADB’s website. • For subject APRDC 01, disbursement of compensation amount is pending for 45.522 acres out of 72.171 acres. District administration has handed over possession of land of 24.828 Acres to APRDC. Total 31.49 Crores has been disbursed to 296 (43.27%) out of total 684 PAPs. There is enough Budgetary Allocation for payment of Land Acquisition and Rehabilitation and the concerned authorities have to upload the Bills through CFMS for making payment. • NGO APRDC-01 reported that, socio-economic base line data has been completed for 358 residing in the out of total 684 awardee private landowners. The balance 326 have not submitted the verification documents to the RDO. They may be absentee landowners, or they may not be willing to submit their documents. RDO and PIU are making efforts to identify these landowners during mutation process and disburse their compensation amount. • For saving packages of Tranche-1, Land Acquisition Notification is not yet issued by DC based on the detail to be provided by APRDC (Preliminary Notification and Acquisition is pending under Section 11. Unless Notification/Publication is issued the work of preliminary survey of land to be acquired cannot be initiated for subprojects APRDC-04, APRDC-05 and APRDC-06. • EOI for selection of Road Safety Awareness Consultant is published, RFP to be issued in Q1-2020 after GoAP approval. • Recall for EOI for selection of External Monitoring Consultant for Implementation of Resettlement Plan to be issued in Q1-2020., as GoAP had rejected the TBER of first call. • Awaiting Engagement of NGO for the stakeholder consultations as per para (26) of FAM, for close co-ordination with PMSC. • Should ensure that the Insurance Policies as per contract conditions, like Contractor All Risks (CAR), Workmen Compensation Policy (WC), Other Material /Marine Policy etc, are renewed. • Damaged Personal Protective Equipment (PPE’s) for workers, if any shall be replaced, in periodical intervals. • Hygienic measures shall be in place and to be maintained at work site.

2) DDR-Subprojects APIIC-03

17. This land acquisition and resettlement due diligence report is prepared for the proposed tranche-1 package APIIC/03, under which construction of internal infrastructure in Naidupeta industrial cluster is proposed.

18. The total land in possession of APIIC in the Naidupeta industrial clusters is 4556.84 acres. APIIC has the relevant land possession certificates for its land in Naidupeta. Components proposed under the subproject include internal road network, storm drains, power transmission and communication lines and internal water distribution pipelines, elevated storage reservoir and a one-stop service centre. Sites of 1 acre each required for the 2 proposed power substations area available within the boundary of APIIC Naidupeta industrial cluster, and construction is in progress. A site of 2.05 acres has been identified for the proposed one-stop service centre building with built-up area of 1640 sq.m for which construction is under final stages of completion.

19. Since all the facilities are proposed on vacant, unused APIIC lands that had already been acquired for the purpose of setting up industrial clusters, industrial parks and SEZs, there is no involuntary resettlement impacts.

3) Resettlement Plan - Subprojects APIIC-04

20. This Resettlement Plan is prepared for investments proposed for subproject components of providing bulk water facility and summer storage in Naidupeta Industrial cluster subproject under tranche- 1 of VCICDP based on detailed design and detailed measurement survey. It addresses the IR impacts of the proposed subproject components and is consistent with the agreed Resettlement Framework and ADB’s SPS 2009.

21. The total land requirement for the intake and summer storage tank has been estimated as 65.50 acres. Intake land and proposed for Summer Storage Tank is owned by Andhra Pradesh Industrial Investment Corporation (APIIC). No land acquisition is envisaged for proposed components and alignment.

22. Efforts have been made in detailed design to avoid or minimize resettlement impact through careful design of pipe alignments for transmission mains through available, existing right of way of the -Naidupeta road. Potential impact of 17.80 kms proposed transmission main was assessed through detailed measurement survey and no relocation or permanent economic impact has been identified as a result of proposed pipe-laying activity. Only potential temporary income loss to 8 shopkeepers and 2 kiosks for transmission main pipelaying activity for a period of 15 days each has been identified

23. The Resettlement Plan proposes assistance for temporary loss of income to affected persons based on the entitlement matrix prepared for the project. Mitigation measures are also included in the Resettlement Plan. Potential losses that can be avoided/mitigated through proper scheduling of work, avoidance of impact to businesses where possible, provision of planks for access to shops and businesses and traffic management plans to avoid disruption have been proposed.

24. To avoid the temporary loss of income Contractor arranged wooden planks during trenching work. Shopkeepers business was not disturbed during laying also the work done in a good manner to minimize the source effect to the people and their environment.

C. Brief about the subprojects PIU GVMC

25. Under VCIC project, the GVMC as PIU has been implementing 4 subprojects in Tranche -1. Brief of these subprojects are as under.

Distribution Network improvements for NRW reduction and 24x7 supply in GVMC area

26. Proposed subproject components for GVMC 24x7 water supply involving civil works include: (i) construction of 3 elevated level service reservoirs (ELSR): 1 ELSR of 3000 KL capacity at Ramamurthy Pantulupeta; 1 ELSR of 320 KL at Narsimha Nagar and 1 ELSR with 800 KL capacity at Abid Nagar (ii) construction of 2100 KL GLSR Madhavdhara; construction of 1 GLSR with 2200 KL capacity at Indira Nagar and 1 GLSR of 2200 KL at Shramik Nagar; (iii) 30.65 Km of transmission mains/feeder mains (MS/DI) (iv) 353.5 Km of water supply distribution network both HDPE & DI; and (vi) provision of 48000 house service connections.

27. Measures to avoid and minimize private land acquisition and involuntary resettlement impacts include identification of government land for construction of each of the proposed 6 reservoirs and pump house and municipal/government road right of way for laying of all pipelines.

28. The total land requirement for new reservoirs is estimated as 2.07 acres. One pump house and two proposed reservoir sites (0.6 acres) and alignments for subproject components are owned by GVMC, while 1 proposed reservoir site (0.47 acres) belongs to state government and three proposed reservoir site belongs to Simhachalam Devasthanam (1 acre). No land acquisition is envisaged for proposed sites and alignments. For details of land requirement at each location, refer Table 7 below.

29. The following mitigation measures has been adopted to avoid and/or mitigate temporary impacts to businesses and residents during linear works:(i) provision of advance notice to community, (ii) conducting awareness campaigns on the proposed project, its benefits, potential temporary impacts and mitigation measures, grievance redress mechanism, etc., (iii) maintaining access by providing planks and leaving spaces to avoid disturbance to residents and businesses, (iv) managing traffic flows as per the traffic management plan prepared by the contractor in coordination with local authorities and communities, (v) undertaking civil works at night along congested commercial stretches and limiting the amount of time of open trenches, (vi) placing details of telephone hotlines and contact information of PIU officers in signages in visible places, (vii) providing assistance to mobile vendors and hawkers to shift to alternative nearby locations.

Design erection, commission and operate a grid connected 3 MW floating type solar power project on Meghadri Gedda reservoir in Vishakhapatnam

31. The main objective of this subproject is to design erect, commission and operate a grid connected 3 MW floating type solar power project on Meghadri Gedda reservoir in Vishakhapatnam. The proposed project brings in advantages of producing clean, pollution free energy, demonstrate use of reservoir area for solar power generation and provide employment to the people living around the area.

32. Subproject components proposed under the 3MWp grid connected floating type Solar PV Power Project include (i) installation of solar panels floating on the reservoir, (ii) feeder line to 33kV Narawa substation and (iii) floating walkway for access to solar unit.

33. The floatation device will be prefabricated and designed for simple mechanical on-site installation. There shall be no requirement of welding, masonry or complex machinery at the installation site. The floatation device will be modular, such that the installed assembly can be easily expanded and scaled up if required. Each module/combination of maximum two modules should support at least one solar panel. All modules should be standardized and independently created.

Water shed development and Rejuvenation of Mudasarlova Catchment area.

34. The subproject Rejuvenation of Mudasarlova Lake is falling under Vishakhapatnam node. Subproject components proposed under the rejuvenation of and desilting and lining of the inlet channels to the reservoir include (i) desilting of the reservoir, (ii) desilting and lining of 2958m long channel in the western side of the reservoir, (iii) desilting and sectioning of 400m long channel in the northern side of the reservoir (iv) disposing of desilted soil in the northern side of the reservoir and (v) contour trenches on the foothills

35. The subproject also involves planting of 7500 trees in the foreshore of the reservoir in the northern side and western side and inside the reservoir area in the southern side. On the existing bund of the reservoir, grass laying and stone pitching will be done. Further, 75 recharge wells are proposed in the public buildings of the catchment area.

36. Provision for sitting and solar lamp post on reservoir bund. Installation of automated water level recorder for surface and ground water and a climatic station in the reservoir to record the data and plan for decision making.

37. All subproject components are proposed in the reservoir area and adjoining land belonging to GVMC that free from any encumbrance and there are no non-titleholders in these lands. The Simhachalam hill in the southern side is under control of Simhachalam Devasthanam Temple Board.

4) DDR -UCCRTF/06

Procurement of E-vehicles along with supporting Charging Infrastructure Including Operation & Maintenance for a period of 5 years

38. The objective of subproject is Procurement of E-vehicles along with supporting charging infrastructure including Operation & Maintenance for a period of 5 years. The procurement of e-vehicles will be done by the GVMC to substitute in-use vehicles for solid waste collection, Buses and Cars under use for operational purpose on a pilot basis. GVMC has proposed to introduce e-vehicles in its key operations. The following areas are being considered in the initial phase:

• Solid waste collection using E-Rickshaws • E – Rickshaws for passenger movement at Beach road. • Buses on BRTS on a pilot Basis

39. This will also serve as a demonstration phase for monitoring the operational performance and the accrued environmental benefits particularly relating to the GHG reductions and mitigation of high carbon pattern of growth through such sustainable transport initiatives. The project will also help in capacity building of local operators and charging stations.

40. The proposed subproject is procurement of environment and climate friendly e-vehicles that will replace in-use petrol and diesel vehicles. The project will bring positive environmental and socioeconomic benefits because the e-vehicles will not generate any air or noise pollution and will replace gasoline powered cars, vans and buses that use lead acid batteries.

41. The subproject is unlikely to cause any adverse impacts because it involves procurement of environmental and climate friendly e-vehicles. The subproject will have positive impacts in terms of reducing GHG emissions from the replacement of petrol and diesel vehicles and setup and demonstration of electric vehicle charging facilities in the city of Visakhapatnam.

42. For Solid waste collection using E-Rickshaws: Land for parking and maintenance of e- rickshaws belongs to GVMC at Shanti Ashram near MUPP colony. No involuntary resettlement impacts are assessed at the identified sites

43. E – Rickshaws for passenger movement at Beach road: Land for parking, maintenance and charging of e-rickshaws belongs to GVMC at Aqua Sports Complex. No involuntary resettlement impacts are assessed at the identified sites.

44. Buses on BRTS on a pilot Basis: Land for parking and maintenance of e-buses belongs to APSRTC at Maddlilapalem Bus depot. No involuntary resettlement impacts are assessed at the identified sites. Certificate/Order for transferring of land to the project authority GVMC.

1) Resettlement Plan APTransco-01

Augmenting power distribution capacity for meeting Industry demand at Kapuleppada, Nakkapalle/ Chandanada and Achutapuram locations – AP Transco 01

47. The proposed subproject (package Andhra Pradesh Transmission Corporation Ltd (APTransco) 01) involves construction of three substations, one of 132 kilovolt (kV) capacity and two of 220 kV capacity, and related laying of transmission lines for 24 Kms and underground cable for 26 kms.

48. For future load requirements of the industries within the clusters identified in Vizag node, APTransco and Andhra Pradesh Industrial Infrastructure Corporation (APIIC) have identified the need to create and/or upgrade substations at three locations within the node, for which 7.6 ha of government land is identified. The capacities proposed are 132 kV and 220 kV sub-stations and associated transmission lines for meeting the load requirements in the specified clusters coming up with in/vicinity of VCIC. This involves setting up new sub stations and/or strengthening existing substations and laying /strengthening transmission lines and cables primarily at 220 kV and 132 kV voltage level and then augmenting downstream distribution network as necessary. The proposed overhead transmission towers leading to Nakkapalle SS are estimated to require an additional 1.23 ha land, of which the alignment will be finalized by the turnkey contractor in consultation with APTransco and other stakeholders, hence ownership is not yet known. The intervention will benefit the public and industries in: (i) improved voltage profiles of the regions; (ii) additional load growth of about 1,350 Megawatt (MW), met by constructing proposed substations; (iii) reduction of system losses of about 100 MW due to

erection of proposed substations; (iv) industry and population gets reliable power supply; and (v) quality and quantity of power ensured over wide geographical area.

49. The subproject is likely to require to use private land for erection of transmission towers (1.23 ha), and is also likely to cause damage to crops during erection of transmission towers and lines. Temporary disruption to access during underground cable laying work, resulting in potential temporary loss of income to an estimated 48 shop owners/vendors and 16 employees, for a maximum period of 10 days each during implementation, as well as temporary access disturbances to residents living along and/or having land along the corridor of transmission line, is assessed.

2) Resettlement Plan APTransco-03

Augmenting Transmission Infrastructure in Yerpedu-Srikalahasti Node

51. Subproject (package APTransco 03, for Yerpedu-Srikalahasti node) under tranche 1 of VCICDP multi tranche financing facility (MFF) aims to augment power distribution capacity to meet industry demand at Rachagunneri, Naidupeta and Yerpedu locations. Proposed civil works under the subproject include construction of three substations, one each of 132 kilovolt (kV), 400 kV and 220 kV capacity, and laying of 111.271 (kms) transmission lines.

52. The Resettlement Plan has been updated for the subproject based on technical information, maps, and drawings available with APTransco. The subproject is classified as “Category B” for Involuntary Resettlement impact as per ADB’s Safeguard Policy Statement (SPS), 2009.

53. The proposed subproject will involve involuntary resettlement impacts such as resumption of assigned land for substation, use private land for erection of transmission towers and is likely to cause damage to crop during erection of transmission lines. Land has been resumed for the construction of substation in Yerpedu and Rachagunneri. The 9 assigned landowners affected due to resumption of land for SS Yerpedu and 18 assigned landholders for SS Rachagunneri, totaling 27 landholders have been compensated.

54. Compensation for land diminution is paid in three installments i.e. the first, after completion of foundation, the second after erection of tower and last after stringing work is completed. The compensation amount is based on the extent of land taken for construction of tower. First installment paid

55. So far 8 farmers were paid compensation for crop loss. (Paddy farmers – 6, Groundnut-1 and Sugarcane-1 farmer). The details of compensation paid for the three crops is given below.

Upgrading & Rehabilitation of ‘Samarlakota to Rajanagaram’ Section of ‘Kakinada – Rajanagaram’

Road to ‘2 Lane Dual Carriageway Standard’

59. The subproject involves reconstruction and widening of 29.600km stretch of the Samarlakota to Rajanagaram section of Kakinada to Rajanagaram road, also known as ADB Road, which connects the Samarlakota town with the National Highway-16 (Old NH-5) at Rajanagaram. The start point of the corridor is Samarlakota near the RoB junction at chainage 26.400km and ends at chainage 55.970km at National Highway in Rajanagaram village. The road is the main artery of and is one of the most important roads in the East Godavari district. The proposed corridor traverses along 11 villages.

60. The subproject involved acquisition of land measuring 72.17 acres, will impact 405 structures comprising of 133 residences, 173 commercial, 64 residences cum commercial involving others category 35 compound wall and portion of the structure. Further 79 tenants, 418 agricultural landowners and 28 common property resources will also be affected.

3 NGO APRDC-01 reported that, socio-economic base line data has been completed for 358 landowners residing in the villages out of total 684 awardee private landowners. The balance 326 have not submitted the verification documents to the RDO. They may be absentee landowners or they may not be willing to submit their documents. RDO and PIU are making efforts to identify these landowners during mutation process and disburse their compensation amount.

B. Resettlement Plan APRDC-04

External Connectivity to Naidupeta Industrial Cluster Road

61. The subproject involves reconstruction and widening of 8.700 kilometers (km) stretch of the External Naidupeta Industrial Cluster road, which connects the Venkatagiri – Naidupeta road with the National Highway-16 (previously NH-5) at Thimmaji Kandriga village. The start point of the road is Thimmaji Kandriga village at chainage 0.000 km and ends at chainage 8.700 km at National Highway -16 in near Pandluru Village. The proposed corridor traverses along 6 villages.

62. The subproject road falls entirely in Nellore district of the State of Andhra Pradesh and traverses through 3 revenue divisions. Nellore district (Renamed as Sri Potti Sriramulu Nellore district), located in region, is one of the 13 districts of Andhra Pradesh. The district is bordered by the to the east, district to the west, to the north, Chittoor district and Thiruvallur district of to the south. The district is located between 13.30- 15.6 Northern latitude and 70.5- 80.16 eastern longitude.

63. The subproject APRDC-04 involved land acquisition 33.074 ha (81.71775 acres). Out of total 33.07 ha, private land acquisition is 24.48 ha and govt. land acquisition is 8.59 ha. As per LPS and baseline survey, sub project will impact on 13 structures and 72 agriculture landowners; out of 18 affected structure 13 are private structures comprising 10 residential and 3 commercial. The remaining 5 structures are common property resources (CPRs) affected along the road.

C. Resettlement Plan APRDC-05

External Connectivity to Routhusuramala Cluster, Chittoor District road

64. The subproject road widening of 9.207 km stretch for the Connectivity of Routhusuramala Cluster (Part of South Block of Proposed Chittoor (Yerpedu – Srikalahasthi) Node). The proposed road connects the National Highway SH-61 at Neleballi. The project road passes mainly through two districts from 0+000 Km to 3+200 Km comes under Nellore district and remaining part of the road falls in Chittoor district. The project road passes mainly though plain and rolling terrain. The topography of the region is mixed type with combination of horizontal and vertical curves. The land use is mixed type with sections of agricultural land on plains and small/medium size industries in clusters. There exists a tar plant and stone quarry beside the project road. Roadside plantation is observed at few places on the project road.

65. The project would lead to the improvement of road connectivity between the State Highways and National Highways and will facilitate faster movement of goods and material from the Krishnapatnam and Chennai ports to the industrial areas, special economic zones and coal based power plants. It also provides access to region, Karnataka State, with the coastal corridor roads. The road passes mainly through agriculture dry lands and at some locations passes through the horticulture crops. Further, it will also reduce the travel time to the residents of this area to work places, schools, hospitals and markets. Farmers too will be benefited by the faster transportation of their produce and buyers coming to their doorstep to procure food grains. Industrial growth will also generate employment opportunities to the people and new townships will be created to meet the demand for housing.

66. The subproject APRDC-05 involved land acquisition 15.075 ha (37.25 acres). Out of total 15.07 ha, private land acquisition is 11.86 ha and govt. land acquisition is 3.21 ha. As per LPS & baseline survey, sub project will impact on 6 structures and 66 agriculture landowners. Out of 6 affected structure 3 are private structures comprising 2 residential, 1 commercial and the remaining 3 structures are common property resources (CPRs) affected along the road.

External Connectivity to Nakkapalli Industrial Cluster Road

67. The sub project involves reconstruction and widening of the 4.70 kms long road corridor, which connects the State highway at Kagitha to Nakkapalli town. It provides access to Costal region, Orrisa & West Bengal State, with the coastal corridor roads. The proposed road Nakkapalli Cluster is a process to connecting State Highways and National Highways. The road passes mainly through agriculture dry lands.

68. The project would lead to the improvement of road connectivity to the improved connectivity between the State Highways with National Highways will facilitate faster movement of goods and material to and fro from the port to the nearby industrial areas, special economic zones and Mineral based industries. Further, it will also reduce the travel time to the residents of this area to workplace, schools, hospitals and markets. Agriculturist too will benefit by being able to quickly transport their produce without delay and buyers coming to their doorstep to procure food grains. Industrial growth will also generate employment opportunities to the people and new townships will be created to meet the demand for housing. However, the sub project will require private land and removal of encroachments and squatting for improving the corridor, resulting in negative impacts to some people living along the corridor.

69. The subproject APRDC-05 involved land acquisition 18.226 ha (45.0226 acres). Out of total 18.22 ha, private land acquisition is 16.07 ha and govt. land acquisition is 2.15 ha. As per LPS & baseline survey, sub project will impact on 06 structures and 43 agriculture landowners; out of 8 affected structure 3 are private residential structures and 5 are common property resources (CPRs) affected along the road.

70. The Resettlement Plan will be updated and finalized upon the finalization of detailed engineering design and joint verification survey for land acquisition process during project implementation.

III. CONSULTATION, PARTICIPATION AND DISCLOSURE

A. Public Consultation & Participation

71. ADB’s SPS defines meaningful consultation as a process that (i) begins early in the project preparation stage and is carried out on an ongoing basis throughout the project cycle; (ii) provides timely disclosure of relevant and adequate information that is understandable and readily accessible to affected people; (iii) is undertaken in an atmosphere free of intimidation or coercion; (iv) is gender inclusive and responsive, and tailored to the needs of disadvantaged and vulnerable groups; and (v) enables the incorporation of all relevant views of affected people and other stakeholders into decision making, such as project design, mitigation measures, the sharing of development benefits and opportunities, and implementation issues. Ensure the following issues/agenda & outcomes during Public Communication/Public Consultation meetings, is being organized by the PIUs:

o ensure the Contractor has abide by the Environmental, Health and Safety (EHS) measures/norms. o establish rapport between the project affected persons and other stakeholders for the success of the project; o build an environment where people understand and appreciate the need and importance of the VCIC project; o learn from the people about the issues in terms of the regional linkages, safety, and other social dimensions of the region/ area that need to be considered while execution of the project; o facilitate the partnership and ownership of the community through their involvement in the decision-making process; o sensitization & coordination with the engineering teams on road safety, priority for engagement of local labor focusing on female, including gender equality and child labor issues. o Sensitization & coordination with bank authorities for opening of bank account with spouse for all affected persons. o sensitize for entrepreneurship development, skill upgradation training, etc. in the line with VCIC projects o awareness on HIV/AIDS related issues and analyze the hot spot in convergence with APSACS. o gather and document information on practices / issues that could provide feedback into project design for future projects. o understand and incorporate the views of the people in the execution process in order to minimize the future resistance and delays. o recording/registering the grievance for redressal by the competent authority/stakeholders.

72. Particular attention has been paid to the need of the disadvantaged or vulnerable groups, especially those BPL, the landless, the elderly, female headed households, women and children, Indigenous People/ Scheduled Tribes (if any), and those without legal title to land. The key informants to be consulted, during the project preparation phase and during the Resettlement Plan updating and implementation, shall include the following stakeholders: (i) Heads and members of households likely to be displaced (ii) Physically and economically displaced households belonging to the vulnerable groups (iii) Host communities (iv) Women in the displaced as well as host communities

(v) Local self-government leaders, and, (vi) Government line departments.

B. Public Disclosure

73. All the RPs prepared under VCICDP has been disclosed on the Program website of PMU (www.apindustries.gov.in/VCIC/), PIUs website www.aprdc.ap.gov.in, www.apiic.in, www.aptransco.gov.in, www.gvmc.gov.in as well as on ADB website www.adb.org . The hard copies of RPs are also available in the office of PMU-VCICDP. Simplified version of the RP and the Entitlement Matrix has been prepared in local language (Telugu) and distributed in the form of handbills to the concerned stakeholders.

74. Moreover, the Social Safeguard Monitoring Report (SSMR), internal monitoring reports, are also disclosed on the ADB as well as the Program website. Social Monitoring Reports is prepared Semi -Annual and duly uploaded on the websites.

C. Conducted Outreach Programs during July to December 2019

75. The awareness programs were mainly related to informing details of VCICDP, Subproject benefits, work commencement, worksite inconveniences, safety aspects and compensation details. In the projects where construction works were not initiated, the programs were mainly related to project details and recording concerns of the public. Following are details of outreach programs conducted during the reporting period.

76. Majority of the training programs were conducted by GVMC, followed by APRDC, APTransco and lastly by APIIC. As projects implemented by APIIC have no impacts on public and interaction with them is minimal, number of outreach programs for public were also less.

77. Awareness campaigns were primarily conducted in GVMC/02 Project to sensitize public on the subproject, work commencement, worksite inconveniences and safety to support the contractor in smooth implementation of the project.

78. Awareness Campaign in GVMC: Total 79 awareness campaign conducted from July to December, 2019 on advance information about work commencement and worksite safety was conducted in project areas of GVMC. 1975 persons including 1025 women were met through house visits by Social Mobilization team of the Contractor (NCC).

79. Public Awareness Programmes: In addition to house campaigns in GVMC/02 project, public meetings were conducted with colony leaders, committees and women groups to inform about the project and work progress details. In APTransco/03 project, the landowners who agreed for construction of towers in their lands were informed about the land utilization, compensation and work schedule details.

80. Student Awareness Programmes: The NGO of APRDC/01 Project and NCC (Contractor) of GVMC/02 conducted awareness programmes for students in their respective college premises. Group discussions, debates and presentations were conducted on Road Safety and HIV/AIDS.

81. Safety Awareness Programmes: During the reporting period, 43 male and 07 female workers were participated. The migrant workers were sensitized through their respective safety experts General, Use of PPEs, First Aid, Emergency, Road, Hight, Electrical, Vehicle, Mechanical etc subjects.

82. Computer based online Customer feedback: NCC (Contractor) of GVMC/02 Project had developed a monitoring system i.e. Supervisory Control and Data Acquisition (SCADA) for operation and maintenance purposes of GVMC/02 project. All the houses which were provided water connections were tagged with the monitoring system using geographic information system (GIS). NCC plans to develop mobile app to be used by residents for payment of water charges, submission of complaints etc. It was discussed to include customer feedback in mobile app to enable the residents to share their views on the services provided to them through the project

IV. GRIEVANCE REDRESSAL MECHANISM (GRM)

A. Common Grievance Redress Mechanism (GRM)

83. Project grievance redress mechanism has been established vide G.O No 163 dated 18.06.2018 from Industries and Commerce (Infra) Department to evaluate, and facilitate the resolution of affected persons’ concerns, complaints, and grievances related to social and environmental issues of the project. The GRM aims to provide a time-bound and transparent mechanism to voice and resolve social and environmental concerns linked to the project.

84. A common GRM is in place for social, environmental, or any other grievances related to the project. Every grievance shall be registered and careful documentation of process with regard to each grievance is undertaken, as explained below. The PIU environmental and social safeguards officers will have the overall responsibility for timely grievance redress on environmental and social safeguards issues, including keeping and maintaining the complaint and redress records. Public awareness campaign is being be conducted to ensure that awareness on the project and its grievance redress procedures is generated.

85. Affected persons have the flexibility of conveying grievances/suggestions by sending grievance redress/suggestion in writing, through telephone call to Divisional Engineer, GVMC/ APTransco/ APRDC/ APIIC PIU’s safeguard manager, or by filling forms for complaints/suggestion by email in the VCICD Project site to be installed under the AP Transco/ APRDC/ APIIC/ GVMC websites. The Resettlement Framework provides the sample grievance registration form. Careful documentation of the name of the complainant, date of receipt of the complaint, address/contact details of the person, location of the problem area, and how the problem was resolved has been undertaken. The PIUs’ safeguard officers have the overall responsibility for timely grievance redressal on environmental and social safeguards issues and for registration of grievances, related disclosure, and communication with the aggrieved party.

B. Grievance Redressal Committee (GRC)

86. GRC has been established at three levels, one at Project site, one at district level and another at State /PMU level, to receive, evaluate and facilitate the resolution of displaced persons concerns, complaints and grievances. The GRC provided an opportunity to the affected persons to have their grievances redressed prior to approaching the jurisdictional sub court. The GRC is aimed to provide a trusted way to voice and resolve concerns linked to the project, and to be an effective way to address affected person’s concerns without allowing it to escalate resulting in delays in project implementation.

87. The GRC aims to provide a time-bound and transparent mechanism to voice and resolve social and environmental concerns linked to the project. The GRC is not intended to bypass the government’s inbuilt redressal process, nor the provisions of the statute, but rather it is intended to address displaced persons concerns and complaints promptly, making it readily accessible to all segments of the displaced persons and is scaled to the risks and impacts of the project.

88. The district level GRCs functions out of each District where the subproject is being implemented. The GRC is Chaired by Joint Collector and comprising of the Divisional Engineer acting as its member secretary and the following members: (i) Revenue Divisional Officer (RDO)/Sub Collector of the division; (ii) Project Director, DRDA; (iii) Chief Executive Officer, Zilla

89. The Project Director, PMU is the appellate authority supported by the PMSC and Safeguard Officer of PMU, and concerned PIUs to make final decisions on the unresolved issues.

90. During the reporting period, grievances were mainly related to seeking information related compensation or demanding compensation and worksite inconveniences. The issues were resolved at site level by respective contractors with the support of PIUs. However, the process of payment of compensation has been initiated regarding the issues related to delay in compensation payment in project areas of APTransco/01 and APRDC/01 and will be completed at the earliest. 91. The State of Andhra Pradesh through the DoI is the Executing Agency (EA) for the project and the Project Director; DoI headed by the PMU and is the in charge of overall coordination between the various PIUs and in prioritizing subprojects for subsequent tranches based on social safeguards compliance. A Project Steering Committee has been established to advise the PMU on policy, monitor the implementation of the Investment Program, and coordinate with PIUs on cross-cutting issues.

92. PMU is supported by a full-time Social Safeguard and Gender officer (SSGO).

B. Project Implementation Unit (PIU)

93. PIUs have been set up in each of the implementing agencies. The road subprojects have been implemented by the APRDC PIU; the energy subprojects have been implemented by the APTransco PIU; the infrastructure subcomponents proposed in the industrial estates and special economic zones has been implemented by APIIC PIU; and urban infrastructure subprojects in GVMC area has been implemented by the GVMC PIU. The respective PIUs are responsible for screening subprojects, categorization based on involuntary resettlement and/or indigenous peoples impacts, conducting the social assessment, preparation and implementation of Resettlement Plans and/or Indigenous Peoples Plan as required, and as outlined in the Resettlement Framework with the support of the PIU level Social Safeguard and Gender officer.

VII. MONITORING RESULTS - FINDINGS

96. Approval of Resettlement Framework and Entitlement Matrix is still pending at PMU/ADB level resulted delay in disclosure of Resettlement Plans and also R&R award. 97. NGO APRDC-01 reported that, socio-economic base line data has been completed for 358 residing in the villages out of total 684 awardee private landowners. The balance 326 have not submitted the verification documents to the RDO. They may be absentee landowners, or they may not be willing to submit their documents. RDO and PIU are making efforts to identify these landowners during mutation process and disburse their compensation amount. 98. For subject APRDC 01, disbursement of compensation amount is pending for 45.522 acres out of 72.171 acres. District administration has handed over possession of land 24.828 Acres to APRDC. PMU has allocated Rs.106 Crores against Land acquisition based on DC’s proposal. Total 31.49 Crores has been disbursed to 296 PAPs (43.27%) out of total 684 landowners in project section. APRDC is to seek revalidation of payment from financial department & upload the bill with State Government and to pursue with GoAP for financial budget and allocations for the project. 99. For saving packages of Tranche-1, Land Acquisition Notification is not yet issued by DC based on the detail to be provided by APRDC (Preliminary Notification and Acquisition is pending under Section 11) Unless Notification/Publication is issued the work of preliminary survey of land to be acquired cannot be done for subproject APRDC-04, APRDC-05 & APRDC-06. 100. EOI for selection of Road Safety Consultant completed, RFP to be issued in Q1-2020 after GoAP approval. 101.
