In the matter of Economic Regulation of Aeronautical Services provided by Airport Operators - Interim arrangement to continue the levy of existing tariffs beyond 31.03.2021 for the relevant Control Period.

This is regarding extension of interim arrangement to continue levy of existing aeronautical tariff for further a period beyond 31.03.2021 in respect of the following Airports categorized on the basis of the same being in different stages of determination as detailed in the table below:

(i) The determination of aeronautical tariff by the Authority in respect of Hyderabad, Bangalore, Cochin Airports, for the 3rd Control Period, and, in respect of for the 2nd Control Period, is already in progress and completion of the process will take time. The Authority, has, therefore, decided that the tariff applicable as on 31.03.2021 may be further extended for a period of 06 (six) months w.e.f. 01.04.2021 to 30.09.2021 or till the determination of tariffs for the relevant Control Period, whichever is earlier, as an interim arrangement to avoid any regulatory vacuum.

(i) The tariff determination for 3rd Control Period is due for the above mentioned airports (refer Table-II). Out of these 08 airports, it is ascertained that the commercial operations at 03 airports namely Guwahati, Trivandrum, and Jaipur, are due to be handed over by AAI to M/s Adani, shortly, post privatization. It is, therefore, expected that the submission of MYTP/ATP for these airports by the new Operator will take more time.

(ii) In respect of the remaining 05 airports, the Authority is in receipt of MYTP/ATP in respect of few airports, for which tariff determination process is initiated. MYTP/ATP in respect of other airports is expected shortly.

(iii) Keeping in view that the tariff determination process for all the above mentioned 08 AAI managed airports will take more time, the Authority, has, decided that the tariff applicable as on 31.03.2021 may be extended for a further period of six (06) months w.eJ. 01.04.2021 to 30.09.2021, or, till the determination of tariffs for the 3rd Control Period, whichever is earlier, as an interim arrangement to avoid any regulatory vacuum .

III. Adani Airports:

(i) M/s Adani vide their letter no. ALiALlCO/AERA-IT/2021/1, letter no. AMIALICO/AERA-IT/2021/1 & letter no. AAIALICO/AERA-IT/2021/1 dated 25.01 .2021, has requested the Authority to extend the existing tariff, applicable as on 31 .03.2021, for a further period of 06 (six) months up to 30.09.2021 for Lucknow, Mangaluru, and Ahmedabad Airports. In the aforementioned letters M/s Adani has also stated that they shall be submitting the MYTP/ATP for the three airports (i.e. for Ahmedabad & Lucknow Airports for the 3rd Control Period, 51 and, LLO. Marigaluru for 1 Control Period) by May 2021.

Order No. 65/2020-21 Page 20f3 (ii) The Authority, has therefore, decided that the existing tariff, applicable as on 31.03.2021, may be extended for a further period of six (06) months w.eJ. 01.04.2021 to 30.09.2021, or, till the determination of tariffs for the relevant Control Period, whichever is earlier, as an interim arrangement to avoid any regulatory vacuum .

ORDER

In view of the above, to avoid any regulatory vacuum in respect of the tariffs being levied by the regulated entities, the Authority, in exercise of powers conferred by Section 13(1) of the Airport Economic Regulatory Authority of India Act, 2008 hereby orders that:­

(i) The Airport Operators (listed at Table I, II, & III) are allowed to continue the levy of existing tariff, applicable as on 31.03.2021 , on interim basis, for a further period of 06 (six) months w.e.f. 01.04.2021 to 30.09.2021 or till the determination of tariffs for the relevant Control Period, whichever is earlier. (ii) The Airport Operator may ensure compliance of the Order.

In the matter of Interim arrangement to continue the levy of existing tariffs in respect of MangaluruInternational Airport vide Order No. 46 /2020-21 dated 29th September, 2020, regarding economic regulation of aeronautical services provided by the Airport Operator, Adani Mangaluru International Airport limited with effect from 31.10.2020 to 31.03.2021 or till the determination oftariffs for the First Control Period, whichever is earlier.

The Authority vide Order No. 46/2020-21 dated 29.09.2020 has decided that Mangalore International Airportpresentlymanaged by the Airports Authority of India, shall be allowed to cOll!i!l!!~:~!P l~~,JJJ~ existing tariff for a period of six months w.e.f, 01.10.2020 to 3~.b'3~~'6~'1 or it1lr· 'handing over of the Airport to AMIAL, whichever, is earlier.

2. Adani Mangaluru International Airport Ltd vide letter No. AMIALjCOjAERA­ ITj2020!l dated 17.09.2020 has submitted that Airports Authority of India has selected Adani Group for operation, management and development of Mangaluru International Airport for 50 years and as part of the transition process, Adani Group has formed a Sij\~.· I Purpose Ve~icl~, namely, Adani Mangaluru International Ai1J~o~\'~~Limlt ,'AM ;i'fFiAM;,' ad";~!s ';d the Concession Agreement with ztrfq;tt~, ~';;fi 'i~i O' " 0[1 . ~.~020. 3. AMIAL, vide its letter no. AMIALjCOjAERA-ITj2020j1 dated 17.09.2020, has stated that they will take over the management and operation of the Airport effective 31.10.2020 and has requested the Authority to allow continuation of the existing aeronautical tariff from the date of COD till fresh submission of MYTP by AMIAL and determination of tariff by AERA.

Order No, 48/2020-21 Page 10f3 4. AAI also confirmed that Adani Mangaluru International Airport Limited (AMIAL) will take over and start the management and operation of the Airport w.e.f 31.10.2020.

5. Since AMIAL is to assume the role of the Airport Operator for Mangaluru International Airport effective 31.10.2020, the Authority decides to allow AMIAL to levy and collect the existing Aeronautical tariff as applicable as on 30.10.2020 effective 31.10.2020 (date of commencement of operations by AMIAL) till 31.03.2021 or determination of fresh tariff for aeronautical services for Mangaluru Airport whichever is earlier.

In view of the above, to avoid any regulatory vacuum in respect of the tariffs being levied by the regulated entities and considering change in the status of Airport Operator at Mangaluru International.Airport, the Authority, in exercise of powers conferred by Section 13(1) of the Airport Economic Regulatory Authority of India Act, 2008 hereby orders that:

(i) The Airport Operator, Adani.Mangaluru International Airport limited (AMIAL) is allowed to continue to levy and collect the existing Aeronautical tariff i~~}J~~T~,~~,Org~r~p.46 /2020-21 dated 29.09.2020 w.e.f. 31.10.2020 to 31'03i;20'~1 or'tilt the determination of new tariffs in respect of Mangaluru Airport for AMIAL for the First Control Period, whichever is earlier.

(ii) ,The Airport Operator shall submit MYrP as per the provisions of AERA Regulatory Guidelines.

Note:

1) Landing Charges for Small Domestic Aircrafts up to maximum All Up Weight of 21000 Kgs shall be levied @ Rs.64.90 per thousand Kgs. There is no minimum charge for this category. 2) No landing charges shall be payable in respect of :- (a) aircraft with a maximum certified capacity of less than 80 seats, being operated by domestic scheduled operators ; and (b) Helicopters of all types.

3) Charges shall be calculated on the basis of nearest MT (i.e. 1000 kgs.)

Night parking charges between 2200 hours to 0600 hours are @50% of the existing parking charges at all airports except Kolkata and Chennai airports.

(iv) Night parking charges between 2200 hours to 0600 hours will be as under

For calculating free parking period, irrespective of actual time taken, a standard time of 15 minutes, on account of time taken between touch down and actual parking and another 15 minutes of Taxing from parking shed to take-off point shall be added.

(ii) For calculating chargeable parking time, part of an hour should be rounded off to the nearest hour. Charges for each period of parking are also rounded off to nearest rupee.

(iii) At the in-contact stands, after free parking, for the next two hours normal parking charges shall be levied. After this period, Housing Charges shall be levied.

(iv) Landing / RNF charges for cargo operations are same as for passenger operations.

(v) In all cases, total weight of the aircraft is calculated to the nearest thousand kgs and charges to be rounded off to the nearest rupee. (vii) PASSENGER SERVICE FEE: (revised w.e.f. 1st April,2009):

(a) Rs. 207/-(Rupees two hundred seven only) per embarking International / Domestic passenger at AAI airports including Civil Enclaves except Kolkata, Chennai, Guwahati & Lucknow Airports. (b) $ 5.18 (US$ Five and eighteen cents only) per passenger in respect of the tickets issue against Dollar Tariff. (c) Collection charges: if the payment is made within 15 days of receipt of bills, then collection charges at 2.5% of PSF per passenger is payable. No collection charges shall be payable if the operator fails to pay the PSF to AAI within the credit period and in case of part payment. Airlines to make full payment of PSF collection to AAI and raise a separate invoice for the collection charges on PSF to AAI. (d) No collection charges are payable to casual operator/non scheduled operators. (e) Exemption of airlines from paying PSF from Sky Marshals. Note: For conversion of US$ into INR the rate as on the 1st day of the month for 1st fortnightly billing period and rate as on 16th of the month for the 2nd fortnightly billing period shall be adopted. If the payment is made within 15 days of receipt of bills, then collection charges at 2.5% of PSF per passenger is payable. (viii) USER DEVELOPMENT FEE (UDF): Ministry of Civil Aviation/Airports Economic Regulatory Authority of India (AERA) has approved the levy of UDF to embarking passengers at the following AAI airports. Note: 1. UDF collection charge at a flat rate of Rs. 5/- per pax (all inclusive) is allowed to airlines subject to payment of UDF collection to AAI within the credit period. 2. Airlines to make full payment of UDF collection to AAI and raise a separate invoice for the collection charges on UDF to AAI.

(ix) CHARGES FOR EXTENSION OF SERVICE HOURS (AIRPORT/ATC) ( effective from 01-12-2011)

Charges for Extension of Service Hours (Airport/ATC) are categorized into (a) Instrument Landing System Operating Stations (ILS Station) (b) Non-ILS Operating Stations (Non-ILS Station).

Charges for extension of Service Hours(Airport/ATC) beyond designated watch hours irrespective of the weight of the aircraft are categorized as follows:

1. The charges are payable by all operators/agencies operating outside the watch hours, except aircraft(s) belonging to any armed force of the Union, including BSF & NCC. 2. The charges are payable at the Aerodromes where extension is availed at the time of landing / taking off as the case may be. Where credit facilities have been already authorized (for example scheduled operators, State Govt. aircraft etc.), payment will be accepted only in demand draft along with the Routine bills. 3. When the two aircraft use the facility at the same time, Charges for Extension of Service Hours for each Airline/aircraft should be charged separately and no sharing of charges between the Users is permissible. 4. Fraction of hours may be rounded off to the next half an hour and charged accordingly. 5. If the aircraft has taken off just before the closing of watch hours, watch hours should be extended at least for a period of 30 minutes after take off as is the normal practice, this will not attract extra service charge. If the aircraft returns to land due to any technical reason, extended period beyond the normal watch hour, if any, should not be charged. However, any extension required after such landing should be charged as per rates applicable. 6. Any extension of Service Hours provided to accommodate an aircraft experiencing technical problem and requesting emergency landing should not be charged. Any extension required after such landing should be charged as per rates applicable. 7. No charges will be levied for extension of Service hours due to inescapable delays because of runway block/VVIP Movements/weather conditions at the station.

8. The concessional tariff for Extension of Service Hours (Airport/ATC) applicable to small domestic aircrafts with MTOW 21000Kgs. and below has been withdrawn from the date of implementation of revised rates for Extension of Service Hours i.e. w.e.f. 01-12-2011.

9. If an Operator, after obtaining approval of AAI for extension of service hours, subsequently intends to withdraw the request under any circumstances, shall inform AAI at least 6 hours in advance of the scheduled departure or arrival time. If the Operator fails to do so, he shall be charged Service Charges for Extension of Service Hours for a period of 4 hours as penalty. 10. The charges for Extension of Service Hours (Airport/ATC) shall be levied as per revised rates per hour basis for a minimum period of one hour. 11. The Service Charges indicated above are only for the services rendered by AAI. 12. The Charges for Extension of Service Hours (Airport/ATC) are applicable to the airports which are having designated watch hours. 13. In case when ILS is not operational , rates for non ILS station is to be charged.

14. All the above charges are subject to levy of Service Tax as per the applicable rates.

In exercise of power conferred under tlule BBA ofthe Aircraft Rules, l-937, the Central Government has accorded approval for levy ofrevised Aviation Security Fee (ASF) rates on air tickets issued on or after 1't April,2021at 00.01 hours as under:

Aviation Security Fee for the domestic passengers will be levied at the rate of Rs. 200/- per embarking passenger.
