It is doubtful whether there exists even any general agree- ment as to what subjects are within its scope. The problem of whether, and in what sense, it is to be considered philosophy or science, cannot, however, be discussed without adopting at least some tentative notion of its meaning that shall serve as the basis for the discussion. This can be more effectively done by a general description of the types of problem usually dealt with in treatises and courses on Jurisprudence than by framing a logically correct definition that secured accuracy and completeness by resort to a convenient vagueness. Investigation discloses its use to denote lines of inquiry having little in common other than a professed interest in general questions and problems concerning law and justice. -
Philosophy 320: Knowledge and Assertion
Course Syllabus: Philosophy 320: Knowledge and Assertion Matthew A. Benton [email protected] Description This 300-level upper-division undergraduate course, intended primarily for philosophy majors, will cover the literature on a fascinating question that has recently surfaced at the intersection of epistemology and philosophy of language: whether knowledge is the norm of assertion. The idea behind such a view is that in our standard conversational contexts, one who flat-out asserts that something is the case somehow represents herself as knowing that thing, and thus, there is a norm to the effect that one ought not to flat-out assert something unless one knows it. Proponents of the knowledge-norm have appealed to several strands of data from ordinary conversation practice and problematic sentences to sup- port their view; but other philosophers have leveled counterarguments. This course will evaluate the debate, including the most recent installments from the cutting edge of the philosophical literature. The course will meet a demand amongst undergraduates to study this re- cently (and hotly) debated issue: the literature relating knowledge and assertion is new enough that it is not typically covered by other undergraduate courses in epistemology or philosophy of language. It will hold special appeal for un- dergraduates with cross-disciplinary interests in language, epistemology, and communal/social normativity, and will provide a rich background for those who want to do further advanced study in philosophy or linguistics. Course Requirements Weekly readings and mandatory class attendance; students missing more than 5 class sessions will have their final grade lowered a half grade for each additional absence. -

Abstract Legitimate political decision-making is underpinned by well-ordered political deliberation, including by the decision-makers themselves, their advisory bodies, and the public at large. But what constitutes well-ordered political deliberation? The short answer to this question is that it’s political deliberation that is governed by relevant norms. In this chapter, I first discuss different types of norms that might govern well-ordered political deliberation. I then focus on one particular type of norms: epistemic norms. My aim in this chapter is to shed light on how the validity of contributions to political deliberation depends, inter alia, on the epistemic status of the claims made. 1. Introduction Political deliberation is the broad, multi-stranded process in which political proposals get considered and critically scrutinised.1 There are many forums in which political deliberation takes place. Some of them are formal institutions of government such as the cabinet and parliament. Other forums of political deliberation include advisory bodies, government agencies, political parties and interest groups, the press and other broadcasters, and, increasingly, social media platforms. The Fairy Tale Sleeping Beauty and the Year 2020 By Richard John Fraser Cooper Who has not been taken aback by the unprecedented events of this year? Going forward, we are undoubtedly in a time of change, but what kind of change, and what may be learnt from times of change that have gone before? Much can be learnt when we more deeply question the events of one hundred years ago and see the movement of spiritual history in relation to 2020. Rudolf Steiner has drawn our attention to looking at history through the lens of 100 years. Each 100- year phase carries 3 x 33 1/3 years within it, to make a total of one hundred. Steiner showed how the rhythm of 331/3 years mirrors the life of Christ on earth, from birth to crucifixion and resurrection. It is therefore important to explore how we may reconnect with what was initiated 100 years ago, in its positive and negative aspects, to gain insight into mankind’s struggle toward the Christ impulse. 100 years ago from the ominous outbreak of the Coronavirus Crisis in 2020, the official implementation of the Treaty of Versailles was signed on the 10 January, 1920. The Treaty, enforcing reparation payments on Germany for its war guilt, was instrumental in laying the groundwork for the historical events that would later unfold; notably, the rearmament of Germany leading to the Second World War and the world order that would later emerge after 1945. Quite aptly, the signing had taken place in the Hall of Mirrors at the Palace of Versailles, in Paris, France, being rather symbolic of an elite struggling to pursue their own national and established political concerns separated from any of the spiritual implications of the decisions before them. -

Macias California Western School of Law [email protected] (rev. 9/8) In Utilitarian Jurisprudence in America, Peter King held up Thomas Cooper, David Hoffman, and Richard Hildreth, as those early American legal thinkers most notably influenced by Bentham.1 For King, Hildreth represented “the first real fruition of Benthamism in America,” whereas Cooper’s use of Bentham was subservient to his Southern ideology, and Hoffman’s use was mainly to “reinforce” a utilitarianism otherwise “derived from Paley.”2 Although Hildreth’s work falls outside the timeframe of early-American legal science, Cooper’s and Hoffman’s work falls squarely within it. What follows is, in part, a reevaluation of Cooper and Hoffman within the broader context of early republican jurisprudence. Because Cooper became an advocate of southern secession late in life, too many historians have dismissed his life’s work, which consisted of serious intellectual undertakings in law and philosophy, as well as medicine and chemistry. Hoffman, on the other hand, has become a man for all seasons among legal historians. His seven-year course of legal study contained such a vast and eclectic array of titles, that one can superficially paint Hoffman as advocating just about anything. As of late, Hoffman has been discussed as a leading exponent of Scottish Common Sense philosophy, second only to James Wilson a generation earlier. This tension between Hoffman-the-utilitarian and Hoffman-the-Scot requires a new examination. HICKS* Law as a general system of rules impartially applied acts as the me- dium of sovereign governmental order harmonizing the interests of indi- viduals and groups in society as equally and fairly as possible. The indi- vidual is free within the rules establishing security and order and is free from law which is not conducive to the general good. Similarly, an indi- vidual is free to pursue his own ends if they are compatible with the greatest happiness of the greatest number and also is free not to act on behalf of the common good. While these boundaries are defined by law, the actual social relations within them are the concern of ethics or psy- chology, not legislation.' Thus, political theory as utilitarianism sees the law according to its own representation of the good and its own descrip- tion of human nature. This is the original coordination of individual soci- ety and the body politic in our tradition. -

POLITICAL JURISPRUDENCE MARTIN LOUGHLIN I: INTRODUCTION Political jurisprudence is a discipline that explains the way in which governmental authority is constituted. It flourished within European thought in the period between the sixteenth and nineteenth centuries and since the twentieth century has been in decline. That decline, attributable mainly to an extending rationalization of life and thought, has led to governmental authority increasingly being expressed in technical terms. And because many of the implications of this development have been masked by the growth of an academic disciplinary specialization that sacrifices breadth of understanding for depth of knowledge, sustaining the discipline has proved difficult. -

Norm (philosophy) From Wikipedia, the free encyclopedia Norms are concepts (sentences) of practical import, oriented to effecting an action, rather than conceptual abstractions that describe, explain, and express. Normative sentences imply "ought-to" types of statements and assertions, in distinction to sentences that provide "is" types of statements and assertions. Common normative sentences include commands, permissions, and prohibitions; common normative abstract concepts include sincerity, justification, and honesty. A popular account of norms describes them as reasons to take action, to believe, and to feel. Types of norms Orders and permissions express norms. Such norm sentences do not describe how the world is, they rather prescribe how the world should be. Imperative sentences are the most obvious way to express norms, but declarative sentences also may be norms, as is the case with laws or 'principles'. Generally, whether an expression is a norm depends on what the sentence intends to assert. For instance, a sentence of the form "All Ravens are Black" could on one account be taken as descriptive, in which case an instance of a white raven would contradict it, or alternatively "All Ravens are Black" could be interpreted as a norm, in which case it stands as a principle and definition, so 'a white raven' would then not be a raven. Those norms purporting to create obligations (or duties) and permissions are called deontic norms (see also deontic logic). The concept of deontic norm is already an extension of a previous concept of norm, which would only include imperatives, that is, norms purporting to create duties. The understanding that permissions are norms in the same way was an important step in ethics and philosophy of law. -

The first was an oral will, sometimes called a nuncupative will or deathbed wish. Because of their limited application, oral wills made (signed) after Sept. 1, 2007, are no longer valid in Texas. The two other types are still Hvalid. A will written entirely in the deceased’s handwriting is known as a holographic will. State, 1 Ohio St. 422 (1853), the defendant demanded money of the prosecuting witness and, as the wife was handing it over to the prosecuting witness, the defendant snatched it and pocketed it. This was held to be robbery since it is enough that the property was in the presence and under immediate control, and that the offended party was laboring under fear, and that the intent to rob was present. The property need not actually be severed from the person. Cf. Ibeck v. State, 112 Tex. Cr. 288, 16 S.W. (2d) 232 (1929), where it was held that one may be robbed of property not taken from his person.
