Commission communication under Article 9(3) of Council Directive 96/67/EC Notification by the Federal Republic of of the application of Article 9(1)(b) and (d) of Directive 96/67/EC to (Flughafen Hamburg GmbH) (98/C 267/07)

(Text with EEA relevance) In accordance with the provisions of Article 9(3) of Council Directive 96/67/EC of 15 October 1996 on access to the groundhandling market at Community , the Commission received, on 3 August 1998, notification of the request to approve the decision of the Government of the Federal Republic of Germany of 23 July 1998 to grant to Hamburg airport (Flughafen Hamburg GmbH) an exemption to:

—Ùlimit self-handling to a single user for the categories of services listed under point 5.4 of the Annex to the Directive. This exemption is granted, on the basis of Article 9(1)(d) of the Directive, until 31 December 2000,

—Ùreserve for Flughafen Hamburg GmbH the supply of services to third parties for the categories of services listed in point 5.4 of the Annex to the Directive. This derogation is granted, on the basis of Article 9(1)(b) of the Directive, until 31 December 2000.

The exemption is granted by the Government of the Federal Republic of Germany because of the absence of available space at the airport and the growing demand for space and because of security problems that will result from opening up the market to the degree provided for by the Directive.

The notification also includes a plan for extending the airport by freeing, at the end of 2000, a total apron surface area of 13Ø000Øm2 for groundhandling equipment and the development of section No 2 for handling operations.

In accordance with the provisions of Article 9(3) of the Directive, the Commission invites interested parties to submit comments within 15 days of this publication. Comments should be sent to the following address:

(Text with EEA relevance) In accordance with the provisions of Article 9(3) of Council Directive 96/67/EC of 15 October 1996 on access to the groundhandling market at Community airports, the Commission received, on 3 August 1998, notification of the request to approve the decision of the Government of the Federal Republic of Germany of 23 July 1998 to grant to (Flughafen Stuttgart GmbH) an exemption to:

—Ùban self-handling for the categories of services listed under point 4, with regard to the physical handling of freight and mail, whether incoming, outgoing or being transferred, between the air terminal and the aircraft, and points 5.4 (excluding the transport of crew), 5.5 and 5.6 of the Annex to Directive 96/67/EC. The exemption is granted by the Government of the Federal Republic of Germany as all the available space at the airport will be accounted for with the opening of the market in services to third parties from 1 January 1999 to the degree provided for in German legislation.

The notification is accompanied by a plan presented by the airport for overcoming those problems. In particular, the plan includes the construction of a new hanger for groundhandling equipment and the establishment of a freight centre in the southern part of the airport which could be put into service in early 2001.

In accordance with the provisions of Article 9(3) of Council Directive 96/67/EC of 15 October 1996 on access to the groundhandling market at Community airports, the Commission received, on 3 August 1998, notification of the request to approve the decision of the Government of the Federal Republic of Germany of 23 July 1998 to grant to Cologne/Bonn airport (Flughafen Köln/Bonn GmbH) an exemption to: —Ùlimit self-handling to a single user for the categories of services listed under points 3 and 4, with regard to the physical handling of freight and mail whether incoming, outgoing or being transferred, between the air terminal and the aircraft, and point 5.4 (excluding the transport of crew) of the Annex to the Directive. This exemption is granted, on the basis of Article 9(1)(d) of the Directive, until 31 December 1999.

The exemption is granted by the Government of the Federal Republic of Germany as all the available space at the airport is already being used, due to the opening-up of the market, and because the demand for space will grow as a result of opening up the market to the degree provided for by the Directive, in particular with the partial use of bays for storing materials or for groundhandling operations.

The notification is accompanied by a plan for extending the airport by constructing Terminal 2 and by freeing new spaces, including an area of almost 15Ø000Øm2 for groundhandling operations.
