DECISION No. 12‐ПР/2006 ON EVALUATION THE NEED FOR PREPARING AN ENVIRONMENTAL IMPACT ASSESSMENT

Pursuant to Article 93, Paragraph 1, item 1 and Article 5, item 3 from the Environmental Protection Act and submitted written information by the Investor under Attachment No. 2 from the Regulation on the conditions and procedure for performing an Environmental Impact Assessment of investment proposals in terms of construction, activities and technologies, I hereby RULE an Environmental Impact Assessment to be performed in terms of investment proposal for Wind Farm developing. Location of the investment proposal: the land of the of , Suvorovo municipality. Assignor: “EOLICA ” AD, city of , 8, Bacho Kiro Str. Characteristics o the investment proposal: The key processes are related to production of electricity generated from wind power. On the site shall be built 30 wind turbines with capacity of 2,3 MW each. They shall be installed on 80 m high steel towers with blade diameter of 90 m. The wind farm shall have total capacity of 60‐80 MW.

GROUNDS:

1. For the purpose of developing the wind farm on site having surface area of about 1000 decares there should be performed an Environmental Impact Assessment with regards to noise, birds, landscape and inhabitants health in terms of landscape characteristics. 2. Within the territory of Suvorovo municipality lays protected area named “Suha reka” according to draft Natura 2000 project. 3. The introduction of anthropogenic equipment not typical for the landscape shall permanently change its visual image.

This decision shall not revoke the investorʹs obligations under the Environmental Protection Act and the other special acts and statutory regulations and may not be considered as a ground for cancelling the responsibility under the environmental legislation. In case any change occurs in the Investor’s investment proposal or in any of the circumstances under which this decision has been issued, the Assignor/the new assignor should notify the Regional Environmental and Water Inspectorate, city of Varna within 1 month following the change. The parties interested may appeal this decision under the terms and procedure of Administrative Procedure Act before the Ministry of Environment and Water within 7‐ day period.

Regarding: Assignment on determining the scope and the contents of Environmental Impact Assessment of investment proposal for wind farm developing on the land of the town of Suvorovo.

Dear Mr. Delchev,

With regards to Article 95, Paragraph 2 from the Environmental Protection Act (promulgated in State Gazette issue 91/2002, amended and supplemented) and Chapter III from the Regulation on the conditions and procedure for performing an Environmental Impact Assessment (promulgated in State Gazette issue 25/2003) on the assignment on determining the scope and the contents of Environmental Impact Assessment of investment proposal for wind farm developing on the land of the town of Suvorovo submitted by the Regional Environmental and Water Inspectorate, city of Varna, I would like to express the following opinion: The assignment on determining the scope and the contents of Environmental Impact Assessment contain the required scope of information according to Article 10, Paragraph 3 from the Regulation.

The Environmental Impact Assessment report should contain a forecast and assessment on the following: ‐ “Atmospheric air” – only during the construction phase (construction, transportation and assembly works); ‐ “Waste” – during the construction and operation phases ‐ types, quantities, treatment (for instance providing the waste for subsequent treatment to companies holding the relevant documents pursuant to Article 12 from Waste Management Act); ‐ “Plant and animal kingdom” ‐ during the construction and operation phases; ‐ “Geologic environment” – reporting the results from consultation carried out with “Geozashtita” EOOD, city of Varna; ‐ “Soils” – the need to be considered of recovering the qualities of damaged territories; ‐ “Harmful physical factors” – during the operation phase – noise, vibrations and electromagnetic radiation; ‐ “Health and Hygienic aspects” – during the operation phase with assessment of psychological and visual discomfort from the equipment size and work.

To be considered and assessed alternative options for location of turbines /number, height, capacity of equipment/ and the possibility for “zero alternative”.

To be stated the grounds for the choice made characterizing the level of accessibility of environmental impact including in terms of the life and health of population.

With regards to the requirements of Article 95, Paragraph 3 consultations to be carried out with: ‐ Agriculture and Forests District Directorate; ‐ NEK – in terms the possibility of connection to the existing electricity distribution network; ‐ The National Institute on the Monuments of Culture with the Ministry of Culture; ‐ “Geozashtita” EOOD – Varna; ‐ Ministry of Health.

Based on the above stated and with regards to the request for evaluating the quality of the Environmental Impact Assessment, the corrected assignment on the scope of Environmental Impact Assessment reporting the results from the consultations conducted with reference on them and the grounds for the approved and rejected remarks and/or recommendations, should be submitted together with the Environmental Impact Assessment report.

The Environmental Impact Assessment report should contain detailed map materials in scale – plan–situation with wind farm and the nearest situated populated areas with land properties reference numbers.

The structure of the Environmental Impact Assessment report should be observed and fully comply with the requirements of Article 96, Paragraph 1 from the Environmental Protection Act and Article 12 from the Regulation on the conditions and procedure for performing an Environmental Impact Assessment (adopted by Decree of Council of Ministers No. 59/2003, amended and supplemented).

The Non‐technical resume of the report should be prepared in compliance with the provisions of Article 12, Paragraph 2 from the Regulation and item 27, § 1 from the Provisional Regulations of Environmental Protection Act as a separate, integrated document allowed for public access.

The present contract was signed on the connection of the PRODUCER to the electricity transmission network of NEK EAD under the terms and conditions of Regulation No. 6 on the connection of producers and consumers of electricity to the electricity transmission and distribution networks issued by the Minister of Power Engineering and Energy Resources, promulgated in State Gazette issue 74 from 24.08.2004, hereinafter referred as to the “Regulation No. 6”.

1. Subject Matter of the Contract

1.1. By this contract NEK EAD and the PRODUCER determine the conditions for connection of site Wind Farm (hereinafter referred as to the “SITE”) being possession of the PRODUCER to the electricity transmission network, as well as other rights and obligations of the parties to the moment of signing the Agreement for connection of the SITE. 1.2. The necessary conditions as specific technical requirements for the connection of the Site pursuant to Article 52, Paragraph 1 from Regulation No. 6, shall be determined by NEK EAD.

2. Connection of the Site

2.1. NEK EAD undertakes to connect to the electricity transmission network wind power plant comprising of the aggregate amount of the wind turbines at the wind farm situated on the land of the town of Suvorovo, Suvorovo Municipality, district Varna. 2.2. The connection of the Site shall be conducted on 110 kV, as follows: 2.2.1. The connection of the Site shall be carried out at “Vulchi dol” 110/20 kV substation through new output field and connection electric air line 110 kV from “Vulchi dol” substation to 110/30 kV substation of the PRODUCER. 2.2.2. The development of 110/30 kV substation on the Site shall be done by the PRODUCER and shall be his property. The specific location of the ground designated for the construction of the substation and the plan of the terrain shall be additionally provided by the PRODUCER to NEK EAD. 2.2.3. The construction of new 110 kV vault line from “Vulchi dol” substation to the PRODUCER’S substation shall be done by NEK EAD and shall be its property.

3. Deadlines/ Stages for SITE Construction

Installation capacity – 60 MW Deadline for construction – 24 months as of the date of enforcement of the Contract for connection.

4. Deadlines for Construction of Connection Facilities

4.1. NEK EAD undertakes to build the connection facilities and to connect the SITE of the PRODUCER to the electricity transmission network within the deadlines determined as follows: 4.1.1. The deadline for the construction of the new 110 kV vault line from “Vulchi dol” substation to the SITE shall be about 24 months and shall commence since the date the Contract for connection enters into force. The exact deadline shall depend mainly on the location of 110/30 kV substation, the distance to “Vulchi dol” substation, the possible passage routes and shall be specified within 45 days following the submission of the terrain plan by the PRODUCER to NEK EAD. The expenses for research of the routes shall be covered by the PRODUCER against provided by NEK EAD expense documents. 4.1.2. The deadline for the construction of the terminal field 100 kV in the Open Distribution Installation 110 kV of “Vulchi dol” substation shall be 14 months as of the date from the Contract for connection enters into force. 4.2. NEK EAD and the PRODUCER agree that by the Contract for connection shall settle their relations with regards to the method of planning, construction and commissioning of the connection facilities according to the provisions of Territory Development Act, including the opportunity for the PRODUCER to build on his own the entire or part of the connection facilities owned by NEK EAD pursuant to Article 60, Paragraph 5, 6, 7 and 9 from Regulation No. 6.

We hereby consider your request as a notice to the competent body required according to Article 4, Paragraph 1 from the Regulation on the conditions and procedure for performing an Environmental Impact Assessment of investment proposals in terms of construction, activities and technologies (promulgated in State Gazette issue 25/2003). Investment proposals for developing Wind Farms are included in Attachment No. 2 of the Environmental Protection Act and pursuant to Article 93, Paragraph 1, item 1 are subject to evaluation of the need to perform an Environmental Impact Assessment. The consideration should be done after filing a request with the information for each separate ground in compliance to the provisions of Attachment No. 2 of the Regulation and documents for duly served notification to the mayors and the community affected, including the neighbors of the properties by newspaper and/or in other suitable way – Article 4, Paragraph 1 and Paragraph 2 from the same Regulation. Considering the evaluations made for similar investment proposals upon preparing the information of the platforms in the land of the village of Gorichane, Shabla municipality and the land of Kavarna municipality there should be considered the cumulative environmental impact (the Via Pontica migration path, the landscape, etc.), and the respective preventing/limitation measures. We bring to your attention the fact that a ground for changing the purpose of the land and for approval of a Detailed Development Plan according to the provisions of Territory Development Act, is a ruled decision for evaluation for “non‐performance of Environmental Impact Assessment” or a decision under Article 19, Paragraph 1 from the Regulation (in case of performance Environmental Impact Assessment).

Dear Mrs. Petkova,

After the provisional investigations conducted on the wind resource on the territory of Suvorovo municipality and the discussions with you and representatives of the Municipal Council, “Eolica Bulgaria” AD would like hereby to express its intentions as follows:

1. To develop on the territory of Suvorovo municipality wind farms with capacity of 100 MW – 50 wind turbines. 2. To register companies for the purpose of operation the wind farms in Suvorovo municipality. 3. To recruit local companies and people for developing the equipment and the communication network. 4. To open new job places following the construction of the wind farms with regard to their operation. 5. To pay for the ceded right of building for each wind turbine. 6. To pay to Suvorovo municipality the amount of BGN 1,500.00 for each wind turbine installed on municipal terrain on annual basis. 7. To fund the social and cultural activity of Suvorovo municipality within the tax regulations. 8. To fund two university scholarships for students from Suvorovo municipality in majors related to the scope of business of “Eolica Bulgaria” AD.

For the purposes of implementing these intentions “Eolica Bulgaria” AD shall expect from Suvorovo municipality the following:

1. The company to be authorized to purchase municipal properties: • 79,318 decares with No. 009/003 located in the area “Letishte” in the land of the town of Suvorovo; • 135,406 decares with No. 006/003 located in the area “Parcelite” in the land of the village of Levski; • 304,939 decares with No. 006/005 located in the area “Parcelite” in the land of the villlage of Levski.

Or to replace these municipal properties against our properties located on the land territory of Suvorovo municipality.

2. The company to be authorized to use easements on the municipal roads belonging to the above specified municipal properties.

3. “Eolica Bulgaria” AD to be assisted in its relations with the private owners of properties on the territory of Suvorovo municipality.

All commitments of “Eolica Bulgaria” AD shall be fulfilled after we receive authorizations by the competent governmental institutions Ministry of Power Engineering and Energy Resources, Ministry of Environment and Water, NEK, and following our connection to the national transmission network.

We declare our willingness to organize together with the municipality public discussions of the project of “Eolica Bulgaria” AD for the construction of wind farms on the land of Suvorovo municipality.

Following the approval of our proposals by the Municipal Council, we would like to sign a bilateral agreement and “Eolica Bulgaria” AD to be considered by Suvorovo municipality as a strategically preferred partner.

This 12.10.2005 at the City Hall Building of Suvorovo, Hall No. 3, at 10.30 am a meeting was held between the Mayor of the municipality, municipality representatives, ʺEolica Bulgariaʺ AD, city of Sofia, independent experts, representatives of the Municipal Council, Water Supply and Sewerage – town of Suvorovo, Brazdi Agrarian Co‐operation. The meeting was called for the purpose of public discussion on project “Construction of wind farm in “Letishte” area, on the land of the town of Suvorovo. The meeting was attended by:

The meeting was opened by Mrs. Dr. Petkova and Mr. Burhanlarski. They presented the guests attending the meeting. The meeting continued with discussions on the project.

Mr. Burhanlarski – There shall be 30 wind turbines towers with height 80 m and length of blades 45 m. The blades shall take the wind and turn it into power. The base of each tower shall be 250 m. Implementation of this project shall not damage the integrity of the agricultural land. We do not expect any adverse environmental impacts. Dr. Petkova – The Company owns the area designated for the wind farm construction. The land was purchased through tender procedure. Mr. Harvatov – Is there going to be any negative impact, the composting with mineral organic fertilizers on the tower bases? Eng. Pehlivanov – Has not an impact. Mrs. Voycheva – We need an opinion from the municipality regarding the location of cultural monuments near the ground built. Dr. Petkova – This opinion should be provided by the Ministry of Culture. Mr. Yanchev – Deep there under the track there are remains of Thracian necropolis. Eng. Pehlivanov – We do not plan to carry out construction works under the track. Mr. Raychev – Shall there be any serving road to the towers? Mr. Burhanlarski – There shall be no such road. The towers shall be located nearby the road and there shall be no need of any special maintenance. Mrs. Voycheva – Is there any protected area on the land of the municipality? Are there any areas declared by Natura 2000 on the territory of Suvorovo municipality? Mr. Apostolov – We have a protected area called “Urumovo lale Uromofii Uromofii Tulip (Tulipa Urumofii)” on the land of the village of Chernevo and area “Pobiti kamani”/ “Banovska grupa”/ on the land of the village of Banovo. Dr. Petkova – On a meeting held at the District Administration, city of Varna the issue was raised for Natura 2000. There are no areas that could be proposed for Sites of Natura 2000 on the territories of Suvorovo municipality, Vetrino municipality and Provadiya municipality. The District Administration refused to provide us a written confirmation on this issue as the information was kept with the Regional Environmental and Water Inspectorate, city of Varna. Eng. Pehlivanov ‐ Are there any reservoirs, wells nearby the ground where the towers shall be raised? Mr. Yankov – There are some water catchments but they are out of use. Eng. Pehlivanov – Is it possible to face problems with the land owners? Mr. Raychev – People are concerned as they do not nave information. Dr. Petkova – We may invite the land owners on a meeting and inform them. People are afraid of the unknown. It is our fault that we did not carry out information campaign. Mr. Burhanlarski – We agree such meeting to be organized. Mr. Gochev – It’s a good idea. Mr. Pehlivanov – We are glad that the community of Suvorovo municipality is positive about this investment.

The meeting was closed down.

Regarding: Investment proposal for construction of wind farm on the land territory of the town of Suvorovo.

DEAR SIRS, As a result of the examination made in the registers of the National Institute of Monuments of Culture with regards to immovable monuments of culture, it was found that on the land of the town of Suvorovo there are concentrated a large number of archaeological monuments. There is a real possibility 10 of these monuments (settlements from various historical ages, mounds and settlement hills) to fall within the borders of the territory designated for the implementation of the investment proposal. With regards to the above stated, we think it is of vital necessity to be carried out a preliminary inspection of the terrains which shall be affected during the development of the planed engineering‐technical infrastructure and the enforcement and expansion of the existing roads, with the purpose to avoid possible damage of archaeological monuments of culture. The possibility unknown to the present moment architectural monuments to exist on the lines specified, requires strict observance of the provisions of Article 18 from the Monuments of Culture and Museums Act (promulgated in State Gazette issue 29/1969) during the implementation of the investment proposal. For this purpose it is necessary the Investor to co‐ ordinate its activities with the Archaeological museum, city of Varna.

OPINION

Regarding construction of wind farm on the territory of Suvorovo municipality, district Varna by “Eolica Bulgaria” AD, city of Sofia

1. Following the field investigation performed by St. Yanchev, Curator at Museum of History, town of Suvorovo and Eng. Hr. Marinov, Chief Advisor of “Eolica Bulgaria” AD, city of Sofia, on the terrains designated for wind farm construction, it was found that those terrains do not fall within the area of archaeological sites.

2. In case the construction works come upon some archaeological materials or archaeological site, “Eolica Bulgaria” AD, city of Sofia shall temporary suspend the construction of the respective engineer facility till rescue research is being done. After the archaeological artefacts /if any/ are collected, the construction of the engineer facilities of “Eolica Bulgaria” AD, city of Sofia shall continue on the respective terrain.

3. The expenses for any archaeological rescue research shall be covered by “Eolica Bulgaria” AD, city of Sofia.

In reply to your letter regarding investment intention for construction of wind farm Northwest from the town of Suvorovo, we would like to inform you on the following:

WHEREAS: (1) Report T‐PVS/Inf (2002) 30 of Bern Convention ‐ ʺWind farms and birds: analysis of the impact of wind farms on birds and Guidance for ecological criteria for assessment and selection of their locationʺ; (2) Recommendation of Bern Convention 7.5. on wind turbines and migration species; (3) Recommendation No. 117 (2005) of the Convention on conservation of wild flora and fauna and their natural habitats adopted on December 1st, 2005 with regards to the plans for developing wind farm near the town of , and other projects for wind farms along the migration path Via Pontica (Bulgaria); (4) The opinion of Bulgarian Society for Protection of Birds that in order to be determined the adequate status of migration in each region where is planned the construction of wind farms, it is necessary to be planned and performed preliminary (basic) ornithological research and monitoring of the migration of roaming birds. The main purpose of such research shall be to establish the level of dangerousness from collision of these birds with the facilities before such facilities are installed on the research site; (5) In compliance with the Assignment on determining the scope and the contents of Environmental Impact Assessment of investment proposal for construction of wind farm – town of Suvorovo of the Regional Environmental and Water Inspectorate, town of Varna.

Presently the Bulgarian Society for Protection of Birds is conducting such basic research in the region of the town of Suvorovo.

The recent researches in the region of “Konaka” area, located north west from the town of Suvorovo and within range of 500 m from the observation point in all directions, to 1 km in South‐West and North‐East direction from the point, as well as all birds observed North and South from the observation point, not depending on the distance to 2 km from the point, show that in this region there is a possibility for construction of wind farm.

We can provide information from the interim report upon demand and the GPS coordinates of the point where the research has been conducted from.

Till July 30th 2006 we shall provide the final report and analysis of the risk level for the respective region, subject to ongoing ornithological researches.

OPINION

REGARDING: Condition of the terrain where the wind farm shall be built located on the territory of the town of Suvorovo with regard to landfalls.

This opinion was submitted upon request No. 223 dated 24.02.2006 filed by “Eolica Bulgaria” AD – Sofia with regards to the construction of wind farm on the land territory of the town of Suvorovo. The location of the wind park is shown on the map (enclosed to the request) in scale 1:70000 and further clarified according to the coordinates of some of the wind turbines. The engineering and geological surveys done till the present moment on the landfall processes in Varna district, the visual observations, the investigations and the surveys conducted in the region on the condition of the terrains where the wind farm shall be located with regard to landfalls, lead to the following conclusions and recommendations: 1. In the region where the find farm shall be built were not registered any local active landfalls and there are no information on such landfalls taken place in the past. With regards to the plain character of the terrain, the occurrence of landfalls is only possible along and near the steep hills. 2. Taking into account the considerable area of the wind farm and special features of the geological and lithological structure in the region, we recommend the conditions for founding of each wing turbines to be determined after specific engineering‐geological survey. 3. The construction should be in compliance with the seismic activity in the region – VII degree according to Medvedev‐Karnik‐Shponhoer scale, with seismic coefficient 0.10.

I re‐categorize natural landmark “Complex Pobiti kamani” situated on the territory of the town of , Beloslav municipality, district Varna, declared by virtue of Order РД–258 dated 17.07.1995 of Ministry of Environment entered under No. 515 at the State Register of protected territories, having area of 253,3 hectares, in protected area named “Pobiti kamani”.

6. On the territory of the protected area “Pobiti kamani” shall be preserved the regime of the activities determined by clause 1 of this Order.

7. The change should be registered with the State Register of protected territories.

8. This Order shall come into force since the date of its promulgation in State Gazette.

The Committee was presented with the following materials: • Order No. РД‐258 dated 17.07.1995 of Ministry of Environment and Water for declaring the area “Pobiti kamani” for natural landmark; • Order No. РД‐817 dated 23.08.2002 of Ministry of Environment and Water for re‐ categorizing the natural landmark “Pobiti kamani” into protected area “Pobiti kamani”; • Map of the property restored on the land of the village of Banovo, Suvorovo municipality.

І. After the verification made in order the protected area “Pobiti kamani” to be marked on the map of the restored property on the land of the village of Banovo, Suvorovo municipality, it was found that:

1. Protected area “Pobiti kamani” comprises properties with numbers according to Map of restored property of the land of the village of Banovo, Suvorovo municipality, as follows: ‐ “Banovska grupa” – some parts from properties No. 000122 (134‐5) and No. 000123 (139‐а, е, ж, з, 3, 4, 9).

2. The “Arbitrary sign” and the “Type line” of the protected territory were not introduced for all properties under item 1. The “Type line” for the protected territory and the “Arbitrary sign” for the protected territory should be introduced – for two (2) properties.

3. The “Restrictions” for use with code “65” were not specified on all properties from item 1 according to Map of restored property on the land of the village of Banovo that fall within the boundaries of the protected territory under the order for declaring and according to the Protected Territories Act. “Restrictions” for use with code “65” should be imposed for the above mentioned two (2) properties – “Protected territory. Pursuant to Articles 19 and 22 of the Environmental Protection Act I reduce the area of protected territory “Lozenski Pat” in the land of , declared with Order No: 294, dated 28.04.1980 of Environmental Protection Committee, with 160,1 decares. The protected area includes cadastral numbers: 1463 – part (128,3 decares), 1465 (84,5 decares), 1590 (107,1 decares), under the land allotment scheme of Svilengrad municipality, total area 319,9 decares. I amend the regime of the protected territory, as follows: 1. In the region of the protected area the following shall be forbidden: a) any construction, draining and other activities, changing the natural pattern of the territory or deteriorating the water regime; b) ploughing up or use of the lands in a way, leading to damaging or destruction of the Summer Snowflake (Leucojum aestivum); c) grazing of domestic animals; d) collecting of leaf – stem mass of the Summer Snowflake (Leucojum aestivum) through uprooting or cutting at height, less than 5 – 7 cm. above the ground surface. e) mowing down the grass before ripening of the Summer Snowflake (Leucojum aestivum) seeds. 2. In the region of the protected territory the following shall be allowed: a) undertaking any relevant measures for improving the water regime and the Summer Snowflake (Leucojum aestivum) condition after coordination with the Ministry of Environment; b) collecting Summer Snowflake (Leucojum aestivum) in specified by the Ministry of Environment quantities. In 3 months term from the publishing of the Order in “State Gazette” the borders of the site should be marked with permanent and clearly visible signs. The amendment should be reflected in the State Register of the protected natural sites. The violators of the present order shall be punishable under Article 31 of the Administrative Violations and Penalties Act, unless subject of a bigger penalty. In the limits of the groups of the nature landmark it shall be forbidden: a) establishment of quarries, execution of mine – geological and other activities, which damage and destroy the stone /rock/ forms or change the natural pattern of the territory; b) any construction except the stipulated under the worked out structural project of the nature landmark;

Issue 69 State Gazette Page 15 c) taking of sand, rock masses or individual columns; d) pollution with household and industrial waste; e) wood felling and hauling with the exception of felling per species and selection felling; f) planting of afforested areas; g) picking up or destroying grass and shrub vegetation, as well as herbs collecting; h) hunting. In the limits of the groups of the nature landmark a traditional usage of lands of the agricultural fund is allowed. Pursuant to Article 25, paragraph 2 of the Environmental Protection Act I declare the nature landmark “Pobiti Kamani” as protected nature territory with international significance for preservation of unique geological forms. The present order rescinds decrees No: 12304 of 26.05.1937 and No: 22517 of 15.12.1938 of the Ministry of Agriculture and State Estates; Order No: 3702 of 29.12.1972 of the Ministry of Forests and Environmental Protection; Order No: 800 of 31.08.1981 of the Environmental Preservation Committee and item 14 of “Nature Landmarks” of section II of Order No: 988 of 4.11.1993 of the Ministry of Environment. In 3 months term from the publishing of the Order in “State Gazette” the Forest Co‐ operations – Suvorovo and Varna, should mark the borders of the individual groups “Pobiti Kamani” with terrain’s permanent and clearly visible signs. The site, as well as the changes, arising from the present order should be reflected in the State Register of the protected natural sites. The violators of the present order shall be punishable under Article 31 of the Administrative Violations and Penalties Act, unless subject of a bigger penalty. Pursuant to article 19 and 22 of Environmental Protection Act with the purpose of preserving the natural habitats of protected and rare species birds, included in “Red Book of the Peoples Republic of Bulgaria” and the list of the endangered species in Europe, I declare the following protected territories: 1. “Rakov dol” – the land of the village of Gabar, municipality; forest fund of State Forestry – Bourgas, sections: 97 – а, б, в, г, д, ж, 1, 2, 3, 4, 5, 7, 8; 98 – в, г, 8, under forest development project of 1981, total area 128 hectares. 2. “Vran Kamak” – the territory of the village of , Srednogorie municipality: State Forestry – Srednogorie, sections: 290 – a (part 0,6 hectares); 291 – a (part 1,3 hectares), б (part 5,4 hectares), 1; 292 – б (part 17,3 hectares), в, г, д, е, ж (part 1,7 hectares), 4,5,6; 306 – ж, з, и, 5 (part 1,0 hectares); 307 – в (part 2,2 hectares), г (part 9,5 hectares) under forest development project of 1990, total area of 60,6 hectares. In the limits of the protected territories the following shall be forbidden: 1. any construction, establishment of quarries and other activities, changing the natural pattern of the territory or deteriorating the water regime; 2. conducting of any forest economic activities, during the period from January 1st to August 30th; 3. Planting non‐characteristic for the region species; 4. Grazing of goats and pigs; 5. disturbance, catching and ringing and marking of the nesting birds, the taking of the eggs or the youngsters. In the region of the protected territories it shall be permitted: 1. conducting of forest activities for the maintenance of the forest vegetation upon a maximum provision of the biological species’ requirements under a special development project, coordinated with the Regional Environmental Inspectorate – Bourgas; 2. Hunting of big game, as well as regulating the number of the predators in the period from September 1st to December 30th. In 3 months term from the publishing of the Order in “State Gazette” the State Forestry – Bourgas and Srednogorie should mark the terrain’s borders of the protected territories with permanent and clearly visible signs. The sites should be entered in the State Register of the protected natural sites. The violators of the present order shall be punishable under Article 31 of the Administrative Violations and Penalties Act, unless subject of a bigger penalty.
