Translation from Bulgarian Attachment No. 1 MINISTRY OF ENVIRONMENT AND WATER Regional Environmental and Water Inspectorate – Varna 9000 Varna, 4, Yan Palah Str., e‐mail: riosv‐[email protected], tel.: 052/ 634‐589, fax: 052/ 634‐593 Entry No. 26‐00‐7758/ 27.12.2005 DECISION No. 12‐ПР/2006 ON EVALUATION THE NEED FOR PREPARING AN ENVIRONMENTAL IMPACT ASSESSMENT Pursuant to Article 93, Paragraph 1, item 1 and Article 5, item 3 from the Environmental Protection Act and submitted written information by the Investor under Attachment No. 2 from the Regulation on the conditions and procedure for performing an Environmental Impact Assessment of investment proposals in terms of construction, activities and technologies, I hereby RULE an Environmental Impact Assessment to be performed in terms of investment proposal for Wind Farm developing. Location of the investment proposal: the land of the town of Suvorovo, Suvorovo municipality. Assignor: “EOLICA BULGARIA” AD, city of Sofia, 8, Bacho Kiro Str. Characteristics o the investment proposal: The key processes are related to production of electricity generated from wind power. On the site shall be built 30 wind turbines with capacity of 2,3 MW each. They shall be installed on 80 m high steel towers with blade diameter of 90 m. The wind farm shall have total capacity of 60‐80 MW. GROUNDS: 1. For the purpose of developing the wind farm on site having surface area of about 1000 decares there should be performed an Environmental Impact Assessment with regards to noise, birds, landscape and inhabitants health in terms of landscape characteristics. 2. Within the territory of Suvorovo municipality lays protected area named “Suha reka” according to draft Natura 2000 project. 3. The introduction of anthropogenic equipment not typical for the landscape shall permanently change its visual image. This decision shall not revoke the investorʹs obligations under the Environmental Protection Act and the other special acts and statutory regulations and may not be considered as a ground for cancelling the responsibility under the environmental legislation. In case any change occurs in the Investor’s investment proposal or in any of the circumstances under which this decision has been issued, the Assignor/the new assignor should notify the Regional Environmental and Water Inspectorate, city of Varna within 1 month following the change. The parties interested may appeal this decision under the terms and procedure of Administrative Procedure Act before the Ministry of Environment and Water within 7‐ day period. City of Sofia Regarding: Assignment on determining the scope and the contents of Environmental Impact Assessment of investment proposal for wind farm developing on the land of the town of Suvorovo. Dear Mr. Delchev, With regards to Article 95, Paragraph 2 from the Environmental Protection Act (promulgated in State Gazette issue 91/2002, amended and supplemented) and Chapter III from the Regulation on the conditions and procedure for performing an Environmental Impact Assessment (promulgated in State Gazette issue 25/2003) on the assignment on determining the scope and the contents of Environmental Impact Assessment of investment proposal for wind farm developing on the land of the town of Suvorovo submitted by the Regional Environmental and Water Inspectorate, city of Varna, I would like to express the following opinion: The assignment on determining the scope and the contents of Environmental Impact Assessment contain the required scope of information according to Article 10, Paragraph 3 from the Regulation. The Environmental Impact Assessment report should contain a forecast and assessment on the following: ‐ “Atmospheric air” – only during the construction phase (construction, transportation and assembly works); ‐ “Waste” – during the construction and operation phases ‐ types, quantities, treatment (for instance providing the waste for subsequent treatment to companies holding the relevant documents pursuant to Article 12 from Waste Management Act); ‐ “Plant and animal kingdom” ‐ during the construction and operation phases; ‐ “Geologic environment” – reporting the results from consultation carried out with “Geozashtita” EOOD, city of Varna; ‐ “Soils” – the need to be considered of recovering the qualities of damaged territories; ‐ “Harmful physical factors” – during the operation phase – noise, vibrations and electromagnetic radiation; ‐ “Health and Hygienic aspects” – during the operation phase with assessment of psychological and visual discomfort from the equipment size and work. To be considered and assessed alternative options for location of turbines /number, height, capacity of equipment/ and the possibility for “zero alternative”. To be stated the grounds for the choice made characterizing the level of accessibility of environmental impact including in terms of the life and health of population. With regards to the requirements of Article 95, Paragraph 3 consultations to be carried out with: ‐ Agriculture and Forests District Directorate; ‐ NEK – in terms the possibility of connection to the existing electricity distribution network; ‐ The National Institute on the Monuments of Culture with the Ministry of Culture; ‐ “Geozashtita” EOOD – Varna; ‐ Ministry of Health. Based on the above stated and with regards to the request for evaluating the quality of the Environmental Impact Assessment, the corrected assignment on the scope of Environmental Impact Assessment reporting the results from the consultations conducted with reference on them and the grounds for the approved and rejected remarks and/or recommendations, should be submitted together with the Environmental Impact Assessment report. The Environmental Impact Assessment report should contain detailed map materials in scale – plan–situation with wind farm and the nearest situated populated areas with land properties reference numbers. The structure of the Environmental Impact Assessment report should be observed and fully comply with the requirements of Article 96, Paragraph 1 from the Environmental Protection Act and Article 12 from the Regulation on the conditions and procedure for performing an Environmental Impact Assessment (adopted by Decree of Council of Ministers No. 59/2003, amended and supplemented). The Non‐technical resume of the report should be prepared in compliance with the provisions of Article 12, Paragraph 2 from the Regulation and item 27, § 1 from the Provisional Regulations of Environmental Protection Act as a separate, integrated document allowed for public access.
