IN THE UNITED STATES DISTRICT COURT FOR THE NORTHERN DISTRICT OF IOWA CEDAR RAPIDS DIVISION UNITED STATES OF AMERICA, Plaintiff, No. CR15-0046-LTS vs. ORDER MAX JULIAN WRIGHT, Defendant. ____________________ This matter is before me on a motion for new trial and judgment of acquittal (Doc. No. 159) filed by defendant Max Wright. Plaintiff (the Government) has filed a resistance (Doc. No. 171) and Wright has filed a reply (Doc. No. 177). Also before me is the Government’s motion to strike Wright’s reply (Doc. No. 178) as being too long and too late. I. BACKGROUND In the third superseding indictment (Doc. No. 98) the grand jury charged Wright with three counts: conspiracy to distribute heroin/cocaine/Fentanyl causing serious injury and death (Count 1) and two counts of distribution of Fentanyl (Counts 2 and 3).1 On November 13, 2015, the Government filed a motion in limine pursuant to Federal Rule of Evidence 104(a). Doc. No. 88. On February 17, 2016, I entered an order (Doc. No. 129) granting in part and denying in part the motion. Relevant to Wright’s present motion, I stated: The Government is entitled to offer into evidence, pursuant to a limiting instruction, the certified judgment of Wright’s most-recent conviction, 1 At trial, Wright did not contest Counts 2 and 3. Case 1:15-cr-00046-LTS Document 185 Filed 07/07/16 Page 1 of 48 dated August 7, 2008 (attached as Exhibit 3 to the Government’s motion). Unless and until ordered otherwise, however, no reference shall be made in the presence of the jury to any of Wright’s other prior convictions. -

Pappy Jr. Master of Arts in Screenwriting In this satirical comedy screenplay, idealistic automotive engineer Clyde Bunter struggles to convince his Uncle Howard, owner of a fourth-rate car company in 1970’s Detroit, to let him build a revolutionary new fuel efficient engine. But Uncle Howard’s sudden coma leaves the company in the hands of Clyde’s incompetent cousin, Max, and the company’s evil CFO, Edgar Wright. Together, these two manage to confound all of Clyde’s efforts, finally forcing him to quit the company and strike out on his own, finding the money to build his very own “car of the future.” Unfortunately, Wright’s continued efforts from afar to sabotage the new car project result in a failed venture and an undercover sting operation which leaves Clyde facing federal charges. Faced with an inept court-appointed legal team, the brilliant young engineer must successfully defend himself against the charges or else face 20 years in prison. -

THE SECRET LIFE OF OTTO AND HILDA Jody Hobbs Hesler Otto Augsburg knew exactly what he wanted when he walked into the Jiffy-J on Avon Street: Utz sour cream and onion potato chips, his favorite American junk food. Actually, the chips were the only American junk food Otto ate, and the Jiffy-J was the only store in town that carried them. He knew because he’d dispatched one of his underlings to search for them once when a craving hit him especially hard. Today he selected the single serving size, the bag no longer than the fin- gers of his own hand but enough to slake his craving. He would have bought the chips and gone on his way if one more thing, standing at the checkout counter, hadn’t caught his attention and set off an entirely new craving. The bright red human-height plastic M & M, with black plastic arms and legs, white mitts for hands, white boots for feet, wearing a Christmas hat and a smirk. Otto wanted that, too. 123 124 VALPARAISO FICTION REVIEW Unlike some of his colleagues, who bought Jaguars for their children’s six- teenth birthdays or vacation homes in Jamaica, Otto preferred more modest indulgences. Especially ones that tickled his sense of humor. Here—this thing was ridiculous: If one wished for candy, why would one be likelier to buy it at the hands of a giant, anthropomorphic morsel of it? Plus, the Santa Claus hat, four full months after the holiday had passed, added spice to the silliness. He would buy it and give it to his daughter, now in her third year at UVA. -

Muere Max Wright, el «padre» humano de ALF Max Wright, uno de los protagonistas de la popular serie de televisión de los años 80 ALF, falleció este miércoles. Familiares confirmaron que el actor, quien interpretó a Willy Tanner, el padre de la familia que acogió al peludo extraterrestre, murió en su casa en Hermosa Beach, a las afueras de Los Ángeles, California. Wright, que tenía 75 años, libró una batalla contra el cáncer durante muchos años.
