CLOSURE ORDER WITH DISCONNECTION OF ELECTRICITY

WHEREAS complaint petitions were received by the West Bengal Pollution Control Board (hereinafter will be referred to as the `State Board'), on 07­06­2010, 15­06­2010, 26­08­2010, 21­09­2010, 10­03­2011, 17­05­2011, 07­06­2011 and 03­12­2013, against a Gravure printing unit namely M/s Priya Packaging, located at 95/1 H, Cossipore Road, Kolkata Municipal Corporation(KMC) Ward No. 02, P.S. Cossipore, Kolkata­700 002, alleging air pollution (pungent smell of gases) and noise pollution due to its various printing activities.

AND WHEREAS inspection of the said unit was conducted by the State Board official on 13­07­ 2010 and it was observed during inspection that the unit engaged in gravure printing on polypropylene and polythene film. The printing process was conducted by 02 nos. of prining machines and 01 no. of slitting machine using printing ink, thinner like ethyle acetate etc. as raw materials. An exhaust fan was found to install in asbestos roofed workshop so as to facilitate fresh air inlet to the unit. The unit was previously located at 112B, Cossipore Road, P.S. Chitpur, Kolkata­ 700 0002 and Consent To Operate certificate of the State Board for the workshop at that premises expired on 31­12­2009. It was reported that the said unit relocated to the present address at 95/1 H, Cossipore Road, P.S. Cossipore, Kolkata­ 700 002, approx.. 1.5 yrs ago. However, the unit could not produce trade licence as well as NOC/Consent of the State Board for the present location at the time of inspection. Moreover, the unit falls under Orange category of industry and is not permitted to establish in new location within the KMC area after 1997 as per siting policy of the State Board.

AND WHEREAS the unit was called for hearing on 24­07­2010 by the State Board to remain present with all statutory licenses, including ‘Consent to Establish(NOC)/Consent to Operate’ of the State Board and Sri Brijesh Kr. Singh appeared on behalf of the unit. The unit was directed not to operate at new location at 95/1 H, Cossipore Road, Kolkata­ 700 002 without obtaining Consent to Operate of the State Board. However, the unit has the liberty to operate at the old place at 112 B, Cossipore Road, Kolkata­ 700 002.

AND WHEREAS the State Board issued a letter dated 07­04­2011 to the Officer In­charge, Cossipore Police Station for taking necessary action for compling with the directions issued in the Record of Proceedings dated 24­07­2010. It was reported by the Deputy Commissioner of Police, North & North Suburban Division, Kolkata in the letter dated 04­05­2011that the said unit obtained certificate for ‘Consent to Operate’ from District Industry Centre(DIC), Kolkata vide No. DIC/KOL/COO(G)/1035 dated 07­02­2011 for running Off­Set Printing at 95/1 H, Cossipore Road, Kolkata­ 700 002, for a period from 10­06­2009 to 30­06­2015.

AND WHEREAS inspection of the said unit was again conducted by the State Board official on 10­05­2011 and the unit could not produce trade licence as well as NOC/Consent of the State Board at the time of inspection. ­2­

AND WHEREAS the State Board issued a direction dated 16­06­2011 stating that the said unit shold not operate in the new location at 95/1 H, Cossipore Road, Kolkata­ 700 002 violating the siting policy. However, the unit is at liberty to operate at its earlier place i.e. at 112 B, Cossipore Road, Kolkata­ 700 002 subject ot possessing valid Çonsent to Operate’of the State Board.

AND WHEREAS inspection of the said unit was once again conducted by the State Board official on 17­12­2013 and this time also, the unit could not produce trade licence as well as NOC/Consent of the State Board.

AND WHEREAS the unit was called for hearing again on 21­04­2014 and Sri Uttam Agarwal appeared on behalf of the unit. The unit failed to produce the copy of trade licence as well as NOC/Consent of State Board at the time of hearing.

NOW THEREFORE, considering the running of the unit without valid Consent certificate of the State Board as well as violation of the directions and siting policy of State Board, that M/s Priya Packaging is hereby directed to close all kinds of its operations at the present location with immediate effect

Electricity connection of the said unit is ordered to be disconnected forthwith.

The General Manager­Operation (C&M), CESC Ltd., is requested to take necessary steps to disconnect the electricity connections of the unit immediately.

Closure order will take immediate effect and the Officer­in­Charge, Cossipore Police Station, under Kolkata Police is requested to execute the closure order against the aforementioned unit and submit the compliance report to the State Board within seven days from the receipt of this memo.

This direction has been issued to the Officer­in­Charge, Cossipore Police Station and the General Manager­Operation (C&M), CESC Ltd., in conformity with the orders of the Hon'ble High Court, Calcutta, dated 21­08­1998 and 28­04­1999 respectively.

The Environmental Engineer, Salt Lake Regional Office of the State Board is requested to take necessary steps for proper execution of the closure order and ensure the disconnection of electricity of the said unit. He/she is also requested to visit the unit involving the local police authority, if situation demands.

This direction has been issued in exercise of the powers conferred under the Water (Prevention & Control of Pollution) Act, 1974, the Air (Prevention & Control of Pollution) Act, 1981 and the Environment (Protection) Act, 1986 and Rules made thereunder.

This order has the approval of the Competent Authority.
