ORDER Sri B. Shankar has filed 2nd appeal dated 10-06-2019 which was received by this Commission on 11-06-2019 for not getting the information sought by him from the Public Information Officer/ The Deputy Tahsildar, Koheda Mandal, Siddipet District and the First Appellate Authority/ the Revenue Divisional Officer, Husnabad Division, Siddipet District. The brief facts of the case as per the appeal and other records received along with it are that the appellant herein filed an application dated 06-06-2018 before the Public Information Officer requesting to furnish the information under Sec. 6(1) of the RTI Act, 2005TSIC on the following points mentioned: Stating that the appellant did not get any response from the Public Information Officer, he filed 1st appeal dated 29-08-2018 before the First Appellate Authority requesting him to furnish the information sought by him u/s 19(1) of the RTI Act, 2005. Stating that the appellant did not get any response from the First Appellate Authority, he preferred this 2nd appeal before this Commission requesting to arrange to furnish the information sought by him u/s 19(3) of the RTI Act, 2005. On perusal of the material papers available on record, it is observed that an application was filed U/Sec 6(1) of the RTI Act by the Appellant on 06-06-2018. The Public Information Officer Koheda Mandal, submitted that the available information was furnished to the Appellant vide Lr. No. B/321/2020 dt.12-03-2020 and filed an affidavit to that effect. The Commission directs to issue Show Cause Notice to the then & present Public Information Officers / Koheda Mandal, Siddipet District calling for their explanation for not furnishing the information as specified U/Sec. 7 (1) of the Act, by causing abnormal delay in furnishing the information they are directed to furnish their explanation within (7) days from the date of receipt of this order or otherwise further action as deemed fit will be taken as per provisions of Sec. 20 of the RTI Act, by opening a separate file. With the above warning/direction, the appeal is closed.
