Question: 6915 QUESTION ON NOTICE — Ms Sandell to ask the Minister for Environment, Climate Change and Water — With reference to the announcement on 6 March 2016 of plans to order 50 GL of water from the desalination plant to assist Ballarat:

(1) How much Moorabool River water will be transferred to Ballarat and for how long.

(2) How will the Government compensate the river for the removal of this water.

(3) Why did the Government not consult the public, especially people along the river, and publicly investigate the social and environmental implications of the water transfer before making its decision.

Answer: The Government committed to optimising our water grid through water for Victoria.

The Victorian Environmental Water Holder currently holds approximately 2.5 billion litres of environmental entitlement in Lal Lal reservoir, which can be used for the Moorabool River.

The government is committed to improving the health of waterways, 36 of these waterway are the focus of large-scale project to achieve targeted outcomes, including the Moorabool River. The Water for Victoria discussion paper reconfirms the environmental water recovery targets for the Moorabool river as outlined in the Central Region Sustainability Water Strategy and commits to working with communities and stakeholders to identify options to meet existing shortfalls in the Moorabool.

Question: 6916 QUESTION ON NOTICE — Ms Sandell to ask the Attorney-General — (1) What is the status and application of Trust Deed 5510 to property at 2–4 Miller Street, West and 621–643 King Street, West Melbourne.

(2) Will the Attorney-General take any steps to enforce the conditions of this Trust Deed in relation to planning applications for the relevant site.

Answer: I am advised that:

•(1) The property at 2-4 Miller Street, West Melbourne and 621-643 King Street, West Melbourne was given by Crown Grant dated 1 October 1866 for the purpose of providing a site for a church or place of religious worship by the Baptist denomination.

On 22 January 1889, the Governor granted an application by the trustees of the property for an allowance to sell, mortgage or otherwise dispose of the land pursuant to section 3 of the State Aid to Religion Abolition Act 1871.

The allowance removed the conditions of the Crown Grant restricting the use of the land to purposes of religious worship, and provided that the proceeds of any disposition were to be applied to purposes authorised by Model Deed of Trust 5510.

Subsequently, Model Deed of Trust 5510 ceased to apply to the property when it was transferred by the trustees to the Baptist Union of Victoria on 4 December 1961, pursuant to section 4 of the Baptist Union Incorporation Act 1930 (the Incorporation Act).

At that time, the trusts set out in Schedule B to the Incorporation Act replaced the provisions of Model Deed of Trust 5510.

These were not limited to using the property for the purposes of religious worship.

(2) As outlined above, the Model Deed of Trust 5510 no longer applies to the property referred.

Question: 6919 QUESTION ON NOTICE — Ms Sandell to ask the Minister for Local Government — Does the upcoming review of the Local Government Act 1989 also include a review of the City of Melbourne Act 2001.

Answer: Yes. As indicated in the Review Terms of Reference, the review will include consideration of all legislation for which the Minister for Local Government has administrative responsibility with a view to simplifying and integrating these Acts in the new Act where possible. Other related legislation includes the City of Greater Geelong Act 1993, the City of Melbourne Act 2001 and the Municipal Association Act 1907.

The population of the Mornington Peninsula continues to rise, and that growth is particularly apparent in rising numbers of both primary and secondary students. This year Balcombe Grammar School has seen a significant increase in the number of students using the bus system to travel to school. That increase has led to a series of incidents in which up to 20 students have been denied access to the south-bound afternoon service from that school. An additional south-bound service is urgently needed. My question to the minister is: what action will he take to ensure that transport is available for all students, not just those lucky enough to get on the bus before capacity is reached?

Answer: Transport services supporng students from Balcombe Grammar School are provided through Public Transport Victoria; I have referred this maer to The Hon. , Minister for Public Transport to respond.

The Andrews Labor Government, through the Department of Educaon and Training, provides a conveyance allowance for eligible students to support families in rural and regional Victoria with the cost of transporng their children to the nearest government school/campus or appropriate denominaonal school.

A conveyance allowance boundary was introduced from 1 January 2013 to beer define metropolitan Melbourne and rural Victoria. Students aending schools within the Mt Martha postcode were provided with an exempon from the boundary change due to limited transport infrastructure availability in these areas (at that me-2013).

I am advised that 230 students aending Balcombe Grammar School in 2015 (full year) were in receipt of a conveyance allowance payment, totalling $94,728. The Term One, 2016 conveyance allowance data idenfies that 164 students are in receipt of the conveyance allowance payment, totalling $17,950. It is ancipated that this number will increase as Balcombe Grammar has yet to submit all student applicaons for the conveyance allowance.

Question: 6921 CONSTITUENCY QUESTION — Ms Kilkenny to ask the Minister for Education — My constituency question is for the Minister for Education. Constituents in my electorate are very concerned that the federal Liberal government will not fund years 5 and 6 of the Gonski national funding agreement. I ask the minister: how much worse off will schools in my electorate of Carrum be if the federal Liberal government does not fund years 5 and 6 of this agreement? The Gonski funding model addresses student disadvantage and ensures that funding is directed to the areas that need it most. There is an unacceptable link between low achievement and student disadvantage. Gonski funding focuses on breaking this link and ensuring that all students, regardless of their background, have the skills to shape their future. If the federal Liberal government walks away from its obligations under the Gonski national agreement, what will this mean for schools and students in my electorate?

Answer: I share your concerns about securing funding for the final two years of the Gonski Agreement. The Commonwealth Government has indicated it will not meet its commitment to the Gonski Agreement in 2018 and 2019, pung over 1$ billion in Commonwealth funding to Victorian schools at risk. This includes an esmated $6 million to $6.5 million in the electorate of Carrum. This decision compromises the ability of schools to provide high- quality educaon to all students, parcularly those in need.

I hope that the Commonwealth Government is willing to honour the funding agreements and partner with Victoria to develop funding agreements post-2017.
