The swift passage of appropriations legislation should not be jeopardized by ideological provisions that have no place in funding legislation. The agreement on FY 2011 appropriations reflected this understanding, and this year's agreement should do so as well. In addition, temporary stop-gap appropriations bills prevent agencies from making needed decisions, generating harmful uncertainty and waste. Accordingly, the Administration urges the Congress to pass final appropriations, without ideological or political provisions, to fund the Government for the remainder of the fiscal year.

If the President is presented with a bill that undermines critical domestic priorities or national security through funding levels or language restrictions, contains earmarks, or fails to make the tough choices to cut where needed while maintaining what we need to spur long-term job creation and win the future, the President will veto the bill.

The Administration looks forward to working with the Congress to resolve both funding and language issues in a timely, mutually acceptable way. Funding critical priorities within the BCA's constraints requires difficult cuts and tough choices about allocation levels both among and within subcommittees. Highlights of the Administration's priorities within these constraints are outlined below.

Nonsecurity Priorities

Education, Training, and Health Programs. The Administration strongly commends the Senate Committee's Labor, Health and Human Services, Education, and Related Agencies Appropriations bill for funding key education and training priorities, including providing $699 million for the Race to the Top and vigorous support for other education reforms; sustaining the maximum Pell Grant award of $5,550 without reducing access to higher education for low- income students; investing in early education; supporting the Workforce Innovation Fund and worker training; and adequately funding AmeriCorps. In a period of limited resources, these initiatives encourage and reflect the systemic changes and evidence-based interventions that can achieve the greatest impacts at the lowest cost. In order to provide the level of resources needed to fund critical priorities, the Administration urges the Congress to maintain the programmatic funding level in the Senate Committee's bill, which already provides funding below the FY 2011 enacted level after excluding cap adjustments provided for under the BCA. Funding legislation must not require agencies funded in this bill to bear a disproportionate share of the program cuts required by the BCA.

Affordable Care Act (ACA). Final appropriations legislation for FY 2012 must adequately fund the multi-agency activities needed to implement the health care reforms included in the ACA. Rising health care costs drive budget deficits and impose crushing financial burdens on millions of families across the country. The ACA will hold health insurance companies accountable, lower health care costs, guarantee more choice, and ensure that quality, affordable coverage is available for all Americans. Through reforms to cut waste, reduce errors, and boost quality, the ACA will reduce the deficit by hundreds of billions of dollars.

Innovation, Clean Energy, and Advanced Manufacturing. The Administration urges the Congress to provide adequate funding for initiatives foundational to scientific and business innovation, including programs needed to make the transition to a clean energy economy and to 2

foster other advanced manufacturing. These priorities include the Department of Energy's Energy Efficiency and Renewable Energy Programs (for which the Administration requests no less than $1.95 billion), Advanced Research Projects Agency ($300 million), Office of Science ($4.95 billion), and Energy Information Administration ($105 million); the National Science Foundation; and the National Institute of Standards and Technology intramural research programs. The Administration also appreciates the significant increase provided in both the House and Senate Commerce, Justice, Science, and Related Agencies bills for the Joint Polar Satellite System. Robust funding for this project is essential so that the Nation does not risk significant degradation in weather forecasts and, in turn, negative impacts on public safety and critical industries.

Physical Infrastructure and Housing. Short-term job creation and long-term competitiveness depend on adequate investment in roads, rails, public transportation, and airports. The Administration continues to support a new surface transportation investment of $50 billion, a highway bill reauthorization and an Infrastructure Bank authorization. While those matters are pending, the Administration strongly prefers the approach in the Senate's Transportation, Housing and Urban Development, and Related Agencies Appropriations bill, which funds highway, highway safety, and mass transit obligation limitations at baseline levels and supports TIGER grants. At the same time, adequate investment in transportation cannot occur at the expense of critical support for public housing, homeless assistance, housing counseling, and other affordable housing programs when they are greatly needed. The Home Affordable Modification Program, which is a key tool to stabilizing the housing market, must be preserved.

Dodd-Frank Wall Street Reform and Consumer Protection Act. In order to implement the Dodd-Frank Act, the Administration strongly supports the Senate bill's funding levels for the Securities and Exchange Commission and the Commodity Futures Trading Commission, which will enable the regulators to develop, implement, and enforce new requirements for the securities and derivatives markets to protect investors and promote fair trading and a stronger, more stable economy. The Dodd-Frank Act contains essential measures to crack down on abuses in the mortgage industry, make financial contracts simpler, end hidden fees, and provide clear and concise information to borrowers about the obligations they are undertaking.

Protection of Food Safety and Health. It is critical that the Agriculture, Rural Development, Food and Drug Administration, and Related Agencies Appropriations bill provide robust funding for the Food and Drug Administration to continue implementation of the Food Safety Modernization Act, which includes improved prevention standards, inspections, and oversight of imports. The Administration also appreciates the Senate bill's strong funding for the Food Safety and Inspection Service at the Department of Agriculture. To provide a healthy start for America's children, the Special Supplemental Nutrition Program for Women, Infants, and Children must also be fully funded.

Conservation and Environmental Protection. We also must protect the programs that Americans rely on for the preservation of our air, water, and land. The Administration urges the Congress to make available no less than $450 million for the Land and Water Conservation Fund, which provides for the preservation and management of areas important to hunters, anglers, and recreationists nationwide. The Congress should also fund the Environmental Protection Agency's operating budget at a level no lower than the FY 2011 enacted level, so it 3

can carry out its core mission of protecting human health and the environment, providing us with clean air and water, enforcing the law (including increased inspections at oil facilities), and undertaking needed research, among other critical functions.

Core Government Functions. The Administration is proud of its record of cutting waste, fraud, and abuse. At the same time, the Government must have the resources to do its job. The significant reductions in funding for the Internal Revenue Service in both the House and Senate bills will undermine taxpayer service, reduce collections from scofflaws, and add billions of dollars to the deficit. The Administration urges the Congress to provide the IRS program integrity cap adjustment proposed in the President's deficit reduction plan, to invest in tax enforcement and compliance efforts that will save money in the long run and help ensure that all taxpayers live up to their responsibilities. Adequate funding should also be provided for the Federal Aviation Administration's operating requirements and modernization efforts to ensure that our air traffic control system can continue to safely and efficiently accommodate current and projected demand.

Terminations and Reductions. Given the tight budget constraints this year, adequate funding for top priorities requires lower funding elsewhere. The Administration commends both the House and Senate Committees for adopting many of the terminations and reductions proposed in the President's FY 2012 Budget. There remain areas, however, in which either the House or Senate bills have funded programs at higher levels than requested, and the Administration urges the Congress to redirect these funds to other priorities. For example:

 Both the House and Senate bills provide significantly more funding for non-disaster, non-emergency Corps of Engineers programs than requested. These funds could instead support investments in innovation and research that will contribute more significantly to long-run growth.  The Budget proposed more than $70 million in savings from the Department of Agriculture which the House and Senate have not adopted and which could be used to ensure adequate support for loans and services in rural America and for food safety.  Reduced funding for State Criminal Alien Assistance Program, consistent with the President’s Budget, would free up scarce resources for higher-priority needs such as the Community Oriented Policing Services Hiring Grants Program.

Extraneous Provisions. The primary purpose of appropriations legislation is to fund the Government, and the Administration strongly opposes ideological and political provisions in these bills. The Administration strongly objects to the inclusion of measures that:

Security Priorities

The President has made it clear that he has no greater responsibility as Commander-in- Chief than protecting our national security, and that he will not accept a budget that compromises our ability to keep the United States safe and secure or to protect and advance our Nation's security interests around the world. The President believes that civilian and military power are inextricably linked, and that effective deployment of tools in a coordinated and flexible way is fundamental to meeting the whole of our national security priorities. The budget, therefore, must build military strength and smart civilian security programs, domestically and around the world.

Overall Defense and State and Foreign Operations Funding Levels. The most critical potential tradeoffs in security funding occur between the Department of Defense (DOD) and the agencies and programs funded in the State, Foreign Operations, and Related Programs Appropriations bill. The Administration strongly supports the Senate's allocation of funding, which was driven by 302(b) allocations that passed the Senate Appropriations Committee by a 29 to 1 vote. The DOD funding level, a freeze, will sustain our strong military, while the difficult but manageable reductions in the Department of State and other international programs leave the resources to sustain critical U.S. engagement around the world. By contrast, an unbalanced approach will not serve America's national security or its vital interests around the world.

Defense. The Administration appreciates congressional efforts to address DOD's highest warfighter needs, especially related to Overseas Contingency Operations, and to support the troops and their families. However, the Administration has concerns with some of the reductions proposed in both the Senate and House bills, and notes there are more than adequate offsets available in programs with lesser military value. The Administration also urges the Congress to support the Senate levels in the final appropriations legislation for Military Construction, and looks forward to working with the Congress to ensure that the highest priority projects are funded.

State and Foreign Operations. The Senate bill for State, Foreign Operations, and Related Programs protects key priorities while making difficult choices, such as adopting proposals in the President's FY 2012 Budget to reduce assistance to countries in Europe and Central Asia with lesser need. The Administration will strongly oppose legislation that decimates vital, bipartisan efforts like global health programs, food security, and global initiatives – all programs aimed at the root causes of instability and insecurity in fragile and failing countries around the world. The Administration also opposes a failure to provide funding for general capital increases at multilateral development banks, which would hamper economic recovery worldwide. The Administration will work with the Congress to explore opportunities where increased transfer authority will provide flexibility to manage this constrained resource level.

National Nuclear Security Administration (NNSA). The Administration urges the Congress to support robust funding for NNSA to continue the commitment to modernization of the nuclear weapons complex and to upgrading the stockpile set forth in the Nuclear Posture Review and reaffirmed as part of the New START Treaty ratification process. In addition, at a time when a grave danger is posed by the proliferation of nuclear materials which can fall into the hands of terrorist organizations, the Administration urges support for highly enriched uranium reactor conversions. 5

House Republicans' assault on our environmental laws must be stopped.

Americans must once again stand up for their right to clean air and clean water.

Since the beginning of this year, Republicans in the House have averaged roughly a vote every day the chamber has been in session to undermine the Environmental Protection Agency and our nation's environmental laws. They have picked up the pace recently — just last week they voted to stop the EPA's efforts to limit mercury and other hazardous pollutants from cement plants, boilers and incinerators — and it appears their campaign will continue for the foreseeable future.

Using the economy as cover, and repeating unfounded claims that "regulations kill jobs," they have pushed through an unprecedented rollback of the Clean Air Act, the and our nation's waste-disposal laws, all of which have successfully protected our families for decades. We all remember "too big to fail"; this pseudo jobs plan to protect polluters might well be called "too dirty to fail."

The House has voted on provisions that, if they became law, would give big polluters a pass in complying with the standards that more than half of the power plants across the country already meet. The measures would indefinitely delay sensible upgrades to reduce air pollution from industrial boilers located in highly populated areas. And they would remove vital federal water protections, exposing treasured resources such as the , Lake Erie, the Chesapeake Bay and the Los Angeles River to pollution.

How we respond to this assault on our environmental and public health protections will mean the difference between sickness and health — in some cases, life and death — for hundreds of thousands of citizens.

This is not hyperbole. The link between health issues and pollution is irrefutable. Mercury is a neurotoxin that affects brain development in unborn children and young people. Lead has similar effects in our bodies. Soot, composed of particles smaller across than a human hair, is formed when fuels are burned and is a direct cause of premature death. Nitrogen oxides and volatile organic compounds contribute to the ozone alert days when seniors, asthmatics and others with respiratory problems are at serious risk if they do nothing more dangerous than step outside and breathe the air. "Too dirty to fail" tries to convince Americans that they must choose between their health and the economy, a choice that's been proved wrong for the four decades that the EPA has been in existence. No credible economist links our current economic crisis — or any economic crisis — to tough clean-air and clean-water standards.

A better approach is the president's call for federal agencies to ensure that regulations don't overburden American businesses. The EPA has already put that into effect by repealing or revising several unnecessary rules, while ensuring that essential health protections remain intact.

We can put Americans to work retrofitting outdated, dirty plants with updated pollution control technology. There are about 1,100 coal-fired units at about 500 power plants in this country. About half of these units are more than 40 years old, and about three-quarters of them are more than 30 years old. Of these 1,100 units, 44% do not use pollution controls such as scrubbers or catalysts to limit emissions, and they pour unlimited amounts of mercury, lead, arsenic and acid gases into our air. Despite requirements in the bipartisan 1990 Clean Air Act amendments, these facilities have largely refused to control their emissions — creating an uneven playing field for companies who play by the rules and gaming the system at the expense of our health.

If these plants continue to operate without pollution limits, as a legislative wish list from House Majority Leader Eric Cantor (R-Va.) would allow, there will be more cases of asthma, respiratory illness and premature deaths — with no clear path to new jobs.

By contrast, the nation's first-ever standards for mercury and other air toxic pollutants which the EPA will finalize this fall — and which the Republican leadership aims to block — are estimated to create 31,000 short-term construction jobs and 9,000 long-term jobs in the utility sector through modernizing power plants. And the savings in health benefits are estimated to be up to $140 billion per year by 2016.

Contrary to industry lobbying, this overhaul can be accomplished without affecting the reliability of our power grid.

Our country has a long tradition of treating environmental and public health protections as nonpartisan matters. It was the case when President Nixon created the EPA and signed into law the historic Clean Air Act, when President Ford signed into law the and when President George H.W. Bush oversaw important improvements to the Clean Air Act and enacted the trading program that dramatically reduced acid rain pollution.

For Arielle Klagsbrun, the Keystone XL pipeline is President Obama’s last chance.

Klagsbrun went door to door to elect Obama in 2008. On her 18th birthday, she voted for him. “When President Obama was elected, I was probably one of the most excited people in the whole world,” she told National Journal.

Three years later, Klagsbrun isn’t so excited. “It’s just not the same feeling as it was in 2008,” she said.

At a fundraiser in St. Louis earlier this month, she wasn’t listening to Obama anymore. She was interrupting him. Klagsbrun and a fellow student shouted at the president to stop the $7 billion Keystone XL pipeline, a controversial 1,700-mile project to bring carbon-heavy tar-sands oil from Alberta, Canada, to refineries on the Gulf Coast of Texas.

“The Keystone XL is the moment for Obama to say, ‘Yes I am the person that you voted for,'” said Klagsbrun. “Should he veto the pipeline, a whole generation will be reinspired all around.”

The youth vote was critical to Obama’s election. An estimated 22 million Americans under the age of 30 voted in 2008 – the third-highest showing of young voters in U.S. history, according to the Center for Information and Research on Civic Learning and Engagement. Young voters preferred Obama by a 2-1 margin.

Environmental activists oppose the pipeline project because extraction and production of tar-sands oil is much more damaging to the environment and emits more greenhouse gases than the processes for obtaining and processing conventional oil. Proponents argue that it would slash U.S. dependence on foreign oil and create thousands of U.S. jobs.

All signs point to the administration’s approval of the controversial project.

“We’re looking at it right now,” Obama told protesters who interrupted his speech on Wednesday at the University of Colorado in Denver. “No decision has been made. And I know your deep concern about it. So we will address it.”

experts and insiders say there’s no way the president will reject the project. A combined 91 percent of National Journal‘s Energy and Environment Insiders said earlier this month that Obama will give it the green light, with more than 70 percent predicting it would happen before the end of the year.

The State Department, which must decide whether to approve the project because it crosses international borders, held hearings across the country and in Washington this fall and hopes to make a decision by the end of the year.

“There’s going to be a huge uproar if the administration approves the pipeline,” said Stewart Boss, cochairman of the Sierra Student Coalition at the University of North Carolina. Though Boss, a junior at UNC, was too young to vote in 2008, he was certainly not short on the optimism and hope that drove his generation to the polls. Pending and past decisions such as the pipeline project, expanded drilling in the Arctic, and the Environmental Protection Agency’s stalled ozone-pollution rule, Boss said, are cases in which Obama doesn’t have the excuse of a divided government.

Boss and other environmentalists are putting their faith in the EPA instead of the White House. “More than any other person, [EPA Administrator] Lisa Jackson has been standing her ground on these climate and energy issues,” said Boss.

Jackson said this week that the EPA is close to completing its review of the State Department’s final environmental impact statement for the Keystone project. The EPA found an earlier draft “inadequate.”

“This is a pipeline that cuts our country literally in half," Jackson told a meeting of young environmental activists at Howard University on Thursday.

Many of these young activists regard Jackson as a true champion of environmental issues.

“We stand behind Lisa Jackson and the EPA and we are pushing for President Obama to stand behind her," said Maura Friedman, a University of Georgia student who organized the university’s Beyond Coal campaign.

 We’re proud to lead the world in developing some of the most advanced prescription drugs to fight disease and save lives. But sometimes, we run low on a certain type of drug – driving up prices and putting patients at risk.  Over the last five years, the number of these drug shortages has nearly tripled. Even though the FDA has successfully prevented the many of the shortages, it’s clear we need to do more.

 We can’t wait to act. That’s why the President signed an executive order directing the FDA to take action to help further reduce and prevent drug shortages, protect consumers and prevent price gouging.

 In addition to the executive order, the President called on Congress to pass bipartisan legislation that will give the FDA new tools to prevent drug shortages.

 We can’t wait for an increasingly dysfunctional Congress to do its job, so the President will continue to act where they won't.

 The President will continue to fight to restore a sense of security for middle‐class Americans and rebuild an economy that works for everyone – not just folks at the top.

 Our problems are too serious. The stakes are too high. The issues facing Americans require serious bipartisan solutions, yet the Republicans in Congress have decided to put party before country and block legislation that would create jobs and grow the economy.

 While we will continue to work with Congress to bring up the American Jobs Act piece by piece, the President will continue to take executive actions that fight for the middle class because the American people simply can’t wait.

 These steps aren’t a substitute for the bold action we need to create jobs and grow the economy, but they’ll make a difference.

 While President Obama continues to take executive actions, Republicans in Congress will have the opportunity to do what’s right for the country. They’ll have a chance to vote on a bill that will make an immediate investment of $50 billion in our nation’s surface transportation infrastructure and a $10 billion investment to create a bipartisan National Infrastructure bank. Executive actions last week:  On Monday in Las Vegas the President highlighted a set of steps to help responsible borrowers with little or no equity in their homes take advantage of today’s low mortgage rates.

 On Tuesday, we challenged Community Health Centers to hire 8,000 veterans – approximately one veteran per health center site – over the next three years. Additionally, we took action to expand opportunities for veterans with medical training in the military to become physician assistants.

 On Friday, we directed agencies to take steps to speed up the transfer of federal research and development from the laboratory to the marketplace. REDUCING PRESCRIPTION DRUG SHORTAGES

By the authority vested in me as President by the Constitution and the laws of the United States of America, it is hereby ordered as follows:

Section 1. Policy. Shortages of pharmaceutical drugs pose a serious and growing threat to public health. While a very small number of drugs in the United States experience a shortage in any given year, the number of prescription drug shortages in the United States nearly tripled between 2005 and 2010, and shortages are becoming more severe as well as more frequent. The affected medicines include cancer treatments, anesthesia drugs, and other drugs that are critical to the treatment and prevention of serious diseases and life-threatening conditions.

For example, over approximately the last 5 years, data indicates that the use of sterile injectable cancer treatments has increased by about 20 percent, without a corresponding increase in production capacity. While manufacturers are currently in the process of expanding capacity, it may be several years before production capacity has been significantly increased. Interruptions in the supplies of these drugs endanger patient safety and burden doctors, hospitals, pharmacists, and patients. They also increase health care costs, particularly because some participants in the market may use shortages as opportunities to hoard scarce drugs or charge exorbitant prices.

The Food and Drug Administration (FDA) in the Department of Health and Human Services has been working diligently to address this problem through its existing regulatory framework. While the root problems and many of their solutions are outside of the FDA's control, the agency has worked cooperatively with manufacturers to prevent or mitigate shortages by expediting review of certain regulatory submissions and adopting a flexible approach to drug manufacturing and importation regulations where appropriate. As a result, the FDA prevented 137 drug shortages in 2010 and 2011. Despite these successes, however, the problem of drug shortages has continued to grow.

Many different factors contribute to drug shortages, and solving this critical public health problem will require a multifaceted approach. An important factor in many of the recent shortages appears to be an increase in demand that exceeds current manufacturing capacity. While manufacturers are in the process of expanding capacity, one important step is

2 ensuring that the FDA and the public receive adequate advance notice of shortages whenever possible. The FDA cannot begin to work with manufacturers or use the other tools at its disposal until it knows there is a potential problem. Similarly, early disclosure of a shortage can help hospitals, doctors, and patients make alternative arrangements before a shortage becomes a crisis. However, drug manufacturers have not consistently provided the FDA with adequate notice of potential shortages.

As part of my Administration's broader effort to work with manufacturers, health care providers, and other stakeholders to prevent drug shortages, this order directs the FDA to take steps that will help to prevent and reduce current and future disruptions in the supply of lifesaving medicines.

Sec. 2. Broader Reporting of Manufacturing Discontinuances. To the extent permitted by law, the FDA shall use all appropriate administrative tools, including its authority to interpret and administer the reporting requirements in 21 U.S.C. 356c, to require drug manufacturers to provide adequate advance notice of manufacturing discontinuances that could lead to shortages of drugs that are life-supporting or life-sustaining, or that prevent debilitating disease.

Sec. 3. Expedited Regulatory Review. To the extent practicable, and consistent with its statutory responsibility to ensure the safety and effectiveness of the drug supply, the FDA shall take steps to expand its current efforts to expedite its regulatory reviews, including reviews of new drug suppliers, manufacturing sites, and manufacturing changes, whenever it determines that expedited review would help to avoid or mitigate existing or potential drug shortages. In prioritizing and allocating its limited resources, the FDA should consider both the severity of the shortage and the importance of the affected drug to public health.

Sec. 4. Review of Certain Behaviors by Market Participants. The FDA shall communicate to the Department of Justice (DOJ) any findings that shortages have led market participants to stockpile the affected drugs or sell them at exorbitant prices. The DOJ shall then determine whether these activities are consistent with applicable law. Based on its determination, DOJ, in coordination with other State and Federal regulatory agencies as appropriate, should undertake whatever enforcement actions, if any, it deems appropriate.

Sec. 5. General Provisions. (a) Nothing in this order shall be construed to impair or otherwise affect:

(i) authority granted by law to an agency, or the head thereof; or

(ii) functions of the Director of the Office of Management and Budget relating to budgetary, administrative, or legislative proposals.

(b) This order shall be implemented consistent with applicable law and subject to the availability of appropriations.

Opponents to the Keystone XL pipeline got a boost Thursday from the Obama administration's former energy and climate chief.

"It would be, my hope is that, this pipeline did not go forward," Carol Browner said, speaking at a Washington Post Live event in downtown Washington.

"There's been a lot of analysis about the jobs ... but, you know, I think there's enough debate there about really how many jobs, what are the duration of those jobs, that, again, I believe we have an obligation to start to address it," she said.

"First of all, there are very clear criteria in which the State Department has to make this decision and they will have to speak to those criteria because, obviously, whatever decision they make there will probably be litigation," Browner said.

On Tuesday, President said the State Department will deliver recommendations to the White House on the proposal. White House spokesmen have emphasized that the State Department is in charge of the review.

Browner also suggested the debate over the Keystone pipeline would be a non-issue if Congress and the administration enacted climate change legislation.

"I am, for one, obviously disappointed that we don't have a climate policy. I think it's unfortunate," Browner said. "I think it would've, I think, been the morally and ethically right thing to do to reduce greenhouse gases."

Meanwhile, former National Security Adviser Gen. , speaking at the same event, said the Keystone XL project should go forward.

"I think it's a good project recognizing that, economically, it makes sense," Jones said. "It's certainly going to create a lot of jobs and as long as we can get around the other issues — is it the right thing to do? I think it is."
