Accepted 13 July, 2011 This paper is trying to examine the state-civil society relation and also argue from the theory of deliberative democracy in explaining the roles of civil society in Malaysia. Carolyn Hendriks sees deliberative, from two fundamental approaches; there are micro deliberative which concentrates on defining the procedural conditions of a structured deliberative forum and macro deliberative which are more concerned with the messy, unstructured deliberation which takes place in the public sphere. With the combination of civil society and deliberative democracy, this paper will open up the discussion on the state-civil society relations in Malaysia. It manages to trace that Malaysian civil society movements, in engaging and managing the relation with the state, have employed both deliberative methods of deliberative democracy. In fact, Malaysian civil society has gone a step further by joining the opposition party and contesting in the election for power due to hostile relation between the state and civil society. However, the reality is that there are too many considerations that need to be contemplated by the state and civil society in their relations, especially when it involves national security and race issues. Simultaneously, however, research has also shown that the larger political context in which the EIA is embedded is crucial in determining its influence on decision-making. Moreover, particularly in the case of mega-projects, vested economic interests, rent-seeking, and politics may provide them with a momentum in which the EIA risks becoming a mere formality. To substantiate this point, the article examines the EIA of what is reportedly Asia’s largest dam outside China: the Bakun Hydro-electric Project (BHP) in Malaysia. The study is based on mixed methods, particularly, qualitative research (semi-structured interviews, participatory observation, and archival study) coupled to a survey conducted in 10 resource-poor, indigenous communities in the resettlement area. It is found that close to 90% of the respondents are dissatisfied with their participation in the EIA, while another 80% stated that the authorities had conducted the EIA without complying to the procedures.

It started in the Banquet Hall. Representatives of the Malaysian Nature Society (MNS) came to speak about their views and goals for nature. We walked onto the golf course at around 7pm, a little while before sunset. As we followed the path, we saw many herons, most perched on the higher branches of trees. We caught a few of them fighting as well. We also saw a few Hadeda Ibis flying around, also regular visitors to our grounds. When the sky turned dark, we began to watch for frogs. We learned to notice them by eye shine – a glint of light reflected off their eyes was enough to give their hiding spots away. I was shocked at how many frogs there were, especially with a flashlight shone onto a large patch of bush. We even got to touch one of the frogs! It was Steven Wong who caught it. He was very knowledgeable on the subject of all the night critters we encountered and told us loads about every little creature, down to the very last detail. In fact, all the experts had the answers to everything we asked about! They weren’t hesitant to enlighten us on any other topics either. I learned to differentiate between damselflies and dragonflies, all thanks to the MNS experts.

    Towards an Integrated Management Plan for Belum- Temengor Rainforest: Concept and Strategy (Malaysian Nature Society) 1 Introduction The Belum Temengor Complex refers to 320,000 ha of Sundaic lowland and montane forest, is one of the last remaining and largest contiguous tropical rainforest in northern Peninsular Malaysia. Located in Northern Perak, it consists of what was previously the Belum Forest Reserve and the Temengor Forest Reserve and is contiguous with the Hala- Bala Wildlife Sanctuary and Bang Lang National Park in southern Thailand. At its centre lies the dendritic Tasik Temengor. The lake (172 km 2) is the result of the damming of several rivers for the purpose of irrigation, water catchment and generating hydro- electricity. In 1994 and 1998, the Malaysian Nature Society (MNS) organized two scientific expeditions into two sites within the forest complex to document its rich biological diversity and propose for it to be gazetted as a protected area. In fact, in 1995, MNS submitted a report to the State of Perak entitled “Management Guidelines for Proposed Belum Nature Park” (MNS, 1995) A third expedition, organized by the Forestry Department Peninsular Malaysia (FDPM) in 2003, further consolidated earlier findings. Through these expeditions, the forest complex was known to support healthy populations of large mammals (e.g. Asian elephants Elephas maximus , tigers Panthera tigris, Malayan tapir Tapirus indicus, primates Hylobates and Presbytis spp. etc.), birds (e.g. pheasants, hornbills, trogons, broadbills etc.), reptiles and amphibians and others. Plants also exhibited a high diversity and some are endemic to the forest complex. The forest complex is also home to the local indigenous tribes of Jahai and Temiar, numbering about 10,000 individuals .In 1993, DYMM Paduka Seri Sultan Perak Sultan Azlan Shah declared the formation of the Royal Belum State Park.
