Contributing Factors are items or situations that have been identified by the Centers for Disease Control as the leading causes for foodborne illness in the United States. Contributing Factors are: - Food from unsafe source/unwholesome. (visible spoilage or defective packaging noted, inability to identify source, home prepared/canned foods on premises) - Inadequate cooking or reheating. (product temperatures consistent with inadequate cooking or reheating, malfunctioning heating units) - Improper cooling or refrigeration. (malfunctioning cooling units, product temperatures above 41 degrees, product temperatures consistent with improper cooling procedures) - Cross contamination. (raw meat stored improperly, cutting board/utensils not properly sanitized) - Poor personal hygiene/poor food handling practices. (lack of proper handwash skills/hand contact with ready to eat foods, smoking, eating, or drinking in food prep area) It is our goal that each retail food establishment in Whiteside County reduces these Contributing Factors to 0. Inspection Frequency: Routine operational inspection frequency is based largely on the number of food handling operations (or lack thereof ) in an establishment and are categorized as follows: - Category 1 - Category 1 facilities are inspected three (3) times per year. Presents a relatively high risk of causing foodborne illness based on the large number of food handling operations typically implicated in food borne outbreaks and/or the type of population served by a facility. - Category 2 - Category 2 facilities are inspected two (2) times per year. Presents a medium relative risk of causing a foodborne illness based upon limited food handling operations typically implicated in foodborne outbreaks.

Defendant-Appellant. ) _____________________________________________________________________________ JUSTICE McDADE delivered the judgment of the court, with opinion. Presiding Justice Carter and Justice Lytton concurred in the judgment and opinion. _____________________________________________________________________________ OPINION ¶ 1 Defendant, Devin M. Kochevar, was charged by information with one count of criminal sexual abuse (720 ILCS 5/11-1.50(c) (West 2012)). He filed a motion to suppress the statement he had made during a custodial interview with regard to the alleged abuse, which was denied. The case was tried to a jury and Kochevar was found guilty. He was sentenced to serve 90 days of jail time with all but 10 days suspended and 24 months of probation, and he was required to register as a sex offender, undergo sex offender treatment and aftercare, provide a DNA sample, and pay a variety of fines and fees. He appealed, challenging the denial of his motion to suppress his custodial statement as involuntarily procured and seeking reversal of his conviction and new proceedings.
