Approved: March 23, 2016 MINUTES OF THE HOUSE JUDICIARY COMMITTEE The meeting was called to order by Chairperson Charles Macheers at 3:30 pm on Tuesday, March 15, 2016, 112-N of the Capitol. Representative John Carmichael made a motion to approve the minutes of the Committee meetings of March 3 and March 7, 2016, seconded by Representative Blaine Finch. After a vote, the minutes were unanimously approved. Hearing on: SB410 — Establishing a CARE family pilot program for foster care. Vice-Chairperson Charles Macheers opened the hearing on SB410. Jason Thompson gave an overview. Representative John Whitmer had a question. Vice-Chairperson Macheers recognized Senator Forrest Knox as a proponent of SB410 (Attachment 1). Vice-Chairperson Macheers recessed the hearing on SB410 so that Senator Knox could testify on SB418 and then return to Senate Chambers. Vice-Chairperson Macheers reopened the hearing on SB410. He then recognized Christie Applehanz, who testified as an opponent of SB410 on behalf of the Children's Alliance of Kansas (Attachment 2). There were questions by Representatives Janice Pauls and Mark Kahrs. Brian Smith testified as an opponent on behalf of the Galena School District No. 499 (Attachment 3). Representatives Randy Powell, John Whitmer, Janice Pauls, and Jim Ward had questions of Mr. Smith. Thomas Witt, testified as an opponent of SB410 on behalf of Equality Kansas (Attachment 4). Representative Leslie Osterman had a question for Mr. Witt. Tina Woods testified as an opponent of SB410 (Attachment 5). Representative Carmichael questioned her about her experience in living in a single parent foster home. Senator Knox returned for questioning. With the Vice-Chair's permission, questions were asked by Representatives John Carmichael and Janice Pauls. Vice-Chairperson Macheers directed the Committee's attention to the written opponent testimony of Brittany Smith (Attachment 6). Neutral testimony was given by Dawn Rouse, Office of Judicial Administration (Attachment 7). Questions were asked by Representative John Carmichael relating to firearms in foster homes. Representative Carmichael requested the Revisor or Research Department to prepare a memorandum explaining the current status of firearms in foster care homes. Kathy Armstrong of the Department for Children and Families advised the Committee that the regulation relating to firearms in foster homes is KAR 28-4-820(g). Vice-Chairperson Macheers recognized Mark Tallman of the Kansas Association of School Boards who provided neutral testimony on SB410 (Attachment 8). Representatives John Carmichael and Leslie Osterman had questions. Darla Nelson-Metzger provided neutral testimony on behalf of Families Together (Attachment 9). Vice-Chairperson Macheers noted that there was written neutral testimony from Jaime Rogers of the Department for Children and Families (Attachment 10). Hearing on: SB418 — Amendments related to human trafficking, children in need of care and juvenile offenders. Vice-Chairperson Charles Macheers opened the hearing on SB418. Vice-Chairperson Macheers recognized Senator Forrest Knox as a proponent of SB418 (Attachment 11). Vice-Chairperson Macheers recessed the hearing on SB418 to continue the testimony on SB410. Senator Knox left the room. Vice-Chairperson Macheers reopened the hearing on SB418. Jason Thompson, Revisor, provided an overview of the bill. Questions were asked by Representatives Annie Kuether and John Carmichael. Vice-Chairperson Macheers recognized Dawn Rouse, Office of Judicial Administration, as a proponent of SB418 (Attachment 12). A question was asked by Representative Janice Pauls. Kathy Armstrong of the Department for Children and Families responded. Kathy Armstrong, Kansas Department for children and Families, testified as a proponent on SB418 (Attachment 13). Vice-Chairperson Macheers noted that there was written proponent testimony from the Honorable Daniel Cahill (Attachment 14) and Pat Colloton of the Office of Attorney General (Attachment 15). In addition, there was written neutral testimony from Mark Tallman of the Kansas Association of School Boards (Attachment 16). Vice-Chairperson Macheers closed the hearing on SB418. Possible action on bills previously heard SB393 - Consideration of domestic abuse in determining the issue of custody, residency and parenting time of a child. Vice-Chairperson Macheers reminded the Committee that they had previously discussed sending SB393 to the Judicial Council. At the Vice-Chairperson's request Jason Thompson, Revisor, provided an overview of the bill, which he did. Representative John Carmichael moved to recommend that SB393 be referred to the Kansas Judicial Council for their review and comment, seconded by Representative Leslie Osterman. The motion carried.
