2020060994.Pdf SIA of Land Acquisition for Establishing Industrial Park by KINFRA (Padiyoor and Kalliyad Villages) CHAPTER 1 EXECUTIVE SUMMARY 1.1 Project and public purpose The proposed project is intended to establish an Industrial Park by KINFRA under the IDZ scheme in Padiyoor and Kalliyad Villages of Iritty Taluk in Kannur District. The project aims at improving the industrial facilities of the District thereby increasing the overall development of the State. This will in turn increase the employment opportunities to the populace. Establishment of industrial park can attract more investments in the state thus strengthening the economy as well. 1.2 Location Government of Kerala had accorded administrative sanction vide G.O.(Rt) No.89/2019/ID dated 29/01/2019 to acquire a total area of 708.5968 Acres of land in Padiyoor and Kalliyad Villages of Iritty Taluk in Kannur District for establishing an Industrial Park by KINFRA. 1.3. Size and attributes of land acquisition An extent of 389.255 acres of land from survey Nos. 26, 27, 28, 29, 30, 31, 32, 33, 34, 35, 36pt, 37, 38, 39, 40, 41, 42pt, 51pt, 84pt, 85pt, 86pt, 88, 89pt, 90, 91pt, 92pt 93, 94, 95, 96, 97, 98pt, 99, 100, 101, 102pt, 104pt, 105pt from Kuyiloor Desom of Padiyoor Village, 69.3414 acres of land from survey Nos. 147, 149pt, 150pt, 151, 152, 153pt, 154pt, 155, 156 from Padiyoor Desom of Padiyoor village and 250 acres of land from survey No. 23/1A pt of Urathur Desom of Kalliyad village in Kannur district is required for the implementation the proposed project. The land identified for the project of establishing the Industrial Park belongs to around 50 families, within which about 20 families are presently residing there. The commercial activities in the area is mainly based on farming of cashews, rubber Centre for Management Development, Thiruvananthapuram 1 SIA of Land Acquisition for Establishing Industrial Park by KINFRA (Padiyoor and Kalliyad Villages) plantation and similar variants of trees. Majority of the directly affected families are relying on the particular area for their livelihood. 1.4 Alternatives considered The area which is considered for the acquisition is located in Padiyoor and Kalliyad villages in Kannur district, close to the Pazhassi Dam. The project is intended for developing various infrastructural and business ventures near to the Kannur International Airport. Even though the proposed area is large, the number of houses that will be acquired numbers around 20. The lion’s share of the area is rich with Cashew farms and remaining portion is utilized for rubber farming. A good portion of the area is the land remaining after mining of Laterite stones. The proposed area does not have any presence of places of worship, area under Forest jurisdiction or cemeteries. In consideration with all of the above, no alternative land has been considered for the proposed project. In addition to that the properties of families who are near to the borders of the proposed project plan can be left out from consideration for acquisition during later stages. 1.5 Social impacts The land identified for the project of establishing the Industrial Park belongs to around 50 families, within which around 20 families are presently residing there. The lion’s share of the area is rich with Cashew farms and remaining portion is utilized for rubber farming. A good portion of the area is the land remaining after mining of Laterite stones. The project area is around 28 km away from District Collectorate and is bordered by the Pazhassi Dam constructed on the Irrikkur River to the south. The proposed area for land acquisition and subsequent project completion is obtained after leaving the Pump house, peripheral area and road belonging to the Pazhassi dam out of acquisition. Around 20 families in the project area are using this land for residential purposes. Presently there are many individuals employed here and both the owners and the workers solely depend on this area for getting their income. Other families are also getting their income from the proposed project area as they rely on the productive assets as a source. 1.6 Mitigation measures The land identified for the project of establishing the Industrial Park belongs to around 50 families. In addition to that, about 20 families are presently residing there and they do not have any properties other than this. The lion’s share of the area is rich with Cashew farms and remaining portion is utilized for rubber farming. A good portion of the area is the land remaining after mining of Laterite stones. Around 20 families in the project area are using this land for residential purposes. However, the estate which is owned by many families is also included in the project area. Presently there are many individuals that are employed here and both the owners and the workers solely depend on this area for getting their income. Other families are also getting their income from the proposed project area as they rely on these productive assets as a means of livelihood. However, by considering the following measures the authorities can mitigate and compensate the possible negative impacts of the land acquisition. • Compensation for the land owners as per the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act 2013. • Resettlement and Rehabilitation procedure as per the Policy issued by Revenue(B) Department, Government of Kerala vide G.O.(Ms)No.448/2017/RD dated 29/12/2017 for the rehabilitation and resettlement package for land acquisition in the state in lieu of RFCTLAR&R Act 2013. • Reconstruction of livelihood of people is an important factor in this project. Majority of the directly affected families are relying on the project area for their livelihood through cashew farm and rubber plantations. The loss of these assets will cause them a significant impact. Through this, the impact of losing livelihood as a result of land acquisition can be minimised. • The successful rehabilitation of the directly affected families are the other major concern in this land acquisition. The authorities should make sure that the displaced families will get proper rehabilitation. CHAPTER 2 DETAILED PROJECT DESCRIPTION 2.1 Background of the Project including Developer’s Background and Governance/Management structure As part of the decision to establish an Industrial Park for KINFRA, Government of Kerala (GoK) had accorded administrative sanction vide G.O.(Rt) No.89/2019/ID dated 29/01/2019 to acquire a total area of 708.5968 Acres of land in Padiyoor and Kalliyad Villages of Iritty Taluk in Kannur District for establishing an Industrial Park by KINFRA. The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement (RFCTLARR) Act 2013, enacted by the Government of India, has mandated the conduct of Social Impact Assessment study prior to the land acquisition. Government of Kerala had accorded sanction vide G.O.(P) No.57/2019/RD dated 04/09/2019 to Centre for Management Development, Thiruvananthapuram to conduct SIA in this regard and to prepare a Social Impact Management Plan for the same. The entire project is designed to involve and integrate the local community in all intended developmental initiatives. The concept of the Industrial Park is to provide a single platform that brings together various infrastructural facilities and industrial assistance from the Government to the public. The project would take an environment friendly approach by conserving energy and making use of alternate technologies. Centre for Management Development, Thiruvananthapuram 4 SIA of Land Acquisition for Establishing Industrial Park by KINFRA (Padiyoor and Kalliyad Villages) The land in Kannur district which has been proposed for the Industrial Park could be acquired due to the following reasons: • Even though the area for acquisition is quite large, very little number of families will be affected by loss in residential property. Around 20 homes will be lost in acquiring an area of about 708 acres. • Easy and quick access to various factors needed for the operation is Industrial Park, from moment of initial construction to daily operations. • The whole area is to be conserved from the ecological point of view. Pathways can be constructed keeping the concept of bio restoration in mind. 2.2 Rationale for Project, including how the project fits the public purpose criteria listed in the Act. The project aims in developing the district as a leading industrial hub. The industrial park can cater the social and economic development in the area. Industrialisation has resulted in a considerable rise in the standard of living of the people. Increase in job opportunities is a major advantage. The BMCs of Kerala has also been declared as Environmental watch groups by the Government of Kerala vide GO No 04/13/Envt dated 13.05.2013. In Kerala after the devastating natural disasters of August 2018 Post Disaster Needs Assessment ( PDNA) has been conducted officially by international organizations. The present report of Rapid Impact Assessment of flood/ landslides on Biodiversity focus on community perspectives of the affect on Biodiversity and Ecosystems. It is for the first time in India that such an assessment of impact of natural disasters on Biodiversity was conducted at LSG level and it is a collaborative effort of BMC and Kerala State Biodiversity Board (KSBB). More importantly each of the 187 BMCs who were involved had also outlined the major causes for such an impact as perceived by them and suggested strategies for biodiversity conservation at local level. Being a study conducted by local community all efforts has been made to incorporate practical approaches for prioritizing areas for biodiversity conservation which can be implemented at local level.
