Education Clauses in State Constitutions Across the United States∗ Scott Dallman Anusha Nath January 8, 2020 Executive Summary This article documents the variation in strength of education clauses in state constitu- tions across the United States. The U.S. Constitution is silent on the subject of education, but every state constitution includes language that mandates the establishment of a public education system. Some state constitutions include clauses that only stipulate that the state provide public education, while other states have taken more significant measures to ensure the provision of a high-quality public education system. Florida’s constitutional education clause is currently the strongest in the country – it recognizes education as a fundamen- tal value, requires the state to provide high-quality education, and makes the provision of education a paramount duty of the state. Minnesota can learn from the experience of other states. Most states have amended the education clause of their state constitutions over time to reflect the changing preferences of their citizens. Between 1990 and 2018, there were 312 proposed amendments on ballots across the country, and 193 passed. These amendments spanned various issues. Policymakers and voters in each state adopted the changes they deemed necessary for their education system. Minnesota has not amended its constitutional education clause since it was first established in 1857. Constitutional language matters. We use Florida and Louisiana as case studies to illus- trate that constitutional amendments can be drivers of change. Institutional changes to the education system that citizens of Florida and Louisiana helped create ultimately led to im- proved outcomes for their children. -

Our group Family and Friends of Dakota Uprising Victims was founded in 2011 to recognize our settler ancestors and honor their sacrifice and place in Minnesota history. On August 18, 1862, many settlers lost their lives, their homes, their property and peace of heart and mind. -

These are the magnitude of geological time and the enormous gaps in the geological record of any one region. To quickly gain an appreciation of the enormous number of years Involved in reviewing the events of the past that have been recorded In the rocks of Minnesota, let us imag ine that all the events in the geologic history of our state since the formation of the earliest known rocks are to be portrayed before our eyes on an enormous motion picture screen during one revolution of the hour hand on a clock. Twelve hours on our imaginary clock will then represent at least five hundred million years In the geologic history of our state. Each hour will represent over forty million years; each minute, seven hundred thousand years; each second, as it ticks by, will see eleven thousand, six hundred years in the geologic history of Minnesota move past us in review. On this clock of ours, the entire history of man on the earth will occupy less than a minute, and one-fifth of a second will serve for all the period recorded in the history of civilized man. There are three branches of state government: the executive, the judicial and the legislative. In Minnesota, the legislative branch consists of two bodies with members elected by the citizens of the state. These two bodies are called the Senate and the House of Representatives. Upon election, each Senator and Representative must take an oath to support the Constitution of the United States, the Constitution of this state, and to discharge faithfully the duties of the office to the best of the member’s judgment and ability. These duties include the consideration and passage of laws that affect all of us. Among other things, laws passed by the Legislature provide for education, protect our individual freedoms, regulate commerce, provide for the welfare of those in need, establish and maintain our system of highways, and attempt to create a system of taxation that is fair and equitable. -

MINNESOTA LAW REVIEW VOL. V MAY, 1921 No. 6 THE CONSTITUTION OF MINNESOTA' By WILLIAM ANDERSON* 1. THE MOVEMENT FOR STATEHOOD THE organized territory of Minnesota existed from 1849 to 1858. Included within its areas was not only the present state of Minnesota but also those portions of the present states of North and South Dakota which lie east of the Missouri and White Earth rivers. In this extensive region, double the area of the present state, there were at the beginning of the territorial period a scant five thousand people of the white race. The population increased slowly at the outset. The lands west of the Mississippi were not opened to settlement until after the conclusion of the Indian treaties of 1851 and 1852. In 1854, with the opening of the first railroad from Chicago to the Mississippi, the inrush began, thousands of settlers coming each year from New Eng- land, New York, and the states north of the Ohio. By 1857 there were 150,000 people in the territory. -

SNELLING AVENUE, MINNEAPOLIS: RESEARCH ON THE HISTORY OF THE AFRICAN AMERICAN COMMUNITY HENNEPIN COUNTY COMMUNITY WORKS MINNEAPOLIS, MINNESOTA 2009 SNELLING AVENUE, MINNEAPOLIS: RESEARCH ON THE HISTORY OF THE AFRICAN AMERICAN COMMUNITY Prepared for Hennepin County Community Works and the Minnehaha-Hiawatha Community Works Strategic Development Framework Hennepin County, Minneapolis, Minnesota by Carole S. Zellie Landscape Research LLC St. Paul, Minnesota 2009 Typical houses and their grain-elevator backdrop: the 3900 block of Snelling Avenue, 2008. Minneapolis’ late 19th-century African American population was small in number; the 1870 census recorded only 160 individuals.1 By 1900, the number rose to 2,592, reached 4,176 by 1930, and 4,646 in 1940. During this period “black people resided in every ward in the city, but the majority were . concentrated in the area of Nicollet Avenue and 10th Street.”2 The Seven Corners area near Washington and Cedar Avenues (much of which is now covered by I-35W and other development) comprised another settlement. The settlement concentration subsequently shifted toward north Minneapolis, into areas being vacated by Jews.3 African American families were among the first to settle in the neighborhood that grew south of E. Lake Street along the Chicago, Milwaukee, and St. Paul (CM&StP) rail corridor. Snelling Avenue, with adjacent portions of Minnehaha and Hiawatha Avenues, became one of relatively few areas of early 20th-century Minneapolis where African Americans established a long-term community with a high rate of home ownership. Snelling Avenue, today a small part of the Longfellow neighborhood, developed with tall elevators and mills as its noisy neighborhood backdrop; small factories were also placed between houses at the northern edge of the area. -

LASS birthplace of Minnesota, primarily because on August 26, 1848, invited Sdelegates to the Stillwater Conven- tion chose veteran fur trader Henry Hastings Sibley to press Minnesota’s case for territorial status in Con- gress. About a week and a half after the convention, however, many of its members were converted to the novel premise that their area was not really Minnesota but was instead still Wisconsin Territory, existing in residual form after the State of Wisconsin had been admitted to the union in May. In a classic case of desperate times provoking bizarre ideas, they concluded that John Catlin of Madison, the last secretary of the territory, had succeeded to the vacant territorial governorship and had the authority to call for the Dr. Lass is a professor of history at Mankato State University. Among those present was Mayor Samuel F. Snively, the man chiefly responsible for the construction and development of the unique boulevard system. ROAD Through personal determination ROAD and a remarkable talent for rais- ing donations, Snively brought MARK RYAN more than three-quarters of the parkway to fruition, helping establish one of Duluth’s most noted landmarks. Terrace Parkway, as the initial portion of the road was first called, was the brainchild of William K. Rogers, a native of Ohio who became president of the State Bank of Duluth and the city’s first park board. In 1888 Rogers had presented a plan for a hilltop boulevard that would follow the ancient gravel shore- line left by glacial Lake Namadji, a larger ancestor of present-day Lake Superior. A companion park stretching along Lake Superior’s shore from Seventh Avenue East to Fortieth Avenue East would be connected by per- pendicular links following several rivers and creeks that plunged from the crest of the hills toward the lake. In the late 1880s Mr. Ryan is a writer and film maker who Winding Mission Creek Road, native-stone resides in Minneapolis.
