Call to Order and Roll Call 2. Public Comment: This time is set aside for citizens to address the City Council on matters listed on the Consent Agenda as well as other items not included on the Regular Agenda. If your comments concern an agenda item noted on the regular agenda, please address the Council when that item is open for public comment. Each speaker is allocated three (3) minutes to speak. Speakers may not cede their time. Comments should be limited to matters within the jurisdiction of the City. Council discussion or action cannot be taken on items not listed on the agenda other than to receive comments. If you have documents to present to members of Council, please provide a minimum of seven (7) copies to the Deputy City Clerk. 3. Council and Staff Comments CITY COUNCIL BUSINESS Page 4. Consent Agenda - The City Manager recommends approval of the following Consent Agenda items. All Resolutions and Ordinances on this agenda, or added hereto, shall be introduced or adopted, as 4-21 applicable, by title only, and the full reading thereof is hereby waived. a. Approval of Disbursements: Accounts Payable 4/8 and 4/21/21; Total Gross Payroll and Taxes: For Period Ending 4/4/21 b. Monthly Investment Report City Council Regular Meeting April 26, 2021 1 Mt. Shasta Regular City Council Meeting Agenda Monday, April 26, 2021 Page 2 of 3 Page 5. Discussion and Possible Action: Fourth of July Annual Fireworks Display Location Change 22-28 Background: Mt. Shasta Community Fireworks is proposing a location change for the annual fireworks display. The relocation to Shastice Park does not require Council approval, however, staff would prefer that Council weigh-in on the decision. Report By: Tom Haistings, Pyrotechnician, Mt. Shasta Community Fireworks Recommended Council Action: Discuss and determine whether the fireworks display should take place over Shastice Park on the Fourth of July. Page 6. Project Update from Johnson Controls Regarding the City Renewable Energy and Infrastructure Improvement Project 29-37 Background: Johnson Controls will be presenting a general update on the status of the project. With two of the three solar arrays fully operational as well as the commercial garage at the Corporate Yard, the project is nearing completion. Throughout the construction process, multiple issues arose that had to be addressed to ensure long-term project financial viability. Johnson Controls will review the project and the issues and explain where the process stands today. Report By: Brian LaBrie, Johnson Controls Recommended Council Action: No action, information only. Page 7. Discussion and Possible Action: Fire Department Staffing 38-48 Background: In 2018, the City of Mt. Shasta was awarded a Staffing for Adequate Fire and Emergency Response (SAFER) grant to partially fund two firefighter positions for three years. The grant expires on December 30th of this year and the City faces the possibility of losing two full-time fire personnel. City staff requests that the City Council develop a plan to maintain the staffing of the fire department due to the critical nature of fire and emergency response. Report By: Bruce Pope, City Manager and Matt Melo, Fire Chief Recommended Council Action: Staff respectfully requests Council consider various short and long-term alternatives to maintain the staffing in the Fire Department. Page 8. Discussion and Possible Action: Censure of Councilmember Tim Stearns 49-96 Background: At the March 22nd City Council Meeting, Councilmember Montgomery requested an item for the censure of Councilmember Tim Stearns be added to the April 12th agenda. The request was seconded by Mayor Redmond; the item is on the agenda for discussion and possible action. Report By: Tessa Montgomery, Councilmember Recommended Council Action: Determine whether to approve resolution expressing disapproval of a City Council Member’s conduct. Page 9. Discussion and Possible Action: Request for Qualifications or Proposals for Development of the East 97-113 side of the Roseburg Landing Project Area Background: This agenda item was a request from Councilmember Stearns for the City Council to discuss the possibility of pursuing a Request for Qualifications or Proposals for the development of the East side of The Landing property. Report By: Bruce Pope, City Manager Recommended Council Action: Staff believes the proposal to go out with for an RFP or RFQ is premature and is therefore recommending denial of this agenda item. Formation of an Ad Hoc Committee for the Recruitment for the Position of City Manager Background: The City Manager has given his notice and will be leaving the City in July of this year. The City Council will discuss appointing two Councilmembers to an ad hoc committee to assist in the recruitment process. Report By: Bruce Pope, City Manager Recommended Council Action: Staff respectfully requests that Mayor Redmond appoint two Councilmembers to an ad hoc committee for the recruitment of a new City Manager. 11. Future Agenda Items (Appearing on the agenda within 60-90 days): a. City Council Workshop to Discuss City Priorities – 4/2021 b. Bid Award and Notice to Proceed for Tank 1 – 5/10/2021 c. Budget discussion re: Funding the Visitor’s Center and Siskiyou Outdoor Recreation Alliance – 5/2021 d. Discussion and Possible Action: Returning to Open Meetings – 6/14/2021 e. Discussion and Possible Action: City-Wide Cleanup Day – TBD f. Sharing of Code Enforcement services with other cities – TBD 12. Adjourn Availability of Public Records: All public records related to an open session item on this agenda, which are not exempt from disclosure pursuant to the California Public Records Act, that are distributed to a majority of the legislative body will be available for public inspection at City Hall located at 305 North Mt. Shasta Blvd., Mt. Shasta, CA at the same time the public records are distributed or made available to the members of the legislative body. Agenda related writings or documents provided to a majority of the legislative body after distribution of the Agenda packet will be available for public review within a separate binder at City Hall at the same time as they are made available to the members of the legislative body. Puzey* INTRODUCTION Imagine yourself as a child. I know, I know, it seems a little silly and perhaps even oxymoronic to try to imagine simpler times while reading a legal article, but I implore you to do so. Each of us had something that we aspired to become, be it a racecar driver or a rock star, a ballerina or a ball-player. Do you remember what your aspiration was? For many kids, early dreams and aspira- tions planted the seed for a real career—a seed that gradually blossomed as those children learned what they liked and what they ultimately desired. That tiny seed of “make believe” helped them to decide how to achieve their particu- lar career choice. Would-be doctors began studying extra hard and taking advanced classes. Hopeful singers belted out tunes at the top of their lungs and enrolled in vocal lessons. Aspiring baseball players joined local teams, where they worked hard at practice—running sprints, catching flies, taking extra cuts, and lifting weights. Slowly, but surely, dreams began to morph into reality. In today’s society, laws of equal opportunity generally promote and encourage children of both genders to pursue whichever career choice they desire.1 Little girls who dream of becoming baseball players, however, do not have this opportunity. Instead, Title IX’s Contact Sports Exemption essentially denies women the chance to pursue baseball as a legitimate career, or even to play the sport at the collegiate level.

Kouzmanoff said his feelings weren't hurt that the A's made a reported six-year, $76 million offer to free agent Adrian Beltre. Or that they talked with the Seattle Mariners about trading for Chone Figgins. "I feel like I'm ready to have a productive year, and I want to help the team make the playoffs and win a championship," he said. "What they're going to do business-wise is what they're going to do. I have no control over that. But I'm confident in my ability to play third base." Manager Bob Geren knew Kouzmanoff was aware of the buzz surrounding his uncertain status in the winter. That's why Geren chatted with him before the A's took the field for their first full-squad workout Monday. "There wasn't much that needed to be said," Geren said. "I let him know he's a major league third baseman, and he's ours, and I'm happy he's here. He knows that teams look at other players." Kouzmanoff's 16 homers led the A's last season -- his first with the team -- and his 71 RBIs tied Kurt Suzuki for the team lead.
