The shares were bought from Fersa Renovables for a third of the price paid by Enemalta. The evidence shows Cifidex funded the share purchase through a €3 million payment transferred by 17 Black to the company in late November 2015. lS. The Company was established for the sole purpose of the development and operation ofa 46MW capacity wind farm located in the Mozura/Uicinj region of Montenegro with an annual estimated gross production of 102 5 GWh The purchase was completed by Enemalta to facilitate the transaction and the intention of the Board is to transfer the subsidi!II) to a related company (associate) in 2016 i.e. the Company never had the intention to operate the Company ttself and it was acqutred widt the intention to sell and accordingly this was classified as available for sale. Jn April2016, an agreement was signed to sell the subsidiary. Upon approval ofthe Government of Montenegro, the ownership will be transferred. The Company considers the carrymg amount ofasset held for sale to be a reasonable estimate of its farr value pnnc1pally in view ofthe relatively short period bel'.Yeen the date of purchase and the reporting date (Leve12). Enemalta's 2015 accounts state it paid €10.3 million for the Mozura wind farm shares. By June 2016, Cifidex had sent back to 17 Black the original €3 million along with an additional "profit" of at least €4.6 million, three sources with access to 17 Black's banking records in Dubai have confirmed. The timing of the December 2015 Montenegro deal coincides with an e-mail sent out by government advisers Nexia BT, mentioning how 17 Black would feed up to €2 million into offshore structures they set up for former Energy Minister Konrad Mizzi and former OPM chief of staff Keith Schembri. Enemalta said in a reply to a request for comment about the Montenegro Mozura Hill deal that the information "is being compiled and verified accordingly". A Times of Malta freedom of information request for all of Enemalta's correspondence with Cifidex and its representatives was rejected on the basis of "trade secrets". 17 Black link to govern1nent officials The e-mail mentioning 17 Black as a major source of funds for Schembri's and Mizzi's Panama cmnpanies was part of an application to open bank accounts for their secret offshore structures at the Winterbotham Bank in the Bahamas. This application process was aborted once Caruana Galizia started to tease knowledge on her blog about what the two government officials were up to in early 2016. No money is known to have been transferred to the Panama companies from 17 Black. It is unknown what 17 Black did with the €4.6 million "profit" from the Montenegro deal. Of further suspicion is the fact that the only transactions which appea r to have been carried out using bank cards during this trip are on Dr. Mizzi's personal credit card and are only for 0.01 euros which means that these were carried out in order to ensure that the card is valid. This therefore raises the question as to why Dr. Mizzi refrained from using his official card during this trip. The FIAU had flagged Mizzi's frequent trips to Montenegro in a draft 2017 report. The FIAU report, which detailed reasonable suspicion of criminal activity in Mizzi's dealings, was finalised and sent to the police in spring 2018. The report contained intelligence naming Fenech as 17 Black's owner. Former Prime Minister Joseph Muscat, accompanied by Mizzi, travelled to Montenegro to inaugurate the completed wind farm project in November 2019. Both Muscat and Mizzi told Times of Malta they had no knowledge of Fenech's or 17 Black's connection to the project. "I dispute your assertion that an email from my service provider states that I might profit from 17 Black. I have publicly stated that I have no connection whatsoever with 17 Black," Mizzi said. On Schembri's role in the project, Muscat said that to his knowledge, his chief of staff was not involved in the negotiations.     Statement to the special committee on financial crimes, tax avoidance and tax evasion (TAX3) 11 February 2019 Strasbourg Matthew Caruana Galizia I am a software engineer and data journalist and worked full time for the International Consortium of Investigative Journalists, a nonprofit based in Washington, DC, from April 2014 to April 2018. I was responsible for receiving large volumes of leaked data for my employer and making them available to a large network of journalists for investigation, through a secured platform that I built for the purpose with help from my team. The leaked data came from the Luxembourg tax office, HSBC private bank in Switzerland, Singapore-based Portcullis TrustNet, BVI-based Commonwealth Trust Limited (CTL), Panama-based Mossack Fonseca and Bermuda-based Appleby. I received specialised training that allowed me to easily interpret the leaked legal and corporate documents from offshore law firms. As a software engineer I could build the tools that would allow myself and other journalists all over the world to collaborate on an investigation of hundreds of millions of these documents. My mother, Daphne Caruana Galizia, was an independent investigative journalist with thirty years of experience in journalism. She was assassinated in Malta with a bomb placed under the seat of her car on 16 October 2017, while working full time on a journalistic investigation into the illicit activities of JOSEPH MUSCAT, KEITH ALLEN SCHEMBRI, KONRAD MIZZI, KARL CINI, BRIAN TONNA, YORGEN FENECH, Electrogas Malta and the State Oil Company of the Azerbaijan Republic (SOCAR). Other individuals that she investigated are directly connected to the individuals named above but are party to what I believe to be separate violations that would take many more committee meetings to cover.

An analysis was carried out by the FIAU in relation to Dr Konrad MIZZI and his ownership of an offshore trust and company whilst holding political appointment with Maltese Government. The FIAU also refers to a preliminary report submitted to the Malta Police dated 7th April, 2016 bearing reference 474759/16. A more detailed analysis was subsequently carried out the FIAU in terms of the powers conferred to it under Article 16(1) of the Prevention of Money Laundering Act (Chapter 373 of the Laws of Malta).     Malta: International organisations concerned by appearance of political interference into the investigation of the assassination of Daphne Caruana Galizia 26 November 2019 We, the undersigned organisations, reiterate that the investigation into the assassination of Daphne Caruana Galizia must be independent and impartial. We remind Prime Minister, Joseph Muscat that there must be no political interference in the investigation. In the last week a number of important, overdue developments have taken place in relation to the investigation into the assassination of Daphne Caruana Galizia including the arrest of Yorgen Fenech, the former head of the Electrogas Malta energy company, as a person of interest in the murder and Melvin Theuma, the suspected middleman. Since Fenech’s arrest on 20 November, Malta’s Prime Minister Muscat has been the main source of information in relation to the progress of the investigation including whether pardons will be given to suspects in exchange for evidence. The Police Commissioner and the Attorney General have been absent from communications with the public and press. We are concerned that the Prime Minister, by placing himself at the centre of the investigation, raises the spectre of undue executive interference in the investigation. This is particularly so given the vested financial interests between Fenech and the Prime Minister’s current chief of staff Keith Schembri and cabinet minister Konrad Mizzi relating to the company, 17 Black. The financial interests of Muscat’s cabinet present the serious possibility of a conflict of interest for the Prime Minister with regard to the investigation. These concerns are intensified by Malta’s well- documented weak separation of powers as outlined in recent reports of the Venice Commission and the PACE Legal Affairs Committee.

    MALTA 2019 HUMAN RIGHTS REPORT EXECUTIVE SUMMARY Malta is a constitutional republic and parliamentary democracy. The president is the head of state, appointed by a resolution of the unicameral parliament for a term of five years. The parliament appointed George Vella president for a five-year term beginning April 4. The president names as prime minister the leader of the party that wins a majority of seats in parliamentary elections. Early parliamentary elections held in 2017 were considered free and fair. On December 1, Prime Minister Joseph Muscat announced he will resign the Labor Party (PL) party leadership following the election of a new leader on January 12, 2020. He also said that he will resign as prime minister in the days that followed the leadership election to make way for a new premier. The PL intends to complete its five-year mandate, which began in 2017. The national police maintain internal security. The armed forces are responsible for external security but also have some domestic security responsibilities. Both report to the Ministry of Home Affairs and National Security. Civilian authorities maintained effective control over the national police, the intelligence services, and the armed forces, and the government has effective mechanisms to investigate and punish abuse. Significant human rights issues included: an alleged unlawful killing by two members of the armed forces and allegations of high-level government corruption. The government took steps to investigate, prosecute, and punish officials who committed violations, whether in security services or elsewhere in the government. Section 1.
