PROCEEDINGS OF 191st MEETING OF THE ERC-NCTE HELD ON 14th – 15th July, 2015.

The 191st Meeting of the Eastern Regional Committee (ERC), National Council for Teacher Education (NCTE) was convened on 14th – 15th July, 2015 at Conference Hall, ERC, NCTE, 15, Neelakantha Nagar, Nayapalli, Bhubaneswar. The Chairperson, Members and Convener as listed below were present at the time of the 191st ERC Meeting. Prof.(Dr.) P.C. Sanjiva Suman - State representative of Bihar Dr. Tilottama Senapati - State representative of Odisha Shri Chandrapida Neelap - Regional Director, ERC & Convener At the outset, the Regional Director welcomed all the members of Committee and apprised them about the provisions of the NCTE Act, Rules, Regulations and Guidelines issued from time to time. With the permission of Chairperson, Shri Chandrapida Neelap (Convener) presented the Agenda before the Committee for its due consideration and appropriate decision.

Further the Committee has suggested that all the institutions be informed to install the Fire Safety Equipment and submit the Fire Safety Certificate if not submitted earlier. ATTENTION! 1. The committee unanimously decided that the institution may reply in response to the decision of the committee uploaded on the ERC website without waiting formal letters from the office of ERC. The replies so received will also be considered by the committee.

2. The Endowment Fund / Reserve Fund (5 Lakhs + 7 Lakhs) is 12 Lakhs per programme. (See ERC website for detail). 3. The institution need to submit list of 10 schools for internship and school based activities duly approved by District Education Officer. 4. Institutions must give the affidavit for consent / willingness for number of units either one or two if it was not submitted earlier. 5. The institution shall comply with the additional facilities required (additional built- up area, additional staff, additional funds etc) for the SECOND UNIT as prescribed in NCTE (Recognition Norms and Procedure) Regulations 2014 before 31.10.2015. 6. As per provisions u/s 17(4) of the NCTE Act, 1993, if an institution offers any course or training in Teacher Education without obtaining recognition or permission under this Act, the qualification in teacher education obtained pursuant to such course or training or after undertaking a course or training in such institution, shall not be treated as a valid qualification for purposes of employment under the Central Government, any State Government or University, or in any school, college or other educational body aided by the Central Government or any State Government.

As per decision of 177th ERC Meeting held on 18th November 2014, withdrawn order under section 17(1) was issued vide No. 27954 dated 28.11.2014 from the academic session 2015-2016 on the reasons mentioned therein,

The institution preferred an appeal to NCTE Hqrs against the ERC’s order dated 28.11.2014. As per NCTE Regulation on terms and condition of services: The academic and other staff of the institutions shall be paid such salary as may be prescribed by the concerned Government for equivalent posts in the state education system by account payee cheque or as per advice into the bank account of the employee specially opened for the purpose.

The institution need to adhered to the norms of NCTE.

The salary to the staff must be paid through Bank transaction as per pay scale prescribed by UGC/State Govt.

2. The institution is required to submit a fresh faculty list duly approved by the Registrar of the concerned university indicating their qualifications, percentage of marks and school subject in Master degree along with experience certificate and Ph.D. certificate of the principal. 3. In response to the above clarification letter the institution has sought some more time to compliance the above deficiencies. 4. Withdrawn order under section 17(1) was issued vide No.27007 dated 19.08.2014 from the academic session 2015-2016 on the reasons mentioned therein.

The institution preferred an appeal to the NCTE Hqrs. against the ERC’s order dated 19.08.2014. The appellate authority vides order No. 89-331/2014-Appeal/13th Meeting-2014/ A99015 dt. 10.12.2014 concluded that the appeal deserves to be remanded to ERC with a direction to conduct an inspection of the new premises at the earliest and take further action as per the Regulation. In the meantime the order of withdrawal shall remain abeyance.

The ERC in its 179th meeting considered the appeal order dated 10.12.2014 and decided that VT will be constituted as per NCTE Regulation 2014 after receiving the consent/willingness from the institution. In the meantime the order of withdrawal shall remain abeyance.

The institution namely K.K.M. College, Pakur, Jharkhand-816107 (Code No.APE00436) granted recognition by ERC, NCTE on 07.09.2005 with an annual intake of 100 from the academic session 2005-2006.

As per the decision of ERC in its 175th meeting, the recognition for B.Ed. course was withdrawn under section 17(1) of NCTE Act 1993, from the academic session 2015-2016 vide order No. 27379 dated 24.09.2014 on the reasons mentioned therein.

The institution preferred an appeal to the NCTE Hqrs. against the ERC’s order dated 24.09.2014. The Appellate Authority vide order No. 89-359/2014-Appeal/2nd Meeting-2015/ 3837 dt.05.05.2015. remand back the case to ERC with a direction to reconsider the matter by causing inspection on payment of fee.

The ERC in its 188th meeting held on 19-20 May 2015 considered the appeal order dated 05.05.2015 and as decided by ERC, inspection letter to the institution as well as VT experts were issued on 07.07.2015. VT report not yet received.

Further the Director of Higher Education, Govt. of Jharkhand vide letter dated 26.05.2015 committed that all such requirements along with appointment of full time faculty will be complied as per new Regulation 2014 by 31.10.2015.

After considering the records available in the file, and relevant provisions of the NCTE Act 1993, Rules, Regulations and guidelines issued by NCTE Hqrs., the Committee discussed the matter in detail and observed as under: The institution Jagannath Jain College, At/Po– Jhumari Telaiya, Dist – Koderma, Jharkhand - 825409 (Code No. APE00425) was granted recognition vide this office order dated 07.09.2005 for conducting B.Ed. course of one year duration with an annual intake of 100 from the academic session 2005-2006.

As per the decision of ERC in its 176th meeting, the recognition for B.Ed. course was withdrawn under section 17(1) of NCTE Act 1993, from the academic session 2015-2016 vide order No.27756 dated 12.11.2014 on the reasons mentioned therein.

The institution preferred an appeal to the NCTE Hqrs. against the ERC’s order dated 12.11.2014. The NCTE Hqrs. vide its order No. 89-05/2015-Appeal/2nd Meeting-2015/3757 dt.05.05.2015 decides to grant 3 months time to the appellant institution to furnish concrete evidence of compliance of NCTE Regulations, 2014.

The ERC in its 188th meeting held on 19-20 May 2015 considered the appeal order dated 05.05.2015 and as decided by ERC, a letter to the institution was issued vide no. 32000 dated 24.05.2015 with the following documents.

(i) The institution has not submitted any proposal for shifting of the B.Ed. Dept in the new building constructed by the Dept. (ii) Before granting the recognition to the institution, the principal of the college has given an undertaking to the effect that he would move the authorities to demarcate 5 acre of land from the available land of college for B.Ed. section exclusively. (iii) During Special inspection of the college conducted on 23.10.2013 revealed that the B.Ed. course is conducted in a portion of the building of the General College namely the Jagannath Jain College. Only two classrooms, one language lab and one office room aggregating to a total area of around 2334 Sq. ft. are exclusively available for conducting the B.Ed. course as against the requirement of a minimum of 1500 Sq. Mts. as per the prescribed NCTE norms. All other facilities are shared with the General College. Thus, the available infrastructure facilities are inadequate for conducting B.Ed. course as per the prescribed NCTE norms. The construction of the new building is under process which likely to be completed by the end of this financial years. (iv) Original FDRs of Rs. 5.00 lakh & Rs. 3.00 lakh in the joint name of the institution and RD, ERC, Bhubaneswar not submitted. (v) The institution has not appointed teaching faculty against the vacant post as required as per NCTE norms. The existing faculty are also on contractual basis till date.

(vi) No regular HOD is appointed by the institution till date. (vii) The institution has not submitted the fresh faculty list duly approved by the Registrar of the concerned university.

In response to letter dated 25.05.2015, reply from the institution yet to be received and time has been given three months time from the issue of this letter.

In response to ERC letter the following replies were submitted : The Registar, Vinoba Bhave University vide letter No. VBU/R/1960/2015 dated 25.05.2015 stated that the B.Ed. course is under the duly approved self-financed scheme. The payment of salary of the teachers employed is the college for B.Ed. teaching is made out of the fund/finance obtained from students under self- financed scheme. The service of the teachers will continue till the self-financed scheme is continuous.

Further the Director of Higher Education, Govt. of Jharkhand vide letter dated 26.05.2015 committed that all such requirements along with appointment of full time faculty will be complied as per new Regulation 2014 by 31.10.2015.

In view of the above the Committee decided as under: Recognition of the institution be continued. The status of the institution will be reviewed after 31st Oct. 2015.

Baharagora College, Baharagora, East Singhbhum, Jharkhand-832101 (B.Ed.) 42. 191.12.15 (Ranchi University) (Code No.APE00377) After considering the records available in the file, and relevant provisions of the NCTE Act 1993, Rules, Regulations and guidelines issued by NCTE Hqrs., the Committee discussed the matter in detail and observed as under: The institution namely Baharagora College, Baharagora, East Singhbhum, Jharkhand-832101 (Code No. APE00377) granted recognition by ERC, NCTE on 24.05.2005 with an annual intake of 100 from the academic session 2005-2006.

As per the decision of ERC in its 175th meeting, the recognition for B.Ed. course was withdrawn under section 17(1) of NCTE Act 1993, from the academic session 2015-2016 vide order No. 27385 dated 24.09.2014 on the reasons mentioned therein.

The institution preferred an appeal to the NCTE Hqrs. against the ERC’s order dated 24.09.2014. The NCTE Hqrs. vide its order No. 89-23/2015-Appeal/2nd Meeting-2015/3781 dt. 05.05.2015 decided to grant three months time to the appellant institution for fulfilling the norms & standards and comply within the NCTE Regulations, 2014.

The ERC in its 188th meeting held on 19-20 May 2015 considered the appeal order dated 05.05.2015 and as decided by ERC, a letter to the institution for shifting of premises was issued vide No. 32808 dt. 05.06.2015 on the following grounds.

a. The institution has submitted a D.D. of Rs. 3000/- bearing No. 029048 dated 30.04.2015 issued from Central Bank of India for processing fee for shifting of premises and the same is returned herewith to the institution. However, the institution is required to submit a D.D. of Rs. 1,50,000/- towards processing fee for shifting of premises. b. Certified copy of registered land document not submitted. c. Building plan duly approved by the Govt. Engineer not below the rank of J.E. mentioning the plot No., khesra No., total area and built up area etc. for the proposed premises for shifting of the building.

d. Affidavit Rs. 100/- stamp paper mentioning the details of land in the prescribed format – not submitted. e. Site plan issued from Land Revenue Department not submitted. f. Notarized copy of change of land use certificate (Conversion of land from agriculture to non-agriculture) issued by the Land Registering authority not submitted. g. Land possession certificate / Mutation certificate issued from the Land Registering Authority not submitted. h. Non- encumbrance certificate in the name of institution/society issued from the Land Registering Authority - Not submitted. i. As per submitted off-line application form, the name of the affiliating body is “Kolhan University” whereas as per previous correspondence from the affiliating body is Ranchi University. j. The institution has submitted the faculty list signed by Principal dated 10.04.2015 only whereas the same is not duly countersigned by the Registrar of the concerned University. k. As per submitted faculty list, it is mentioned that the appointment of lecturers are on contractual basis which is not as per NCTE norms and also it appears that the institution has not appointed for the post of Principal/HOD.

In response to letter dated 25.05.2015, reply from the institution yet to be received and time has been given three months time from the date of appeal order dated 05.05.2015.

Further the Director of Higher Education, Govt. of Jharkhand vide letter dated 26.05.2015 committed that all such requirements along with appointment of full time faculty will be complied as per new Regulation 2014 by 31.10.2015.

In view of the above the Committee decided as under: Recognition of the institution be continued. The status of the institution will be reviewed after 31st Oct. 2015.

Chatra College, Chatra, Dist.- Chatra, Jharkhand-825401 (Course: B.Ed.) 43. 191.12.16 (Management: Constituent College) (A.B.-Vinoba Bhave University) (Code No.APE00447) After considering the records available in the file, and relevant provisions of the NCTE Act 1993, Rules, Regulations and guidelines issued by NCTE Hqrs., the Committee discussed the matter in detail and observed as under: The institution namely Chatra College, Chatra, Dist.- Chatra, Jharkhand-825401 (Code No. APE00447) granted recognition by ERC, NCTE on 12.08.2005 with an annual intake of 100 from the academic session 2006-2007.

Revised recognition order to the institution was issued vide No. 32447 dt. 30.05.2015 with an annual intake of 100 for two basic units of 50 students each from the academic session 2015-2016.

The ERC in its 174th meeting held on 5th August 2014 considered the reply from the institution dated 28.07.2014 in response to ERC’s SCN dated 17.06.2014 along with original file of the institution and as decided by ERC, a show cause notice to the institution was issued vide No. 26960 dated 18.08.2014 on the following grounds.

(i) The institution functions as a wing of the degree college. Its own building out of the B.Ed. fund is still under construction. (ii) The institution has failed to engage teaching and non-teaching staff on regular basis. (iii) The institution has also failed to provide the necessary instructional facilities. (iv) In the absence of a regular HOD, the institution is not managed professionally. (v) The institution has not submitted the renewed/converted FDRs of Rs.5 lakh and Rs.3 lakh in the joint name of institution and RD, ERC, NCTE, Bhubaneswar.

In response, the institution has not submitted the reply of Show cause notice dated 18.08.2014 issued to the institution. However, the institution is still deficient on the following grounds:-

As per the decision of ERC in its 175th meeting, the recognition for B.Ed. course was withdrawn under section 17(1) of NCTE Act 1993, from the academic session 2015-2016 vide order No. 27290 dated 19.09.2014 on the reasons mentioned therein.

The institution preferred an appeal to the NCTE Hqrs. against the ERC’s order dated 19.09.2014. The appellate authority vide order No. 89-356/2014-Appeal/2nd Meeting-2015/ 3793 dt. 05.05.2015 remanded back to ERC with a direction to consider the reply furnished by the appellant institution in light of the provisions of NCTE Regulations, 2014. However, the institution will not be entitled to take admissions for the academic session 2015-16 till ERC issues a formal order in this regard.

The ERC in its 188th meeting held on 19-20 May 2015 considered the appeal order dated 05.05.2015 and as decided by ERC, inspection letter to the institution as well as VT experts were issued on 07.07.2015. VT report not yet received.

After considering the records available in the file, and relevant provisions of the NCTE Act 1993, Rules, Regulations and guidelines issued by NCTE Hqrs., the Committee discussed the matter in detail and observed as under: The institution namely A. S. College, Deoghar, PO/Dist – Deoghar, Jharkhand - 814112 (Code No. APE00439) granted recognition by ERC, NCTE on 12.08.2005 with an annual intake of 100 from the academic session 2006-2007.

As per the decision of ERC in its 175th meeting, the recognition for B.Ed. course was withdrawn under section 17(1) of NCTE Act 1993, from the academic session 2015-2016 vide order No. 27322 dated 22.09.2014 on the reasons mentioned therein.

The institution preferred an appeal to the NCTE Hqrs. against the ERC’s order dated 22.09.2014. The Appellate Authority vide order No. 89-354/2014-Appeal/2nd Meeting-2015/ 3809 dt. 05.05.2015 remanded to ERC with a direction to consider the developments reported by the appellant by conducting an inspection of the institution and take further action as per the NCTE Regulations, 2014 which have come into force w.e.f. 28.11.2014. In the meantime, the order of withdrawal shall be kept in abeyance.

(Constituent 46. 191.12.19 College) (Ranchi University) (Code No.APE00437) After considering the records available in the file, and relevant provisions of the NCTE Act 1993, Rules, Regulations and guidelines issued by NCTE Hqrs., the Committee discussed the matter in detail and observed as under: The institution namely , Po/Dist.-Godda, Jharkhand-814134 (CodeNo.APE00437) granted recognition by ERC, NCTE on 12.09.2005 with an annual intake of 100 from the academic session 2005-2006.

As per thZe decision of ERC in its 175th meeting, the recognition for B.Ed. course was withdrawn under section 17(1) of NCTE Act 1993, from the academic session 2015-2016 vide order No. 27297 dated 19.09.2014 on the following grounds.

(i) As per special inspection of the institution, it is revealed that B.Ed. course is still being conducted in a portion of the building of Godda College. The available built up area for the B.Ed. College is only 3500 Sq. ft. as against the requirement of a minimum of 16146 Sq. ft. or 1500 Sq. Mts. (ii) The institution has not submitted any proposal for shifting of premises along with other required documents and shifted the B.Ed. Department in the new premises without getting approval from the ERC, NCTE, Bhubaneswar. (iii) The teaching faculty are appointed on contractual basis. As per NCTE norms the teaching faculty must be appointed on regular basis. (iv) The post of HOD and two lecturers are vacant.

The institution preferred an appeal to the NCTE Hqrs. against the ERC’s order dated 19.09.2014. The NCTE Hqrs. vide its order No. 89-355/2014-Appeal/2nd Meeting-2015/3829 dt. 05.05.2015. remanded to ERC with a direction to conduct an inspection of the institution about the built up area made available for the B.Ed. course and take further action in the light of the NCTE Regulations, 2014. In the meanwhile the order of withdrawal shall be kept in abeyance.

Course of one year duration with an annual intake of 100 from the academic session 2005-2006.

As per the decision of ERC in its 176th meeting, the recognition for B.Ed. course was withdrawn under section 17(1) of NCTE Act 1993, from the academic session 2015-2016 vide order No. 27794 dated 13.11.2014 on the following grounds.

(i) The B.Ed. department is located in a part of the college building with a covered area of 443 Sq. Mts. which is less than the required 1500 Sq. Mts. as per NCTE norms.

(ii) The institution has failed to create the required instructional facilities. For instance, Science Resource Center does not have the required apparatuses and the required consumables and chemicals are not available. Psychology Resource Centre has not been created. (iii) The departmental library has a stock of 800 books which is less than the required 3000 as per NCTE norms.

(iv) The University has recruited eight lecturers on contractual basis for 11 months for the year 2013-14 and posted them in this college on 03.09.2013. The services of the staff are terminated after 11 months and fresh appointments are made in the beginning of a session. The institution has not appointed teaching faculty on regular basis till date.

(v) The institution is very deficient in respect of instructional facilities prescribed by the NCTE.

The institution preferred an appeal to the NCTE Hqrs. against the ERC’s order dated 13.11.2014. The Appellate Authority vide order No. 89-07/2015-Appeal/2nd Meeting-2015/3761 dt. 05.05.2015. decided to grant the appellant institution time to comply with the norms laid down in NCTE Regulations, 2014 and submit a status report to the Appeal Committee within a period of 3 months from the date of issue of appeal orders.

The ERC in its 188th meeting held on 19-20 May 2015 considered the appeal order dated 05.05.2015 and as decided by ERC, a letter to the institution was issued vide No. 32091 dt. 25.05.2015 with a direction to submit a status report to the appeal committee within a period of 3 months from the date of issue of appeal orders.

In response to letter dated 25.05.2015, the institution has submitted vide reply dated 30.05.2015 received in this office on 05.06.2015

In reply to the letter, the institution has submitted representatives report dated 30.05.2015 received in this office on 05.06.2015 mentioning as under:-

“The Graduate School College is a constituent unit of Kolhan University, Chaibasa. It is a composite college running different under graduate and post graduate course as per UGC norms i.e. enforced w.e.f. 28.11.2014 allow teacher education course to be located in a composite institutions. The land area has been enhanced to approximately 3000 Sq. Mts. According to the building plan it is of two storey and the proposal for 3rd floor has been already sent ot Kolhan University, Chaibasa.

Now the B.Ed. department of this college has created instructional facilities in Science, Art and Craft resource centre, ICT resource centre and Psychology in the college premises. These are recently created and developed as Block-A main building as previous. Block-B Science lab, Psychology lab, Arts and Craft lab. Block-C – Physical education centre.

The library has already acquired the required no. of 3000 books approximately as per NCTE norms. Annual sports for B.Ed. students are arranged every year.

Whereas NCTE Regulation 2009 mentioned appointment of faculty on full time and regular basis. The words regular have been omitted in 2014 regulation. Now according to the new regulation there shall be fulltime teaching faculty and the service conditions of the faculty is to be left to be decided by the State Govt./affiliating body.

At present the college has sufficient infrastructure and instructional facilities in its premises which are used by the students of B.Ed. college ETC.

So kindly consider the case because withdrawal of recognition will deprive the students of carrier opportunities in the backward region of Kolhan at such fair fee structure. The institution will further inform about the current status report regarding the college progress”.

A letter No. 967 dated 26.05.2015 received from Director, Higher Education, Govt. of Jharkhand, MHRD on 27.05.2015 requesting to the ERC, NCTE to allow the B.Ed. institutions (Constituent Unit) of the Universities of Jharkhand in cases where the recognition of the institutions from the session 2015-2016 have been withdrawn and the decision has been taken to stop teaching B.Ed. course. The universities of the State have agreed to follow and abide by the norms of the NCTE by 31.10.2015.

Further the Director of Higher Education, Govt. of Jharkhand vide letter dated 26.05.2015 committed that all such requirements along with appointment of full time faculty will be complied as per new Regulation 2014 by 31.10.2015.

In view of the above the Committee decided as under: (i) Recognition of the institution be continued. (ii) Review the status will be taken up after after Oct.2015. Government Teachers Training College (College of Teacher Education), Ranchi, 49. 191.12.22 Jharkhand-834001 (B.Ed.) (Govt.) (Ranchi University) (File No. JH-S/N-6/2001) After considering the records available in the file, and relevant provisions of the NCTE Act 1993, Rules, Regulations and guidelines issued by NCTE Hqrs., the Committee discussed the matter in detail and observed as under: The institution namely Government Teachers Training College (College of Teacher Education), Ranchi, Jharkhand-834001 (File No. JH-S/N-6/2001) granted recognition by ERC, NCTE on 20.06.2002 for conducting of B.Ed. Course of one year duration with an annual intake of 100 from the academic session 2002-2003.

Revised recognition order to the institution was issued vide No. 32743 dt. 31.05.2015 with an annual intake of 100 for two basic units of 50 students each from the academic session 2015-2016.

The ERC in its 179th meeting held on 22-23 January 2015 considered the reply from the institution dated 06.12.2014 in response to ERC’s SCN dated 24.11.2014 along with original file of the institution and as decided by ERC, a show cause notice to the institution was issued vide No. 30115 dated 31.01.2015 on the following grounds.

(i) Regarding land and building, the Government teachers training college, Ranchi is a very old Government institution for boys which was established in the year 1955 i.e. prior to the coming into force of the NCTE Act, 1993. The institution was not functioning subsequently, for many years. In pursuance the decision of the State Government, it applied for recognition for B.Ed. course to the ERC, NCTE, Bhubaneswar on 31.12.2001. It was granted recognition for conducting B.Ed. course with an intake of 100 students from the academic session 2002-2003 in the campus of the Zila School, Ranchi. The institution does not have its own land and building for running B.Ed. programme.

(ii) The institution has not appointed the qualified and regular teaching faculty as per NCTE norms.

In response to SCN, the institution submitted its reply dated 13.02.2015 received in this office on 25.02.2015 with a copy of representation dt.13.02.2015 addressed to the Director, Higher Education, Jharkhand to give direction so that the reply of show cause notice be communicated to the ERC office within the stipulated time and a copy endorsed to the ERC office. However, the institution is still deficient on the grounds mentioned in the letter dated 31.01.2015.

Further the Director of Higher Education, Govt. of Jharkhand vide letter dated 26.05.2015 committed that all such requirements along with appointment of full time faculty will be complied as per new Regulation 2014 by 31.10.2015.

In view of the above the Committee decided as under: (i) Recognition of the institution be continued. (ii) Review the status will be taken up after Oct.2015. Deficiency found if any will be communicated.

College, Po–Jharia, Dist.-Dhanad, Jharkhand-828111 (Code No. APE00428) granted recognition by ERC, NCTE on 14.09.2005 with an annual intake of 100 from the academic session 2006-2007.

As per the decision of ERC in its 176th meeting, the recognition for B.Ed. course was withdrawn under section 17(1) of NCTE Act 1993, from the academic session 2015-2016 vide order No. 27757 dated 12.11.2014 on the reasons mentioned therein.

The institution preferred an appeal to the NCTE Hqrs. against the ERC’s order dated 12.11.2014. The Appellate Authority vide order No. 89-09/2015-Appeal/2nd Meeting-2015/3769 dt. 05.05.2015 decided to grant 3 months time from the date of issue of appeal orders, to the appellant institution to make appointment of faculty as per provisions of NCTE Regulations 2014.

The Registar, Vinoba Bhave University vides No. VBU/R/1960/2015 dated 25.05.2015 stated that the B.Ed. course is under the duly approved self-financed scheme. The payment of salary of the teachers employed is the college for B.Ed. teaching is made out of the fund/finance obtained from students under self-financed scheme. The service of the teachers will continue till the self-financed scheme is continuous.

Further the Director of Higher Education, Govt. of Jharkhand vide letter dated 26.05.2015 committed that all such requirements along with appointment of full time faculty will be complied as per new Regulation 2014 by 31.10.2015.

(Vinoba Bhave University) (Code No.APE00429) After considering the records available in the file, and relevant provisions of the NCTE Act 1993, Rules, Regulations and guidelines issued by NCTE Hqrs., the Committee discussed the matter in detail and observed as under: The institution namely Guru Nanak College, Dhanbad, Post Box No. 93, Dist.-Dhanbad, Jharkhand-826001 (Code No. APE00429) granted recognition by ERC, NCTE on 07.09.2005 with an annual intake of 100 from the academic session 2005-2006.

As per the decision of ERC in its 174th meeting, the recognition for B.Ed. course was withdrawn under section 17(1) of NCTE Act 1993, from the academic session 2015-2016 vide order No. 26998 dated 19.08.2014 on the following grounds:

(i) The institution is functioning as a department of the General Degree College. (ii) The Principal of the Guru Nanak College, Dhanbad has also submitted an undertaking dated 08.10.2004 on non-judicial stamp paper that the infrastructural, instructional and other facilities will be provided for B.Ed. course as per norms. (iii) As per special Inspection Report, the institution does not have adequate infrastructural facilities as required as per the prescribed norms. Out of three classrooms available for B.Ed. course, two classrooms have a space of 437 Sq. ft. which is less than the required 500 Sq. ft. as per NCTE norms. Thus, only one classroom is only as per NCTE norms as against the requirement of a minimum two classrooms with an area of minimum 500 Sq. ft. each. (iv) The multipurpose hall available is having an area of 1890 Sq. ft. as against the requirement of a minimum of 2000 Sq. ft. as per NCTE norms. (v) The library is 420 Sq. ft., science lab 150 sq. ft. and computer lab 228 Sq. ft. are very small and inadequate as per norms. Psychology lab is not available in the institution. (vi) Thus, infrastructural facilities available with the institution are inadequate for running B.Ed. course. (vii) During the special inspection it is found that Khalsa College and Khalsa School are running in the same campus which is against the rules.

The institution preferred an appeal to the NCTE Hqrs. against the ERC’s order dated 10.12.2014 decided that another inspection under section 13 of the Act be conducted for which the appellant shall pay fee within a period of one month from the date of issue of appeal order.

The ERC in its 188th meeting held on 19-20 May 2015 considered the appeal order dated 05.05.2015 and decided that the matter be forwarded to the NCTE Hqrs. for conducting the re-inspection u/s 13 of the NCTE Acte 1993. Accordingly, a letter to the NCTE Hqrs. was issued vide No. 30192 dated 04.02.2105 with a request to conduct an inspection u/s 13 of the NCTE Act 1993.

No communication has been received from NCTE Hqrs. till date.

In view of the above the Committee decided as under:

As per the decision of ERC in its 174th meeting, the recognition for B.Ed. course was withdrawn under section 17(1) of NCTE Act 1993, from the academic session 2015-2016 vide order No. 26966 dated 18.08.2014 on the following grounds.

(i) The Foundation/Trust runs a school and the B.Ed. College in the same campus which is contravene to the NCTE Norms and Regulations. (ii) As per the VT report Library is housed in a small room having seating capacity of 15 persons and not suitable for a B.Ed. college. The ICT Resource Centre has also been setup in a small room which is not fit for a computer lab. The Psychology lab set up in a class room does not have the required number of tests. (iii) The facilities actually created for the school have been claimed to be the facilities of the B.Ed. College. Thus the institution is very deficient in terms of infrastructures and instructional facilities. (iv) The institution is not having a qualified Principal. (v) The list of the faculty submitted by the institution after the show cause notice is neither approved by the Register of the University nor having information regarding the qualifications of the their eligibility as per norms. (vi) There is no qualified regular Librarian in the institution.

The institution preferred an appeal to the NCTE Hqrs. against the ERC’s order dated 18.08.2014. The NCTE Hqrs. vide its order No. 89-364/2014-Appeal/2nd Meeting-2015/3801 dt. 05.05.2015 remand back the case to ERC with a direction to reconsider the case applying the norms laid down in NCTE Regulations 2014.

The ERC in its 188th meeting held on 19-20 May 2015 considered the appeal order dated 05.05.2015 and as decided by ERC, a letter to the institution was issued vide no. 32503 dated 30.05.2015 with the following documents.

(i) Building plan clearly showing the demarcation for B.Ed. Course including the school area duly signed by Govt. Engineer be submitted. Different room / spaces with name and measurement as per new Regulation 2014 to be indicated in the building plan. (ii) Faculty list recruited with due procedure and approved the Registrar of the concerned university along with certificate / testimonial to be submitted. (iii) VCD covering the entire land and building as well different rooms / department to be submitted. (iv) After receiving the above documents inspection may be conducted (if required) on payment of inspection fee.

In view of the above the Committee decided as under:

(i) Recognition be continued (ii) The institution is required to submit the Experience Certificate of Principal.

Rajeev Gandhi Memorial Teacher’s Training College, 12-Digwadih, PO–Pathardih, 57. 191.12.26 Dist – Dhanbad, Jharkhand – 828119 (B.Ed.) Course of one year duration with an annual intake of 100 from the academic session 2009-2010.

The ERC in its 178th meeting held on 11-12 December 2014 considered the reply from the institution dated 27.11.2014 in response to ERC’s SCN dated 11.11.2014 along with original file of the institution and decided that the case may be referred to the NCTE Hqrs. for further direction. Accordingly, a letter to the NCTE Hqrs. was issued vide No. 28405 dated 01.01.2015 on the following:

(i) As per special inspection conducted by the NCTE Hqrs on 22.10.2013 it was found that the built up area of the institution is only 13400 sq.ft i.e. 1244.89 sq.mts which is less than the required 1500 sq.mts as per NCTE Regulation 2009.

(ii) The institution clarified that : “The visiting team had reached our institution at 4.30 p.m. on 22nd October 2013 after completing its inspection of Ravi Mahato B.Ed. College, Mahuda (Dhanbad) which is 40 Km away from our institution. When the members of this visiting team reached to our institution they started going through our original documents by comparing the same through the relevant papers submitted by us earlier. In this process, more than two hours time had been spent & it became near about 6.30 o’clock of the evening. Then they asked us for physical verification. As it was too late we requested the members to start physical verification on next day, but they did not take heed of our request and said that on next day they have scheduled to visit another B.Ed college situated at Ranchi which is also most important assignment for them. The team started their work when it was sun set & in deem light they started physical verification of our institution which is consisting of two Blocks A & B adjacent to each other but unfortunately roughly they have assessed the built up are of the building without measuring the actual measurement of these two Block A & B. We became surprise to note that the total measurement of Block A & B of our institution is 2000.48 sq.mts. (the details of which is submitted earlier) whereas report of the visiting team shows that it is 1300 sq.mts. only. We could not understand when they did not measure whole area by using any measurement Tap, then how it is calculated.”

It is very pertinent to mention that in Block A which is a four story building consisting offices, staff rooms, class rooms, five laboratories & one hall of 371sq.mts (three hundred seventy one) and block B also a four story building consisting a Girl’s common room, ICT-cum-ET lab, Library, Smart class room etc. Photographs of these two Block A & B is being enclosed herewith for your perusal & ready reference.”

(iii) The fact on record in the Visiting Team report and the reply of the institution are contradictory.

As per decision of ERC in 178th meeting, the matter was referred to NCTE Hqrs. vide letter dated 01.01.2015. No direction/communication has been received from NCTE Hqrs. till date.

In view of the above the Committee decided as under: Reminder letter to the NCTE Hqr. be issued.

As per the decision of ERC in its 175th meeting, the recognition for B.Ed. course was withdrawn under section 17(1) of NCTE Act 1993, from the academic session 2015-2016 vide order No. 27331 dated 22.09.2014 on the reasons mentioned therein.

The institution preferred an appeal to the NCTE Hqrs. against the ERC’s order dated 22.09.2014. The NCTE Hqrs. vide its order No. 89-363/2014-Appeal/2nd Meeting-2015/3833 dt. 05.05.2015 remanded to ERC with a direction to consider these submissions and conduct an inspection of the institution about the availability of the requisite built up area for the B.Ed. course and take further necessary action as per the NCTE Regulations 2014. In the meantime, the order of withdrawal shall be kept in abeyance.

The ERC in its 188th meeting held on 19-20 May 2015 considered the appeal order dated 05.05.2015 and as decided by ERC, inspection letter to the institution as well as VT experts were issued on 15.07.2015. VT report not yet received.

Further the Director of Higher Education, Govt. of Jharkhand vide letter dated 26.05.2015 committed that all such requirements along with appointment of full time faculty will be complied as per new Regulation 2014 by 31.10.2015.

In view of the above the Committee decided as under: (i) Recognition of the institution be continued. (ii) Review the status will be taken up after Oct.2015.

After considering the records available in the file, and relevant provisions of the NCTE Act 1993, Rules, Regulations and guidelines issued by NCTE Hqrs., the Committee discussed the matter in detail and observed as under:

The institution namely Ranchi Women’s College, Circular Road, Ranchi, Jharkhand-834001 (Code No.APE00287) granted recognition by ERC, NCTE on 12.05.2005 with an annual intake of 100 from the academic session 2005-2006.

As per the decision of ERC in its 175th meeting, the recognition for B.Ed. course was withdrawn under section 17(1) of NCTE Act 1993, from the academic session 2015-2016 vide order No. 27404 dated 24.09.2014 on the reasons mentioned therein.

The institution preferred an appeal to the NCTE Hqrs. against the ERC’s order dated 24.09.2014. The NCTE Hqrs. vide its order No. 89-362/2014-Appeal/2nd Meeting-2015/3845 dt. 05.05.2015 remand back the case to ERC with a direction to consider the matter in light of the NCTE Regulations 2014 and get an inspection conducted on payment of fee.

The ERC in its 188th meeting held on 19-20 May 2015 considered the appeal order dated 05.05.2015 and as decided by ERC, inspection letter to the institution as well as VT experts were issued on 15.07.2015. VT report not yet received.

Further the Director of Higher Education, Govt. of Jharkhand vide letter dated 26.05.2015 committed that all such requirements along with appointment of full time faculty will be complied as per new Regulation 2014 by 31.10.2015.

In view of the above the Committee decided as under: (i) Recognition of the institution be continued.

Volume - IV (Part - II) ER-191.12 Cases U/S 13 Bokaro Steel City College, Sector-VI, Bokaro, Jharkhand-827006 (B.Ed.) 63. 191.12.29 (Constituent Unit) (Vinoba Bhave University) (Code No.APE00450) After considering the records available in the file, and relevant provisions of the NCTE Act 1993, Rules, Regulations and guidelines issued by NCTE Hqrs., the Committee discussed the matter in detail and observed as under: The institution namely Bokaro Steel City College, Sector-VI, Bokaro, Jharkhand-827006 (Code No.APE00450) granted recognition by ERC, NCTE on 12.08.2005 with an annual intake of 100 from the academic session 2006-2007.

As per the decision of ERC in its 175th meeting, the recognition for B.Ed. course was withdrawn under section 17(1) of NCTE Act 1993, from the academic session 2015-2016 vide order No.27334 dated 22.09.2014 on the reasons mentioned therein.

The institution preferred an appeal to the NCTE Hqrs. against the ERC’s order dated 22.09.2014. The NCTE Hqrs. vide its order No. 89-353/2014-Appeal/2nd Meeting-2015/3825 dt. 05.05.2015 remanded to ERC with a direction to consider the submissions and verify through an inspection of the institution the availability of built up area claimed and take further action as per the NCTE Regulations, 2014. In the meantime the order of withdrawal shall be kept in abeyance.

The ERC in its 188th meeting held on 19-20 May 2015 considered the appeal order dated 05.05.2015 and decided that VT be constituent on payment of inspection fee of Rs.50,000/- in D.D. Accordingly, a letter to the institution was issued vide No. 32009 dated 24.05.2015 to submit the inspection fee. In response, the institution has not submitted the D.D. of Rs.50,000/- towards inspection fee till date.

In response to ERC letter the following replies were submitted:

The Registrar, Vinoba Bhave University vides letter No.VBU/R/1960/2015 dated 25.05.2015 stated that the B.Ed. course is under the duly approved self-financed scheme. The payment of salary of the teachers employed is the college for B.Ed. teaching is made out of the fund/finance obtained from students under self-financed scheme. The service of the teachers will continue till the self-financed scheme is continuous.

Further the Director of Higher Education, Govt. of Jharkhand vide letter dated 26.05.2015 committed that all such requirements along with appointment of full time faculty will be complied as per new Regulation 2014 by 31.10.2015.

In view of the above the Committee decided as under: (i) Recognition of the institution be continued. (ii) Review the status will be taken up after Oct.2015. Deficiency found if any will be communicated.

Kartik Oraon College, Gumla, Jharkhand – 835207 (Constituent College) 64. 191.12.30 (Course: B.Ed.) (Ranchi University) (Code No. APE00295) After considering the records available in the file, and relevant provisions of the NCTE Act 1993, Rules, Regulations and guidelines issued by NCTE Hqrs., the Committee discussed the matter in detail and observed as under: The institution namely Kartik Oraon College, Gumla, Jharkhand – 835207 (Code No. APE00295) granted recognition by ERC, NCTE on 21.06.2005 with an annual intake of 100 from the academic session 2005-2006.

As per the decision of ERC in its 175th meeting, the recognition for B.Ed. course was withdrawn under section 17(1) of NCTE Act 1993, from the academic session 2015-2016 vide order No. 27359 dated 22.09.2014 on the reasons mentioned therein.

The institution preferred an appeal to the NCTE Hqrs. against the ERC’s order dated 22.09.2014. The NCTE Hqrs. vide its order No. 89-362/2014-Appeal/2nd Meeting-2015/3845 dt. 05.05.2015 remanded back the case to ERC with a direction to reconsider the matter by causing inspection on payment of fee.

The ERC in its 188th meeting held on 19-20 May 2015 considered the appeal order dated 05.05.2015 and as decided by ERC, a letter to the institution was issued vide no. 31997 dated 24.05.2015 on the following.

(i) The council decided to remand back the case to ERC with a direction to reconsider the matter in light of the NCTE Regulations 2014 and get an inspection conducted on payment of inspection fees.

(ii) The institution is advised to arrange the infrastructure, instructional facilities, faculty list as per new Regulation 2014 and intimate to ERC with the inspection fee of Rs.50,000/- in D.D. at the earliest to enable the ERC to conduct inspection. In response, the institution has not submitted the D.D. of Rs. 50,000/- towards inspection fee till date.

(ii) Experience Certificate of HOD is not as per new Regulation 2014. (iii) No part time teachers as per Regulation 2014. (iv) Original FDRs in joint operation not submitted.

In view of the above the Committee decided as under: Clarification letter be issued to the institution giving 21 days. Raj Rammohan Ray College of Education (B.Ed), Vill- Adampur, PO- Mahadevpur, 68. 191.12(II).2 Dist-Malda, West Bengal-732121 (B.Ed) (Private) (University of Gour Banga) (Code No.ERCAPE01008) After considering the records available in the file, and relevant provisions of the NCTE Act 1993, Rules, Regulations and guidelines issued by NCTE Hqrs., the Committee discussed the matter in detail and decided as under: The President of the institution requested to withdraw the recognition. The Committee accepted the request of the institution and decided to withdraw the recognition of the institution for B.Ed. Course from the session 2015-2016.
