LCB File No. R062-04 PROPOSED REGULATION OF THE STATE FIRE MARSHAL NOTICE OF INTENT TO ACT UPON A REGULATION Notice of Hearing for the Adoption of Regulations of The Division of the Nevada State Fire Marshal The Division of the Nevada State Fire Marshal will hold a public hearing at 9:00 a.m., on June 21, 2004, at 401 South Carson Street, The Legislative Counsel Bureau (LCB), Room 2134 and it will be video conference at the Grant Sawyer Building, 555 E. Washington Ave., Las Vegas, NV, Room 4412. The purpose of the hearing is to receive comments from all interested persons regarding the Adoption of regulations that pertain to chapter 477 of the Nevada Administrative Code. The following information is provided pursuant to the requirements of NRS 233B.0603: INFORMATION REGARDING ADOPTION Upon adoption of any regulation, the agency, if requested to do so by an interested person, either prior to adoption or within 30 days thereafter, shall issue a concise statement of the principal reasons for and against its adoption, and incorporate therein its reason for overruling the consideration urged against its adoption. 1. Purpose and Need of the Proposed Regulations. The mission of the Division of the Nevada State Fire Marshal is to minimize the loss of life and property from fire and hazardous materials and to reduce injury and exposure to the general public and to emergency responders. The purpose of these regulations is to define and clarify the rights and responsibilities of persons licensed under this chapter. 2. Terms of the proposed regulations. The following description of the regulations to be adapted in Chapter 477 are as follows: Because the authoritative codes in the State of Nevada will change from the Uniform Codes to the International Codes, all references to the Uniform codes such as the “Uniform Building Code” or “Uniform Fire Code” have been changed from “Uniform” to “International” in Chapter 477. With the implementation of the international codes, construction plan review fees will increase. The amount of the increase is presented in Chapter 477. --1-- Agency Draft of Proposed Regulation R062-04 3. Estimated Economic Effect. Applicants applying for licenses under this chapter will be required to pay an additional fee for the cost of construction building plan examinations. 4. Estimated Cost to the Agency. None known at this time. 5. Duplication with other Agencies: None known at this time. 6. Federal Law. None known at this time. 7. Federal Regulation. None known at this time. 8. Increases of Existing Fees. Fees for fire and life safety components of construction plan examination will increase with the implementation of the International Codes. These fees are presented in Chapter 477 of the NAC. Persons wishing to comment upon the proposed action of the Nevada State Fire Marshal may appear at the scheduled public hearing or may address their comments, data, views or arguments in written form to the Nevada State Fire Marshal on or before June 14, 2004. Informal comments may be submitted up to June 20, 2004. If no person who is directly affected by the proposed action appears to request time to make an oral presentation, the Nevada State Fire Marshal may proceed immediately to act upon any written submissions. A copy of this notice and the draft regulation to be adopted will be on file at the Nevada State Library, 100 Stewart Street, Carson City, Nevada for inspection by members of the public during business hours. Additional copies of the notice and the regulation to be Adopted will be available at the Nevada State Fire Marshal’s Office located at the following address’: 107 Jacobsen Way, Carson City Nevada; Reno Office, University of Nevada Reno, 1664 North Virginia St. Reno, NV; Dayton Office 231 Corral Dr. Dayton Nevada; Elko Office, 911 West Idaho, Elko Nevada; Pahrump Office, 1360 East Basin Rd. Pahrump, Nevada; Las Vegas Office, University of Nevada Cheyenne Campus 3200 East Cheyenne Ave. North Las Vegas, Nevada; Boulder City Office, USCCN 700 Wyoming, Boulder City, Nevada; and in all counties in which an office of the agency is not maintained, at the main public library, for inspection and copying by members of the public during business hours. This notice and the text of the proposed draft regulation are also available in the State of Nevada Register of Administrative Regulations, which is prepared and published monthly by the Legislative Counsel Bureau pursuant to NRS 233B.0653 and on the Internet at http://www.leg.state.nv.us. Copies of this notice and the proposed regulation will also be mailed to members of the public upon request. A reasonable fee may be charged for copies if it is deemed necessary. This does not apply to a public body subject to the Open Meeting Law.
