 a Tug and Work Vessel Program – using: Vessel 9, Vessel 10, Vessel 11, Vessel 12, Vessel 13, Vessel 14, Vessel 15, Vessel 16, Vessel 17, Vessel 18, Vessel 19, Vessel 20, Vessel 21,Vessel 22 and Vessel 23 (maximum overall vessel length less than 50 and maximum passenger capacity of less than 25 passengers for each vessel).

Conduct of a Charter Operation – being:

 a Vessel Charter Program – using Vessel 1, Vessel 2, Vessel 3, Vessel 4, Vessel 5, Vessel 6, Vessel 7, Vessel 8, Vessel 9, Vessel 10, Vessel 11, Vessel 12, Vessel 13, Vessel 14, Vessel 15, Vessel 16, Vessel 17, Vessel 18, Vessel 19, Vessel 20, Vessel 21, Vessel 22, Vessel 23, Ship 1, Ship 2, Ship 3 and Ship 4 (maximum passenger capacity of less than 25 passengers for each vessel).

Page 2 of 11 CONDITIONS OF PERMISSIONS

COMPLIANCE WITH ALL LAWS

G1 All activities conducted under this permission must be undertaken in accordance with the provisions of the laws in force from time to time in the State of Queensland and the Commonwealth of Australia.

G2 To the extent applicable and unless written endorsement to the contrary appears in this permit, the Permit Holder must: (i) comply with the enforcement provisions contained in Part 2 of the Plans of Management gazetted under Part VB of the Great Barrier Reef Marine Park Act 1975; and (ii) only operate to an intertidal area adjacent to a location within the Planning Areas with access consistent with that provided in the Plans of Management for that adjacent location.

G3 The Permit Holder must ensure: (i) the Restricted Access Special Management Areas are not used or entered at any time unless access has been granted under the zones to which the permission applies; and (ii) the Maritime Cultural Heritage Special Management Areas are only used or entered for the purpose of transiting; and (iii) all other Special Management Areas are used and entered in accordance with the restrictions specified in the Great Barrier Reef Marine Park Regulations 1983 and the Great Barrier Reef Marine Park Zoning Plan 2003.

G4 The Permit Holder must ensure that when operations are conducted in the Marine Parks under this permit, a copy of this permit is held at the site or sites of operation and on the vessel or aircraft or ship during transit to and from that site or sites.

G5 The Permit Holder must inform staff and participants in the program of relevant restrictions applying under any zoning plans, plans of management, Marine Parks regulations and this permit.

G6 The Permit Holder must further comply with the conditions specified in any schedules attached to this permit when entering or using a zone of, or place in, the Marine Parks to which the relevant conditions relate.

DEED CONDITIONS

G7 Within 30 business days of the commencement date of this permit, the Permit Holder must execute, seal and deliver a Deed to the Managing Agency in the form annexed to this permit, identified with the permit number and marked ‘Deed of Agreement’.

G8 The Permit Holder must observe and perform its obligations under and pursuant to the Deed. Any breach of the Deed shall be a breach of this condition.

AUTHORITY CONDITIONS

G9 The Permit Holder may authorise other persons to conduct the activities covered by this permit, by giving to those persons an Authority in the form attached to this permit (Attachment A) or as otherwise approved by the Managing Agency.

G10 An Authority remains valid for the period of time shown on each individual Authority, unless the Authority is sooner revoked in writing by the Permit Holder or unless the permission is sooner suspended, revoked or expires.

G11 The Permit Holder must provide a copy of this permit to any person issued Authority under condition G9.

GENERAL CONDITIONS

G12 When providing transport in the Marine Parks to another operation permitted under a different Marine Parks permit, the Permit Holder must ensure that the total number of persons (including crew) on the vessel or aircraft or ship does not exceed relevant setting or permit limits.

Page 3 of 11 G13 The Permit Holder must ensure that any mooring used is: (i) permitted under a current Marine Parks permit; (ii) safe to use; and (iii) of a type and design suitable for the vessel or aircraft or ship used under this permit.

G14 The Permit Holder must ensure that any vessels authorised under this permit are: (i) maintained in a proper condition; and (ii) operated in a competent manner.

NOTIFICATION APPROVAL CONDITIONS

G15 Prior to any vessel or aircraft or ship being operated under this permit, the Permit Holder must: (i) have given written notification to the Great Barrier Reef Marine Park Authority of the vessel or aircraft or ship name and registration number of the specific vessel or aircraft or ship to be operated under this permit; and (ii) have received written approval for use of that vessel or aircraft or ship from the Managing Agency and a copy of that approval must be held on-board the vessel or aircraft or ship at all times.

G16 An approval under condition G15(ii) above ceases to have effect for a specific vessel or aircraft or ship when a subsequent approval for the same or any other vessel or aircraft or ship is given under that condition.

G17 Interchange with another vessel or aircraft or ship of similar size and passenger capacity is permitted for a period of less than 72 hours, if such interchange is of an unexpected nature resulting from maintenance or repairs of the permitted vessel or aircraft or ship, or for a period exceeding 72 hours, subject to written approval from the Managing Agency.

ENVIRONMENTAL HARM CONDITIONS

G18 The Permit Holder must take all reasonable steps to ensure that activities carried out under this permit do not cause harm to the environment.

G19 The Permit Holder must notify the Managing Agency within 24 hours of all incidents. The notification must include: (i) details of the incident including date, time, location, cause and nature of the incident; (ii) the name and contact details of the person(s) witnessing, reporting and/or responsible for the incident; (iii) the type, estimated volume and concentration of any pollutants involved; (iv) the type and number of any pests transported; (v) the type and estimated scale of any physical damage to the environment caused; and (vi) measures taken or proposed to be taken to mitigate the impact or risk and the success of those measures in addressing the incident or risk.

G20 The Permit Holder must provide written details of the notification as specified in condition G19 to the Managing Agency within 48 hours of the time the Permit Holder became aware of the incident. This written notification must include details specified in condition G19 as well as the following: (i) measures taken or proposed to prevent or mitigate against the recurrence of such an incident; and (ii) any other relevant matters.

INCIDENT RESPONSE CONDITIONS

G21 Prior to the commencement of activities authorised under this permit, the Permit Holder must develop, or update, an Incident Response Plan, which documents procedures to deal with all types of incidents that may occur as a result of permitted activities and which are likely to cause harm to the environment.

G22 The Incident Response Plan must include, but is not limited to: (i) identification and assessment of all potential hazards and risks to the environment including oil and fuel spills and the transport, transfer or potential introduction of pests; (ii) response procedures, including roles and responsibilities of persons conducting activities authorised under this permit; (iii) identification of incident response equipment to be held on vessels approved under this permit; (iv) training procedures for persons conducting activities authorised under this permit; and (v) notification and reporting procedures including agency contact information.

Page 4 of 11 G23 In relation to the Incident Response Plan referred to in condition G22, the Permit Holder must: (i) provide a copy of the most recent version of the Incident Response Plan to the Managing Agency within 21 days of being called upon to do so; and (ii) review the Incident Response Plan annually and update as needed to reflect any modifications to permitted activities or operational procedures.

ACCESS FOR OBSERVERS

G24 The Permit Holder must provide the Managing Agency nominees with access to: (i) activities authorised under this permit to witness, inspect or audit any part of the operations; and (ii) any documented records related to activities authorised under this permit.

G25 The Permit Holder must provide the Managing Agency nominees referred to under condition G24 with the necessary assistance in carrying out their duties.

DELIVERY OF GOODS

G26 If carrying hazardous substances, the Permit Holder must only carry limited quantities in accordance with the International Maritime Dangerous Goods Code.

Page 5 of 11 BARGE, TUG and WORK VESSEL SCHEDULE

B1 The Permit Holder may offer the following services, in accordance with specific Conditions of Permission: (i) transport of freight and goods; and (ii) transport of packaged fuel but NOT including transport and transfer of bulk fuel.

B2 When operating Vessel 20 and in addition to the services identified under condition B1, the Permit Holder may offer the provision of transport, accommodation and services to persons other than tourists.

NAVIGATING A SHIP CONDITION

B3 Permit Holder must ensure that Ships are only operated within the Designated Shipping Areas or General Use Zones unless transiting to and from an approved intertidal area in accordance condition B5 and B6.

TUG-AND-TOW CONDITIONS

B4 When using permitted vessels in a tug-and-tow configuration and the total length of the tow is greater than 150 metres, from the stern of the towing vessel to the aft end of the tow, the Permit Holder must ensure that the vessels are: (i) only operated within the Designated Shipping Area or General Use Zone unless transiting to and from an approved intertidal area in accordance with condition B4; (ii) not anchored outside the Designated Shipping Area or General Use Zone at any time unless within a Designated Anchorage; and (iii) manned by a suitably qualified pilot within Compulsory Pilotage areas in the Great Barrier Reef Marine Park unless exemption has otherwise been granted.

INTERTIDAL AREA ACCESS CONDITIONS

B5 The Permit Holder may only access the intertidal areas: (i) using a boat ramp, barge ramp, jetty or harbour wharf that is of a type and design suitable for the vessel; or (ii) in accordance with an Intertidal Areas Notification Approval.

B6 If access to other intertidal areas is required, the Permit Holder must: (i) give the Managing Agency at least 14 days written notice seeking approval to access an intertidal area; (ii) not access the intertidal areas unless an Intertidal Areas Notification Approval is received; (iii) comply with any direction the Managing Agency may impose on access; and (iv) hold a copy of the Intertidal Areas Notification Approval on-board the vessel at all times.

B7 The Permit Holder must take reasonable steps to prevent: (i) the introduction of pests into the Marine Parks; and (ii) the transfer of pests between locations within the Marine Parks.

B8 The Permit Holder must ensure that vessel propellers are disengaged during cargo transfer unless it is unsafe to do so.

SCHEDULE OF WORKS

W1 The Permit Holder must provide a Schedule of Works in writing to the Managing Agency, no less than 20 business days prior to the commencement of any works not covered by an approved Environmental Management Plan.

W2 The Permit Holder must: (i) Not carry out any works until the Schedule of Works has been approved by the Managing Agency; and (ii) implement the approved Schedule of Works.

ENVIRONMENTAL SITE SUPERVISION

W3 Where the Managing Agency’s written approval of the Schedule of Works provided under condition W2 requires environmental site supervision of works, the Permit Holder must: (i) provide the 24-hour contact details of an on-site liaison officer whom the Environmental Site Supervisor can contact; and (ii) only conduct works in the presence of an officer of the Managing Agency, unless otherwise advised by the Managing Agency; and (iii) provide the Environmental Site Supervisor with access to works at all times.

W4 The Environmental Site Supervisor is authorised to stop, suspend or modify works, which in their opinion have caused or are likely to cause environmental harm.

W5 Where the Environmental Site Supervisor has directed the Permit Holder to cease works, the Permit Holder must not recommence works unless authorised by the Environmental Site Supervisor.

W6 The Permit Holder and its employees, contractors and subcontractors and agents must comply with any reasonable direction given by the Environmental Site Supervisor for the purpose of ensuring compliance with this permit, the Schedule of Works or any direction considered necessary by the Environmental Site Supervisor for the conservation, protection and preservation of the Marine Parks and property in the Marine Parks.

C1 When conducting transport and related services to persons other than tourists, the Permit Holder must not access Preservation Zones and Special Management Areas in accordance with condition G3 unless: (i) in the presence of an officer of the Managing Agency; (ii) with persons other than an officer of the Managing Agency, the Permit Holder must notify the Managing Agency and must not conduct activities until written approval is given.

C2 The Permit Holder must ensure that when conducting charter operations in accordance with condition C1 this activity is not conducted whilst transporting tourists or in conjunction with a tourist program.

C3 When providing transport and services to persons conducting activities in the Marine Parks which require the written permission of the Managing Agency, the Permit Holder must: (i) not operate under this permit unless those persons have been granted the appropriate Marine Parks permit; and (ii) only conduct operations in accordance with the conditions of that permit.

C4 When providing transport and services to persons conducting activities in the Marine Parks which require notification to the Great Barrier Reef Marine Park Authority under Part 5 of the Great Barrier Reef Marine Park Zoning Plan 2003 and/or Part 4 of the Marine Parks (Great Barrier Reef Coast) Zoning Plan 2004, the Permit Holder must: (i) not operate under this permit unless those persons have notified the relevant Managing Agency of their intended activities; and (ii) only conduct operations in accordance with any directions imposed by the Managing Agency.
