61/13 Applications for Planning Permission

The following members of the public addressed the meeting regarding the Plans List Items indicated:

Plans List Item 1 – Keith Dale spoke in favour of the application and Councillor Lanigan spoke on behalf of the Parish Council.

Planning Minute/1 Plans List Item 2 – Bill Ashton spoke in favour of the application and Deb Leighton spoke against the application. Plans List Item 4 – John Knight spoke in favour of the application and Lisa Hughes spoke against the application. Plans List Item 6 – Ms Hopkinson spoke in favour of the application. Plans List Item 8 – David Nasey spoke in favour of the application.

Considered:

The report listing applications and the Director of Planning’s recommendations thereon. Members also considered further information circulated on the Members’ Update Sheet at the meeting including; updated recommendations from the Director of Planning and comments received after the agenda was printed from: consultees, objectors and supporters.

Resolved: (a) That with regard to all applications listed in the report and subject to: (i) the amendments specified below; and (ii) the imposition of conditions in accordance with the relevant provisions of Sections 91-94 of the Town and Country Planning Act 1990, except in those instances where an alternative condition is contained in the Director of Planning’s recommendation or in an amendment referred to in (i) above; decisions be given in accordance with the Director of Planning’s recommendations:

List Plan No and Description of Proposal No 1. NYM/2013/0383/FL – Construction of farm shop building (Use Class A1) with associated access road and parking area at Arglam Farm, Easington for Mr Keith Dale, Deepdale Farm, Loftus, & Cleveland, TS13 4JF. Decision Consideration deferred for Officers to clarify the nature of use and to enable a site visit to be undertaken, with the attendance of Members being regarded as an approved duty for the purposes of the payment of Members’ allowances. 2. NYM/2013/0403/CU – Change of use from dwelling (C3) to residential children’s’ care home (C2) (no alterations) at Grange Farm, Easington for Mr Bill Ashton, 37 Emerald Street, Saltburn-by the-Sea, Cleveland, TS12 1EE. Decision The Officer recommendation of refusal was moved and seconded by Members. A vote took place on this motion which was lost. A recommendation of approval contrary to Officer recommendation, for a temporary five year period and with the maximum number of children occupying the children’s care home not exceeding five, was moved and seconded by Members. A vote took place on this motion which was carried. The application was approved contrary to Officer recommendation as Members considered that whilst the neighbouring properties are in close proximity to Boulby Grange Farm, the use proposed would not have an unacceptable impact on the amenity of the neighbouring properties. Members requested that permission be granted on a temporary five year basis and only for a maximum of five children to allow for the use and its impacts to be assessed and considered. 3. NYM/2013/0442/FL – Construction of detached local occupancy dwelling with associated garage, access and landscaping works at land adjacent 82 Rosedale Lane, Port Mulgrave for M Anthony & Mrs Tanya Lonsdale, 3 Wheatsheaf Cottages, Egton, Whitby, North , YO21 1TZ. Decision Approved as recommended.

Planning Minute/2 4. NYM/2013/0446/FL – Formation of a new access track (part retrospective) at Plane Tree Farm, Carlton for Mr J knight, Plane Tree Farm, Carlton, , TS9 7DB. Decision David Hugill declared a personal interest in this item as the application has been discussed at Parish Council meetings and both the applicant and objector are known to him. Approved as recommended with the Director of Planning to clear an amendment to condition 3. 5. NYM/2013/0357/FL – Change of use and alterations to barns to form tearoom and retail space with gallery at Seaton Hall Farm, Staithes for Mr William Kidd, Seaton Hall, Staithes, North Yorkshire, TS13 5AT. Decision Approved as recommended. 6. NYM/2013/0270/CU – Use of land for the siting of 16 no. additional touring caravans at Golden Hill Farm, Liverton Road, Liverton for Ms C Hopkinson, Golden Hill Farm, Liverton Road, Liverton, , TS13 4TJ. Decision Consideration deferred to enable a site visit to be undertaken to enable Members to fully assess the visual impact of the proposal on the locality, with the attendance of Members being regarded as an approved duty for the purposes of the payment of Members’ allowances. 7. NYM/2013/0414/NM – Non material amendment to planning approval NYM/2012/0660/FL to allow removal of low level solar panels and relocation to roof together with reduction in size of glazing to south and east elevations at St Heddas Primary School, Egton Bridge for St Heddas Primary School, Egton Bridge, Whitby, North Yorkshire, YO21 1UX. Decision Ted Sanderson declared a personal interest in this item as a member of the Parish Council and due to his grand children attending the School. Approved as recommended. 8. NYM/2013/0389/FL – Construction of single storey rear extension and 1 no. dormer window to rear at 28 Castle Road, Thornton le Dale for Mr David Nasey, 28 Castle Road, Thornton le Dale, Pickering, YO18 7TR. Decision Approved as recommended. 9. NYM/2013/0431/FL – Variation of condition 1 (material amendment) of planning approval NYM/2008/0823/RM to allow construction of retaining wall to dwelling, alterations to hard surfaced area and alterations to the size and siting of agricultural building together with position of door to east elevation at land at south side, Alders Road, Rosedale, East for Mr & Mrs Barraclough, Dale Head Farm, Rosedale, Pickering, Y18 8RL. Decision Approved as recommended.
