Report No. 889/04 ANGUS COUNCIL DEVELOPMENT CONTROL COMMITTEE 19 AUGUST 2004 DELEGATED APPROVALS REPORT BY THE DIRECTOR OF PLANNING & TRANSPORT Abstract: This report recommends that the Committee notes the applications detailed in Appendix 1 of the report granted by the Director of Planning & Transport in accordance with the Scheme of Delegation detailed in Standing Orders. 1.0 RECOMMENDATION 1.1 The Committee is asked to note the applications, detailed in the Appendix, granted approval under delegated powers. 2.0 INTRODUCTION 2.1 In terms of the Scheme of Delegation to officers, the Director of Planning & Transport is authorised to approve planning applications in accordance with the Development Plan, the Local Plans or established policies and where there are no objections, except those which raise a general issue affecting a large area, or are of major land or economic development significance. 3.0 APPROVALS 3.1 Attached as an Appendix is a list of applications granted under delegated authority during the period 7 July 2004 to 11 August 2004. 4.0 FINANCIAL IMPLICATIONS 4.1 There are no financial implications. 5.0 HUMAN RIGHTS IMPLICATIONS 5.1 There are no Human Rights issues arising directly as a result of this report. 6.0 CONSULTATION 6.1 The Chief Executive, Director of Law & Administration and Director of Roads have been consulted in the preparation of this report. Uniform\DCDELGAT Report No. 889/04 ANGUS COUNCIL DEVELOPMENT CONTROL COMMITTEE LIST ‘A’ - DELEGATED APPROVALS Application No. Promoter Location 04/00152/OUT Miss N J Davidson Outline Erection of a Dwellinghouse at:- Land at Bog Road Brechin Angus DD9 7AL Conditions 1 That the approval of the details of the siting, size, height, design, drainage and external appearance of the building(s) and the means of access thereto, shall be obtained from the Planning Authority before any development is commenced. 2 That the application for approval of the reserved matters specified herewith shall be made to the Planning Authority before:- (a) the expiration of three years from the date of the grant of outline planning permission; (b) the expiration of six months from the date on which an earlier application for reserved matters approval was refused; or (c) the expiration of six months from the date on which an appeal against such refusal was dismissed, whichever is the latest. Only one application for approval of reserved matters (under (b) or (c) above) may be made after the expiration of a three year period mentioned in sub-section (a). 3 That the development hereby approved must be begun not later than:- (a) the expiration of five years from the date of the grant of outline planning permission; (b) if later (under (b) or (c) in the above condition) the expiration of two years from the final approval of the reserved matters or, in the case of approval on different dates, the final approval of the last matter to be approved. 4 That no alterations or amendments be made to the details contained in the approved and docqueted plans unless so indicated by conditions attached to this consent or agreed in writing with the planning authority. 5 That provision be made within the site for the parking of two private cars per dwelling. 6 That a vehicular turning space be provided within the site to allow vehicles to enter and leave the site in a forward gear. Uniform\DCDELGAT Report No. 889/04 5 That the rainwater run-off from the dwellinghouse be directed to a soakaway system to the satisfaction of the building control authority. 6 That the part of the building to be removed shall be carefully demolished and stone stored on site for re-use on the new development 7 That prior to the commencement of the development, details of the means of site enclosure proposed to be used, shall be submitted for the prior approval of the planning authority and be erected on or before completion of the development. 8 That, prior to the occupation of the dwellinghouse, the car parking and turning area shall be completed to the satisfaction of the Director of Planning & Transport 9 That no development takes place until there has been submitted to and approved by the planning authority, a scheme of landscaping, including, where appropriate, an indication of all existing trees and hedgerows on the land and details of these to be retained and cleared, together with the measures for their protection in the course of development. 10 That all planting comprised in the approved details of landscaping be carried out in the first planting season following the completion of the development or at earlier stages and any plants or trees which within a period of five years from the commencement of the use die; are removed or become seriously damaged or diseased, shall be replaced in the next planting season with others of a similar size and species. 04/00286/FUL McDonald Contractors Extension to Student Accommodation at:- Ltd Crofts Carmyllie Arbroath Angus DD11 2RQ Conditions 1 That the development hereby permitted shall be begun before the expiration of five years from the date of this permission. 2 That no alterations or amendments be made to the details contained in the approved and docqueted plans unless so indicated by conditions attached to this consent or agreed in writing with the planning authority. 3 That the disposal of sewage effluent be in accordance with the standards required by the building control authority. 4 That the occupation of the premises hereby approved shall be by persons temporarily employed in agriculture or forestry work during the period May to October inclusive and at no other time without the prior written approval of the Director of Planning and Transport Uniform\DCDELGAT Report No. 889/04 04/00303/FUL M Griese Formation of a First Floor Flat at:- Coasters 11 Brownlow Place Ferryden Montrose Angus DD10 9RN Conditions 1 That the development hereby permitted shall be begun before the expiration of five years from the date of this permission. 2 That no alterations or amendments be made to the details contained in the approved and docqueted plans unless so indicated by conditions attached to this consent or agreed in writing with the planning authority. 3 That, prior to the commencement of works on site, details of proposed measures for Noise Attenuation shall be submitted for the approval of the Director of Planning & Transport 04/00314/LBC Mr & Mrs Hill Part Demolition of Existing Garage Store and Erection of a Dwellinghouse at:- Land at Chanonry Wynd Brechin Angus DD9 6JS Conditions 1 That the development hereby permitted shall be begun before the expiration of five years from the date of this permission. 2 That no alterations or amendments be made to the details contained in the approved and docqueted plans unless so indicated by conditions attached to this consent or agreed in writing with the planning authority. 3 That the roof and external wall finishes be agreed in consultation with and be to the satisfaction of the Director of Planning & Transport prior to the commencement of work. 4 That the windows shall be timber sash and case and painted and detailed specifications of same shall be submitted to and approved by the Director of Planning & Transport prior to installation. 5 That the rainwater run-off from the dwellinghouse be directed to a soakaway system to the satisfaction of the building control authority. 6 That the developer shall afford access at all reasonable times to any archaeological organisation acceptable to the planning authority and shall allow them to observe work in progress and record items of interest and finds.
