Suggested Motion THAT Committee of the Whole receive report CD-07-21, and implement the recommendations of the Waterfront and Parking Strategy;

AND THAT Committee of the Whole review and consider the draft bylaw to permit and regulate Kiteboarding from municipal property and forward to Council for adoption;

AND Further that Committee of the Whole consider the City of Parking and Boat Launch Program and determine if the Township of will opt in for the program in 2021.

Background & Discussion Review:

In 2020, with the COVID-19 Pandemic the Township of Ramara experienced a significant increase in use of its waterfront properties, parks, greenspaces and access points to Lakes Simcoe, Couchiching, St. John and Dalrymple. This increased use was directly attributed to the COVID-19 Pandemic, the provincial restrictions and emergency order regulations prohibiting many social gatherings, organized activities and sports. The Township experienced a significant increase in use of the noted areas and in some cases overcrowding and non-compliance with social distancing requirements occurred.

As a result, to ensure public safety and compliance with provincial and local health unit COVID-19 regulations the Township made the difficult decision in the summer of 2020, to close all primary waterfront parks, water access points and prohibited kiteboarding/kitesurfing from municipal lands. These areas and closures were enforced by the Township's Bylaw Enforcement Department with assistance from a contracted security provider.

Following the summer of 2020, staff undertook a review of the Township's water access points, waterfront amenities and facilities in order to provide Council with an overview and the framework for a new Waterfront and Parking Strategy for the summer of 2021, and beyond. As a result, Council has selected four primary locations for the focus of this strategy, with some additional secondary locations needing to be included within the strategy.

The following four (4) locations have been selected as the primary locations along the Ramara Waterfront:

The following locations have been identified as secondary locations within the Waterfront and Parking Strategy.

1. Bluebird Street (Municipal Parking Lot) 2. Florida Avenue (Municipal Waterfront Park) 3. The Steps (Municipal Waterfront Park) 4. Simcoe Road (Municipal Road Allowance at Lake Simcoe)

Waterfront and Parking Strategy Intent:

The intent of the new waterfront and parking strategy is to make improvements to the identified areas to ensure a shared, safe and enjoyable use of the Township's public places. These improvements are also designed to be compliant with COVID-19 protocols which will be required for the foreseeable future. These changes are intended to allow residents, seasonal residents and non-resident (visitors) the opportunity to enjoy our public spaces, but giving the Township the ability to manage, regulate and restrict access as required based on local, provincial and federal health requirements. These recommended improvements and changes will also facilitate contactless use and a safe environment for all users.

The intent of the plan is not to make significant physical changes in size, location or add large infrastructure to these waterfront areas, but to enhance a safe environment for those individuals who have traditionally used these areas.

The Waterfront Strategy was last presented to Committee of the Whole on March 1, 2021, and as a result further public meetings and consultations were deemed necessary to gain input, feedback and comments on the proposed plan.

On March 3, 2021, a public meeting was held on Zoom where numerous residents, stakeholders and members of the public participated in an open discussion regarding the locations, use, proposed regulations and parking. This public consultation process provided valuable information and input that has been incorporated into the revised plan.

Waterfront Strategy and Parking Plan by location:

In consultation with municipal departments, public and stakeholders, the following is the recommended physical changes, strategy and parking plan for to the primary waterfront areas:

1- Heritage Farms (Suntrac Drive) Boat Launch - Lake Simcoe

• The boat launch be maintained as currently configured • That parking be restricted at the boat launch to facilitate the launching and removal of boats or any other motorized or non-motorized watercraft (15 min loading/unloading zone) Page 3 of 29 Waterfront and Parking Strategy Final Report

• That the creation of paid (Honk Mobile) or permit parking spaces not be implemented at this location and parking restricted. • Boat Launch area signage with rules, regulations, safety guidelines and parking restrictions be posted • Permanent entrance barriers with COVID-19 signage to facilitate quick closures of the boat launch be installed • That a safety assessment be conducted to determine if the current boat launch is safe for use due to location, water depth and weather conditions on Lake Simcoe

2- Lagoon City Beach and Park - Lake Simcoe

• Increased off-street municipal parking lot area (across the street from the park on current green space) • Implementation of paid (Honk Mobile) and permit parking spaces in the municipal lots • Posted and clear parking restrictions to allow use of the Post mailboxes • On street Parking restrictions on Lake Avenue and Poplar Crescent • On Street Permit Parking Zone on Lake Avenue and Poplar Crescent • Parking Lot signage with rules, regulations and parking restrictions • Permanent entrance barriers with COVID-19 signage to facilitate quick closures of parking lots • Implementation of a Kiteboarding Bylaw to permit and regulate Kiteboarding • Installation of portable washrooms and waste receptacles for the summer season

3- Lovely Day Park and Boat Launch - Lake Simcoe with access to Lake Couchiching

• Implementation of paid (Honk Mobile) and permit parking spaces in the municipal lot • Parking Lot signage with rules, regulations and parking restrictions • Permanent entrance barriers with COVID-19 signage to facilitate quick closures of parking lots • Opening and maintenance of current municipal boat launch on the Winchester Street municipal road allowance (Lovely Day Park) • Budget consideration and construction/Installation of new municipal boat launch in 2022 on the Winchester Street road allowance • Budget consideration and construction of new larger municipal parking lot in conjunction with future park and infrastructure upgrades • Installation of portable washrooms and waste receptacles for the summer season 4- Poplar Lane Boat Launch (Green and Black River)

• The boat launch be maintained as currently configured • The boat launch and associated lands are not be used for the parking of vehicles • That parking be restricted at the boat launch to facilitate the launching and removal of boats or any other motorized or non-motorized watercraft (15 min loading/unloading zone) • That the creation of paid (Honk Mobile) or permit parking spaces not be implemented at this location and parking restricted. • That on street parking restrictions be implemented on Poplar Lane, Riverleigh Drive and Park Lane Crescent to permit the safe passage of vehicles, pedestrians and boat launch users • Parking Lot signage with rules, regulations and parking restrictions • Information/Safety signage with information about the river(s), speed limits, water current information and local day use parks/parking, etc, be posted. In consultation with municipal departments, public and stakeholders, the following is the recommended physical changes, strategy and parking plan for to the secondary waterfront areas:

1. Bluebird Street (Municipal Parking Lot)

• Implementation of paid (Honk Mobile) and permit parking spaces in the municipal lot • That on street parking restrictions be implemented on Bluebird Street to permit the safe passage of vehicles, pedestrians and parking lot/boat launch users • Parking Lot signage with rules, regulations and parking restrictions • Permanent entrance barriers with COVID-19 signage to facilitate quick closures of parking lots • Installation of portable washrooms and waste receptacles for the summer season 2. Florida Avenue (Municipal Waterfront Park)

• Implementation of paid (Honk Mobile) and permit parking spaces in the municipal lot • Implementation of specialized parking pass for residents with deeded access rights to be used when parking is permitted and during closures related to COVID-19 • That on street parking restrictions be implemented on Concession Road B, Florida Avenue and Spyglass Point Road to permit the safe passage of vehicles, pedestrians Park and parking lot users • New natural stone barricades to define parking lot and greenspace • Stone Barricades placed to provide access for the launching of non-motorized watercraft and accessibility for mobility devices and strollers • Stone Barricades to prevent motorized vehicles and recreational vehicles from entering the greenspace • Installation of a new permanent gate to allow emergency vehicle and maintenance access to the greenspace and water • Parking Lot signage with rules, regulations and parking restrictions • Permanent entrance barriers with COVID-19 signage to facilitate quick closures or restricted use of the parking lot • Installation of portable washrooms and waste receptacles for the summer season 3. The Steps (Municipal Waterfront Park)

• Implementation of permit parking only spaces in the municipal lot (Road Allowance) • Permanent No Parking zone has been enacted by Council on Ridge Avenue • Parking Lot and Park signage with rules, regulations and parking restrictions • Implementation of Kiteboarding Bylaw to prohibit the activity at all times • Posted “No Kiteboarding’ signage to be installed • Installation of portable washrooms and waste receptacles for the summer season

4. Simcoe Road (Municipal Road Allowance at Lake Simcoe)

Updated Parking Regulations:

It is recommended that the following updates to the parking bylaw be presented to council and implemented:

1- Municipal Parking Lots (Off Street Parking)

That the existing and proposed municipal parking lots located at Lagoon City Beach/Park, Bluebird Street, Lovely Day Park, Florida Avenue have the following posted parking restrictions:

• No overnight parking (10:00 pm to 7:00 am) • No Commercial Vehicle Parking • No unattached trailer parking • Valid Resident Parking Permit Required or • Payment of Daily Parking Fee

2- Municipal Boat Launches – Poplar Lane and Heritage Farms (Off Street Parking)

That the municipal boat launch located on Poplar Lane and Heritage Farms (Suntrac Drive) have the following posted parking restrictions:

• That all areas of the municipal road allowance and boat launch area be signed No Parking • That an area directly adjacent to the boat launch be signed and identified as active loading/unloading zone with a 15 minute maximum

3- On Street Parking Regulations

It is recommended that the Township's Parking Bylaw be amended to include the following restrictions on streets near the selected waterfront access points:

Township of Ramara Resident (Tax Payer) Parking Permits:

The Township has implemented a resident (tax payer) parking permit system. These resident parking passes can be used at all identified waterfront locations that have posted with permit required signs or on street locations where permit parking signs have been posted. The parking permits would be available to all property owners in the Township who could obtain a maximum of two (2) permits per property. In 2021, these permits be issued at no cost to residents and that a report be drafted following the summer of 2021, with recommendations on the permit system going forward. Each permit will be numbered, displayed on the rear view mirror of the vehicle and be assigned to a unique licence plate for use. The transfer of the parking permit between different vehicles would not be permitted.

In addition, to the standard resident parking passes, those residents who can demonstrate and provide documentation that they have deeded access to the Florida Avenue Municipal Park may apply for a special resident parking pass for this location.

Municipal Parking Lot Parking Fee:

It is recommended that the parking bylaw amendment include a daily parking and season pass rate for non-residents, visitors and vehicles not displaying a valid resident parking pass. The daily parking and season pass fees will be collected using a Honk Mobile, a contactless mobile parking program with vehicle operators being able to pay for parking on their mobile device when they arrive or pay in advance via a link on the Township's website. The payment of the daily parking fee or use of a season parking pass would only be valid in a municipal parking lot, use in designated on street permit parking areas would not be permitted. 2021 Parking Rates:

1- Daily Parking pass - $20.00 per vehicle 2- Season Parking Pass $200.00 per seasons pass

Municipal Waterfront Areas COVID-19 Protocols

In addition, it is recommended that as a result of current and possible future provincial COVID-19 restrictions that a Phased Closure Policy be adopted by Council for the Municipal Waterfront Areas:

Phase 1: All waterfront amenities, parks, beaches and parking lots are open for general use by residents, non-residents and visitors;

Phase 2: All waterfront amenities, parks and beaches are open for general use by residents, non-residents and visitors;

Municipal Parking Lots are only open to vehicles displaying a valid Resident Parking Pass Only. The purchase and use of daily or season parking passes is suspended.

The municipal waterfront zones are posted “Resident Parking Passes Only” at key intersections. All on street parking is restricted to vehicles displaying a valid resident parking passes.

The implementation of this restriction will limit access to all waterfront amenities for non-residents and visitors.

Phase 3: All waterfront amenities, municipal parks (waterfront and inland parks), beaches, boat launches and parking lots will be closed to all users. These municipal facilities will be barricaded to prevent access and use and municipal parks and beaches will also be fenced to prohibit access and use in accordance with any provincial emergency orders, public health guidelines and Township of Ramara Bylaw 2020.32, attached to this report.

The only exception will be access to the Florida Avenue Municipal Park for residents with deeded access displaying a valid special parking pass.

The recommendation of movement of the Township from a more or less restrict phase will be done in consultation with Provincial guidelines, public health recommendations and consultation with senior municipal staff.

Kiteboarding/Kitesurfing Bylaw Page 8 of 29 Waterfront and Parking Strategy Final Report

Following discussions with Township staff, stakeholders, and residents, it’s recommended that Township of Ramara Kiteboarding Bylaw 2020-53, be repealed and a Bylaw to Permit and Regulate Kiteboarding attached hereto be enacted.

Bylaw Highlights:

• Kiteboarding shall be permitted from Lagoon City Public Park and Beach; • Specific zones of the park have been designated for the rigging and access/exit points for Lake Simcoe; • Specific Zones have been dedicated to use by park/beach users; • Two (2) no kite zones have been established; • The bylaw and general safety rules have been developed in consultation and with assistance from stakeholders; • General safety rules provide protection for both kite boarders, park/beach and water users; • Kiteboarding at “The Steps” and Simcoe Road municipal road allowance (Lake Simcoe) will be prohibited at all times; • Kiteboarding will be permitted from all other municipal properties, road allowances and lands under its control, except from June 1st to September 30th annually;

Waterfront, Parking and COVID 19 Emergency Order Enforcement: The Bylaw Enforcement Department will play an active role in the enforcement of the new waterfront and parking strategy. The department has increased in full time compliment to three (3) officers and effective the first week of May an additional four (4) seasonal officers will be employed. This increase will give the department the ability to provide day, afternoon and evening shift coverage from Monday to Thursday, with the addition of overnight enforcement from Friday to Monday and on statutory holidays. The combination of full time and seasonal officers will provide the Township with the ability to pro- actively enforce the new parking regulations, paid parking requirements and any restrictions associated to COVID-19 and public health orders. These officers will also be responding to all general bylaw enforcement complaints including short-term rentals, noise, fireworks, littering, dumping, park use and others.

City of Orillia Waterfront Parking and Boat Launch Program – Summer 2021:

The City of Orillia has established a Waterfront Parking and Boat Launch Program for the summer of 2021. This program allows Orillia residents to obtain a resident parking permit allowing them to park and launch boats for free. The fee for non-residents and visitors is $50.00 a day to park and/or launch a boat.

The program also offers the opportunity to area municipalities (Oro-Medonte, Severn, Chippewas of Rama First Nation and Ramara) to opt-in to the parking and boat launching program. If the Township chooses to participate in this program we would be required to make a financial contribution of 50 cents per resident. Based on current census data provided by the City of Orillia the financial contribution required by the Township would be $4,744.00 (9488 residents). The City of Orillia would recognize the Township of Ramara Resident Parking passes and no additional administrative duties or impacts would be placed on the Township. It is recommended that Council consider its desire to participate in this program and make the required financial contribution. The program is further explained in the attached letter dated April 1, 2021.

Alternatives That the Township enforce its existing bylaws and regulations to regulate parking and use of its properties.

Financial Information The staffing resources to implement and enforce the proposed regulations have been budgeted for within the 2021 Municipal Budget.

If the Township opted in for the City of Orillia Waterfront Parking and Boat Launch program there would be a $4744.00 payment required to the City of Orillia.

THE CORPORATION OF THE TOWNSHIP OF RAMARA

BY-LAW NUMBER 2021.XX

BEING A BYLAW TO PERMIT AND REGULATE KITESURFING FROM MUNICIPAL PROPERTY

WHEREAS Section 8 (1) of the Municipal Act provides that the powers of a municipality under this or any other Act shall be interpreted broadly so as to confer broad authority on the municipality to enable the municipality to govern its affairs as it considers appropriate and to enhance the municipality’s ability to respond to municipal issues.

AND WHEREAS Section 9 of the Ontario Municipal Act, 2001 states the municipality has the capacity, rights, powers and privileges of a natural person for the purpose of exercising its authority under this or any other Act. 2006;

AND WHEREAS Council deems it necessary to the health, safety and welfare of residents and visitors to control and regulate the use of Township beaches, Township parks, Township road allowance and all municipal property for recreational purposes;

NOW THEREFORE the Council of the Corporation of the Township of Ramara enacts as follows:

PART 1 – DEFINITIONS

1. For the purpose of this By-law:

a. “Bylaw Enforcement Officer” means a person appointed by Council to enforce municipal bylaws.

b. “Kitesurfing” means the sport of riding on a small surfboard that is propelled across water by a large kite to which the rider is harnessed and also includes kiteboarding.

c. "Kitesurfing or Kiteboarding equipment” means any equipment used for kitesurfing and includes but is not limited to kites, boards, harnesses, equipment bags, bars, trainer kites, masts and bridles. Page 12 of 29

d. "Municipal property” includes a park, beach, road allowance, boat launch or any property owned or under the control of the Township of Ramara.

e. “Township” means The Corporation of the Township of Ramara

PART II - APPLICATION OF THE BYLAW

2. This By-law applies to all Municipal Property or lands owned by the Corporation of the Township of Ramara or under its management and control.

PART III – REGULATIONS

3. Regulations

I. Permitted Locations:

a. Kitesurfing is permitted from the Lagoon City Public Park and Beach at all times subject to the rules and regulations as set out in Schedule A of this bylaw.

II. Regulated Locations:

a. Kitesurfing is permitted from all other Municipal Property, subject to the following regulations;

i. No person shall use any Municipal Property for staging or as a launching area to access the water for the purpose of kitesurfing between June 1st and September 30th annually;

ii. No person shall use any Municipal Property listed in Schedule B of this by-law as a staging or launching area to access the water for the purpose of kitesurfing at any time;

iii. No person shall unload, store, set up, dry or place any kitesurfing equipment on any municipal property listed in Schedule B of this bylaw at any time;

iv. No person shall use any Municipal Property listed In Schedule B of this bylaw to offer kitesurfing lessons or training at any time; Page 13 of 29

PART IV- ENFORCEMENT AND PENALTIES

4. This bylaw shall be enforced by a Bylaw Enforcement Officer;

5. Every person who is convicted of an offence is liable to a fine in the amount of $1,000.00, exclusive of costs, or otherwise as provided for in the Provincial Offences Act, R.S.O. 1990, c. P.33, as amended.

6. When a person has been convicted of an offence under this By-law,

a. the Superior Court of Justice, or

b. Any Court of competent jurisdiction thereafter, May, in addition to any penalty imposed on the person convicted, issue an order prohibiting the continuation or repetition of the offence or the doing of any act or thing by the person convicted directed toward the continuation or repetition of the offence.

PART V – SEVERABILITY

7. If a court of competent jurisdiction should declare any section or part of a section of this By-law to be invalid the remainder of this By-law shall continue to be valid and remain in force.

PART VI – SHORT TITLE

8. This Bylaw may be referred to as the “Kitesurfing” Bylaw.

PART VII – EFFECTIVE DATE

9. This Bylaw comes into force on the day it is passed.

BEING A BYLAW TO PERMIT AND REGULATE KITESURFING FROM MUNICIPAL PROPERTY

1. Permitted Locations – Lagoon City Public Park and Beach;

a. Kitesurfing is permitted at Lagoon City Park and Beach at all times subject to the rules and regulations as set out in this schedule;

i. No person shall use any portion of the Lagoon City Public Park and Beach for launching, accessing or exiting of Lake Simcoe for kitesurfing, except from the designated and posted Entry/Exit zone;

ii. No person shall unload, store, set up, dry or place any kitesurfing equipment on any portion of the Lagoon City Public Park and Beach, except in the designated and posted Rigging Zone;

iii. No Person shall launch or land a kite within 25 metres of any tree, building, utility pole, or person; except when that person is assisting in safe launching and landing procedure, or should a navigation emergency occur.

iv. No person shall advertise or use any portion of the Lagoon City Public Park and Beach as their primary business location for a kitesurfing school or lessons, except under the following conditions;

1) A kitesurfing school or instructor may provide instruction or lessons using the Lagoon City Public Park and Beach as a launching point only, subject to them complying with all requirements of this bylaw and schedules.

v. No person shall access or use the designated kitesurfing Rigging or Entry/Exit Zones prior to the opening or after the closing of the Lagoon City Public Park and Beach as posted by official sign.

b. The following map(s) shall establish the areas for kiteboarding at the Lagoon City Public Park and Beach; Page 16 of 29

c. Lagoon City Public Park and Beach Kiteboarding Rules:

Green Rigging/Drying Zone: 1. No assembled kites or lines should be left unattended on the ground unless during rigging or drying. 2. De-rigging and drying of kites should be at the back of the Rigging/Drying Zone. 3. Inflate only one kite per person at a time. 4. During busy times it is recommended to help others for faster setup. 5. Lagoon City Public Park and Beach Kiteboarding Rules:

Green Rigging/Drying Zone:

1. No assembled kites or lines should be left unattended on the ground unless during rigging or drying. 2. De-rigging and drying of kites should be at the back of the Rigging/Drying Zone. 3. Re: City of Orillia Waterfront Parking and Boat Launch Program - Summer 2021

Please note that Orillia City Council, at its meeting held on March 29, 2021, established a 2021 Waterfront Parking and Boat Launch program. The purpose of the program is to ensure the health and safety of the community, manage crowd control at Orillia’s waterfronts and discourage travel to Orillia from other more restrictive colour zones.

The program was established to include residents from the Townships of Oro-Medonte, Severn, Ramara and the Chippewas of Rama First Nation who display a permit issued by their municipality. Participation is contingent on a financial contribution of 50 cents per resident of each of the respective municipalities. Based on current census data, the Township of Ramara’s financial contribution would be $4,744 (2016 Census Data: 9488 residents).

Further details regarding the program are enclosed. Should the Township of Ramara wish to participate in the program, please advise my office by April 30, 2021.

Program Duration:

The program will run from approximately June 1, 2021 to September 15, 2021 on Friday through Sunday and statutory holidays. The program will be monitored by the City’s Emergency Management Committee and the duration of the program may be reduced should the situation warrant.

Program Locations:

The parking locations for the program are: Couchiching Beach Park, Centennial Park, Veterans’ Memorial Park, J.B. Tudhope Memorial Park, as well as the surrounding streets. The Couchiching Beach Park and Collins Drive boat launches are also included in the program. Other locations may be considered and added to the program on an as needed basis. Visitors to the City will only be able to park in peripheral lots at the downtown waterfront area and J.B. Tudhope Memorial Park.

Fees:

Orillia residents are required to obtain a Resident Parking Permit which will permit them to park and launch their boats for free. Non-residents are required to pay $50 per day to park in limited parking areas, and $50 per day to launch boats.

Surrounding Communities

Orillia City Council supported the hiring of a Waterfront Park/Boat Launch Manager as well as a prominent and proactive by-law enforcement presence in the waterfront parks this summer.
