NO. 14-3740 CUSTOMERS BANK, Defendant. OPINION Slomsky, J. June 6, 2017 I. INTRODUCTION AND BACKGROUND Plaintiff Robert D. Sayre was employed by ISN Bank (“ISN”), the predecessor of Defendant Customers Bank (“Customers”), as Vice President and Counsel from June 20, 2005 through March 31, 2010. (Sayre Tr., 37:20, 38:10-19, Sept. 19, 2016.) During his employment, Plaintiff received a home equity mortgage loan from ISN. (Exs. J-2, J-3.) While Plaintiff was making timely monthly payments on the mortgage, he was terminated as an employee and did not receive what he believed to be a previously negotiated severance package. (Sayre Tr., 48:11- 14, Sept. 19, 2016.) As a result, Plaintiff felt that he had the right to set-off against his mortgage obligation the amount of the severance package that was owed to him.1 Defendant refused to 1 Set-offs are often used when attempting to end a financial obligation. A set-off has been described as follows: A [s]et-off signifies the subtraction or taking away of one demand from another opposite or cross demand, so as to distinguish the smaller demand and reduce the greater by the amount of the less; or, if the opposite demands are equal, to extinguish both. Protecting Postmodern Historicism: Identification, vE aluation, and Prescriptions for Preeminent Sites Abstract Just as architectural history traditionally takes the form of a march of styles, so too do preservationists repeatedly campaign to save seminal works of an architectural manner several decades after its period of prominence. This is currently happening with New Brutalism and given its age and current unpopularity will likely soon befall postmodern historicism. In hopes of preventing the loss of any of the manner’s preeminent works, this study provides professionals with a framework for evaluating the significance of postmodern historicist designs in relation to one another. Through this, the limited resources required for large-scale preservation campaigns can be correctly dedicated to the most emblematic sites. Three case studies demonstrate the application of these criteria and an extended look at recent preservation campaigns provides lessons in how to best proactively preserve unpopular sites. -

Led by U.S. Conference of Mayors President Miami Mayor Manny Diaz, over 60 mayors will also meet with Attorney General Eric H. Holder, Jr., Housing and Urban Development Secretary Shaun Donovan, Transportation Secretary Ray LaHood, Energy Secretary Dr. Steven Chu, Education Secretary Arne Duncan and White House Senior Staff. The mayors meeting with President Obama and Vice President Biden will take place from 10:30 a.m. to 11:15 a.m. in the East Room of the White House and will be OPEN to the press. The mayors will also hold a press availability at the White House at 11:30 a.m. immediately following the meeting (location is TBD). Welcome to the Institute of Politics at Harvard University Trey Grayson, Director The 2012 election cycle is in high gear, and the past six months have been fast- paced at the Institute. As you will note in this newsletter, the IOP has been at the forefront of election and campaign-related programming, with events, conferences and younger voter research unavailable anywhere else. One of my biggest goals since beginning service as the Institute’s Director has been to improve how the IOP utilizes technology – in an effort to maximize efficiency internally and best distribute and share our content externally to audiences inter- ested in politics and public service. Race Relations in Boston: a Tale of Two Mayors, Raymond L. Flynn and Thomas M. Menino Ronda Jackson and Christopher Winship The Stuart Incident On October 23, 1989, Charles Stuart, a white, 30-year-old furrier, living in suburban Reading, Massachusetts, made a desperate 9-1-1 call to the Boston Police dispatcher. He reported that he had been shot. His wife, Carol Stuart, a lawyer, seven-months pregnant at the time, had also been shot, and was in the passenger’s seat next to him bleeding and unconscious. Though frightened and in shock, Stuart was able to provide some details of the crime. He told the dispatcher that he and his wife had just left a birthing class at a nearby hospital and gotten into their car parked near the Mission Hill housing project when a young black man in a hooded sweatshirt robbed and shot them both. The dispatcher stayed on the line with Stuart while police cruisers in the area found the Stuarts’ car and the two wounded victims.1 The Stuarts were rushed back to the same hospital where they had attended Lamaze class. Doctors performed an emergency c-section on Carol to remove the baby and, hopefully, save her life. Baby Christopher was put in the intensive care unit, but died 17 days later. Carol Stuart died six hours after the surgery. After giving police his account of the events, Charles Stuart was rushed into emergency surgery. He survived the surgery, but then went into a coma for several weeks after the shooting.2 Mayor Raymond Flynn and Police Commissioner Mickey Roache were immediately told of the shootings. -

Birth to Eight Collaborative Early Childhood Mayoral Recommendations These attached Mayoral Recommendations were created by the Birth to Eight Collaborative based on the goals developed by the Collaborative, the work we have engaged in together over the past five years and what we have learned during the pandemic. Draft recommendations were discussed at a collaborative wide meeting in April, updated with the convening feedback in May, and distributed to the membership for comment and sign on in June. The final recommendations were then shared in July with the campaigns of all six candidates for Mayor of the City of Boston. As of July 29, 2021, the five candidates have endorsed the recommendations. INTRODUCTION All political scientists who study education policy start their analysis with a similar premise: “educational reform does not take place in political vacuum.”1 Studies of the politics of school choice have focused primarily on state-level political dynamics (Mintrom 2000, Henig, et. al. 2002, Wong & Shen 2004). This line of research makes sense since the charter school market is initially created and subsequently altered by the state legislature. In this paper, however, we break from this trend and focus our attention on local government and the politics of school choice. Specifically, we examine the relationship between school choice and big city mayors. Our preliminary analysis finds that mayoral positions on school choice is influenced not only the existing legislation governing school choice in their city, but also by their city’s size and racial composition. Although the state legislature writes the charter school or voucher laws, mayors play important roles in the legislative and policy enactment process. At the legislative level, mayors can influence the type of laws that are enacted by working with state legislators and lobbying for more choice options. -

Robert White appeals the district court ruling denying his application for postconviction relief. White argues his trial counsel was ineffective for failing to depose or question the affiant of a search warrant and for failing to effectively cross-examine a key witness. Because we find counsel was not ineffective, we affirm. I. Background Facts and Proceedings On September 23, 2008, Robert White was charged with conspiracy to deliver a controlled substance as a second offender, possession of a controlled substance with intent to deliver, and failure to possess a drug tax stamp, each with the sentencing enhancement of being a habitual offender. A jury convicted him of all three charges and being a habitual offender. White was sentenced to an indeterminate forty-five-year prison term. Following his conviction White appealed and challenged the district court’s denial of his motion to suppress and motion in limine.1 See State v.
