This Act is administered in the Ministry of Foreign Affairs and Trade. 1 Reprinted as at Niue Amendment Act 1970 20 September 2007 15 Public purpose for which land held may be altered or 4 cancelled 16 Adoption orders 4 An Act to amend the Niue Act 1966 1 Short Title This Act may be cited as the Niue Amendment Act 1970, and shall be read together with and deemed part of the Niue Act 1966 (hereinafter referred to as the principal Act). Part 1 Minerals 2 Interpretation In this Part of this Act, unless the context otherwise requires,— Minerals means all minerals, mineral substances, gold, sil ver, precious metals, ferrous metals, nonferrous metals, baux ite, phosphate, phosphate rock, diatomaceous earth, limestone, marble, coal, bitumen, lignite, precious stones, and petroleum existing in their natural state on or under the surface of any land; and includes any other substance existing in its natural state on or under the surface of any land which the Cabinet of Ministers from time to time, by notice in the Niue Island Gazette, declares to be a mineral for the purpose of this Part of this Act; but does not include— (a) Any coral, common clay, common sand, common gravel, common stone, or common earth; or (b) Any prescribed substance within the meaning of the Atomic Energy Act 1945: Minerals: the words “the Cabinet of Ministers” were substituted, as from 19 October 1974, for the words “the Resident Commissioner” by section 2(2)(c) Niue Amendment Act 1974 (1974 No 43). Petroleum includes any mineral oil or relative hydrocarbon and natural gas existing in its natural condition in strata; but does not include coal, helium, or bituminous shales, or other 2 Reprinted as at 20 September 2007 Niue Amendment Act 1970 Part 2 s 10 stratified deposits from which oil can be extracted by destruc tive distillation. 3 Prospecting for and mining minerals The Niue Assembly may, by Act of the Niue Assembly, make provision for prospecting for and mining minerals (including minerals in the seabed or subsoil of the continental shelf of Niue), for the vesting of any minerals or classes of minerals in the Crown, and for any other like or related purposes. The words “The Niue Assembly” were substituted, as from 19 October 1974, for the words “The Niue Island Assembly” pursuant to section 2(2)(d) Niue Amendment Act 1974 (1974 No 43). The words “Act of the Niue Assembly” were substituted, as from 19 October 1974, for the word “Ordinance” pursuant to section 2(2)(e) Niue Amendment Act 1974 (1974 No 43). Part 2 5 Miscellaneous amendments Section 5 was repealed, as from 9 December 1971, by section 18(5) Niue Amendment Act 1971 (1971 No 143). 6 Section 6 was repealed, as from 19 October 1974, by section 3(1) Niue Amend ment Act 1974. See regulation 2 Niue Constitution Act Commencement Order 1974 (1974 No 43). 7 8 9 10 Resident Commissioner may cultivate land on behalf of owners (1) This subsection substituted a new subsection for subs (4) of s 462 of the principal Act. (2) The Schedule to the Niue Amendment Act (No 2) 1968 is hereby consequentially amended by repealing so much thereof as relates to subsection (4) of section 462 of the principal Act. 3 Reprinted as at Part 2 s 11 Niue Amendment Act 1970 20 September 2007 11 Section 11 was repealed, as from 19 October 1974, by section 3(1) Niue Amend ment Act 1974. (b) This paragraph amended s 17 Niue Amendment Act (No 2) 1968 (1968 No 132). (2) Section 15 of the Niue Amendment Act (No 2) 1968 is hereby repealed. 16 Adoption orders (1) This subsection amended s 99 Niue Amendment Act (No 2) 1968 (1968 No 132). (2) (a) This paragraph amended s 100(5) Niue Amendment Act (No 2) 1968 (1968 No 132).
