RE: Notification for Draft Clean Air Act (CAA) Tribal Minor New Source Review (NSR) Permit for the Choctaw Casino Resort Durant (Choctaw Durant Casino) Expansion; Draft Proposed Permit No. R6NSR-OK-001.

Dear Governor Anoatubby:

The purpose of this letter is to notify the that the United States Environmental Protection Agency (EPA) will be proposing a tribal minor NSR permit for the Choctaw Durant Casino (Casino). The minor NSR permit is for the proposed expansion that will increase emissions from the existing Casino operations. The emission sources include new (in addition to the existing) emergency generators and boilers/heaters necessary for the Casino operations.

On April 2, 2020, EPA determined that the permit applications submitted by the Choctaw Durant Casino were administratively complete. The Choctaw Nation provided applications for the existing emission sources and also the new emission sources at the Casino. The existing units will be grandfathered into the tribal minor NSR permit and the new units will have permit limits to ensure continued operations do not exceed the major source emission thresholds. In addition, the permit will have practically enforceable conditions on the testing of the engines such that there should be a minimal impact to the current national ambient air quality standards compliance in the area. The increased emissions from the four (4) new diesel generator engines and fifteen (15) new small boilers are, in tons per year (tpy): 3.43 of Particulate Matter 10 microns or less (PM10) and Particulate Matter 2.5 microns or less (PM2.5), combined; 0.11 of Sulfur Dioxide (SO2); 55.62 of Nitrogen Oxides (NOx); 39.36 of Carbon Monoxide (CO); 4.87 of Volatile Organic Compound (VOC); and 0.001 of Hazardous Air Pollutant (HAP).

EPA expects to electronically publish the public notice for the Choctaw Durant Casino tribal minor NSR permit on our EPA website, www.epa.gov/publicnotices, on July 31, 2020. The application, the proposed permit, and all other documents pertaining to this permit action, will be included in Docket No. EPA-R06-OAR-2020-0376, on the www.regulations.gov website, starting on July 31, 2020.

In accordance with 40 CFR § 49.157(a)(iii), EPA is providing notice that the Choctaw Nation of Oklahoma (Choctaw Nation) has submitted an application for a minor New Source Review (NSR) construction permit for the expansion of the Choctaw Durant Casino. EPA determined the application to be administratively complete on April 2, 2020, and plans to place the draft minor NSR permit on public notice July 31, 2020. The application and all other documents pertaining to this permit action can be found in the docket, No. EPA-R06-OAR-2020-0376, on the Regulations.gov website at: https://www.regulations.gov/ .
