The attorney for the nudists now wants it determined if that also dismisses the disorderly conduct charges. In any event, according to attorney Stuart M. Pepper, the dismissal of the nude statute charges makes it obvious that law cannot be used by police against people wanting to sunbathe nude on Bowman's Beach. Three individuals had pled not guilty after being charged on April 11 with being nude on Bowman's Beach. They were charged under a law making illegal lewd and lascivious nudity. Pepper argued before County Judge Radford S. Sturgis on May 17 that his three clients were only nude and that legal precedent going back more than a decade indicates Phot by Kathleen Blase that it is not illegal under the state statute to be nude if nothing lewd or lascivious is being done. DNR concerned about road kills in state's parks According to the Florida Department of Natural Resources, more than 3,090 mammals, birds and reptiles were killed by vehicles in 64 state parks in 1992. And the toll no doubt was much higher throughout the rest of the 148-unit state park system, officials said, because of the number of animal deaths that were not reported when animals left the roadway before they died or when dead animals were scavenged before being count- ed. Most road kills occurred on highways that pass through state parks or on roads that border state park boundaries. Those roads have a much higher volume of traffic and higher speed limits than park roads. Conversely, according to Lou Hinds, the manager of the J.N. "Ding" Darling National Wildlife Refuge, there are few animals or birds killed on Wildlife Drive because of the type of road it is and because of the strict speed lim- its there. Wildlife Drive is a shell road that winds its way through the refuge. Both conditions virtually prohibit speeding, thus allowing for safer passage by animals and birds. Sanibel-Captiva Road, however, is another story. The old tree has been virtually washed clean by the sun, wind and waves, leaving only the bare wood behind. In the 64 state parks which tallied animal road kills, deer and tortoises led the death count. Thirty-eight deer were reported killed by vehicles; 36 gopher tortoises lost their lives.
