We are pleased to submit this Environmental Audit report for a statutory audit of land at 5 Leah Avenue, Upwey, Victoria. The Environmental Audit is required by the Shire of Yarra Ranges prior to the planned redevelopment of the site for a residential use.

The land subject to the statutory audit is identified on Plan of Consolidation No. 101675, Parish of Narree Worran, County of Mornington in Certificate of Title Volume 9003, Folio 104. The land subject to audit is undergoing a two staged subdivision into four allotments and one reserve. These are described as Lots 1-4 and a Reserve for Public Open Space on proposed Plan of Subdivision PS 421418Q.\Stage- 1 is comprised of Lot 3 and Lot $whils@ge 2 is comprised of Lots and 2 and the Reserve for Public Open Spacg For the purpose of the audit report the land subject to audit is referred to as two sites, comprising the Stage 1 site (Lots 3 and 4) and the Stage 2 site (Lots 1,2 and the Reserve).

Mr Peter J Ramsay received a request on 27 January 1997 from Mr Jon Slykerman to issue a Certificate of Environmental Audit for land at 5 Leah Avenue, Upwey, Victoria. The audit was in accordance with Section 57AA of the Environment Protection Act 1970. As required under Section 57AA(5)(a) of the Environment Protection Act 1970 one copy of the final report has been transmitted to the Environment Protection Authority.

Environmental assessments of the land subject to the statutory audit were undertaken by GeoPollution Management Pty Ltd (GPM) between February 1997 and December 1998. The assessments were performed in accordance with the recommended approach to assessing contaminated sites contained in:

0 Australian and New Zealand Guidelines for the Assessment and Management of Contaminated Sites, issued by the Australian and New Zealand Environment and Conservation CounciVNational Health and Medical Research Council, January 1992 (ANZECC guidelines);

0 Australian Standard AS 4482.1 - 1997, Guide to the Sampling and lnvestigation of Potentially Contaminated Soil, Part 1: Non-Volatile and Semi-volatile Compounds, 5 September 1997, Standards .

The auditor’s requirements for the assessments and the acceptance criteria for the audit were specified by the auditor in our correspondence of 3,7 and 25 February, 7 and 16 April, 6 June and 5 August 1997, and 20 August 1998 to you and GPM. Further analysis of samples from the assessment was also performed in response to the auditor’s requests.

On the basis of.my evaluation of the site conditions as described in the audit report, I am of the opinion that the condition of the Stage 1 site described as Lots 3 and 4 on proposed Plan of Subdivision Stage 1 PS 421418Q at 5 Leah Avenue, Upwey, Victoria on 25 March 1999 is neither detrimental nor potentially detrimental to any beneficial use of the land at Lots 3 and 4. Therefore a Certificate of Environmental Audit has been issued for the Stage 1 site (Lots 3 and 4).

In addition, based on my evaluation of the site conditions as described in the audit report, I am of the opinion that the condition of the Stage 2 site described as Lots 1 and 2 and Reserve for Public Open Space on proposed Plan of Subdivision Stage 2 PS 4214186 at 5 Leah Avenue, Upwey, Victoria on 25 March 1999 is potentially detrimental to the beneficial use of the land at Lots 1 and 2. Therefore a Statement of Environmental Audit has been issued for the Stage 2 site (Lots 1,2 and the Reserve).

The contaminant concentrations in portions of the site exceed guideline values whch are considered to be acceptable for all beneficial uses (eg. residential).

1. SCOPE OF THE ENVIRONMENTAL AUDIT

The land subject to the environmental audit is located at 5 Leah Avenue, Upwey, Victoria. The scope of the environmental audit of land pursuant to Section 57AA of the Environment Protection Act 7970 included:

2. INTRODUCTION

On 21 January 1997, Mr Jon Slykerman of Slykerman’s Nurseries engaged Peter J Ramsay & Associates to perform an environmental audit of land pursuant to Section 57AA(1) of the Environment Protection Act 1970. The land subject to this audit is located at 5 Leah Avenue, Upwey, Victoria. The land has a total area of 8 788 m2.

The owners of the land subject to audit, Mr Jon and Mrs Allison Slykerman, are planning a staged subdivision of the land into four allotments for residential use and a Reserve for Public Open Space. A Certificate of Environmental Audit or a Statement of Environmental Audit is required to be issued for the land in accordance with Section 57AA of the Environment Protection Act 1970 to allow the land to be subdivided and developed for residential purposes.

As the land has been used for industrial/ commercial purposes, prior to any development of the land for residential use the planning authority requires that a Statutory Environmental Audit be performed by an environmental auditor appointed under Section 57AA of the Environment Protection Act 1970. This complies with Ministerial Direction No. 1 and would satisfy the planning authority that the environmental condition of the land is suitable for its intended use.

Mr Jon Slykerman of Slykerman’s ‘Nurseries requested on 21 January 1997 (received on 27 January 1997) that Mr Peter Ramsay undertake a statutory environmental audit for the land prior to the planned subdivision of the land. Mr Ramsay subsequently informed the EPA on 29 January 1997 of the request to issue a Certificate of Environmental Audit. A copy of Mr Ramsay’s letter of notification to the EPA of 29 January 1997 and the EPA‘s response of 30 January 1997 are presented in Appendix B. Mr Ramsay subsequently informed Slykerman’s Nurseries and GPM of the requirements for the audit on 3,7 and 25 February, 7 and 16 April, 6 June and 5 August 1997, and 20 August 1998 (Appendix C).

An initial assessment of the land was undertaken in February 1997 by GPM for the statutory audit. Further soil sampling and analysis programs were performed by GPM periodically up to July 1997. GPM prepared a final site assessment report on 14 December 1998. The report presented the results of the assessments. GPM’s final report is entitled: Environmental Site Assessment of Stage 1 and 2 Subdivision - Former Wholesale Nursery, 5 Leah Avenue, Upwey. Prepared for Slykennan’s Nurseries, 14th December 1998. A copy of the report is presented in Appendix D.

2.1 Beneficial Uses

According to EPA guidelines the beneficial uses that are to be protected in order to satisfy the requirements for a Cedificate of Environmental Audit are:

4. SITE DESCRIPTION

The land subject to audit was inspected by Peter J Ramsay & Associates on 31 January 1997. The land subject to the audit is 8 788 m2 in size and located at 5 Leah Avenue, Upwey, Victoria. The land was still operating as a nursery at the time of the audit. The land is shown in Figure 2.

The land is occupied by numerous buildings including the manager’s residence/ofke, greenhouses and sheds. Other features include the pesticide storage cupboard, mechanised soil mixer and above ground diesel storage tank (AGST). The site is mostly covered with gravel and crushed rock with the exception of some grassed areas as noted in GPM’s report and heavily wooded land in the south of the site. Ferny Creek forms the northern boundary of the land. Adjacent land uses are residential. The features of the land are further described in GPM’s report.

The plans of subdivision (Plan Number PS 421418Q in Appendix A) show that in Stage 1, the land will be subdivided into Lots 3, 4, S2 and Reserve No. 1 for Public Open Space. In Stage 2, Lot S2 will be subdivided to become Lots 1 and 2. However, Peter J Ramsay & Associates has been advised by Mr Jon Slykerman on 18 March 1999 that the Reserve for Public Open Space will now be created in Stage 2, rather than in Stage 1. That is, Lots 3, 4 and S2 will be created in Stage 1, and Lot 52 will become Lots 1 and 2 and a Reserve for Public Open Space in Stage 2.

4.1 Geology and Hydrogeology

The Geological Survey of Victoria, 1 :63 360 Ringwood Sheet, indicates that the land is situated on the Devonian Age ‘Ferny Creek Rhyodacite’ belonging to the Mount Dandenong Volcanics Group.

The soil profile at the land has been determined from auger boreholes drilled at the land by GPM. The soil profile encountered at the land is described in GPM’s report and is comprised of a

, shallow fill layer overlying natural soil. The surface layer of fill (between 0.05 m and 1 m thick) was encountered in all except four boreholes drilled at the site and consists of gravel, sand, silt and clay. Some industrial wastes including sawdust, timber, plastic and coke were present in the fill. The natural soil profile consists of light to dark grey silty clay and clayey silt. The natural soil is consistent with residual soil developed on the Ferny Creek Rhyodacite and alluvium from Ferny Creek.

Perched groundwater and the regional groundwater were not encountered during the ’ assessments performed at the land. GPM’s report states that the groundwater in the area is likely to flow towards Ferny Creek at the northern site boundary.

4.2 Potential for Contamination from Off-Site Sources

No evidence of potential contamination resulting from leachates or wastes entering the land from adjacent properties was indicated during our inspection or in GPM’s report. However, fill used on the premises when the property was originally developed had the potential to be contaminated.

5. SITE HISTORY

Certificate of Title documentation and aerial photographs were reviewed by GPM and the results are presented in their final site assessment report (Appendix D). Further information on the site history was also sought by GPM from Mr Jon Slykerman.

5.1 Previous Land Use

GPM state that the land has been occupied by Slykerman’s Nursery for approximately 40 years.

No underground facilities were identified by GPM on the land.

From the auditor’s review of the site history information potential contaminants which may have been associated with activities on the land are considered to be:

0 Heavy metals from the application of fertilisers;

0 Organochlorine pesticides and herbicides from the storage, mixing and application of the pesticides and herbicides; Heavy metals and organic contaminants potentially present in the fill; and

0 Total petroleum hydrocarbons and monocyclic aromatic hydrocarbons from the storage and use of small quantities of fuels.

5.2 Previous Assessments of the Site

No previous soil contamination assessments are known to have been performed on the land prior to the contamination assessment performed for the audit.

5.3 Priority Sites Register

The land subject to the audit is not listed in the 24 December 1997 edition of the EPA’s Prionty Sites Register or the EPA’s 4 January 1999 listing of .properties for which a Certificate or Statement of Environmental Audit has been issued.

6. ASSESSMENT OF LAND

An initial contamination assessment of the land and further soil sampling and analysis was performed for the statutory audit by GPM between February 1997 and December 1998.

In accordance with EPA Guidelines for Environmental Auditors (EPA 1992b and 1995a-c), the initial assessment and further sampling programs are reviewed in Section 6.1 of this audit report.

t 6.1 Contamination Assessment for the Environmental Audit

Report Title: Environmental Site Assessment of Stage 1 and 2 Subdivision - Former Wholesale Nursery, 5 Leah Avenue, Upwey. Prepared for Slykerman’s Nurseries, 14th December 1998. Environmental Assessor: GeoPollution Management Pty Ltd. Dates of Field Investigation: 10 and 11 February 1997, periodically between 29 April and 2 July 1997. Analytical Laboratories: Primary Laboratory: WSL Consultants Pty Ltd. Secondary Laboratory: MGT Environmental Consultants Pty Ltd. Type of Assessment: Initial Contamination Assessment and further sampling programs.

Scope and Methodology of the Contamination Assessment

The aim of the initial assessment undertaken for the audit was to determine if the soil on the land was chemically contaminated, to provide sufficient information for the purpose of completing a statutory environmental audit of the land, and to identify any underground facilities which could have caused site contamination. The auditor’s requirements are shown in Appendix C.

The assessment included a comprehensive screen for potential contaminants and a rigorous quality assurancelquality control (WQC) program including a split to a second laboratory to meet €PA requirements. -

The contamination assessment for the audit involved: A review of the site history; Preparation of a detailed Work Plan; Drilling of auger holes at 23 grid locations and three targeted locations and soil sampling from the 26 locations; Analysis of soil samples for a comprehensive suite of potential organic and inorganic contaminants; Further analysis of individual samples for organochlorine pesticides based on initial results; Further sampling and analysis of samples retrieved from 50 additional locations to delineate the extent and degree of contamination in areas identified from the initial results as being contaminated; and Implementation of field QNQC programs to determine the accuracy and precision of the sampling and analytical programs. This included the use of the primary laboratory and a secondary laboratory. Four individual samples and one three-part composite sample were split in the field and sent to the secondary laboratory as QA duplicate samples for analysis. Six samples were split in the field and sent to the primary laboratory as QC duplicates for analysis.

Results and Conclusions

The analytical results for the soil samples retrieved during the initial Contamination assessment and further sampling and analysis programs are presented in Tables 6 to 1le in GPM's report (Appendix D). The analytical results for the soil samples were compared with the criteria contained in the ANZECC guidelines and the Victorian EPA's soil quality criteria for fill material and low level contaminated soil. QNQC results were also discussed in the GPM report.

The results of the initial assessment showed that elevated organochlorine pesticide concentrations in excess of the ANZECC environmental investigation threshold (ANZECC B level) ' criterion for total organochlorine pesticide of 1 mg/kg were present in samples retrieved predominantly from the near surface on Lots 1 and 2 and the Reserve (Stage 2 site). In response to the auditor's recommendations further sampling and analysis for organochlorine pesticides in the areas identied on he Stage 2 site was performed. The results of the further analyses (presented in Table lla to lle of GPM's report) showed that organochlorine pesticide concentrations in many of the samples were significantly above the ANZECC B level. These were- in one area on Lot 1, three areas on Lot 2 and one area on the Reserve.

The maximum total organochldrine pesticide concentrations measured in the samples from each area were 1.8 mg/kg, 40 mg/kg, 4.6 mg/kg, 11 mg/kg and 14 mg/kg respectively. These were inside a glasshouse on Lot 1 and inside and adjacent to a small plastic house, plant dispatch area and glasshouse on Lot 2 and at the compost heap on the Reserve. Arsenic, chromium, copper, mercury and zinc concentrations marginally exceeded the equivalent ANZECC B level criteria in some composite samples, however, the results were considered to be consistent with background concentrations in the soil.

The analytical results for the soil samples retrieved from Lots 3 and 4 (Stage 1 site) showed that chemical contaminant concentrations are below the ANZECC B level criteria and are within the range of typical background concentrations in Australian soil.

6.1.1 Auditor’s Comments on the Contamination Assessment

The auditor’s review of the assessment report has shown that the assessment was performed in accordance with EPA guidelines.

EPA and National Association of Testing Authorities (NATA) approved laboratories and approved methods were used for the analyses. The final analytical results are NATA endorsed. The analytical methods used are appropriate.

The auditor’s review of the analytical results for the soil sampres retrieved from Lots 1,.2 and the Reserve (Stage 2 site) in the initial and further assessments shows that the 95% Upper Confidence Limit (UCL) of the arithmetic mean of the total organochlorine pesticide concentrations is 4.4 rng/kg. This is significantly above the ANZECC B level criterion of 1 mg/kg which is considered to be suitable for residential use.

The results of the assessment indicated that the surface fill material on five areas of Lots 1, 2 and the Reserve is contaminated above guideline levels and is not considered to be suitable for a residential land use. The results also show that there is no evidence to suggest that Lots 3 and 4 are contaminated. Therefore it is considered that the land at Lots 3 and 4 is suitable for residential use. Lots 1, 2 and the Reserve would require remediation to make them suitable for their proposed residential and Public Open Space uses. -

Quality AssurancelQuality Control

In order to satisfy the auditor’s requirements a WQC program in accordance with EPA recommendations was implemented during the assessment. The results of GPM’s QNQC program showed considerable variation in the results for organochlorine pesticides for the duplicate samples.

The results of GPM’s WQC program show that 78% of the results for the duplicate samples were within the acceptable range for relative percent difference (RPDs). This is below the desirable 95% completeness and is considered to be barely acceptable.

The auditor’s review of the results of the field QC program confirms GPM’s view that the QC variations are likely to be due to the heterogenous distribution of contaminants in the fill material. The results of the field QA program are considered by the auditor to represent systematic variations between the laboratories. However, the primary laboratory’s results are indicated to be conservative and are therefore satisfactory for the purposes of the audit.

In view of this, the auditor is of the opinion that the results of the QNQC program show that the results of the assessment are realistic estimates of the contaminant concentrations in the fill. The variability identified is considered not to have affected the outcome of the audit.

7. HUMAN HEALTH AND ENVIRONMENTAL IMPACT ANALYSIS

7.1 Exposure Pathways and Risk Characterisation

Lots 3 and 4 (Stage 1 Site)

The results of the assessment indicate that the contaminant concentrations on Lots 3 and 4 are at background levels in Australian soil. Therefore the land at Lots 3 and 4 is suitable for any beneficial use, including residential.

Lots 1,2 and the Reserve for Public Open Space (Stage 2 Site)

Significant organochlorine pesticide contamination above the ANZECC B level criteria is present in the soil on Lots 1, 2 and the Reserve for Public Open Space (Stage 2 site). The ANZECC B level criteria are guideline values which are considered to be protective of all beneficial uses. Therefore there is the pctential that all beneficial uses may not be protected. The ‘95% upper confidence limit of the mean of the results for organochlorine pesticides for the Stage 2 site is also above the ANZECC B level criterion.

In view of this and the ANZECC guidelines it is considered that the soil contamination on the Stage 2 site would present a potential human health risk or environmental risk for a residential land use. This could be realised if humans become exposed to the soil contamination in a residential scenario.

. In the auditor‘s opinion the environmental conditions of the audit site determined by the audit indicate that the current condition of the Stage 2 site is potentially detrimental to the beneficial uses of the land. This precludes the issue of a Certificate of Environmental Audit for the Stage 2 site.

Slykerrnan’s Nurseries plans to remediate the Stage 2 site to make it suitable for its proposed use. This will be performed prior to subdivision of,Stage2. -

8. CONCLUSIONS

Following my review of the environmental assessment report on the land subject to audit, and in view of: The history of the land; The inspection of the land; The analytical results far the soil samples retrieved from the land; The guidelines for the audit, it is considered that the condition of the land at the Stage 2 site comprising Lots 1, 2 and the Reserve for Public Open Space is potentially detrimental to the beneficial uses of the land due to the presence of significant organochlorine pesticide contamination on the site. Therefore a Certificate of EnvironmentalAudit cannot be issued for the Stage 2 site.

Consequently a Statement of Environmental Audit has been issued for Lots 1, 2 and the Reserve for Public Open Space. The Statement of Environmental Audit is attached to this report. The . Statement indicates that the Stage 2 site is not suitable for a residential land use, but is suitable for ongoing use as a nursery.

It is considered that the condition of the land at the Stage 1 site comprising Lots 3 and 4 is suitable for any beneficial use of that land. Therefore a Certificate of Environmental Audit has been issued for the Stage 1 site (Lots 3 and 4). The Certificate of EnvironmentalAudit is also attached to this report.
