Interview of Joost Vantomme, Postal Directive WG Chair

What is the governance process of the Postal Directive WG? With the efficient collaboration of my Vice-chair (TNT - Nanno Aukes / Jan Bart Henry), drafting of a first paper is being taken care of by focus groups: A small team of maximum 5 POs with an equitable geographical distribution and a balanced representation of the different POs’ positions. An agreement on a text at the level of the focus group constitues in most cases a good proxy for an agreement at WG level (27 voting POs).

The Commission has published several studies and reports on the liberalisation of the European postal market since 1997. Could you guide our Members through the “jungle” of EC reports and studies? Before I do so, I would like to remind PostEurop Members that the postal sector is the only regulated industry in which the sectoral Directive obliges the Commission to conduct a prospective study before taking any further steps. Every two years, the EC has to publish a report on the Application of the Directive. Most of the research work is outsourced by the EC to consultants. This explains why there are two WIK Studies: the “Main Developments Study” used as a basis for the EC Application Report, and the WIK Study on the regulatory model, which has been published in parallel with the ECORYS Study on competition development.

What is the secret of a good position paper in the regulatory field? Respect for each other’s positions is key to finding an acceptable compromise. Our work in the Group is not about convincing each other that we are right: it is about understanding WHY we have this or that position. I believe this attitude makes our contributions valuable tools to help grasp the complexity of the existing European postal market.

How do you see the future of EU regulatory debates? The upcoming postal reform will provide a balanced regulatory framework based on European law principles. Liberalisation of postal services has signalled different voices at Member State level because of different view on universal service and financing thereof and because of national differences in culture, employment and development of competition. The Prospective Study currently in finalisation phase is to provide an assessment per Member State, of the impact of a full market opening in 2009 on the provisioning of the universal service. A new Directive is to be proposed by the EC by the end of 2006 and will follow the co-decision procedure (Parliament and Council). The European Parliament is expected to closely follow the postal regulatory debate. A flavour of the important attention that the EU Parliament gives to that debate can already be found in the so-called "Ferber Report" adopted recently. Key stakeholders should realise that the kind of regulation of postal services cannot simply be a copy-paste from other industries where the network element is a crucial factor (electronic communications, energy, railways, ...).
