RECOMMENDATION:

That pursuant to Section 4.16 of the Environmental Planning and Assessment Act 1979 (as amended), Development Application No. 2019/56, to undertake alterations and additions to the Athenium Theatre on the land known Lot 15 Section 9 DP10366 and Lot A DP326545, 89 Broadway Street JUNEE be approved subject to the conditions outlined in Schedule A of the attached Section 4.15 Development Assessment Report. ______

EXECUTIVE SUMMARY

This Development Application seeks consent to undertake internal and external alterations and additions to the Athenium Theatre.

The application has been assessed under Section 4.15 of the Environmental Planning and Assessment Act 1979 (as amended) and as submitted, is considered permissible with consent within the RU5 Village Zone. The applicant has adequately demonstrated that proposed development complies with the objectives and provisions of the Junee Shire Council Local Environmental Plan 2012 and the Junee Shire Development Control Plan 2015.

A Section 4.15 assessment of the proposal considers the development to be consistent with all relevant planning considerations and zone objectives and warrants development consent subject to conditions being granted.

THE PROPOSAL

The site consists of two existing allotments totalling approximately 1800m2. Existing lot A is a vacant site while Lot 15 contains the state listed heritage items being the Athenium Theatre building.

The proposal will see the undertaking of various internal and external building alterations and additions that will encompass both existing allotments, meaning a land consolidation will be required.

The external alterations and additions involve new theatre change and storage rooms at the rear of the existing theatre and the addition of new commercial kitchen, amenities, store and office at the side of the theatre buildings.

Internal alterations will see the installation of a fully ducted, largescale mechanical air handling system (reverse cycle heating and cooling), structural strengthening works and concrete flooring to the underside of the existing stage, under awning feature lighting and ongoing conservation works.

As the site is listed as a state significant heritage item, the application is being treated as Integrated Development, meaning that General Terms of Approval were required from NSW Heritage.

NOTIFICATION

The application, being Integrated Development, was placed on broad scale public exhibition for a period of 30 days and was advertised on Council’s website and in the local newspaper. The notification period ended on 21 October 2019.

No formal submissions were received concerning the application.

ASSESSMENT

A comprehensive Section 4.15 Development Assessment Report prepared by Council’s Environmental Health and Building Surveyor has been completed and is provided as an attachment to this report.

Submitted plans of the development, Statement of Heritage Impact and Statement of Environmental Effects on which the application was assessed is also provided as an attachment to this report.

LIKELY IMPACTS

The development is considered to have little adverse impacts on the locality or the heritage significants of the building itself. It is considered that the new works will provide both positive social and economic impacts for the community as a whole through the ongoing preservation and improvement of an important local facility and cultural landmark.

All other impacts on local environmental considerations have been assessed in the Section 4.15 report and were considered acceptable.

CONCLUSION

When assessed against the relevant legislative and statutory provisions and having regard to the context of the locality and the nature of the proposed development, it was considered that the proposal satisfies the relevant state and local planning provisions.

The proposal is broadly consistent with the desired character of the zone and will not detrimentally impact upon the amenity of the adjoining properties of the locality. Accordingly, the proposal warrants Development Consent subject to conditions.

DEVELOPMENT DESCRIPTION

This Statement of Environmental Effects (SEE) has been prepared on behalf of Junee Shire Council to form part of a Development Application (DA) to undertake alterations and additions to the Athenium Theater located on Lot 15, Section 9 DP10366 & Lot A DP326545, 89 Broadway Street, Junee (the site).

The site currently contains a Local and State Listed Heritage building used as a public assembly building. An aerial image of the site is provided in Figure 1 below.

The proposed alterations and additions will involve the following: 1. The proposed new building works will involve the addition of a commercial kitchen, storeroom, office, sanitary facilities and public dining areas on the vacant land (Lot A) next to the existing theater building which will involve the consolidation of the two existing allotments. 2. Other new building work involving the erection of additional storerooms, staircases, linkages located at the rear of the existing theatre to join all exiting dressing rooms and improve back stage operations and access/egress. 3. Complete upgrade of theatre heating and cooling systems (HAVAC) involving the erection of new condensers, internal ducting, vents & structural supports and new concrete floor under existing stage. 4. Install new structural supports fixtures to support and house stage curtains and rigging equipment. 5. Installation or new under awning (removable) lighting on three sides of the existing front awning.

PLANNING PROVISIONS

JUNEE LOCAL ENVIRONMENTAL PLAN 2012

The subject site is currently zoned RU5 Village under the provisions of the Junee Local Environmental Plan 2012 (JLEP2012), as illustrated in Figure 2 below:

The objectives of the RU5 Zone as described in the JLEP2012 are:

 To provide for a range of land uses, services and facilities that is associated with a rural village.  To promote and encourage development that will strengthen the economies of Junee and the villages of Wantabadgery, , Bethungra and Old Junee in a manner that is compatible with their urban function.  To enable a range of housing forms and complementary business uses taking into account the distinct character of each urban area.

Comments: The proposed works will provide for additional and improved public services to the community which will satisfy the zone objective: 1. Provide for a range on land uses, services and facilities.

Comments: The Athenium Theatre building and associated lands are owned and operated by the Junee Shire Council and would be defined as a ‘Community Facility’ under the JLEP.

Clause 5.10 – Heritage Conservation

The subject site is identified as a state listed heritage item (I2 JLEP) ‘Athenium Theatre, former Jadda Centre)’. The subject site is also located within the identified Heritage Conservation Area as illustrated in Figure 3 below:

The objectives of this clause are as follows: (a) to conserve the environmental heritage of Junee, (b) to conserve the heritage significance of heritage items and heritage conservation areas, including associated fabric, settings and views, (c) to conserve archaeological sites, (d) to conserve Aboriginal objects and Aboriginal places of heritage significance.

Comments: The proposed new building works and internal alterations to the Athenium Theatre building have been designed in conjunction with Junee Shire Council’s Heritage Advisor and Heritage Architect Noel Thompson and are considered to compliment the historic character of the building and locality satisfying the objectives of the clause.

(2) Requirement for consent The proposed alterations and additions to the building will require development consent of the Council under this Clause.

In addition to Local Development Consent, Section 4.47 of the Act identifies the development as being ‘Integrated Development’ as approval under Section 58 of the Heritage Act 1977 is required from the Office of Environment and Heritage as part of an Integrated Development Application.

(5) Heritage assessment As part of this application, heritage management documents have been prepared and are supplied as part of the development application package.

(6) Heritage conservation management plans There is an existing heritage conservation management plan for the Athunium Theatre which will be updated to include the proposed future works and ongoing operation of the facility. The updated management plan is supplied as part of the development application package.

Clause 6.8 – Salinity

The subject site is identified as being ‘saline land’ under the JLEP as illustrated in Figure 4 below:

(1) Objective The objective of this clause is to provide for the appropriate management of land that is subject to salinity and the minimisation and mitigation of adverse impacts from development that contributes to salinity.

Comments: The proposed new building works and internal alterations will be designed and constructed to take into account risks associated with urban salinity. There will be no onsite discharge of water or the drawing of water from local aquifers to be undertaken as part of this development.

JUNEE DEVELOPMENT CONTROL PLAN 2015

Chapter 13 Building in a Saline Environment applies to this site.

13.1 OBJECTIVES The objectives of this Chapter are to:  minimise the amount of water being discharged from buildings or from gardening activities which will lead to intensification of acid sulphate soil conditions within the Junee township,  minimise the extent of sub-soil seepage water from waste disposal facilities on re-charge slopes by nominating effluent disposal facilities relying on spray irrigation and evaporation,  specify measures within building construction to ensure that increased precautions have been taken to reduce the attack of acid sulphate soil conditions to the building structures and products, and  outline precautions that property owners can take in safeguarding salt damp and acid salinity attack on buildings in other locations within the Shire.

Comments: The proposed new building works and internal alterations will be designed and constructed to take into account risks associated with urban salinity in accordance with the specific development controls.

CONCLUSION

This SEE report has been prepared to support a development application to undertake alterations and additions to the State listed heritage item, Athenium Theatre, Junee located on two lot Torrens Title Lots being Lot 15 Section 9 DP10366 and Lot A DP 326545.

The proposal has been described and discussed in previous sections of this report, and has been considered in respect of the relevant planning provisions applicable to the proposed development. The proposal is considered to be permissible for the following reasons:

 The proposal is permissible under the provisions of the Junee Local Environmental Plan 2012 and meets the objectives of the applicable zone.

 The proposal is not in conflict with controls of the Junee Development Control Plan 2015

 The Proposal is not likely to have an adverse effect on surrounding residents.

As demonstrated throughout this report, the development is permissible with consent, subject to a merit assessment.

ADEMDUM to SEE – Address Additional Heritage Considerations as identified by NSW Heritage.

1. Brief Baseline Archaeological Assessment

Section 3.12 (Archaeology) of the ‘Athenium Theatre – Conservation Management Plan Review 2018 identifies “Where works are proposed which involve excavation, an archaeological assessment should be made to determine the possibility that relics may be revealed. This is particularly the case at the rear of the Theatre building and on the adjoining ‘vacant’ allotment (to the south side of the site)”.

Despite the claims made in the Revised CMP – Further research undertaken by the applicant can confirm that there have never been any additional articles or structures on the land to the rear of the theatre building or on the adjacent southern vacant block.

All historical photographs of the building do not show any additional builds that extend beyond the existing footprint. A review of old areal images of the township dating back to the early 1940’s and 1950’s clearly show the extent of the buildings historic footprint and compared to today confirms that there was never any additional buildings or structures on the subject site or the vacant site next door.

It is highly probably given the documentary evidence that since the Athenium Theatre’s Construction in 1929, the areas subject to redevelopment have been and have remained vacant, open space. It is therefore considered that because there have not been any historic buildings or structures on the vacant areas or adjacent site, any potential archaeological artefacts being found in these locations during any future excavation works is extremely low. The statement made in the revised CMP is therefore considered to be factually incorrect.

2. Under Awning Festoon Lighting

Council originally sort a Section 57(2) exemption for the installing of festoon lighting under the Athenium Theatre awning as part of a larger upgrade to the buildings front façade lighting installation.

NSW Heritage originally rejected the festoon lighting based on the assumption that festoon lighting was never an original feature of the building. It was therefore proposed to add the installation of festoon lighting to the subject development application with additional details being provided in this revised SEE.

The Festoon lighting will consist of up to 35 standard 240v wired light sockets being installed under three sides of the existing awning. The sockets will be installed on a poly track that incorporates a poly track cover that will hide all associated wiring and fixing points. The light sockets protrude the track cover by approximately 30mm and is the only visible element of the festoon lighting other than the poly track which is coloured white. It is proposed to install the standard low energy LED light globes for certain evening events only that are to be held various times throughout the year. Otherwise the light globes will be removed and stored to prevent vandalism and to reduce general visual impacts. Wiring for the lighting will be concealed within the mounting track and will extend around the rear of the awning and connected to into the existing external lighting circuitry.

The poly track and light bulb sockets are to be screwed to the underside of the awning directly to the awning lining, which is a steel panel rib type lining panel which is not considered to be part of the original fabric of the building. A photo of this building element and a sectional diagram of the fixing method if supplied below. The entire lighting assembly will be light weight and easily removed in the future if needed.

In addition, while researching historic photographs of the Athenium Theatre a photo was found that clear shows festoon lighting did form part of the buildings awning display in addition to event signage on the front of the awning. It is acknowledged that the original festoon lighting did not extend the full length of the awning which is now proposed in the subject application.

2. Air-conditioning vents installation and impacts on original building fabric

The development application also seeks consent to install a significant mechanical air handing system throughout the building to ensure more use opportunities and raise the level of comfort for occupants.

Concerns regarding the style and type of air supply vents, to be installed in the Theatre Ceiling and Air intake vents to be installed under the stage have been raised in particular their visual appearance and impact on original building fabrics.

Ceiling Air Supply Vents – The mechanical Services plan shows a total number of 21 air supply diffusers to be installed in the upper ceiling of the hall. The mechanical services specifications identify these as swirl diffusers “Holyoake OD5” These diffuses are designed to connect to hidden ductwork in the ceiling crawl space and finish flush with the outer edge of the ceiling giving a seamless less obtrusive visual appearance. It needs to be noted that the specification is a preliminary tender document and that the “make and model numbers for the grills, diffusers etc have been nominated for a guide only, the mechanical contractor shall confirm mounting details of all diffusion equipment prior to final selection and ordering”.

Inspections of the ceiling and research into the past refurbishment works carried out on the building over the years has confirmed that the existing ceiling is not an original building element and has been replaced as some stage. Investigations during the early 2000’s removed sections of the ceiling in the hope of uncovering the original ceiling that was described are containing “open grills or lattice” but none of the original ceiling was present.

The existing ceiling is now primary made up of standard gyprock type plasterboard and does not contain the same ornate features the original ceiling had possessed. Photos of the original ceiling and the existing ceiling are included below.

It is therefore considered that the ceiling air supply vents, installed in the existing ceiling will have no effect on original building fabrics and will have minimal visual impact.

Under Stage Air Intake Vents – The mechanical Services plan shows a total number of 2 air intake vents to be installed in openings under the front stage. These vents are described as being “Half Chevron Holyoake RL25” or similar and will measure approximately 1200mm high x 2000mm wide. It needs to be noted that the specification is a preliminary tender document and that the “make and model numbers for the grills, diffusers etc have been nominated for a guide only, the mechanical contractor shall confirm mounting details of all diffusion equipment prior to final selection and ordering”.

Inspections of the stage and under stage area found that the front wall below the stage is constructed of masonry brick and would be an original element of the building. However it was also discovered that there are two existing openings, measuring 1200mm high x 900mm wide, in this wall that used to provide access to under stage storage. Currently these openings have been covered with timber panels and painted. The location of the new air intake vents are to be installed in these existing openings and will require the minor modification to the brickwork to widen the openings from 900mm to 2000mm.

The design of the air intake vent is to finish flush with the exterior face of the wall with half chevron louvers that face downward, giving the appearance of a solid panel when viewed from the front or above. The finish of the panel is white and can be painted to match surrounding wall color schemes.

Further investigations found that there was not enough space in the subfloor area of the hall itself to install intake vents in the floor itself.

It is considered that the installation of the air intake vents is a critical component to the mechanical air handling system. To maximize efficiently and acoustic impacts the machinery driving the air handling system is to be installed under the stage area and the intake vents are well placed to service this machinery. Extensive consideration into the selection of the right vent style and its location has been given to minimise impacts on original building fabrics and visual impacts.

07: Background to this Statement: [A] Introduction This Statement of Heritage Impact (SOHI) has been prepared for the ‘Athenium Theatre’ building to address the impact of the proposed alterations and additions to the rear and side of the building at Broadway, Junee. Noel Thomson the author of this report is an architect and heritage consultant experienced in providing heritage advice visited the site, undertook site investigation of the current internal and external conditions at the building and has referenced some current photographs to assist in the preparation of this SOHI. This Statement of Heritage Impact is based on the formula prescribed in the Office of Environment and Heritage – NSW Heritage Division manual and should be read in conjunction with the Statement of Heritage Impact booklet.

ALTERATIONS & ADDITIONS TO ATHENIUM THEATRE, JUNEE – STATEMENT OF HERITAGE IMPACT 1 [B] Historical Background & Heritage Significance With reference to the Athenium Theatre Conservation Management Plan (2005) the theatre and its relationship with the development of Junee is covered and this timeline below outlines the historical development and associations with the Athenium Theatre, Junee. C.1928. Nicholas Laurantus joins Ben Cummins (Junee) to build a new theatre in the Broadway; he puts brother George in charge of the Lyceum and overseeing the building of the new theatre. 1929. In May, Theatres and Public Halls gives approval to build. On 10th October the theatre opens as the Athenium Theatre. 1935. Nicholas and George Laurantus build the Rio Theatre at Lockhart. 1939. Nicholas decides to buy a property outside of , decides to sell his theatre interest in Junee, forces George to give up management of the Athenium to go out and manage the property while Nicholas resides in town. C.1940. Robert Tilby Begg takes over the theatre. 1950. R J and E E Pollard buy and run the theatre, renaming it Broadway. 1954. The Pollards sell on to Albert Thomas Manion for his son Kevin and daughter-in-law, Yvonne to manage (purchase price 28 000 pounds $56 000). 1958. The theatre is transferred into a company, Broadway Theatre (Junee) Pty Ltd, of which Kevin Manion and Thomas A Wah are directors 1959. The proscenium is removed, as was the custom to provide a wider opening for Cinemascope presentation. Kevin Manion sells out to a T A Wah who is sole owner under the company until 1971. 1971. Theatre licence is cancelled --- up for sale. 1977-8. Bought by Junee and District Development Association for $20 000 --- makes the Junee and Illabo Councils trustees (virtual owners) of the property as tenants in common. Alterations to make it useful for indoor sports as well as social events, costing $45 000. Funding by community donations. A new licence is issued. 1984. Junee Council appears to be taking greater interest. Theatres and Public Halls initiates a search as to who or what actually owns the building. 1990. Theatres and Public Halls Act is repealed and a new Act transfers licensing, inspections etc to local councils. 1998. The exterior is repainted, the refreshment bar kitchen is re-equipped at a cost of $28,000. 2002-3. The Junee Shire Council wishes to demolish the theatre. 2004. The Athenium Theatre is listed on the State Heritage Register by Heritage Council. 2005. Conservation Management Plan and masterplan concepts prepared. 2007. DA Drawings and SOHI prepared by Workshop 1. 2008. IDA approval for Athenium Theatre upgrade from Junee Shire Council and s60 Approval from NSW Heritage Council for ‘Adaptive reuse of heritage building’. 2009. Replacement of roof to the Athenium Theatre completed. 2010. Preparation of architectural tender documents and tenders called. Nash Bros (builders) awarded contract for the upgrade works at the Athenium Theatre and works undertaken, completed and building use commenced. 2012. Proscenium arch upgrade completed and Dr Ross Thorne donates new stage curtain. 2016. s60 Approval from NSW Heritage Council for ‘refurbishment of dress circle’. 2017. Works for the upgrade refurbishment of dress circle completed. 2018. Noel Thomson Architecture undertakes review of CMP and prepares masterplan for the upgrading of the Athenium Theatre and funding sought. 2019. Funding approval received for the upgrading of the Athenium Theatre and Noel Thomson Architecture prepares DA drawings and SOHI.

ALTERATIONS & ADDITIONS TO ATHENIUM THEATRE, JUNEE – STATEMENT OF HERITAGE IMPACT 2 The Athenium Theatre is historically significant due to its rarity it symbolises the use of a cinema building as the social centre of a town with its being surrogate town hall / community (JADDA) organisation from 1976/7 and its association with the Larantus family and Kaberry & Chard theatre/cinema architects from . The building’s “Art Nouveau / Arts & Crafts” design, function and placement in the planned cultural landscape of the Broadway Junee evoke a sense of grandeur.

[C] Background In 2003 the NSW Heritage Office commissioned Dr Ross Thorne to prepare a heritage assessment and Statement of Significance for the Theatre. This comprehensive assessment lead to the NSW Heritage Office formally placing the Theatre on the State Heritage Register (under the Heritage Act 1977) in January 2004 The Theatre was given State significance due to its rarity as a building type and for its role as the social centre of the town and ‘surrogate’ town hall. In 2004/2005 Philip Leeson Architects Pty Ltd prepared a Conservation Management Plan (CMP) for the Theatre. The CMP included a preliminary structural analysis which noted that the building was robust but was in need of re-roofing and new roof drainage. This work has now been completed and the building is weatherproof. The CMP identified the scope of work required for the Theatre which would allow for adaptive reuse whilst conserving its significance. In 2007, following the receipt of limited funding from the NSW Ministry of Arts, the architectural firm Workshop 1 Pty Ltd produced a detailed set of architectural drawings for the upgrade and restoration of the Theatre based on the Conservation Management Plan and the requirements of the NSW Heritage Office. Junee Shire Council & NSW Heritage Office granted consent to the Development Application on 19 December 2008 for the refurbishment of the theatre and the works were completed in December 2010. Noel Thomson Architecture completed the Conservation Management Plan review and the preparation of Masterplanning for the Athenium Theatre in mid 2018, following workshops held with stakeholders and Councillor’s which obtained all relevant information and briefing to prepare concept designs for the masterplan. Reference is made to that document in this SOHI.

ALTERATIONS & ADDITIONS TO ATHENIUM THEATRE, JUNEE – STATEMENT OF HERITAGE IMPACT 3 3. HERITAGE SIGNIFICANCE

01: Athenium Theatre, Junee Significance With reference to the NSW Heritage Division database and the state listing for the Athenium Theatre (Significance updated, 10 Oct 2013), “Due to its now rarity, as a building-type, the Athenium Theatre symbolises, for the State, an association with past events, persons and groups who contributed or participated in an important and cultural phenomenon of the 20th century, namely 'movie going'. Due to its rarity it symbolises the use of a cinema building as the social centre of a town with it being a surrogate town hall. This and the role of the community (JADDA) organisation from 1976/7 accord the building the status of social significance for the State. The building is highly representative as a good example of the design-work of theatre architects, Kaberry and Chard it being one of only three remaining relatively intact out of a large body of work across the State. The building has an association with Greek immigrant business and benefactor, Sir Nicholas Laurantus, and through its rarity, symbolises his interests in cinema operation in the region. It also is one of the few remaining buildings in NSW that has a direct connection with Gladys Moncrief OBE, and the country touring that she and lesser Australian stage artists did in the 1920s, 30s, and 40s. Of the 116 movie theatres operated by Greek immigrants in NSW, this one unusually possesses added decoration (presumably by George Laurantus, brother of Nicholas) in the form of a trellis and vine leaf motif. It provides a 'Greek overlay' to portion of the auditorium. This exhibits significance in aesthetic terms in relation to the importance of the Greek contribution to developing cinema operation in NSW.”

02: Junee Heritage Conservation Area The Heritage Conservation Area recognises an area on both sides of the railway line and includes the majority of the CBD and some residential areas. This area is identified in the Junee Local Environmnetal Plan 2012. The Heritage Conservation Area strengthens Junee’s position as one of the more important architectural townscape examples for historical buildings in NSW, a line was drawn around an area that has precinct protection. Any proposed external building work in this area requires development consent.

4. LEP & DCP REQUIREMENTS / CONSIDERATIONS

01: Junee Local Environmental Plan The Junee Local Environmental Plan - 2012, reference to Clause 5.10 Heritage Conservation, the following sub-clauses apply; (1) Objectives The objectives of this clause are as follows: “(a) to conserve the environmental heritage of Junee, and (b) to conserve the heritage significance of heritage items and heritage conservation areas including associated fabric, settings and views,” (2) Requirement for consent Development consent is required for any of the following: “(a) demolishing or moving any of the following or altering the exterior of any of the following (including, in the case of a building, making changes to its detail, fabric, finish or appearance): (iii) a building, work, relic or tree within a heritage conservation area.” (4) Effect on heritage significance “The consent authority must, before granting consent under this clause in respect of a heritage item or heritage conservation area, consider the effect of the proposed development on the heritage significance of the item or area concerned. This subclause applies regardless of whether a heritage management document is prepared under subclause (5) or a heritage conservation management plan is submitted under subclause (6).”

ALTERATIONS & ADDITIONS TO ATHENIUM THEATRE, JUNEE – STATEMENT OF HERITAGE IMPACT 4 (5) Heritage impact assessment The consent authority may, before granting consent to any development: “(a) on land on which a heritage item is situated, or (b) on land that is within a heritage conservation area, or (c) on land that is within the vicinity of land referred to in paragraph (a) or (b), require a heritage management document to be prepared that assesses the extent to which the carrying out of the proposed development would affect the heritage significance of the heritage item or heritage conservation area concerned.”

02: Junee Shire Council Development Control Plan With reference to the Junee Shire Council Development Control Plan - 2015, the DCP does not have a Heritage Chapter for guidelines and controls for Heritage Conservation.

5. PROPOSED WORKS TO THE HERITAGE ITEM 01: Existing Conditions (for photographs refer Appendix 5) The Athenium Theatre is located in what was designed to be the grand avenue of Junee. Broadway still retains these elements envisioned in the town plan for Junee, the form of the wide street and central tree lined vista terminating at the war memorial. The building is rendered brick at the Broadway / main facade and of face brick on the remain side and rear facades. The design is typical of the inter-war Art Nouveau style, expressing a dynamic facade with shopfronts, doors, decorative elements. There is a hung cantilevered awning with a deep fascia, below which are two shopfronts and doors to the theatre. The awning fascia and soffit appear to have been replaced in recent years. Above the awning are double piers (or 'slimmed-down' pilasters) at each end supporting an entablature and small cornice at parapet. A little below the entablature is a row of seven windows, which light the rear of the dress circle; the central three are for the projection box. The sides of the building did not originally possess windows but, instead, had vertically sliding timber framed and sheeted panels (or shutters). Over the years, the toilets at the rear, have 'progressed' from unsewered outhouses to sewered brick additions with access from within the building. The corrugated iron roof was replaced with new galvanised roofing in 2009.

Fig 2: Athenium Theatre Building today and photo taken c1950 The front lobby is small with the principal stair to the dress circle to the right, against the sidewall. The original ticket box, (of glass front and sides above a small 'counter', about 900mm cross, 1300mm deep and a shade over two metres high) was freestanding in the space and was removed in 1978. Plain wide double doors provide access to the stalls level of the auditorium. The stalls floor is timber, flat for dancing and indoor sports activities (from 1978). The stage is relatively small to avoid the stringent rules for fire control yet provide enough space for live performance. The widening of the opening in 1959 permitted a screen size larger and in 2012 the original size and proscenium arch was reinstated. Original walls are painted render, but it is contended that the dado decoration replaced timber, with rough plasterwork above and less-rough plaster below. In 1978 a new ceiling covered or replaced the decorative but functional timber battening and lattice-work panelled ceiling.

ALTERATIONS & ADDITIONS TO ATHENIUM THEATRE, JUNEE – STATEMENT OF HERITAGE IMPACT 5 02: Proposed alterations and New Development The proposed development at the Athenium Theatre consists of the retention of the auditorium, dress circle, stage and foyer / amenities areas with the new construction to occur at the side and rear of the building. The proposal is to construct the single storey extension for a kitchen, storage and staff amenities to the side of the building on the current vacant lot. The rear additions are for ‘back of house’ theatre rooms and summary of the construction works are as follows; 1: Construct new link for storage at ground level, relocate stair and provide mechanical services to the building – auditorium, dress circle and stage areas. Upgrade the stage area / proscenium arch structurally for the new stage curtains and rigging equipment. 2: Construct new kitchen/ storage/ toilet structure with link to auditorium and external function area. Upgrade lawn area on adjacent allotment to provide for an external function/breakout area with new arbours, paving, lawn, hedges/landscaping. 3: Rework existing stores at ground level, construct link and dressing room space at upper/stage level and improve access and egress. 4: Building repairs and maintenance including areas of damaged brickwork due to rising damp, review and install appropriate damp course/waterproofing, window repairs and painting, etc

05: In the case of Major Additions to a Heritage Item (Applicable) [A] How is the impact of the addition on the heritage significance of the item to be minimised? Yes The impact of the new development / addition to the Athenium Theatre is to be minimised by the design and placement of the new ‘kitchen / store’ building to the rear of the adjacent vacant block. This new building extension is to have pitched roofs and street facade that will appear sympathetic although being ‘contemporary’ and aims to enhance the streetscape. This building is to be constructed using timber framing and composite panelling and in a design that is complementary to the theatre and painted in a similar colour scheme. The other additions for ‘back of house’ change rooms are located behind the stage areas at the rear of the theatre and will not be visible from the street. For perspective image of the proposed new addition to the side of the building refer Fig 3.

[B] How does the additions / new development affect views to, and from, the heritage Conservation Area? What has been done to minimise negative effects? The Athenium theatre on Broadway is a dominant two storey building surrounded by single storey buildings and the new development/addition occurring on the adjacent vacant block will be single storey and be well setback from the street. This building extension will be constructed to be sympathetic with the theatre building and due to its location will have minimal impact on the streetscape and heritage conservation area.

ALTERATIONS & ADDITIONS TO ATHENIUM THEATRE, JUNEE – STATEMENT OF HERITAGE IMPACT 6 [C] Will the additions tend to visually dominate the heritage item? The aim is to minimalise the impact of the new additions by design, colour, scheme and placement of the building and being a single storey extension, it will not dominate the heritage item / Athenium Theatre building.

[D] Are the additions sympathetic to the Heritage Conservation Area? In what way (e.g. form, siting, proportions, design)? It is noted that the preferred outcomes for development in a heritage conservation area is for it to be respectful of the form and scale of existing buildings within the conservation area. The additions to the Athenium Theatre have been designed to be sympathetic to the heritage item and the Conversation area by means of siting, form, proportion and material selection. For perspective image of the proposed new additions at side & rear refer Fig 4.

[E] How has the impact of the new services / airconditioning on the heritage significance of the item been minimised? The proposal to provide new mechanical air conditioning to the Athenium Theatre is required to make the building more functional. Currently with no air conditioning, use of the building is limited due to the cold in winter and the heat in summer. The aim is to provide new mechanical equipment under the stage area and in the void at the dress circle area with associated external condensing equipment placed where the impact on the theatre will be minimal. There will be some disruption the building fabric where grilles will need to be installed on walls, stage front and ceilings with the aim being to provide these services into the building with minimal visual impact on the heritage item.

[F] Has the advice of heritage consultant been sought? Have the consultant’s recommendations been implemented? If not, why not? Noel Thomson the author of this report is an architect and heritage consultant experienced in providing heritage advice - Noel advises several Riverina Council’s including Junee Shire on heritage matters. The aim of this report is to address concerns for the proposed additions and internal upgrades at the Athenium Theatre building and the impact these changes will have on the heritage item and the conservation area.

6. THE FOLLOWING ASPECTS OF THE PROPOSAL COULD DETRIMENTALLY IMPACT ON THE HERITAGE SIGNIFICANCE OF THE HERITAGE ITEM

01: Impact of New development / addition The design for the new development / addition to a building within a Heritage Conservation Area does not have to replicate the existing built form, but it should be compatible with the existing streetscape in terms of materials, textures and colours. It is also noted that Council may consider a unique architectural solution, provided the applicant can demonstrate the appropriateness of the development in the context of surrounding heritage buildings.

ALTERATIONS & ADDITIONS TO ATHENIUM THEATRE, JUNEE – STATEMENT OF HERITAGE IMPACT 7 The preferred outcomes for development in a heritage conservation area is for it to be respectful of the form and scale of existing buildings / development within the conservation area. In this instance the new additions to the Athenium Theatre are to the side and the rear of the building and they have been designed with form and proportion to have minimal impact on the heritage item / conservation area. The new kitchen / store extension has been designed with a street facade to be sympathetic with the Athenium Theatre main facade and that this addition to the vacant block aims to be a positive infill addition to the heritage conservation area. Refer Fig 5 below.

02: Impact of proposed new airconditioning The proposal for the air conditioning of the Athenium Theatre means that the equipment will be located internally (at void areas) and external to the building. There will be minor impact internally due to the requirement to locate grilles at walls, stage front and ceiling within the theatre and therefore building fabric will need to be removed to allow installation – ductwork / piping will be located within voids (ceiling and underfloor) and not be visible. The condenser equipment externally is to be grouped together and be located between the two egress stairs at the rear of the building and is only visible from the service lane. If this equipment is visually intrusive the proposal will be to provide a covered screen around the units in a way that minimises the impact on the heritage item.

7. CONCLUSION The concerns that have been highlighted by this Statement of Heritage Impact for the upgrading and additions to the Athenium Theatre (former JADDA Centre) at 89 Broadway, Junee is the impact the new development will have on the heritage significance of the heritage listed item I2 and ‘state’ listed heritage item 01687. Review of the historical information, site inspection of the Athenium Theatre building in its current condition the Design Drawings and this SOHI addresses the issues of the impact that the proposed new additions and upgrade of theatre areas will have on the Heritage Item. In summary, the proposed internal upgrade to the various areas of the theatre revolve around the installation of an air conditioning system and the impact will be minor to the heritage item. The addition of new spaces to the rear of the building for improved “back of house” facilities and for better access / egress where they are not visible from street and are of sympathetic construction is appropriate. The proposed new addition for kitchen, store and staff amenities to the side of the theatre where constructed in sympathetic form and setback from the Athenium Theatre main street facade is appropriate for the building / heritage item and heritage conservation area.

ALTERATIONS & ADDITIONS TO ATHENIUM THEATRE, JUNEE – STATEMENT OF HERITAGE IMPACT 8 Approval for the internal changes, the new rear and side additions to the heritage listed “Athenium Theatre” building at 89 Broadway, Junee as per the design drawings and addressed in this Statement of Heritage Impact is recommended for NSW Heritage Council / Junee Shire Council Development Approval.

Junee Shire Council agreed to the preparation of the Conservation Management Plan 2005 review in December 2017 and they provided funding for this Plan. Noel Thomson Architecture (NTA) was appointed as architect and heritage consultant for the upgrading of the Athenium Theatre Conservation Management Plan and the preparation of Masterplanning for future conservation works and upgrading of the theatre’s facilities. The masterplanning is to include the Athenium Theatre site (Lot 15 DP 10366) and the adjoining vacant site (Lot a DP326545) and for OEH NSW Heritage Council confirmation of the state listed site curtilage refer to Appendix 1 for Athenium Theatre (SHR 01687) aerial view showing Curtilage. In 2004 Junee Shire Council engaged Philip Leeson Architects and Pip Gionvanelli Heritage Consultant to undertake initial masterplanning options and prepare a Conservation Management Plan for the Athenium Theatre. Following the adoption of the Conservation Management Plan for the Athenium Theatre by Council in 2005, Workshop 1 Pty Ltd (Dunn & Hillam) architects were appointed to undertake preparation of design and documentation for Development Approval. In 2010 Nash Bros builders were appointed and refurbishment works were undertaken for the ‘adaptive re-use’ of the Athenium Theatre into a multi-purpose function centre. Since its reopening in 2011, the “Friends of the Athenium Theatre” prepared documentation for the proscenium arch upgrade, installation of new curtain to the stage and refurbishment of the dress circle, all with NSW Heritage Council approval. Noel Thomson Architecture, in undertaking the Conservation Management Plan review and the preparation of Masterplanning for the Athenium Theatre, attended the site in early 2018, held workshops with stakeholders and Councillor’s to obtain all relevant information and briefing so as to be able to formulate concept designs for the masterplan. The Conservation Management Plan 2005 suggested some obvious ways in which the building could be sympathetically modified to achieve an upgraded multi-purpose use. There were several options noted along with functionality and mandatory regulatory requirements for adaptation. These recommendations were undertaken in the 2010 works and they are still relevant today, with these now included in this Conservation Management Plan policy recommendations. The Athenium Theatre is to be retained and upgraded in accordance with Conservation guidelines and ‘masterplan’ drawings.

ALTERATIONS & ADDITIONS TO ATHENIUM THEATRE, JUNEE – STATEMENT OF HERITAGE IMPACT 25 From the stakeholder and Council workshops and meeting with Murray Hume Business Enterprise Centre (BEC), who have been engaged by Council to prepare a ‘Business Plan’, the ‘final’ masterplan brief was established with NTA then being able to produce masterplan concept designs. The basis of the design is outlined below; 1. The all-important air-conditioning of the auditorium is to be based on new designs and whether reverse cycle a/c versus evaporative cooling and hydronic heating rather than the previously designed ‘geothermal’ reverse cycle air-conditioning system. 2. The auditorium to remain a multipurpose space for events such as performances, movies and functions – weddings, conferences, etc. 3. The proposed new development of the ‘commercial kitchen’ has been designed with capacity to handle 300 persons at a function/movie. 4. Adjacent to the kitchen is a new store area that will cater for the storage of seating benches, tables, seats, etc required for the auditorium various functions and layouts. In this extension therewill also be 2 unisex toilets and changeroom that will cater for the additional patronage of the venue and staff. 5. Proposal is to upgrade the adjoining lawn area and to provide additional direct egress from the auditorium to a new formal landscaped area with raised platform and arbour that can be utilised as a wedding venue or can be a ‘breakout’ space for conferences, etc 6. The front area where kitchen currently operates is then to be upgraded to become a kitchenette (for movie use) and use of this area as a small function / meeting / seminar / booking office space - where the external access is to be removed and floor levelled. 7. The proposal for the rear of the building at ground level is for the placement of additional and reworking of existing storage areas to cater for the band equipment and storage of lightweight function equipment, decorations, waste, etc and allow space for staff carparking, deliveries and waste collection. 8. The proposal for the rear of the building at the upper / stage level is for the reworking of existing dressing room areas and placement of additional space that will cater for costume changes, allow access to either side of the stage and be a marshalling area for performances. This Conservation Management Plan identifies the management and maintenance tasks, which arise as a result of the heritage significance of the Athenium Theatre. Guidelines are required to ensure the appropriate management, statutory approvals and maintenance tasks are followed. For the Management & Maintenance Plan refer to Appendix 2 and for the Conservation / Maintenance Checklist refer to Appendix 3.

The Proposed Scope of Works section of this Conservation Management Plan is not intended to be an exhaustive specification for building works. It is an indicative list only intended to describe the Masterplan. It should be read in conjunction with the masterplan drawings, the conservation management plan and the opinion of probable cost. All work to comply with the NCC - Building Code of Australia (BCA), AS 1428.1 (General Disabled Access Code) and be subject to future detailed design and specification by relevant consultants.

Recommendation for the implementation of the masterplan designs is that arrangements should be put in place to engage a full team of consultants with relevant experience, including heritage, archaeology, services, structure and landscape consultants to assist in the preparation of tender / construction documentation based on the following stages / scope of works. Stage 1: Building repairs and maintenance including areas of damaged brickwork due to rising damp. Stage 2: Construct storage area, relocate stair, provide mechanical services to the building – upgrade the lighting & sound system for performances and movies.

Stage 4: Construct new kitchen / storage / toilet structure with link to auditorium and external function area. Stage 5: Rework kitchenette and ante area (close off street access doors and level floor) to become new operational / seminar / meeting area. Stage 6: Rework existing stores at ground level and construct link and dressing room space at upper/stage level. Stage 7: Further conservation works, building repairs and maintenance that that will enhance the internal and external areas of the building. Stage 8: Install solar panel system to roof and upgrade electrics.

The Opinion of Probable Construction Costs section of this Conservation Management Plan provides a costs for the Athenium Theatre Masterplanning Development and is based on the Masterplan Concept Drawings (MP1-MP5 inclusive) dated June 2018 for the proposed stages of the above project where undertaken by professional Contractors. The costs (at 2018 prices) for all stages of the proposed development / scope of works is between $1,188,000 and $1,422,500 Excl GST.
