Practice Materials: A Selective Annotated Bihliograpby*

The author provides a selective listing of Idaho legal publications, includ­ ing primary sources, treatises, and current continuing legal education materials that are typically used in the practice of law in Idaho.

Introduction This annotated bibliography is one in a series on state practice materials published in the Law Library Journal.! Both primary and secondary materials currently used in the practice of law in Idaho are included. This bibliography is arranged in five main parts. The first, "General Publications," encompasses commonly used primary source materials such as statutes, legislation, case reports, and administrative law materials. The sec­ ond, "Periodicals," includes legal and law-related journals and newspapers published in the state of Idaho. "CD-ROMs-Full Text" lists products that are comprised primarily of Idaho legal and law-related materials. The fourth part, "Electronic Services," contains such services that are primarily produced in Idaho and comprised of Idaho legal or law-related materials, either in full text or summary form, including those available through the Internet. The final part,

Annotations are derived directly from review of the materials themselves. Where materials were unavailable, annotations were based on printed descrip­ tions of the resource provided by publishers through sales literature or through direct contact. Bracketed information indicates that I supplied the information. Self-explanatory titles were not provided with annotations. . Excluded from this bibliography are audio-visual works, and articles and chapters from larger works unless reprints are available for purchase. Older and out-of-print titles are included only where they remain the best source in a particular topical area. Contact information for publishers, including addresses and telephone numbers, is provided ,in the appendix. Thornton's Idaho State Code. Idaho Falls, Idaho: Thornton Publishing Corp., 1991-. Annual. Four numbered softcover volumes containing an un annotated version of the current state code. The date of the last revision of each section is shown in parentheses following the text of the section. Volume 4 includes a detailed topical index and a list of sections affected with citation to legislative bill number. At separate charge, the publisher also provides a full-text version in WordPerfect (Windows or DOS); an electronic index which works on any IBM compatible computer; and Thornton's Citation Service. 3

Legislation Daily Data. Boise, Idaho: Idaho Legislative Services Office, 1970-. Issued weekly in a print compilation during legislative sessions. Enumerates each bill as introduced,

Idaho Reports: Reports of Cases Argued and Determined in the Supreme Court of the [Territory and} State of Idaho. Various publishers, 1882-1946. Cases since May 28, 1946 have been published by the West Publishing Company. Volumes 1 (published in 1882) and 2 (1903) contained decisions of the Supreme Court of Idaho Territory, covering the periods 1866-80 and 1881-90 respectively. Begin­ ning with volume 3 (1903) and continuing through volume 101 (1980-81), the Idaho Reports contained the decisions ofthe Supreme Court ofthe State ofIdaho. Starting with volume 102 (1981-82), decisions of the Court of Appeals, established in 1982, have been included. The Idaho Reports serve as the official reports of the state. Compilation of official opin­ ions, arranged by opinion number, and selected informal guidelines, arranged chronologically. Both sections include topical indices to relevant documents, and tables of statutes cited. Title, frequency, and publisher varies from 1890-1980. Single copies are available from the Office of the Attorney General. [Idaho Ethics Opinions]. Under the Idaho State Bar Commission Rules for Review of Professional Conduct, the Idaho Supreme Court has inherent power and exclusive responsibility for maintenance of standards for professional conduct, and for the structure and administration of review of such conduct. Disciplinary matters resolved by the Bar Commission's Professional Conduct Board, its hearing com­ mittees, or bar counsel may be required to be noted in The Advocate.7 Matters referred to the Idaho Supreme Court for review that result in formal sanctions by the Court are required to be printed in The Advocate, and are reprinted in the Idaho Supreme Court Report and the Idaho Court ofAppeals Report. Internally, the Bulletin is arranged sequentially using a uniform rule docketing system. Beginning with issue 95-5, May 3, 1995, the Bulletin includes a Sections Affected Index and a Cumulative Index of Adminis­ trative Rule-Makings in each issue. The Cumulative Index cumulates all changes to specific agency rules from July 1, 1993. Idaho Administrative Code. Boise, Idaho: Idaho Office of the State Controller, Division of Statewide Administrative Rules, 1994- . Eight numbered softbound volumes; to be supplemented annually. The Code is the official publication of final admin­ istrative rules. In its initial issue in 1994, the Code included all administrative rules in effect as of October 5, 1994. Periodicals Journals The Advocate. Boise, Idaho: Idaho State Bar, 1957- . Monthly. Official journal of the Idaho State Bar. Includes announcements and reports from the state bar and its sections, the Idaho Law Foundation, and local bar associations; articles; listings of CLE opportunities; disciplinary orders and opinions required to be published; court rule changes from state and federal Idaho courts; and synopses of issues in new cases on appeal. An annual pull-out section containing the Idaho Supreme Court annual report includes court rule revisions. The annual reports of the Idaho State Bar and the Idaho Law Foundation also appear in this journal. Back issues from volume 23 to the present (1980- ) are available on microfiche from William S. Two regular noteworthy features include "Court Decisions" (summarizing notable trial court cases) and "Verdicts and Settlements, ArbitrationlMediation Reports." Cop­ ies of opinions summarized in "Court Decisions" may be obtained from the ITLA office, as well as from the court in question.

Newspapers The Idaho Business Review. Boise, Idaho: Idaho Business Review, 1984- . Weekly. There is no exclusively legal or law-related newspaper in Idaho, but this newspaper provides the best coverage of state business and commercial affairs. A regular column, "The Law," focuses on legal issues'of interest to the business community. Section B of the paper, "News of Record," is comprised of information derived from public records in selected counties surrounding the Boise area. Among the information included are business filings, tax liens filed and released, district and magistrate court actions, bankruptcies, judgments, and Uniform Commericial Code filings. Idaho Statesman. Boise, Idaho: Idaho Statesman, 1864- . Daily. The Statesman pro­ vides the most comprehensive coverage of all branches of state government, as well as federal and local developments. No charge for basic access; subscribers to the Snake River Basin Adjudication Digest12 may access the service free of charge. Materials included on the service include both Digests and other documen­ tation and materials related to state government. Selected Snake River Adjudica­ tion decisions are available in full-text. State of Idaho Government Home Page. Boise, Idaho: Idaho Department of Admini­ stration, 1995-. Includes information and resources from the executive, legislative and judicial branches. The Judicial Home Page, which succeeds Idaholaw, the electronic bulletin board of the Idaho Supreme Court, includes full-text opinions of the Supreme Court and Court of Appeals within three hours of official release, as well as press releases on new decisions, summaries of cases on appeal, and court rules.
