MUNICIPAL ORDINANCE NO. 8 Series of 2018

AN ORDINANCE DECLARING THE OLD MUNICIPAL BUILDING AS A LOCAL CULTURAL AND HERITAGE SITE OF THE MUNICIPALITY OF BUENAVISTA, BOHOL.

WHEREAS, Article XIV, Section 14 of the 1987 Phil. Constitution provides that the State shall foster the preservation, enrichment, dynamic evolution of the Filipino national culture based on the principle of unity in diversity in the climate of free artistic and intellectual expression;

WHEREAS, Section 15 and 16 Article XIV of the Phil. Constitution likewise mandated the State to converse, promote, and popularize the nation’s historical and cultural heritage and resources as well as artistic creations , thus, it shall be under its protection and its disposition regulated;

WHEREAS, pursuant to this constitutional mandate, the Local Government Code, particularly Section 16 thereof, mandates that the Local government units ensure and support the preservation and enrichment of culture and to preserve the comfort and convenience of their inhabitants;

WHEREAS, Section 447 (a) 2 (vi) of the Local Government Code empowers the Sangguniang Bayan to prescribe reasonable limits and restraints on the use of property within the jurisdiction of the municipality;

WHEREAS, the old Municipal building is a very important part of the history of Buenavista because it was the first building built when the town of Buenavista was founded in 1960;

WHEREAS, the old Municipal Building of the Municipality of Buenavista located at Poblacion, Buenavista, Bohol, embodies and exemplifies the richness and abundance of culture and history of the municipality requiring its conservation and preservation to maintain the vast heritage and patrimony of the Boholano race, particularly the Buenavistahanon, for its present and future generations;

Municipal Resolution No. 8 (2) –

WHEREAS, in the pursuit of its objective to preserve the old Municipal Building it is imperative to declare it as a local cultural and Heritage Site and to become town’s tourism spots;

NOW, THEREFORE, be it ordained by the Sangguniang Bayan in Regular Session assembled that:

Section 1. Title.

This Ordinance shall be known as “An Ordinance Declaring the Old Municipal Building as Local Cultural and Heritage Site of the Municipality of Buenavista, Bohol;

Section 2. Purpose.

2.a To declare the Old Municipal Building of the Municipality of Buenavista as a Cultural and Historical Heritage Site;

2.b) To ensure the protection, preservation, and conservation of the old Municipal Building of Buenavista, Bohol;

2.c) To restrict any renovation, demolition or other related activities on the old Municipal Building except those repair and maintenance which are needed and necessary for the preservation of its architectural design;

Section 3. Enforcement and Implementation.

The Municipal Mayor through the Municipal Tourism Officer, Officials where the Old Municipal Building is situated and the Philippine National Police assigned in Buenavista Police Station shall enforce provisions of this Ordinance.

Section 4. Prohibited Acts.

Violations of this ordinance may be made by whoever intentionally:

4.1) Destroys, demolishes, mutilates or damages the Old Municipal Building;

4.2) Modifies and alters the original features of the Old Municipal Building;

4.3) Performs awkward and disrespectful gestures within the Old Municipal Building.

Section 5. Penalty Clause.

Any person, group or corporation found violating any of the provisions of this ordinance of cause the same to be done, shall be liable for a fine of Two Thousand Five Hundred Pesos (P2,500.00) and/or six (6) months imprisonment at the discretion of the court.

Section 6. Separability Clause.

If, for any reason or reason, any part or provisions of this ordinance shall be held to be unconstitutional or invalid, other parts or provisions hereof which are not affected thereby shall continue to be in full force effect;

Municipal Ordinance No. 8 (3) –

Section 7. Repealing Clause.

All ordinances, executive orders and administrative regulations, or parts thereof which are inconsistent with any of the provisions of this Ordinance are hereby repealed or modified accordingly;

Section 8. Effectivity.

This ordinance shall take effect after the SangguniangPanlalawigan approval and after its publication in at least one (1) newspapers of general circulation in the Province of Bohol;
