MINUTES CITY OF MELISSA CITY COUNCIL REGULAR MEETING MAY 25, 2021 5:15 p.m.

1. CALL TO ORDER AND ROLL CALL Mayor Reed Greer called the meeting to order at 6:00 p.m. Mayor Reed Greer, Mayor Pro Tem Jay Northcut, Chad Taylor, Stacy Jackson, Dana Conklin, and Shannon Sweat were present. Craig Ackerman was absent. Members of City Staff and the public were also present. 2. INVOCATION AND PLEDGE OF ALLEGIANCE Jay Northcut gave the invocation. All who were present gave the Pledge of Allegiance. 3. PUBLIC COMMENTS Tanner & Alyson Holder 4321 CR 413 Melissa, TX 75454 Mr. and Mrs. Holder addressed Council regarding item 5A on the Regular Agenda. There were no further comments. 4. CONSENT AGENDA A. Consider and act upon the minutes from the May 11, 2021 Regular Meeting and Work Session and May 18, 2021 Special Meeting. Council Action Motion was made by Jay Northcut and seconded by Shannon Sweat to approve the Consent Agenda as presented. Vote: 6/0/0 5. REGULAR AGENDA A. Consider and act upon a Resolution of The City Council of The City Of Melissa, Texas, exempting property consisting of 3.845± Acres in the Jesse Stiff Survey, Abstract No. 792, Collin County, Texas, from compliance with the development plat requirements set forth in Section 3.05 Of The City’s Subdivision Regulations solely with respect to the construction of one single-family residential structure in accordance with applicable rules and regulations of Collin County and The State Of Texas, and for no other purpose.

Applicant: Tanner Holder Director of Development and Neighborhood Services, Tyler Brewer presented the item to Council. Mayor Greer asked if there was any future roadway activity planned for the area of the property. Mr. Brewer stated that Collin County plans to expand the current County Road 413 in between the subject property and the upcoming Phase 5 of Meadow Run from approximately Melissa Road to Highway 380 in Princeton. Due to the future roadway expansion, it is typical with development plat requests that right- of-way dedication would be required. Shannon Sweat asked if there was a visual or graphic that showed how close the proposed house would be to the road in the future. Mr. Holder stated that he sent a drawing to the Development Services team with the house located on the east side of the property, not the west side where the roadway would be in the future. Mayor Greer asked City Manager, Jason Little to explain to Council what some of the options were for the item. Mr. Little stated that the options were: 1) approve the request which would allow staff to sign the Collin County ETJ form required for development, or 2) require the owner submit a development plat which would allow for further examination and time to consider the request to waive right-of-way dedication as well. A third option would be to table in order for staff to obtain more information for Council. Council Action Motion was made by Stacy Jackson and seconded by Shannon Sweat to table item 5A on the Regular Agenda to the June 8, 2021 Regular City Council Meeting. Vote: 6/0/0 B. Consider and act upon the Melissa Independent School District Coach Kenny Deel Stadium Final Engineering Site Plan, being 20.00± acres situated in the D.E.W. Babb Survey, Abstract No. 33, City of Melissa, Collin County, Texas and generally located approximately 2,138 feet southeast of the intersection of Sam Rayburn Highway and Milrany Lane, City of Melissa, Collin County, Texas as recommended by the Planning and Zoning Commission. Applicant: Melissa Independent School District Mr. Brewer presented the item to Council and explained the one variance request for parking since not all buildings on campus will be occupied at full capacity at any one time. Dana Conklin asked about parking and discrepancies between what was being presented vs. what the City requires. Kenny Deel with Melissa ISD addressed the charts comparing other school districts and the required 4 seats for every one parking space. Mr. Deel stated that the

stadium will likely be completed around December, 2022 which is when the next phase of construction will begin. At that time, there should be 2,800 parking spots, which exceeds the required 4-to-1 required ratio. Council discussed the parking space numbers and ratios. Mildred Bautista of Parkhill, Smith, & Cooper spoke to the question about the number of parking spaces after stadium construction, and then at final buildout. Mayor Greer asked for clarification as to where the 4-to-1 seat-to-parking spaces comes from and Mr. Brewer clarified that it comes from the City’s zoning ordinance for the stadium. Mrs. Conklin asked if the school had a written police and parking control plan in place currently for events and school functions that was utilized and enforced. Mr. Deel stated that there was and it is. Duke Sparks stated that there is a plan with Melissa Sports, LLC and the Z-Plex to allow for overflow parking with a pedestrian crossover should that be necessary. Council Action Motion was made by Shannon Sweat and seconded by Stacy Jackson to approve the Melissa Independent School District Coach Kenny Deel Stadium Final Engineering Site Plan, being 20.00± acres situated in the D.E.W. Babb Survey, Abstract No. 33, City of Melissa, Collin County, Texas and generally located approximately 2,138 feet southeast of the intersection of Sam Rayburn Highway and Milrany Lane, City of Melissa, Collin County, Texas as recommended by the Planning and Zoning Commission. Vote: 5/1/0 Dana Conklin voted against the request. C. Consider and act upon the New Melissa High School Addition Replat, being 77.318± acres situated in the D.E.W. Babb Survey, Abstract No. 33, City of Melissa, Collin County, Texas and generally located on the east side of Milrany Lane approximately 1,067 feet to the south of the intersection of Sam Rayburn Highway and Milrany Lane, City of Melissa, Collin County, Texas as recommended by the Planning and Zoning Commission. Applicant: Melissa Independent School District Mr. Brewer stated that that the replat was in full compliance with the City’s code, all comments had been addressed, and staff recommends approval of the item as does the Planning and Zoning Commission. Council Action Motion made by Shannon Sweat and seconded by Jay Northcut to approve the New Melissa High School Addition Replat, being 77.318± acres situated in the D.E.W. Babb Survey, Abstract No. 33, City of Melissa, Collin County, Texas and generally located on

the east side of Milrany Lane approximately 1,067 feet to the south of the intersection of Sam Rayburn Highway and Milrany Lane, City of Melissa, Collin County, Texas as recommended by the Planning and Zoning Commission. Vote: 6/0/0 D. Consider and act upon the Stoneridge Phase 1 Final Plat, being 50.326± acres situated in the J. Throckmorton Survey, Abstract No. 900 and the J. Emberson Survey, Abstract No. 294, City of Melissa, Collin County, Texas and generally located approximately 2,310 feet to the northeast of the intersection of Melissa Rd and Telephone Rd, City of Melissa, Collin County, Texas as recommended by the Planning and Zoning Commission. Applicant: Melissa 75, LLC Mr. Brewer stated that the plat complies with the City’s code, all staff comments had been addressed, and both staff and the Planning and Zoning Commission recommend approval. Council Action Motion was made by Chad Taylor and seconded by Shannon Sweat to approve the Stoneridge Phase 1 Final Plat, being 50.326± acres situated in the J. Throckmorton Survey, Abstract No. 900 and the J. Emberson Survey, Abstract No. 294, City of Melissa, Collin County, Texas and generally located approximately 2,310 feet to the northeast of the intersection of Melissa Rd and Telephone Rd, City of Melissa, Collin County, Texas as recommended by the Planning and Zoning Commission. Vote: 6/0/0 E. Consider and act upon authorizing the City Manager to Execute a Professional Services Agreement With EST, Inc. for Services Related to the Design, Procurement, and Construction Management of the SH 5 Utility Relocations. Mr. Little stated that TXDOT plans to reconstruct State Highway 5 from 121 to the Grayson County Line. The agreement before Council is to get the utilities out of the way of the construction area so that the reconstruction of the road can commence. TXDOT has stated that, should the City move utilities and the plans for the road change, TXDOT will be responsible for moving utilities in the future. Council Action Motion was made by Jay Northcut and seconded by Shannon Sweat to execute a Professional Services Agreement With EST, Inc. for Services Related to the Design, Procurement, and Construction Management of the SH 5 Utility Relocations. Vote: 6/0/0 F. Consider and act upon authorizing the City Manager to Execute a Professional Services Contract with ClayMoore Engineering for design services related to Cardinal Drive and Highland Road. Mr. Little stated that the agreement would continue a good relationship with ClayMoore regarding road design at a value that the City couldn’t get anywhere else.

Council Action Motion was made by Stacy Jackson and seconded by Shannon Sweat to authorize the City Manager to execute a Professional Services Contract with ClayMoore Engineering for design services related to Cardinal Drive and Highland Road. Vote: 6/0/0 G. Consider and act upon authorizing the City Manager to complete and execute AIA contract with Crossland Construction for Construction Manager at Risk services related to Public Safety facility. Mr. Little stated that the City received 9 submittals for the RFQ from April for CMAR services. After evaluation, three firms were selected for an interview process with a committee containing the City Manager, Police and Fire Chiefs, Finance Director, and Architect for the project. The three firms who were interviewed were Crossland Construction, Piazza Construction, and Pogue Construction. The interview committee recommends Crossland Construction based on their work throughout the City and Council Action Motion was made by Shannon Sweat and seconded by Chad Taylor to authorize the City Manager to complete and execute AIA contract with Crossland Construction for Construction Manager at Risk services related to Public Safety facility. Vote: 6/0/0 H. Consider and act upon a resolution rejecting all proposals submitted as part of RFP 21-001 related to the property located at 2322 Sam Rayburn Highway. Council Action Motion was made by Jay Northcut and seconded by Stacy Jackson to adopt a Resolution rejecting all proposals submitted as part of RFP 21-001 related to the property located at 2322 Sam Rayburn Highway. On the 22nd day of June, 2021, at 6:00 p.m., in the City Council Chamber at City Hall, 3411 Barker Avenue, Melissa, Texas 75454, the City Council of the City of Melissa, Texas (“City Council”) will hold a public hearing, giving all interested persons the right to appear and be heard on the proposed voluntary annexation by the City of Melissa, Texas (“Melissa”) of the area of land consisting of 4.019± acres, situated in the John Emberson Survey, Abstract No. 294, Collin County, Texas, more particularly described and depicted in Exhibit A, attached hereto and incorporated herein for all purposes.

SECTION 2: Area to be Annexed. The City Council may determine whether all of some of the above-described area will be annexed by Melissa, as evidenced by the motions made and subsequent actions of the City Council at a duly noticed public meeting, said actions being reflected in the minutes thereof.

SECTION 3: Authority to Provide Notice; Annexation Agreements. The City Manager, or his designee, is hereby authorized and directed to: (i) cause notice of such hearing to be published on Melissa’s website and in a newspaper having general circulation in Melissa and in the above-described area in accordance with the Municipal Annexation Act (Chapter 43, Texas Local Government Code) (“Act”), and as otherwise required by law; (ii) provide the required written notifications to the owner(s) of the property(ies) contained in the above-described area as well as any applicable public entities as required under the Act; (iii) offer any annexation agreements, as required by law, or as the City Manager deems appropriate, as he solely determines, for Melissa, in accordance with the Act; and (iv) execute the form of any and all annexation agreements described herein.

Re: City of Melissa, Texas - Melissa North Elevated Storage Tank Site Improvements

Dear Mr. Little:

EST, Inc. (EST) opened sealed bids for the project known as Melissa North Elevated Storage Tank Site Improvements at 2:01 PM on May 25th. Two bids were received and publicly read aloud at City Hall. EST reviewed the two submitted bid proposals and determined them to be in compliance with the bid documents. The two sets of bid documents were evaluated to find out which bid offered the best value to the City for items such as bid amount, safety record, current and future workload, equipment inventory, and client references.

Based on our review of the two submitted bid packages, Harrison Walker & Harper (HWH) submitted the lowest tabulated amount for the base bid. The tabulated total amount of the base bid from HWH is $2,816,316.40 and the total from Canary Construction (Canary) is $3,467,751.00. Comparing the two base bids, HWH is $651,434.60 lower than Canary. The submitted schedule for HWH is 260 calendar days less than that of Canary (440 calendar days compared to 180). The engineer’s estimate of the base bid is $2,966,132.40 which is close to the total submitted by HWH.

The bid package also included two alternate bid items for consideration. Alternate bid item Alt-SD2 was included in the bid to get pricing of 609 linear feet of 24-inch Class III corrugated plastic pipe in lieu of the 609 linear feet of 24-inch Class III reinforced concrete pipe included in the base bid. The pricing of Alt-SD2 submitted by HWH will save the City $12.05 per linear foot for a total savings of $7,338.45. EST and Melissa Public Works do not see a benefit in paying extra for the reinforced concrete pipe and recommends adding the alternate corrugated plastic pipe item to the proposed construction contract.

Alternate bid item Alt-W9 was included to get pricing on 24-inch PVC water line in lieu of the 24-inch ductile iron item included in the base bid. This alternate bid was higher than the base bid for both bidders, so EST recommends to not consider adding this item to the proposed construction contract.

By replacing 609 linear feet of base bid item SD1 with alternate bid item Alt-SD2, the total bid total for HWH is $2,808,977.95 compared to a total from Canary of 3,461,661.00.

In addition to reviewing the bid numbers, EST contacted area municipalities who have worked with HWH in the past, and they have all recommended HWH as a general contractor for projects similar in scope and size to this one. EST also contacted HWH’s Vice President of Construction regarding current project workload and backlog, available project personnel, and available equipment. HWH plans to subcontract out the utility work to Acadia Services, who is currently installing utilities on the Melissa Road and Harrison Street Improvements project as well as several residential subdivision projects in town. EST is pleased with the quality of work Acadia Services has performed on these projects and has no concern with them meeting expectations of the City for this project. Acadia’s project manager was contacted to ensure they had adequate equipment, project personnel, and project experience to complete the work required on this project.

Conversations with HWH and their primary subcontractor, Acadia Services, raised no concerns regarding HWH’s ability to complete the project within the submitted schedule and to the quality the City of Melissa expects on every construction project. Therefore, based on their lower bid price and complete bid package evaluation, EST determines Harrison Walker & Harper (HWH) to be the bidder presenting best value to the City of Melissa, and EST recommends they be awarded the construction contract for the Melissa North Elevated Storage Tank Site Improvements project.

Summary of Subject

This request is to gain approval to apply for a matching grant from the Collin County Parks and Open Space Project Funding Assistance Program to construct a sub-surface crossing for Brookside at SH 121.

When the citizens of Melissa are surveyed regarding parks and recreation, the number one request that our citizens wanted is Parks/Open spaces to congregate and trails connecting the community. The City of Melissa has been implementing a comprehensive walking/biking plan that is a combination of City constructed paths as well as trails that are developed as part of subdivision master development plans since suburban development resumed after the Great Recession.

Recently, the City of Melissa updated its City-wide Trail Plan to identify existing trails in the community, as well as trails/walk paths that were being built as part of master plans for subdivision developments. The goal was to visually see where gaps exist to connect people from one side of Melissa to the other. As the City evaluated top priorities, it was determined a means for citizens north of State Highway 121 and citizens south of State Highway 121 to have a safe path to cross from side to side was a top priority and one that would not require pedestrians to interface with high speed, high volume traffic. As a matter of safety on such a high traffic, high speed road as SH 121, it was determined the best way to allow this citizen traffic flow was to create a sub-surface trail/sidewalk under SH 121.

This proposal is to create a sub-surface trail that goes under SH 121 at Clemmons Creek. This sub-surface connector will include a switch back on the south side of SH 121 under the road and connecting with the existing trail on the west end of the Brookside subdivision. This sub-surface trail will allow citizens/students from all subdivisions north of SH 121 to begin to have a trail to connect to Melissa High School on Milrany Road (f/k/a FM 2933). Once constructed, this trail connector will allow citizens of the Trails of Melissa, Milrany Ranch, South Meadow, Avilla Springs, and Meadow Run subdivisions to cross under SH 121 safely to connect to trails that will connect them to the 90-Acre Park being developed at the intersection of Liberty Way and Throckmorton.

The terms of the grant is for a matching of funds. It is estimated that the total cost for this project will be $310K. The City is seeking a match from the Collin County Parks and Open Space Project Funding Assistance Program of roughly $150K.

The Melissa Community and Economic Development Corporation (4B Board) recommends to City Council to proceed with the grant matching application as detailed in minutes from 4B Board meeting on May 20, 2021. This project will initially be funded through the Parks Development Fees to later be reimbursed by the Collin County Parks and Open Space Project Funding Assistance Program and/or future bond sales.

When the citizens of Melissa are surveyed regarding parks and recreation, the number one request that our citizens wanted is Parks/Open spaces to congregate and trails connecting the community. The City of Melissa has been implementing a comprehensive walking/biking plan that is a combination of City constructed paths as well as trails that are developed as part of subdivision master development plans since suburban development resumed after the Great Recession.

Recently, the City of Melissa updated its City-wide Trail Plan to identify existing trails in the community, as well as trails/walk paths that were being built as part of master plans for subdivision developments. The goal was to visually see where gaps exist to connect people from one side of Melissa to the other. As the City evaluated top priorities, it was determined a means for citizens north of State Highway 121 and citizens south of State Highway 121 to have a safe path to cross from side to side was a top priority and one that would not require pedestrians to interface with high speed, high volume traffic. As a matter of safety on such a high traffic, high speed road as SH 121, it was determined the best way to allow this citizen traffic flow was to create a sub-surface trail/sidewalk under SH 121.

This proposal is to create a sub-surface trail that goes under SH 121 at Clemmons Creek. This sub-surface connector will include a switch back on the south side of SH 121 under the road and connecting with the existing trail on the west end of the Brookside subdivision. This sub- surface trail will allow citizens/students from all subdivisions north of SH 121 to begin to have a trail to connect to Melissa High School on Milrany Road (f/k/a FM 2933). Once constructed, this trail connector will allow citizens of the Trails of Melissa, Milrany Ranch, South Meadow, Avilla Springs, and Meadow Run subdivisions to cross under SH 121 safely to connect to trails that will connect them to the 90-Acre Park being developed at the intersection of Liberty Way and Throckmorton.

In the exhibits in Section 7 is a proposed concept of the Brookside Crossing at SH 121. The graphic depicts the switch back on the south side of SH 121 that will be created to travel below grade and to construct the 10’ sub-surface trail under SH 121 to connect to the existing trail on the north side at Brookside Drive.

The other exhibit is from our City of Melissa Trails Master Plan dated April 2021. Trails Enlargement Plan C (2) shows the location of the proposed Brookside Crossing at SH 121. The orange section in the upper left shows the location of the 90-Acre Park referenced above in Section 6.

Parking lot extensions are in process. Additional storm drain being installed before parking lot extensions are poured.

7. Discuss and act on Phase 4 of the Z-PLEX. i. Piazza Construction chosen as CMAR with estimated budget of $7M-$8M. ii. Possible partners for third party , and building are still being determined. iii. Amy and Paula provided recommendation for playground like the playground that was recently built in Trinity Falls. Estimated total budget for playground is $300K.

8. Discuss and act on Phase 1 of 90-Acre Park. i. Crossland Construction chosen as CMAR with estimated budget of $3M - $4M. ii. Goal is to be funded by September 2021 for construction to begin in mid-September with a completion date of end of the year, weather permitting.

9. Discuss and act upon Phase 2 of Country Ridge Park. i. Crossland Construction chosen as CMAR with estimated budget of $500K - $700K ii. Evaluating the cost to build fence between park and property owners. iii. Existing pond will be filled in since Lake Perry Fisher will now be available. iv. Plan to put twenty lights about 200’ apart around Lake Perry Fisher.

10. Discuss and act on restoration of Scott-Barker House. i. Historical house with severe drainage and foundation issues. Architexas has stated that the house needs to be lifted onto a new foundation much like the process of moving a house. This unexpected expense increase has raised the estimated budget for external restoration to around $300K ii. Ron has sent request to Piazza Construction to get a confirmation that cost is appropriate. iii. Amy sent contact information for Burl Cunningham as another person to reach out to for comparison costing. Burl moves homes, essentially, we would be lifting Scott-Barker House on to new foundation much like moving a house. We just are not moving the house.

11. Discuss and act on Clemons Creek at State Highway 121 sub-surface crossing. i. Ron discussed the project with the Board to create a sub-surface crossing under State Highway 121 at Clemons Creek for an estimated cost of $310K. ii. Goal is to submit project to Collin County Parks and Open Space Project Funding Assistance Program for a matching grant. This is the same process the City followed for the spine trail along Liberty Way at the 90-Acre Park. iii. This crossing would allow citizens from Trails of Melissa and soon to be developed Avilla Springs to safely cross under State Highway 121 and connect to trail system that will allow them to access 90-Acre Park. iv. Furthermore, this sub-surface crossing would allow citizens on the north of State Highway 121 to safely cross under the highway and as Availla Springs is developed provide a pathway to the high school on Milrany Road. v. It is proposed that these funds are paid out of the Park Development Fees to get the project started with reimbursement later coming from the Collin County Parks and Open Space Project Funding assistance program and/or future bond sales.

• Motion by Dirk Bush second by Terry Chaloupka to recommend to City Council to proceed with Collin County Parks and Open Space Project Funding assistance program for the sub-surface crossing under State Highway 121 at Clemons Creek. The estimated cost according to PK is $310K for a 10’ trail switch back on the south side of State Highway 121 crossing under the highway and connecting to the trail along Brookside drive on the north side of State Highway 121. It is recommended that these funds are paid out of Park Development Fees with reimbursement from Collin County Parks and Open Space Project Funding and/or future bond sales.

Chimney climber for Bob Miller install delayed because of rain and needing to update anchor supports. ii. 75/121 Interchange still working on resolution to mow and remove existing vegetation in the weeping love grass areas and then re-seed. iii. City backup water fill has some issues that Pacheco Koch is addressing with TxDOT/AALC as warranty concerns.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MELISSA, TEXAS:

SECTION 1: The City Manager of the City of Melissa, Texas is hereby authorized to submit the grant application to the Collin County Parks and Open Space Project Funding

Assistance Program concerning a matching grant for approximately $150,000.00 for the construction of the subsurface SH 121 trail connector project.
