Wrigley Field Experience Waiver of Liability / Publicity Form Read This Notice Carefully WRIGLEY FIELD EXPERIENCE WAIVER OF LIABILITY / PUBLICITY FORM READ THIS NOTICE CAREFULLY. YOU MUST EXECUTE THIS DOCUMENT AND AGREE TO ITS TERMS IN ORDER TO PARTICIPATE IN AN EVENT ON WRIGLEY FIELD. I, the individual signing below, in consideration of the Chicago Cubs (the “Cubs”) allowing me to participate in an event at Wrigley Field, hereby acknowledge, appreciate and agree: 1. I know baseball is an action sport. I also know natural and man-made obstacles or hazards and surface and environmental conditions may be present on the field, in the stands and throughout the stadium during my visit to Wrigley Field (the “Event”) and each may carry a significant risk of personal injury to me and/or damage to my property. At all times when on or around Wrigley Field, I agree to take an active role in identifying and accepting those risks, conditions, obstacles and hazards. I am not required to undertake or participate in the Event—I have freely elected to do so and am choosing to participate in the Event at my own risk. I assume all risk incidental to the game of baseball and/or softball and the play at Wrigley Field, including (but not exclusively) the danger of being injured by or in connection with any released bat or thrown or batted ball. I agree the Cubs, Wrigley Field, the entity sponsoring the Event (“Sponsor”), and their respective agents and employees are not liable for any injuries. 2. I, my heirs, assigns, administrators, executors, legal and personal representatives, and next of kin HEREBY RELEASE, WAIVE AND FOREVER DISCHARGE, PROTECT AND SAVE HARMLESS CUBS, Wrigley Field, Chicago Cubs Charities, the MLB Entities, Sponsor, and its and their respective parent companies, subsidiaries, partners, successors, assigns, officers, members, managers, players, directors, employees, agents, officials, players, representatives, other participants, sponsoring agencies, sponsors, and advertisers, and the owners and lessors of any premises used to conduct the Event (collectively, the “Released Parties”), from all past, present and future claims or allegations of any nature whatsoever, whether known or unknown, and including but not limited to bodily injury or death, WITH RESPECT TO THE EVENT, any promotion or publicity about the Event, AND/OR ANY AND ALL INJURY, DISABILITY, DEATH, or loss or damage to person or property, WHETHER CAUSED BY THE NEGLIGENCE OF ANY OF THE RELEASED PARTIES, OTHER EVENT PARTICIPANTS OR OTHERWISE. For purposes of this Waiver of Liability/Publicity, “MLB Entities” shall mean the Office of the Commissioner of Baseball, its Bureaus, Committees, Subcommittees and Councils, MLB Advanced Media, L.P., Major League Baseball Enterprises, Inc., Major League Baseball Properties, Inc., the Major League Baseball Clubs, The MLB Network, LLC, Tickets.com, Inc., and each of their respective subsidiaries or affiliated entities, any entity which, now or in the future, controls, is controlled by, or is under common control with the Major League Baseball Clubs or the Office of the Commissioner of Baseball. 3. I agree to abide by all rules and regulations of Wrigley Field. I understand the Cubs have the right to remove me from Wrigley Field and/or to terminate the Event at any time and for any reason in the Cubs’ sole and absolute discretion. 4. I understand and agree the Event is for the sole purpose of my entertainment. Any pictures or photographs take shall be used solely for my private, non-commercial use. No sale, transmission, distribution or commercial use may be made of the pictures, descriptions or use of Wrigley Field or the Event. 5. I hereby grant to the Released Parties and their respective designees the right to use my name, voice, photograph, actions and likeness any video and/or audio recordings of my appearance in or around Wrigley Field and any other facts about me or my participation in the Event, in perpetuity (i.e., forever) throughout the universe in all media without limitation and without additional compensation or consideration, notification or permission, unless prohibited by law. 6. I HEREBY AGREE TO INDEMNIFY AND SAVE AND HOLD RELEASED PARTIES HARMLESS from any loss, liability, damage, or cost (including attorneys’ fees) (collectively, “Costs”) arising from my participation in the Event whether caused by the Released Parties’ negligence or otherwise. 7. I, my heirs, assigns, administrators, executors, legal and personal representatives, and next of kin will not make any claim or take any actions or proceedings of any type in respect of any matter referred to in this release against any of the Released Parties or against any other person, corporation, firm or government authority who or which might claim contribution, indemnity or relief from or over the Cubs. 8. I expressly agree this Waiver is intended to be as broad and inclusive as permitted by the laws of the State of Illinois, and this Waiver shall be governed by and interpreted in accordance with the laws of the State of Illinois (excluding choice of law provisions). I agree in the event that any clause or provision of this Release shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this Release which shall continue to be enforceable Any action related to this waiver or its terms may be brought only in a federal or state court sitting in Chicago, Illinois. No such action may be brought as a class action. I hereby declare I have reached the age of 18 years (or my custodial parent/legal guardian is signing below); I have carefully read all of the foregoing; I fully understand its contents; I have given this release and waiver of my own free will; and this release and waiver binds my heirs, assigns, administrators, executors, legal and personal representatives, and next of kin.
