S., Thanks for your call just now. You asked about what happened to Gonzalo's case in the 3rd DCA. As outlined below, we tried to get Gonzalo's conviction vacated in the state court system because of his initial lawyer's ineffective assistance of counsel. This effort failed because a motion for post conviction relief must be filed within 2 years of the conviction. For a brief period, it looked as though, that period could be extended for Gonzalo because of the facts of his case, but the Florida Supreme Court and the Supreme Court have foreclosed that argument. On March 26, 2012, Gonzalo filed a motion for post conviction relief in the Miami-Dade Circuit Court. Essentially, Morales argued that he did not make a knowing and voluntary guilty plea because his lawyer and the Court did not advise him of the immigration consequences of his plea. This argument was based on the case Padilla v. Kentucky, 130 S. Ct. 1473 (2010). The biggest hurdle on this motion was that his conviction was in 1995, and a petition for post conviction relief must be filed within 2 years of the conviction. Morales argued that Padilla should be applied retroactively and therefore his petition was timely. At the time, the Florida Supreme Court was considering whether Padilla was retroactive- Hernandez v. State, 61 So. 3d 1144 (Fla. 3d DCA 2011). Based on these circumstances, we asked the trial court to stay the case until the Supreme Court ruled. Initially the judge held the case in abeyance. On May 24, 2012, she denied the motion as time barred. We file a notice of appeal in the 3rd DCA on June 15, 2012. The Court affirmed the trial court in a per curiam opinion on August 8, 2012. We filed a motion for rehearing on August 20, 2012 to get the case certified to the Supreme Court. The Court denied that motion on September 18, 2012. Subsequently, the Florida Supreme Court (Hernandez v. State, SC11-941 (2012)) and the United States Supreme Court (Cahidez v. United States, 133 S. Ct. 1103 (2013)) held that Padilla is not retroactive. As a result, Gonzalo's motion to vacate was late (it needed to be filed by 1997). In short, Gonzalo tried to get his conviction vacated through the state court process because of ineffective assistance of counsel. There was a chance that because of the facts of Gonzalo's case, he could file the petition beyond the normal 2 year deadline. The Florida Supreme Court and the United States Supreme Court have now ruled that the normal deadline applies. Gonzalo Morales has not further rights on this matter in state or federal court. Wansley Walters, Former Secretary of the Florida Department of Juvenile Justice, Joins Ballard Partners' Tallahassee Office

TALLAHASSEE – Ballard Partners, Florida’s leading governmental affairs firm, today announced the addition of Wansley Walters, a nationally recognized leader in juvenile justice, as a new partner in the Tallahassee office. Walters will co-chair the firm’s public policy team with a strategic focus on children, youth and justice issues.

“Wansley is a highly-respected voice in Florida government and she’s a proven leader with a track record of success," said Brian Ballard, president of Ballard Partners. "We are excited to bring her level of expertise and knowledge to our clients and their issues.”

Walters was appointed by Governor Rick Scott in 2011 to serve as Secretary of the Florida Department of Juvenile Justice (DJJ). Under her leadership, Florida saw the lowest juvenile crime rate in 30 years. As the head of DJJ, Walters launched the Roadmap to System Excellence, which transformed the juvenile justice system in our state and emphasized the importance of prevention services. These reforms were so successful in reducing juvenile recidivism that they were unanimously passed by the Florida Legislature during the 2014 Legislative Session and signed into law by Governor Scott. Florida has since become a national model for juvenile justice. Walters also currently serves as Chair of the Florida Children and Youth Cabinet, a position she was appointed to by Governor Scott.

Walters previously served as the Director of the Miami-Dade County Juvenile Services Department for 14 years before being tapped by Governor Scott to lead the statewide agency. During her tenure as Director of the Miami-Dade County Juvenile Services Department, Miami-Dade had the lowest youth incarceration rate in the state and also boasted one of Florida’s lowest juvenile crime rates. Walters developed and led reforms that resulted in a savings of more than $30 million annually, a 51 percent reduction in juvenile arrests and an 80 percent reduction in juvenile recidivism. Prior to that role, Walters worked at the Miami-Dade Police Department as the Special Projects Administrator and then as Special Assistant to the Director of the Miami-Dade Police Department.

Walters has presented at numerous state, national and international conferences on juvenile justice. She received the 2012 Juvenile Justice Without Borders International Award presented by the International Juvenile Justice Observatory during the International Youth Justice Convention in London. Walters received her Bachelor of Arts in Speech Communications from the University of South Florida.

Governor Rick Scott Appoints Stephen Nielsen to Board of Pilot Commissioners

Tallahassee, Fla. – Today, Governor Rick Scott announced the appointment of Stephen Nielsen to the Board of Pilot Commissioners.

Nielsen, 70, of Davie, is the vice president of Caribbean Atlantic Shore Operations for Princess Cruises. He fills a vacant seat and is appointed for a term beginning May 16, 2013, and ending October 31, 2013.

The appointment is subject to confirmation by the Florida Senate.

• The consistency at which the Legislative Budget Commission (LBC) meets could be an issue when trying to submit Work Program Amendments. • This will impair the Departments ability to respond to unforeseen issues and emergencies effecting Florida’s transportation system. (Examples below). • In acknowledgment of staff concerns of FDOT processes the Department added an informal review process by Appropriations staff prior to submittal. (There have been several instances during the informal review process that Appropriations staff had raised concerns and the Department never formally submitted the draft Work Program Amendment).

Emergency Response • $32m - Tropical Storm Debbie resulting in the flooding and closure of I-10 in 5 locations, causing traffic to be detoured off the interstate. This project elevated a portion of the roadway and included drainage improvements to avoid future interstate closures. • $5m - Emergency repair project for the Flagler Bridge in Palm Beach County. Immediate repairs needed due to settlement causing cracking of the foundation so that bridge could be restored to full operation.

Immediate Safety Projects • $5.1m - Project to install guardrails along both sides of SR80 in Palm Beach County. The project had been planned for the next five year work program but was added to current year due to the increasing number of fatal crashes along this road. • $17m - Road improvements to address lane departure crashes on SR164A in Jackson County. • $4.2m - Resurfacing of Sawgrass Expressway in Broward. Project added because the road “is experiencing rapid deterioration. To prevent damage at the structural level and avoid potential safety issues.” • $5.6m - Drainage improvements to SR116 in Duval County. Project added due to the deterioration of the corrugated metal pipes under the roadway.

Appropriation for Community Redevelopment Agencies Pursuant to SB 1216 (2015)

SB 1216, sponsored by Senator Simpson, and signed by Governor Scott on May 14, 2015, expanded the definition of “blighted area,” to allow CRAs to enter into voluntary contracts to assist with the redevelopment of properties damaged by sinkhole activity. Additionally, the budget includes corresponding language which provides:

From the funds provided in Specific Appropriation 2233A, $2,000,000 of nonrecurring funds from the State Economic Enhancement and Development Trust Fund are allocated to the Department of Economic Opportunity to provide grants to Community Redevelopment Agencies for the purpose of providing seed moneys to assist local communities in their efforts to address the natural phenomenon of subsidence by redeveloping areas undergoing blight due to damage caused by ground subsidence.

(1) Some examples of how the funds could be used by the CRA are as follows:

a) Compiling and assessing the data and analysis necessary for compliance with the statutory requirements for creating the CRA pursuant to s.163.356, including but not limited to Notices to the public, advertising, mailing, and the employment of an executive director, technical experts and such other agents and employees, permanent and temporary, including legal and financial experts.

b) Activities and professional services necessary for the development and approval of the Community Redevelopment Plan pursuant to s.163.360, including but not limited to notices to the public, advertising, mailing and the employment of urban planning professionals, experts, real estate appraisers, demolition experts, dispute resolution professionals, economist, affordable housing experts, engineers, traffic consultants and emergency management experts.

c) Activities and professional services necessary for the implementation of the Community Redevelopment Plan, including but not limited to notices to the public, advertising, mailing and the employment of urban planning professionals, experts, real estate appraisers, demolition experts, dispute resolution professionals, economist, affordable housing experts, engineers, traffic consultants and emergency management experts.

e) Activities and professional services necessary for the development of and implementation of a plan for financing including bond financing, including but not limited to financial advisors, bankers, underwriters, bond counsel, disclosure counsel and related professionals.

f) Activities and professional services necessary for the development and implementation of a plan regarding insurance coverage including but not limited to becoming self-insured, to enter risk management programs, to enter into contracts with re-insurers or relating to re-insurance, or to purchase liability insurance for whatever coverage they may choose or to have any combination thereof in anticipation of any claim, judgment or claims bill; when agencies are subject to homogeneous risk, they may purchase insurance jointly or may join together as self-insurers to provide other means in accordance with s. 768.28(16).

g) Providing assistance to homeowners and other property owners including repairs to damaged property and associated costs consistent with SB 404 and in compliance with the Community Redevelopment Plan, including architects, surveyors, engineers, design professionals..

h) Such other expenditures not inconsistent with the scope of authority prescribed by the "Community Redevelopment Act of 1969”, s.163.330, et seq.

Appropriation for Community Redevelopment Agencies Pursuant to SB 1216 (2015)

SB 1216, sponsored by Senator Simpson, and signed by Governor Scott on May 14, 2015, expanded the definition of “blighted area,” to allow CRAs to enter into voluntary contracts to assist with the redevelopment of properties damaged by sinkhole activity. Additionally, the budget includes corresponding language which provides:

From the funds provided in Specific Appropriation 2233A, $2,000,000 of nonrecurring funds from the State Economic Enhancement and Development Trust Fund are allocated to the Department of Economic Opportunity to provide grants to Community Redevelopment Agencies for the purpose of providing seed moneys to assist local communities in their efforts to address the natural phenomenon of subsidence by redeveloping areas undergoing blight due to damage caused by ground subsidence.

(1) Some examples of how the funds could be used by the CRA are as follows:

a) Compiling and assessing the data and analysis necessary for compliance with the statutory requirements for creating the CRA pursuant to s.163.356, including but not limited to Notices to the public, advertising, mailing, and the employment of an executive director, technical experts and such other agents and employees, permanent and temporary, including legal and financial experts.

b) Activities and professional services necessary for the development and approval of the Community Redevelopment Plan pursuant to s.163.360, including but not limited to notices to the public, advertising, mailing and the employment of urban planning professionals, experts, real estate appraisers, demolition experts, dispute resolution professionals, economist, affordable housing experts, engineers, traffic consultants and emergency management experts.

c) Activities and professional services necessary for the implementation of the Community Redevelopment Plan, including but not limited to notices to the public, advertising, mailing and the employment of urban planning professionals, experts, real estate appraisers, demolition experts, dispute resolution professionals, economist, affordable housing experts, engineers, traffic consultants and emergency management experts.

15020/00/00991082.DOCXv2 d) Activities and professional services necessary for the procurement of federal, state and local funding sources, including funding from the Federal Emergency Management Agency, including but not limited to notices to the public, advertising, mailing and the employment of urban planning professionals, experts, real estate appraisers, demolition experts, dispute resolution professionals, economist, affordable housing experts, engineers, traffic consultants and emergency management experts.

e) Activities and professional services necessary for the development of and implementation of a plan for financing including bond financing, including but not limited to financial advisors, bankers, underwriters, bond counsel, disclosure counsel and related professionals.

f) Activities and professional services necessary for the development and implementation of a plan regarding insurance coverage including but not limited to becoming self-insured, to enter risk management programs, to enter into contracts with re-insurers or relating to re-insurance, or to purchase liability insurance for whatever coverage they may choose or to have any combination thereof in anticipation of any claim, judgment or claims bill; when agencies are subject to homogeneous risk, they may purchase insurance jointly or may join together as self-insurers to provide other means in accordance with s. 768.28(16).

g) Providing assistance to homeowners and other property owners including repairs to damaged property and associated costs consistent with SB 404 and in compliance with the Community Redevelopment Plan, including architects, surveyors, engineers, design professionals..

h) Such other expenditures not inconsistent with the scope of authority prescribed by the "Community Redevelopment Act of 1969”, s.163.330, et seq.

As discussed, I understand Lt. Gov. Carroll will visit the Boca Raton area on june 29th. I am interested in scheduling two additional visits for that time period, if possible. A good client, Broken Sound Country Club is completing a major renovation and expansion. Its general manger, Mr. John Crean has requested that the Lt. Gov. dedicate the new ladies card room at the Club. Additionally, I would like to host a "meet and greet" for the Lt. Gov. inviting approximately 20 to 30 business and political leaders from the area. If the Broken Sound invitation is accepted, i would also do the meet and greet at Broken Sound around the same time. Broken Sound has requested that the dedication be in late june or july. I am not available from july 1st thru july 11th. Please let me know if we can work these 2 events into the Lt. Gov's schedule. thank you.
