DECLARATION OF OPENING/ ANNOUNCEMENT OF VISTORS The Presiding Member declared the meeting open at 6:02pm. 2. PUBLIC QUESTION/STATEMENT TIME Trevor Kowald representing the Katanning Clay Target Club voiced his concerns that if Round Drive closed, that the members of the target club couldn’t use that access to get to their shooting range. He said that he thinks it’s very important to keep it open as it is a boundary between rural and the residential area and is a barrier for fires. He was concerned that if it closed it would increase the traffic going through the residential area. He requested that Council consider the rate payer when making their decision. David Stade from the Katanning Country Club clarified that the road will remain in place but gated with a lock and will be accessible if needed for fire emergency. He said that they would be prepared to liaise with the Clay Target Club to have access when needed and was prepared to work best with the community. Max Wise voiced his concern that there would be no access from Marmion Street if there was a fire and urged council to keep the road open and review the law with respect to objections to closing a road. Julian Murphy advised that the legislation (Land Administration Act 1997) required Council to consider any objections before making a request to close a road. 6. APPLICATIONS FOR LEAVE OF ABSENCE 6.1 Application for Leave of Absence Cr Mydie MOVED: CR ALEP MYDIE SECONDED: CR DANNY MCGARTH OC49/17 That Council grants Cr Mydie leave of absence for June 2017. CONFIRMATION OF MINUTES OF PREVIOUS MEETING 8.1 Ordinary Council Meeting – 26 April 2017 (SEE ATTACHED MINUTES) MOVED: CR MARTIN VAN KOLDENHOVEN SECONDED: CR SERENA SANDWELL OC50/17 That the minutes of the Ordinary Council Meeting held on Wednesday 26 April 2017 be confirmed as a true record of proceedings. ANNOUNCEMENTS BY PRESIDING MEMBER WITHOUT DISCUSSION We acknowledge the traditional owners of this land the Noongar Goreng people and pay respect to their elders past and present Sorry day is a day that pays tribute to the Stolen Generations and their families. The Katanning community will commemorate this day on Friday the 26 May 2017 from 1 to 5 pm in the Town Square all welcome. Congratulations to our local seniors group who held a successful National Seniors Conference at the Rec Centre on Monday. The camaraderie between those present, the willingness to come together to achieve common goals especially in relation to advocating on behalf of the older generation is very important. Our Local group are inspiring leaders in the Region. 10. REPORTS OF COMMITTEES AND OFFICERS ORDINARY COUNCIL MEETING 6 23 May 2017 10.1 DIRECTOR ENGINEERING & DEVELOPMENT SERVICES REPORTS 10.1.1 Endorsement of Fire Management Requirement Brochure (ATTACHMENT) File Ref: ES.AT.1 Reporting Officer: Cindy Pearce, Community Emergency Services Manager Date Report Prepared: 15 May 2017 Issue: Council to endorse the 2017 – 2018 Fire Management Requirement Brochure Body/Background: The Fire Management Requirement Brochure is published annually and distributed to all residents and property owners within the Shire. The Fire Management Requirement Brochure provides land owners and occupiers with information on their responsibilities regarding fire prevention. Also included in the brochure are the contact details of Local Bush Fire Control Officers and information on general fire related matters. There are two changes within the Fire Management Requirement Brochure for 2017/2018. 1) Two items relating to the DFES website has been removed and replaced with the Emergency WA website details. 2) Update of Bushfire Brigade Officers Officer’s Comment: Council endorsement of the Brochure and recommended changes are required prior to printing and distribution. Statutory Environment: Bushfire Act 1954. Policy Implications: Nil. Financial Implications: Annual provision in the budget for printing approximately $2,500. Strategic Implications: Bushfire Act 1954 Officer’s Recommendation/Council Motion: MOVED: CR OWEN BOXALL SECONDED: CR DANNY MCGRATH OC51/17 That Council: 1) Endorses the 2017- 2018 Shire of Katanning Fire Management Requirement Brochure as presented; 2) Endorses the changes relating to the website information update; and 3) Endorses the changes to the Brigade Officers. ORDINARY COUNCIL MEETING 7 23 May 2017 10.1.2 Appointment of Fire Control Officers File Ref: ES.AF.1 Reporting Officer: Cindy Pearce, Community Emergency Services Manager Date Report Prepared: 15 May 2017 Issue: Council to endorse the appointment of authorised Fire Control Officers. Body/Background: Fire Control Officers are appointed by Council under Section 38 of the Bushfires Act 1954 to issue ‘Permits to Burn’ and to carry out other actions as set out in the Bushfires Act 1954 as required by Local Government. Officer’s Comment: It is recommended that Council renews its appointment of Fire Control Officers. Statutory Environment: Fire Control Officers under Section 38 of the Bushfires Act 1854 are appointed by Local Governments. Under Section 38 and 39 Bushfire Control Officer may, subject to directions given by the Local Government, take any measures he/she considers necessary and practicable for: The prevention of bushfires. Protecting life and property in the case of an outbreak of a bushfire Carry out any duty or exercising any authority referred to in the Bushfires Act. Procuring the due observance of the provisions of the Act. (For this purpose it is his/her duty to demand the name and address of any person committing an offence against the Act and to report the circumstances to the Local Government). Policy Implications: Nil. Financial Implications: Budgeted cost of advertising appointments in the Government Gazette approximately $600.
