Bellator Mma Lands Another Top Free Agent in Former Wec & Ufc Lightweight Champion: Benson “Smooth” Henderson BELLATOR MMA LANDS ANOTHER TOP FREE AGENT IN FORMER WEC & UFC LIGHTWEIGHT CHAMPION: BENSON “SMOOTH” HENDERSON SANTA MONICA, Calif. (February 1, 2016) – Bellator MMA President Scott Coker continues to make good on his commitment of adding value to the Bellator roster, as he and the promotion are pleased to announce the signing of former UFC Lightweight Champion Benson Henderson (23-5) to an exclusive, multi-fight deal. The signing was scheduled to be announced today on “The MMA Hour,” which is hosted by 6-time MMA Journalist of the Year, Ariel Helwani. When news of the signing broke earlier than anticipated, the flood of traffic to the website may have been responsible for technical difficulties causing some of the interview to not stream live; However, the interview will be available in its entirety this afternoon at www.mmafighting.com. Henderson has accomplished a great deal over the course of his 10-year professional career as a mixed martial artist. A former WEC and UFC lightweight titlist, “Smooth” holds black belts in both Taekowndo and Brazilian jiu-jitsu, and also earned NAIA All-American honors in both 2005 and 2006. Multiple media outlets named Henderson the fighter of the year in 2012, and has been a part of several epic battles that have received “Fight of the Year” accolades: Donald Cerrone (2009), Anthony Pettis (2010), Frankie Edgar (2012), and Brandon Thatch (2015). “Benson is a tremendous athlete who puts forth an exciting effort each and every time he steps into the cage,” said Coker. “Whether he chooses to fight at lightweight or welterweight, he’s without question a great addition to this promotion, and brings countless amazing matchups to the table. We’re looking forward to having him put on a show for the great Bellator MMA fans that tune into Spike. We plan on announcing his Bellator debut in the very near future.” Having competed at both lightweight and welterweight, there are plenty of enticing potential matchups in Henderson’s future. Bellator’s lightweight division is currently championed by Will Brooks, and features many of the world’s best including: Michael Chandler, Josh Thomson, Marcin Held, Brandon Girtz, Brent Primus, Derek Anderson, and Melvin Guillard. INTRODUCTION The fighters who compete in the Ultimate Fighting Championship (“UFC”) are currently classified as independent contractors. However, this classification appears to contradict the level of control that the UFC exerts over its fighters. This independent contractor classification severely limits the fighters’ benefits, workplace protections, and ability to unionize. Furthermore, the friendship between UFC’s brash president Dana White and President Donald Trump—who is responsible for making appointments to the National Labor Relations Board (“NLRB”)—has added a new twist to this issue.1 An attorney representing a former UFC fighter claimed this friendship resulted in a biased NLRB determination in their case.2 This article provides a detailed examination of the relationship between the UFC and its fighters, the relevance of worker classifications, and the case law involving workers in related fields. Finally, it performs an analysis of the proper classification of UFC fighters using the Internal Revenue Service (“IRS”) Twenty-Factor Test. II. UFC BACKGROUND The UFC is the world’s leading mixed martial arts (“MMA”) promotion. MMA is a one-on-one combat sport that combines elements of different martial arts such as boxing, judo, wrestling, jiu-jitsu, and karate. Started the Girls Soccer Team in 1995, a year after girls soccer came to Chicago. It was of special significance because he created the team and it was a big deal to have girls’ soccer in Chicago. The suburbs had 10 years of girls’ soccer by ’95. Through the 90’s, there were two good boy’s teams that domi- nated on the Northside of Chicago, Amundsen and Foreman. It was difficult to get pass Foreman in the playoffs . Also, in those times it was Southside versus Northside. Finally, in ’98, the girls’ team won their first championship. They beat Kennedy 1-0 in overtime. This was thanks to Angeline Santana.     TITLE OF CASE STUDY: Bellator MMA Live Launch BUSINESS SITUATION From 2005 to 2011, Spike TV had enjoyed considerable success broadcasting competitions of the Ultimate Fighting Championship (UFC) mixed martial arts (MMA) league. Prior to – and to a lesser degree, during – the sport’s run on Spike, MMA had developed a reputation as being unforgivably violent and too primitive to be regarded by the masses or advertisers as a true professional sport. In 2011, the right to those UFC broadcasts moved to the Fox TV, FX, and Fuel networks. Not willing to walk away entirely from the sport of MMA, in 2012 Spike entered into an agreement to begin broadcasting competitions from the little-known but up-and-coming Bellator league starting early 2013. The introduction of the league to Spike TV would be in the form of a weekly series of live competitions titled Bellator MMA Live. Bellator’s approach to the sport differs from that of the UFC in that Bellator employs an NCAA basketball- type “bracket”-style structure to arrange the match-ups in its tournaments, while the UFC relies on the short-term desires of the league and its promoters to arrange matches (Bellator’s motto: “where title shots are earned, not given”). The league’s programming had been airing for a year on the MTV2 network, but to very small audiences (the latest season there had averaged just 177,000 viewers per week). For this new agreement to be profitable for Spike TV, ratings would need to increase substantially from where they were with MTV2 right off the bat.

(August 17, 2015) – Less than a week after signing with Bellator MMA, Josh Thomson’s (20-8) debut is now set. “The Real Punk” will compete in lightweight action against Mike “The Greek Assassin” Bronzoulis (18-8-1) at “Bellator MMA: Dynamite 1” on September 19 at SAP Center in San Jose, Calif. The bout completes a main card that will see both a Bellator cage and a Glory kickboxing ring on one arena floor at the same time – something that has yet to be seen in the combat sports landscape. In the evening’s main event, Tito Ortiz (18-11) will challenge the undefeated Bellator Light Heavyweight World Champion, Liam McGeary (10-0) for the title. Additionally, the previously announced fight card features two Glory kickboxing title fights featuring Zack Mwekassa (13-2, 12 KO) and Saulo Cavalari (31-2, 19 KO) for the vacant Glory Light Heavyweight Championship as well as Gabriel Varga (26-2, 8 KO) defending his featherweight title against challenger Serhiy Adamchuck (29-5, 14 KO).
