Government policies PPS1, PPS3 and PPG13; Local Development Framework Core Strategy policies CP1, CP2, CP3, CP4, CP5, CP9, CP12, CP13 and CP19; Local Development Framework General Development Control policies DC6, DC9 and DC40; and the Planning Obligations Supplementary Planning Document were relevant to the determination of this application. The Arboricultural Officer and Southern Water raised no objections to the proposals. The comments of the County Surveyor were noted. The Parish Council raised no objections to the proposals, subject to conditions. The agent of the applicant spoke in support of the proposals. The application site was within the built-up area of the village of Small Dole, a ‘Category 2’ settlement. It was located at the southern end of the village, on the eastern side of the A2037 and had an area of 0.1 hectares. The site occupies a prominent location in the centre of the village and was highly visible when entering Small Dole from the south. The site was rectangular in shape and partly overgrown. There was existing residential development immediately to the north and south of the site. To the south there was a terrace of late Victorian two-storey dwellings constructed with a rendered finish and slate roof. To the north there was a small block of flats. The site backed onto a sports ground with open countryside beyond, whilst the Mackley Industrial Estate was located further to the south. DCS/9 Planning Application: DC/11/0653 (cont.) 3 Development Control (South) Committee 24th May 2011 Until 2007, the site had been dominated by a mature oak tree, the subject of a Tree Preservation Order. This tree had now been felled under the formal five- day notification process for dead, dying and dangerous trees and a replacement tree had been planted. The application site was significantly overgrown and the Head of Compliance had confirmed that a number of complaints had been received regarding the untidy condition of the site. The applicant’s agent had advised that the land had not been used as a garden for at least four years as it was initially severed, both physically and legally, from the neighbouring dwelling at 5 Henfield Road and then used for the storage of builder’s materials and equipment in connection with the alterations and extensions to that property. The site had subsequently been left vacant, unused and overgrown following the completion of these works. While the current appearance of the site was not in itself a reason for granting planning permission, it was clear that an appropriate redevelopment scheme could visually enhance the character of the surrounding area. Although it was apparent that the various site owners had done little in terms of maintaining the land, it was also noted that the applicants had been trying to secure planning permission for the site over recent years, having submitted six applications in total. Following the grant of outline consent in 2003 for the erection of two dwellings, the subsequent applications had either been refused or withdrawn for various reasons, including the adoption of the Core Strategy of the Local Development Framework in 2007. The current application had been submitted following the refusal of application DC/10/1125. That application had been refused on the grounds that the proposal would represent an over-development of the site, the likely loss of the preserved tree and an in principle objection with regard to policy CP5. It was considered that the scale of the development now proposed had been reduced to an acceptable level.
