Pârvan 4 Abstract Personality admired by Trithemius [1]1 and Pelbartus of Themesvár [2], eulogized by Pierre Nadal [3] and Nicolaus Olahus [4], St. Gerard of Csanád remains beyond the character of his legend an author wrapped in mystery and uncertainty, with a biography closer to miracle than historical argument. Despite this vita fabulosa transmitted by Acta sanctorum [5], the author of Deliberatio supra hymnum trium puerorum (1044) has to tell us some interesting and valuable information about his contemporaneity. Educational Tourism and Nation Building: Cross-Border School Trips in the Carpathian Basin

(1) 57–71.57 Educational tourism and nation building: Cross-border school trips in the Carpathian Basin Tamara RÁTZ1, Gábor MICHALKÓ2 and Réka KESZEG3 Abstract Educational travel provides opportunities for participants to explore specific issues in unconventional ways. In Hungary, primary and secondary schools organise annual study trips as part of their curricula. The aim of these trips is to familiarise students with the main sights of the country, and to bring to life national narratives discussed in lessons. Furthermore, these trips often play a key role in students’ socio-psychological develop- ment, both as future tourism consumers and as future citizens. Recognising the opportunity to influence students’ worldview and way of thinking during their sensitive teenage years, the Hungarian government has created a national programme to financially support school trips organised to visit minority Hungarian communities living in the neighbouring countries. This paper is based on the content analysis of 256 detailed reports submitted by participants of school trips organised in 2013/14 with the aim to visit Hungarian minority communities in the Carpathian Basin. The analysis focuses on the detailed descriptions of the participants’ personal memories of their experiences, the social construction of the visited destinations, and the influence of their memorable experiences on their sense of national identity. The research disclosed that the trips made to Hungarian territories outside the borders contributed to shaping the national sentiment of the students participating in the programme. The findings suggest that since participation in tourism is an effective means to experience nationhood and national identity, by financially supporting school trips abroad, the state may be able to exert political influence over national consciousness. -

KOMPETENSI PENGADILAN TATA USAHA NEGARA DALAM SISTEM PERADILAN DI INDONESIA Oleh : H. Yodi Martono Wahyunadi, S.H., MH. I. PENDAHULUAN Dalam Pasal 24 Undang-Undang Dasar 1945 sekarang (hasil amandemen) disebutkan, bahwa : (1) Kekuasaan kehakiman merupakan kekuasaan yang merdeka untuk menyelenggarakan peradilan guna menegakan hukum dan keadilan. (2) Kekuasaan kehakiman dilakukan oleh sebuah Makamah Agung dan badan peradilan yang berada di bawahnya dalam lingkungan peradilan umum, lingkungan peradilan agama, lingkungan peradilan militer, lingkungan peradilan tata usaha negara dan oleh sebuah Makamah Konstitusi Berbeda dengan UUD 1945 sebelum amandemen, yang mengatur kekuasaan kehakiman dilakukan oleh sebuah Mahkamah Agung dan badan kehakiman di lingkungan peradilan umum, peradilan agama, peradilan militer, dan peradilan tata usaha negara. Kekuasaan kehakiman kita sekarang selain diselenggarakan olah Mahkamah Agung (MA) dan badan-badan peradilan di bawahnya dalam empat lingkungan peradilan juga oleh Mahkamah Konstitusi (MK). Kedudukan Mahkamah Agung sama, baik sebelum dan sesudah amanden UUD 1945 merupakan puncak dari badan-badan peradilan di empat lingkungan peradilan. Empat lingkungan peradilan yang terdiri dari 1 (satu) lingkungan peradilan umum dan 3 (tiga) lingkungan peradilan khusus yaitu : agama, militer dan tata usaha negara. Keempat lingkungan peradilan tersebut masing-masing memiliki badan peradilan (pengadilan) tingkat pertama dan banding. Badan-badan peradilan tersebut berpuncak pada sebuah MA. Untuk lingkungan peradilan tata usaha negara berdasarkan Undang-Undang nomor 5 tahun 1986 tentang Peradilan Tata Usaha Negara sebagaimana diubah dengan Undang- Undang nomor 9 tahun 2004 tentang Perubahan Atas Undang-Undang nomor 5 tahun 1986 tentang Peradilan Tata Usaha Negara dalam Pasal 47 mengatur tentang kompetensi PTUN dalam sistem peradilan di Indonesia yaitu bertugas dan berwenang memeriksa, memutus, dan menyelesaikan sengketa tata usaha negara.
