Justice and Human Rights in the African Imagination There is nobody more qualifed to do justice to the imbrications of liter- ature and ethical commitment in Africa than Chielozona Eze. With this well-accomplished and erudite book, Eze consolidates his position as the leading scholar of African ethics in literary contexts. Professor of philosophy, Rhodes University Justice and Human Rights in the African Imagination Justice and Human Rights in the African Imagination is an interdisciplinary reading of justice in literary texts and memoirs, flms, and social anthropo- logical texts in postcolonial Africa. Inspired by Nelson Mandela and South Africa’s robust achievements in human rights, this book argues that the notion of restorative justice is in- tegral to the proper functioning of participatory democracy and belongs to the moral architecture of any decent society. Focusing on the efforts by African writers, scholars, artists, and activists to build fourishing commu- nities, the author discusses various quest for justice such as environmental justice, social justice, intimate justice, and restorative justice. It discusses in particular ecological violence, human rights abuses such as witchcraft accu- sations, the plight of people affected by disability, homophobia, misogyny, and sex traffcking, and forgiveness. This book will be of interest to scholars of African literature and flms, literature and human rights, and literature and the environment. Preface What we talk about when we talk about justice To help me think through the notion of justice, I present two hypotheti- cal situations, one of which is paraphrased from John Rawls’s “Original Position.” First Situation: On the playground are fve children—three boys and two girls—playing. A mother to one of them comes around, hands them fve oranges, and tells them the oranges are for all of them. There are many scenarios that can ensue: They will share the oranges among themselves. I imagine the children holding a small conversation in which they establish the condition for sharing the oranges: “Everyone gets one orange each,” the leader among them would say. “Yes, one person one orange,” another would support. That would be the just thing to do. It would be fair. Another sce- nario is that one of them, perhaps a boy, could seek to have two oranges, claiming that he is hungrier than the others. What if he gives three of them one orange each and the fourth one gets nothing? Will the three speak up against the situation? What language would they use? What if the boys gang up and deny the girls their oranges because they are, well, girls? The girls object and ask: Why? The boys answer: You are girls, and, according to the bible, sin came into the world through women. Therefore, you must pay for your sins. Second Situation: If, as embryos in the womb—ignorant of the conditions of our future lives, though capable of making decisions about the world—we were asked to imagine a society in which we all would be born, we would, for example, consider the situation in which we are born poor or with disa- bility, or perhaps one in which we are born into wealth. But because we do not know the situation that awaits us, we would most likely strike a middle ground. Faced with a situation in which we are allowed to create an ideal society, we would most likely opt for a society of fair-minded people free of bias, because we might be in disadvantaged positions. One of the things I take from Rawls’s hypothetical situation is the power of the imagination in the dispensing of justice. If we are able for a while to put ourselves in the position of a person denied his or her due, and if we can xii Preface see reality from that perspective even for a while, we might be compelled to rethink our attitude. Of course, the reality is that either most people are incapable of imagining reality from other people’s perspectives or they re- fuse to do so, perhaps because their minds had already been conditioned by some narratives about the other. For example, racists refuse to imagine the racialized as deserving equal consideration as humans largely owing to the stories they have heard about these racialized others. The same applies to sexists. It is easy for a man to justify maltreating a woman because of the ancient tradition that drummed it into him that women are meant to occupy inferior positions in the family and in society. The second part of the title of this book, We, Too, Are Humans, seeks to capture the voice of those who feel that they have not been treated the way humans ought to be treated: fairly.

INTRODUCTION Since October 1986, protection of human rights in Africa as a region has largely been defined through the African Charter on Human and Peoples’ Rights2. The Charter has been pivotal in influencing the development of regional standards on human rights on the continent. Even though it may not have scored visible successes to show, its role as the principal source of legislation on human rights in Africa cannot be denied. Stemming the tide of human rights violation in the world’s most troubled region may doubtlessly be a tall order for the Charter and its Commission. However, few would deny its normative value. In June 1998, the OAU Assembly of Heads of State and Government once again returned to the drawing board this time to adopt a protocol to introduce an institution that had ominously been forgotten in 1981, namely, the African Court on Human and Peoples’ Rights.3 Last year in July 2003, the African Union (as the OAU is now known) used the occasion to, amongst other things, adopt a far-reaching Protocol on Women’s Rights.4 Together with the 1990 African Charter on the Rights and Welfare of the Child,5 the Human Rights Charter with its two Protocols constitute the architecture of the African human rights system. The two Protocols have been added simply to amend the Charter and therefore complete the architecture. 1 . The African Union (AU) is an inter­governmental organization whose 54 member states comprise all countries in Africa except Morocco. (The AU succeeded the Organisation of African Unity (OAU) in July 2002.)     The African Union: Concepts and implementation mechanisms relating to human rights The African Union: Concepts and implementation mechanisms relating to human rights Bience Gawanas Introduction This paper focuses on the evolution of human rights within the African Union (AU), starting from the founding of the Organisation of African Unity (OAU) in 1963. The paper therefore takes as its basic premise the following: • Since its establishment, the OAU has been preoccupied with human rights, as evidenced by the struggle for the decolonisation of Africa and the right to self-determination and independence. Embodied within this, no doubt, is the fact that those agitating and fighting for independence used human rights standards to justify their struggle, as colonialism had no regard for the human rights of colonised people. • The AU, in contrast to the OAU, made human rights an explicit part of its mandate, as embodied in its Constitutive Act, and mainstreamed human rights in all its activities and programmes. However, it is clear that the current methodologies require strengthening with a view to developing a holistic, comprehensive and integrated approach to ensure that all human rights are respected. • Because it is linked to the above points, the human rights discourse cannot be divorced from its historical context or the prevailing political, social, economic and cultural conditions on the continent – particularly when it is understood that the struggle for human rights and the establishment of a human rights system are products of a concrete social struggle.1 In this regard, human rights are also as much about civil and political rights as they are about economic, social and cultural rights.

What remains largely unclear and poorly studied is the dynamics of the State and Governance at Post -Cold War Africa .This paper deployed the Marxian political economy framework and examined the State and governance nexus in Africa’s nascent democracy in the period 1990 to 2014. It argued that the State in Africa remains increasingly elitist and predatory despite the end to one party autocratic regime and multi -party elections. The substantial strategy has been “the politicization of governance”. It conceptualized this theoretical model to demonstrate how the State and governance deploy coercive instrumentalities to appropriate political power . The salient dimensions are explored to demonstrate that the State has remained a “derisive apparatus” in naked pursuit of power. In particular, it demonstrates how political patronage is fought for, resisted or propagated and how this has increasingly resulted in failure of governance and development. Landsat TM images of 1986 and Landsat ETM+ of 2003 both covering the Niger Delta area of Nigeria were used for this study and the images were processed using Erdas Imagine Version 8.7 and Arc Info 9.1 for the GIS operations. The results of the analyses show among other things that coastline erosion was dominant over accretion of sediment deposition. Also that the total area of observed changes along the coastlines was 46.535sq.km. Of this, 27.65sq.km (59.43%) constitutes eroded area, and 40.57% representing 18.88sq.km of the area showed coastal sediment accretion.     Chapter 15 Sacred Surplus and Pentecostal Too-Muchness: The Salvation Economy of African Megachurches Asonzeh Ukah 1 Introduction [E]verything is plastic, even life itself david chidester 2018:178 The beginning of the Christian Church is usually associated with the coming of the Holy Spirit upon the frightened followers of Jesus as narrated in Acts of the Apostle (Chapter 2). After Peter summoned courage to speak to the gathered “multitude”, the story concludes that many of those who heard the word, be- lieved and were baptised and were added to the church numbered “about three thousand” (Acts 2:41). Were this base community to be meeting weekly for liturgical purposes, it would have constituted the first Christian mega- church. However, for many reasons, the early church grew only slowly and met in small groups in members’ homes and often clandestinely. The experience and the phenomenon which the concept of ‘megachurch’ encapsulates is as old as Christianity itself; nevertheless, the coinage of ‘megachurch’, like many other nomenclatures with the prefix ‘mega’ (such as megacity, megaton), is recent and of American provenance, and probably first used in a scholarly con- text in the late 1970s (Dubios 1978). Mega – originally derived from the Greek megas meaning huge, and/or powerful – may have been the shortened form of one million (as a base of measurement), signifying an extremely large scale or excellent quality or sheer quantity. The megachurch denotes an excellent, great and successful church organisation or group. Its proliferation in Africa in recent decades signifies the appeal of its products to a large section of the African Christian population; its practices and organisational structure revolve around a princi- pal charismatic figure believed to be a supplier of sacred or salvation goods who is cast in the mould of a profit-driven spiritual entrepreneur.
