Introduction

As an annual duty commission of Integrity sends its annual report for parliament yet the attempts of Anti-Corruption didn’t became a national issue in a way that to devote all attempts and cooperation between all authorities and strengthening the institutions for implementing this duty. Commission of Integrity continuously stated that corruption is more dangerous than terrorism which wastes public assets, leads to fail institutions, destroys trust between authority and citizens, creates a good atmosphere for other crimes and it’s a huge threat on social and constancy level in Kurdistan Region, meanwhile Kurdistan chose the fifth course in parliament observes forming new cabinet of government of Kurdistan Region again we ask implementing reform and Anti-Corruption will be part of first priority of new government for the purpose of activating service government for citizens also stabilizing the basis of installation is another important point which we hope that the new government work on them and all employments of higher officials and below must be on the basis of experience and knowledge with receiving (CV) of candidates for those posts before its building, the current cabinet we guided the same request to the presidency of parliament and head of fractions in the previous course of parliament and we will present our activities in this report.

The strategy of Anti-Corruption in Kurdistan Region

The project of (The strategy of Anti-Corruption in Kurdistan Region) as a special national strategy for Anti-Corruption in Kurdistan Region, with the support of the international scales and agreements under the light of the agreement of United Nations for Anti-Corruption (UNCAC)with the initiation of commission of Integrity with copartner of related institutions in the main authorities of legislation, implementation and justice, with the cooperation of civil society, with the support of the British Westminster for democracy (WFD), after that development and completion by Reform Institution for development(RID) was prepared. The strategy project was accepted by the Council of Ministries with the decision number (108) in (2017), was published in official Waqqai Kurdistan newspaper with the number (211) in 31/5/2017. This strategy is an attempt for formulating national observation for Anti-Corruption, so as to collect all related sides under some aims and common basis, as a way for Anti-Corruption, in this strategy the mechanism of Anti-Corruption is formulated on four main levels, which contains: prevention from corruption, implementing law, awareness and training, also cooperation and negotiation between related sides, media cooperation and organizations of Civil Society. The main basis was the strategy must be local, means the strategy must contain local problems, of course this is in addition to the taking benefit from experience and international standards, another basis was all related sides and institutions of Anti-Corruption must participate in formulating the strategy, in another meaning the strategy must be completely national.

The process of formulating the strategy contained many shapes and stages which are: 1-Visiting and meeting with related parties 2-preparing a research for general lines of the strategy 3-Making a committee of preparing the strategy 4-Distributing the form of questions 5-Focus group 6-Police paper 7-Comparing the draft to an international experience 8-Negotiation with civil society Commission of Integrity in Kurdistan Region formulated the strategy according to the mechanism, implementation plan, observation and assessing the strategy in the frame of those authority which specified in the law of commission of Integrity, in the frame of the stage of reviewing the draft of the law project and action plan, previously commission of Integrity implemented many workshop and meeting with the special parties in ministries, commissions, departments, institutions, media, and organizations of civil society according to the special sectors to their fields, which contained (8) sector which in the annual report states time and date of the meetings, here by we state the workshops briefly: 1-The sector of civil society and media/ in July 2017 in Sheraton hotel-Erbil, with the presence of chairman of commission and general directors of commission of Integrity a huge workshop with the many media and civil society took place.

2-The sector of local governments/ in July 2018 in hotel chwarchra- Erbil with presence of chairman of commission, general directors of commission of Integrity, head of (RID), each representatives of governorates, Garmyan and Raparrin administrative and council of governorates. 3-Special institutions of implementing the law of (Justice, public prosecutors, commission of Integrity, police, security) in 18/7/2018 in Chwarchra hotel-Erbil with presence of chairman of commission of Integrity, general directors, head of (RID) and representatives of (public prosecutors, council of justice, general directorate of Region police, general directorate of the police of Erbil, Sulaimani, , governorate and Garmyan and Raparin administrative were present. 4-The sector of public finance/ in 25/7/2018 in commission of Integrity's building, with the presence of the chairman of commission of Integrity, general directors and head of (RID) a workshop was implemented with the representatives of (the board of supreme audit, ministry of economy and finance, department of finance and administration in the council of ministries and finance committee in Kurdistan parliament. 5-The sector of regional and international cooperation and negotiation/ in august 2018 in commission of Integrity's building, with the presence of the chairman of commission of Integrity, general directors and head of (RID) a workshop was implemented with the representatives of (the department of foreign relations, ministry of planning, department of nongovernmental organization and international recommendation arrangement). 6-Special sector and Commerce field/ in 31/10/2018 in commission of Integrity's building, with the presence of the chairman of commission

of Integrity, general directors and head of (RID) a workshop was implemented with the representatives of (board of supreme audit, ministry of economy and finance, ministry industrial and commerce, industrial and commerce unit, commission of investment, the committee of commerce and protecting the right of the consumer in Kurdistan's parliament, the union of workman and general directorates of investment of Erbil) took place. 7-Legal sector/ in 31/10/2018 in commission of Integrity's building, with the presence of the chairman of commission of Integrity, general directors and head of (RID) a workshop was implemented with the representatives of the legal parties of (Goran movement, Islamic societal, Kurdistan's toilers party, Islamic movement, bet nahrein party of democracy, Assyrian council, Assyrian movement for democracy and development of Turkmen) took place. 8-The sector of central institutions/ in December 2018 in commission of Integrity's building, with the presence of the chairman of commission of Integrity, general directors and head of (RID) a workshop was implemented with the representatives of (the secretary of the council of ministries, department of negotiation and following up, general directorates of the council of Kurdistan parliament, the representative of the presidency of Kurdistan region, department of negotiation and following up in the council of ministries) took place. Now the draft of the strategy is reformulating and a copy of the strategy is ready and will send to those parties which participated in the meeting of the sectors, in the end within a little fixing observing comments and suggestions the draft will be a prepared project.

Previously we tried hard to implement a meeting with this higher committee so as to start its work officially but unfortunately this didn't happened that's why the implementation of the strategy belated for (2019) we wish the new government will work on it.

Instructions of Functional behavior for the employees of public sector in Kurdistan region

With the support of the paragraph number (7) in the article number (5) of commission of Integrity's amended law in Kurdistan Region number (3) in (2011) which was mentioned as (publishing the instructions of the positive laws of functional behavior for clarifying the standards of public service and work ethics which employees of Kurdistan region must obey them as an establishment condition and continuing on service and observing obligations to them, will be amended from time to time according to its needs), commission of Integrity published the instruction number (1) in 2016 (the instruction of functional behavior for the employees of public sector in Kurdistan Region) and was published in number (204) in Waqqai Kurdistan newspaper, the scale of public service and work ethics were clarified in the content which employees of public sector in Kurdistan Region must obey them as an establishment condition and continuing on service, with the purpose of implementing the article number (36) in the instruction (public departments of Region sign as public employee on promising of obliging the judgments of this instruction according to this sample which commission of Integrity in Kurdistan region prepares it and will be saved in the personal dossier of the employee) that's why commission of Integrity published this contract which employees of public sector promises and obliges to the all judgments and basis of functional behavior of the employees of public sector which was mentioned in the instruction above, on the contrary must be prepared for taking legal action against him/her,

within written document number (3/73) in 26/11/2018 by generalization the contract distributed among all public institutions of Kurdistan region for the purpose of signing all the employees of Kurdistan region on copying the contract and saving it in the personal dossiers of employees also six months is specified for implementing this process it means in this specified period all the employees of Kurdistan region without distinguish of degree and post must sign on the contract and saved in their personal dossiers, after the specified period a special committee in the commission of Integrity will visit the institutions of Kurdistan region for assurance on implementing the process in this way which was specified as this way in this period, Within support of the article three in law number (4) in (1999) in official (Waqqai Kurdistan) newspaper which mentioned as (Anything which will be published in Waqqai Kurdistan) is considered official and will be operated the day of its publication, obliges employees to its contexts of the instruction but formulating an article in the instruction which forces employees to sign on obligation contract of the instruction which aims to instruct employees to their rights and duties and all higher values which employee must oblige to them however previously we implemented many seminars and meetings for the officials of all institutions and we clarified the instructions of functional behavior of employees and we asked them to implement special meeting about employees as it mentioned in the text of the instruction for the purpose of instructing employees to their rights and duties and we published thousand pamphlet in the instruction and distributed on the institutions but the result was not as was expected but after publishing the contract on the institutions we saw positive result, we have been contacted every day and asking about the instruction so as to be instructed about the content, having information of employees about the content of the instruction of functional behavior of employees and obliging values and respecting law,

integrity, justice, equality, honesty, protecting fiduciaries, loyalty and working impartially, those traits elevates the trust of the citizens to the public institutions of Kurdistan Region and also will weaken corruption level, this is the most important aim of the instruction and commission of Integrity.

The most important problems that commission of Integrity faces Legaly: One of the most important problems which commission of Integrity faces is investigators of Integrity which due to the amended commission law number (3) in (2011), this subject was transferred to justice authority, we are in the first two years of (2014,2015)in both Duhok and Sulaimanyah governorate worked with a very few number of investigators although our main duty is investigation in corruption cases we presented an amendment back in 2014 to the previous course of parliament one of our paragraph was giving authority to commission so as to establish investigator but unfortunately due to the disagreement between political parties this part was not amended and parliament didn’t support commission about this issue this caused damage for developing Anti-Corruption. Now commission does not have more than (13) investigators for nearly (800000) employees of public sector and there is no investigators of commission in Halabja governorate, Garmyan- Raparin-Soran-Koya and many other districts in 2017 we asked opinions in legal committee in parliament about this subject however they supported us but council of justice with the excuse of not having a clear text in our law about establishing commission investigators prevented us however there is no text in (the law of commission of Integrity of Iraq) about establishing integrity investigators but themselves will establish investigators and will not be prevented by justice authority of Iraq. Commission without enough employee in investigation field is like a university without teacher that's why this problem is a huge obstacle for many years in developing commission works in Kurdistan those duties which is done is done with a very few

investigation employee. We hope that new parliament will solve this problem in the frame of amending commission law which we prepare for this purpose in the future. Another point of legal side: Many immunity and agreements in the laws which prevent from implementing investigation with those people who has complains even many syndicates has immunity they have to agree then their members come to the court. Not having a specified court for corruption cases is one of the problems of solving corruption cases meantime commission sends many cases to the courts but will stay there for a long time there are cases which even didn’t specified the date of their trial for more than (2) years, except that there are many important cases which was eliminated due to the amnesty last year however parliament eliminated corruption crimes in the amnesty, official document of commission is a supplement. If we want to develop Anti-Corruption, it needs just like a special court for solving corruption cases as soon as possible and corruptors will be punished and became a good sample for preventing corruption crimes in the future, having the court will prevent many forces and interfere in trialing stages of criminals because commission can observe and cooperate this court better.

Administrational and financial side: One of the problems of commission is financial side because establishing commission was from the beginning of starting financial crises in 2014 many of its need couldn’t implemented due to not having an appropriate building for commission, cars and other necessary thing meanwhile hundreds of cars is used by ordinary employees in other institutions yet commission of Integrity rented many cars, also not having enough budget for important activities. Few employees who has specialties in their fields such as (legal, prudence) due to freezing transferring employees in past two years only a few employees is transferred to our commission. Another side is connected to the building abilities of commission employees in the field of legal, investigator, prudence and other specialties, this issue needs financial ability because it needs training in these fields needs a good financial ability especially bringing foreign experts or sending employees outside.

-According to the amended law number (3) in (2011) the office of the chairman of commission has secretariat section its duty is arrangement, documenting and following up the meeting times. The office of the chairman of commission will be managed by an employee as a manager, who manages, documenting, following up and arranging duties of the chairman of commission and all parts of the office of the chairman of commission.

The office of the chairman of commission contains the following divisions: First/Division of the public relations: which contains media. Website and translation sections which is special to our commission. Second/Observation and local prudence which contains the following duties: 1-Prudence of salary registration and the list of the salary of all commission employees. 2-Prudence of registrations of (daily, assignment, small costs, commission predecessors). 3-Prudence of the documents of (costs and registrations of commission). 4-Prudence of all putting and taking money checks for our commission. 5-Prudence of all forms of different monthly predecessors of our commission. 6-Prudence of the predecessors of the chairman of commission.

7-Prudence of special predecessors which particularized for our commission for different purposes. Third/Administration section: Contains all works and duties of administration and finance of the office. Meetings of the chairman of commission in 2018 -In 30/1/2018 at 10 o'clock in the morning higher meeting of the commission of Integrity and presidency of general prosecutors in the meeting hall in council of the presidency of general prosecutors in Erbil were implemented with the presidency of both (Dr. Ahmed Anwar Muhammed) chairman of commission of Integrity and judge (Jawad Fatah Agha) chairman of public prosecutors of Region as an acting director, in the frame of those meeting which both sides decided to implement it for the purpose of cooperating each other on both sides presidency level as two observational institution for Anti- Corruption of administrational and finance in Region and presenting simplifying tools of this cooperation and reflecting on the duties of departments of both sides in governorates and districts of region. Participants of the meeting in presidency of public prosecutors were each judge (Jawdat Saiid Mir Sadiq) members of both commissions of juvenile crimes and consultancy in the council of presidency, officials of the department of public prosecutors in Erbil, Sulaimanyah, Duhok, Halabja and Garmyan. Also by commission of Integrity of Region the meeting with the presence of each general directors of legal department, manager of the office of the chairman of commission, manager of investigation department of Erbil as an acting director and manager of lawsuit division in legal department. The most important points which were mentioned in the previous meetings were:

1-Continuing on more cooperation between components and departments of both sides in whole Region. 2-The conclusion of wane of experience in the field of administration in ministries and institutions of region, neglecting and unfamiliar of many employees of region to the laws and instructions has many violations in the institutions which both side take a good role for cooperation for rule of the law and Anti-Corruption. 3-Commission specifies its representatives for following up dossiers and cooperation with judges of public prosecutors in investigation courts and special penal courts officially although this was done in some governorates but must be implemented in other governorates as well. 4-About retardation of investigation in corruption cases in both investigation and trialing stages by courts both sides agreed on asking council of justice officially that the council guide a generalization to judges in the whole region so as to solve corruption cases as soon as possible which is special to this field putting this kind of dossiers in the first place which is special to corruption and public assets also head of public prosecutors must mention and defend this issue during meeting of councils. 5-Specializing and specifying one of the judges of public prosecutors for investigation courts in corruption cases in region governorates which must be special to this act and couldn’t implement any other acts although it may not be implemented due to the lack of the judges of public prosecutors in this governorate. 6-Giving attention to huge corruption cases in whole region and serious following up for the purpose of collecting proofs about them.

7-Opening training courses for investigators in corruption cases by experts in this field. 8-Cooperation in the field of observing investment deals which contains contracts till bids and tenders. 9-Observing investigation in corruption cases and duties of commission of integrity's investigators by judges of public prosecutors in all cities, governorates and districts of region and presenting report about problems, insufficiencies, solutions and predictions for both presidencies of public prosecutors and commission of Integrity in region for implementing necessary ways about them. 10-Defending obligations of related sides in ministries and departments of region with the cooperation of both sides for rule of law and Anti-corruption. 11-Taking necessary ways in to consideration with the cooperation of the council of justice and related sides for accelerate in investigation and trialing in corruption cases. 12-Cooperation between judges of public prosecutors and representatives of commission in front of investigation, assize and magistrate courts during following up for corruption cases till final stages of lawsuits and publishing final decision. 13-Creating an official E-mail for both sides for exchanging information about corruption cases, duties and activities also specifying special a special employee for supervision and following up information. 14-Defending council of ministers and ministries for apprising representatives of both sides for their presence during implementing

bids and tenders in important projects for observing legal side and protecting public asset. In addition to defending on points above, discussions about issues in different fields fully and specifying obstacles that both sides faces such as obstacles in front of establishing investigators for commission and the problem of not vowing those investigators which commission of integrity established them with its own authority by head of appellate court in addition to commission of integrity has its own finance and administration also needs to open other directorates and offices in Halabja governorate and other districts of big directorates and its obstacles. Also in addition to defending on having positive points in cooperation between both sides on corruption cases and following up dossiers and continuing on more cooperation and putting the light on the issue of not participating commission during implementing tenders and attempting more for giving importance to corruption dossiers by implementation commission and feeling responsible in implementing court decisions and stating the problems of retarding solving dossiers by courts which results to having many lawsuits and transferring judges and specifying special court for fairness in corruption cases and solving them or specializing them in addition of having problems about this issue for the purpose of reaching appropriate solution. -In 3/1/2018 the government of Kurdistan region guided a law project of reform in retirement, salary, donations and other advantages to the parliament of Kurdistan after first recital in parliament were send to six parliament related committee during its working nearly 2 months the committees presented a common report to parliament for discussion and acceptation. During three days of parliament meeting with the presence of Dr. Ahmed Anwar chairman of commission took place, after intense

discussions in 28/2/2018 the law was accepted. We think that accepting this law is a huge achievement for our citizens in the frame of the reform process; we appreciate parliament members in all different political parties, region government, and board of supreme audit, commission of integrity and all other people who supported this law. From our point of view for clarifying truths and achievements of this law to not to lead astray of public opinions of Kurdistan's citizens by anyone and any parties we will present these following points: First: The law of the reform of retirement, salary, donations and other advantages by the government of Kurdistan region was presented and was not any parliament fractions project, but after entering parliament all fractions and related parliament committees together attempted to accept this law while this law was under voting any parliament members and parliament fractions was not against acceptation of this law and all parliament fractions was with the law. Second: The content of the law has many achievements and important points which annually citizens of Kurdistan region waits for it for reform in public sector and retirement as an example we present the following achievements: 1-Arranging accountancy units which is related to seventy and eighty units in ministry of Peshmarga, which is an important and sacred step for arranging the whole Peshmarga force of Kurdistan. 2-Putting mechanism and specific time for clearing the list of martyrs, political cell and handicaps, by forming special committee which is the wish of the citizens of Kurdistan. 3-Arranging salaries which was benefited more than once in public purse with the family of martyrs and people with special needs.

4-Putting condition and legal appropriate regulations for establishing general directors, consultants and higher officials whom maintain experience and justice. 5-Holding augment period of service for employees and workers of Kurdistan region in all three authorities and all levels. 6-Obliging each board of supreme audit, commission of Integrity and public prosecutor in implementing the judgments of the law. 7-Buiding retirement box and prohibiting spending any amount of money from the box. -In 27/2/2018 Kurdistan parliament in the regular meeting of number (13) accepted the project of reform law. After accepting the law project, the presidency of Kurdistan parliament and the staff of the region government, implemented a press conference. Dr. Ahmed Anwar chairman of commission of Integrity of Kurdistan region stated that, the project is an absolute need of Kurdistan region and commission of Integrity will be an observer on implementing the project. He clarified that commission of Integrity supports any reform steps which will be implemented in Kurdistan region. Reform law in retirement contains 24 articles, accepting the reform law will return 150 million Dinar monthly to government. The annual service of employees and their salaries was arranged in the law and least retirement salary will be 300000 thousand dinar and receiving two salaries will be destroyed. -In 11/3/2018 Dr. Ahmed Anwar chairman of commission of Integrity of Kurdistan region implemented a meeting with some activists of civil society in some different organization and discussions were made about some suggestions so as to enrich retirement law.

The text of the document was: 1-Any law which is published must consider justice. 2-Commision of integrity and organizations supports the law project. 3-About retirement we consider article number (3) of reform law in united retirement law number (9) in 2014 of Iraqi federal government as an appropriate solution. 4-Commission of Integrity and organizations will cooperate continuously for the purpose of implementing the law by the government of Kurdistan Region. On Wednesday 25/7/2018 with the presidency of Mr. Nechirvan Barzany prime minister of Kurdistan Region, with the presence of Mr. Qubad Talabany deputy of prime minister, Dr. Ahmed Anwar chairman of commission of Integrity of Kurdistan region, minister of Interior, related ministers, governors, supervisors of independent districts, board of supreme audit, public prosecutors, representative of security and the council of petroleum and oil of Kurdistan region implemented a meeting. The meeting was special for discussion on illegal small refineries which started to work without getting an official permission and ministry of natural resources presented a report about the number of refineries, its places and the history of occurring this illegal phenomena. All participant of the meeting was agreed on solving this phenomenon as soon as possible; especially these refineries became a huge damage to the health and environment of Kurdistan region. Some obvious examples about this subject in Erbil and Sulaimanyah were stated which due to the leftovers of these refineries lead a huge damage to

water resources and agriculture; it is also a main reason for diffusing some dangerous disease. In the result of the meeting was ministry of natural resources with the cooperation of ministry of Interior and head of administrative units solve this issue with the mechanism of legal work and government must take necessary ways for protecting environment and health of citizens in to consideration after that they must present this legal procedures for public view. About this issue president and his deputy ensured on administrative institutions especially implementation institutions such as ministry of Interior, security council and police with the cooperation of governors must work on this subject in the frame of this mechanism that was presented in the meeting and public prosecutor took the responsibility legally to cooperate this team, also they ensured on protecting environment and the life of the citizens is the prior duty of the government of Kurdistan region, because the life of the citizens and protecting environment in economic issues is the most important thing and there must be difference between the life and environment of citizens, with the issue of providing fuels. -In 31/7/2018 Dr. Ahmed Anwar chairman of commission of Integrity of Kurdistan Region in a press conference published the statistics of corruption cases of the first six months of this year.in the beginning of the press conference chairman of commission of Integrity of Kurdistan region stated that, right now commission is busy with the preparation of the strategy plan of Anti-Corruption in Kurdistan, because there must be a plan. Dr. Ahmed Anwar chairman of commission of Integrity of Kurdistan stated that during 1/1/2018-30/6/2018 the number of the cases that were sending to commission was: In Erbil (23 cases in Assize court and 5 cases in Magistrate court).

In Sulaimanyah (9 cases in Assize court and 4 in Magistrate court). In Duhok (9 cases in Assize court and 9 cases in Magistrate court). He clarified more that all cases which now are in the special court in Erbil are 56 cases. In Sulaimanyah are 38 cases. In Duhok are 18 cases. Meantime those cases that were concluded in all three governorates are 32 cases Reprehension 15 cases. Discharge 6 cases. Amnesty 11 cases. Also he stated that they are planning to cooperate higher commission of election and questionnaire in Kurdistan implement prudence of the names of political parties. -In 1/8/2018 a staff of International bank in Erbil visited Dr. Ahmed Anwar chairman of commission of Integrity of Kurdistan Region and implemented a meeting. The staff contained Michele Bryan, Miss Muna and some other companions. In the meeting they discussed on the role of commission of Integrity and observational institutions in Kurdistan region. International bank has its own special program for cooperating observational institutions such as commission of Integrity for strengthening their role in working and observing the works and duties of Region's institutions.

-In 9/12/2018 in commemoration of Anti-Corruption day of commission of Integrity of Kurdistan region published the statistics of Corruption and chairman of commission of Integrity of Kurdistan region clarified that they will try more for Anti-Corruption. Dr. Ahmed Anwar chairman of commission of Integrity of Kurdistan region published the statistics of corruption of 11 months in 2018 in a press conference clarified that 170 cases were investigated. Chairman of commission said that, 11 months of 2018 there was 12 document following up and 35 of revealing truths. As Dr. Ahmed stated all corruption cases in Kurdistan, assize and magistrate court were 170 corruption cases in a way that in Erbil 76 corruption cases, in Sulaimanyah 54 cases and in Duhok 40 cases were investigated. The statistic reveals that most of the cases were concluded in Duhok which are 16 cases, in Erbil 15 cases and in Sulaimanyah 2 cases were concluded.

The main duty of revealing corruption situation and collecting date (information) about them depending on artificial institution receiving news, information, grievance and investigations in corruption cases which was stated in (first article \7) in commission rule according to the Iraqi legal punishments laws number (111) in (1969) of commission rule within support of basic judicial punishment laws and instructions of arranging investigation works of commission number (3 in 2016) , cooperation in observing field of spending , receiving and behaving to region assets and the way of managing them, returning culprits who ran away abroad, returning those assets which was taken abroad. Exchanging information and common international investigation. Duty of Investigation department about investigation in corruption cases is going through three stages (receiving information and following up, newstelling stages which investigators of commission investigates it without investigation judge (initial investigation) , punishment lawsuit stage which commission investigators investigates it under observation of judicial investigation court of integrity and both stages consider as case).

Duties of Legal Office

As per our commission’s revised law number (3) of (2011) and by law number (7) of (2014) in which by the decision number (10) of (2015) given to our commission from Kurdistan region government, our department duties are as following:- 1-Presenting thoughts and advice in legal cases which is given to the commission and representing commission on those complains which is raised to them given by an official deputy of commission head. 2-Discussing in front of specialized courts in those which is concerned of corruption crimes and revising about the ways of complain. 3-Representing the commission in those investigation committees which has been made by the order of the commission. 4-Preparing investigation and scientific researches special for Anti- corruption laws and international agreements in that field 5-Offering and requiring aids of international exchange laws 6-Monitoring of integrity in the decisions and works of public sector 7-Putting preventing instructions of contradictory interests of region 8-Taking upon action for monitoring the level of integrity decision and works of public sector and publishing reports about it from time to time 9-Preparing suggestion and legal project in the field of anti-corruption and fighting against it.

Demanding Department

Demanding department in the way of Pursuing corruption cases room purses in tribunal (felony/crime) in Kurdistan region, and participates in courting as a defiance of public rights those that has connection to corruption. And pursuing those demands (cases) in which commission sponsors it or has been sponsored at our commission for the purpose of judging and complaining. And comes up of tasks of collecting information about things that have been gained by corruption crimes also pursuing and cooperating with concerned aligned and persecutor to guarantee the returning things that have been gained in corruption in all public corruption crimes.

Advisory and Draft Suggestion Department

This department comes up by giving opinion and suggestions in a legal ways and prepares investigation and researches for prevention and fighting against corruption. And compose a legal project draft and rules those which are connected to prevention of corruption. And also compose rules, interior laws of commission, revising and evaluating (legal instruments).

And also expresses thoughts and opinions of various legal inquiries, preparing researches and evaluation for legal work and also mending administration those which are concerned about necessity of temporary reports to prevent corruption and fighting against and pursuing it. And also any other tasks which is given to this department. 1-Giving opinion and advisory the about activities of legal representative in commission of integrity: To be more familiar about our commission’s legal representative task in the time of performing their commission’s legal duties and works or at the time of having a problem and issue with other organizations we presented this explanation: commission’s legal representative job is near to prosecutor’s job in tribunal court in which Kurdistan region commission’s legal representative is present has the ability to present to the judge any clues that can be found. In the end he/she can criticize judge’s decision by the law of criticizing, as per law term twelve/ second syllable (1) legal representative has the ability in the time of representing our commission of those complains that has been registered on our commission to take any legal action to secure commission’s rights among all civilized courts, penal court and all ministries and connected organizations.

1- Giving advisory on the law number (39) of 2015 of Federal Iraqi government for money laundering and financing terrors: - To put any federal Iraqi law in Kurdistan, Kurdistan Parliament should accept it by a parliament decision, for this purpose our department/ advisory section in 2018 we went on reviewing the contest of the above mentioned law, and give opinion and advisory about them in which it consisted in various change in sections(paragraphs), syllables, and law terms of money laundering, in a way that fits Kurdistan region’s organizations so this law could be executed in a neat and legal way as of Baghdadi law. 2- Giving opinion and advisory about a case of building a school in (Lilaf city) in Duhok province by a contractor: - Project pursuit department from presidency of ministry of councils in 2018 requested an investigation about building a school in (Lilaf city) in Duhok province, after pursuing and studying about the subject from our department we came to know that directorate of investigation in Duhok has investigated about this complain and has sent to tribunal court and in the result the tribunal court ( felony court of Duhok) had settled this case by releasing the accused and decisions had been done, so we suggested that as per courting penalty laws it can’t be investigated again. But other related departments can according to law of discipline in public and private sector employees number (14) in 1991 that can treat irresponsible employee. And as for amending the deformity of the project: they can as per stipulation of contracting for civil engineer works to take a legal discipline with the project contractor, because points are not our commission’s expert (specialty). 3- Giving advisory about project law from board of supreme audit of Kurdistan region government : - After a request from Kurdistan region’s board of supreme audit to our commission to give opinion and advisory about project law of board

of supreme audit in 2018 in advisory department, we came into reading the law and revising the terms of this law, in the result we suggested some revising in some of contents in conceptual laws and the rightful use of conceptual laws and authorities and how to fulfill the mentioned law in a way that service to end corruption. 4- Giving opinion and advisory about directing a written document in some of notary departments to our commission in 2018 in which it requested an investigation about corruption cases: - We had received some written texts from notary departments in Erbil in which it was requested to investigate some cases, as per law none of organizations can request our commission by a written document for the purpose of investigation, so we suggested like that ( as pre law of commission of integrity in Kurdistan region number (3) for 2011 the revised law number (7) of 2014 this commission as per term second has its own moral ethic and financial independent, administration and has its own budget and it is under supervision of parliament. - And also as per law five term second and that is its content ((receiving informant, information and complain about a corruption by all means and ways and from all sources)). - So we as commission of integrity any news or information by any means or from anybody or any party if it is from our specialty we work on it, and it is not needed by any means from a notary organization (departments) to order our commission for an investigation). 5- And also this department in addition to its tasks came on visiting social reformation directorate and police directorate/department of arresting and transferring Kurdistan region’s cities by composing a higher committee by an administrational written order number (133) in 14/11/2016 with a cooperation of minor committees of Sulimaniah province by a written order number (191) in 29/10/2017 and minor

 For information there a monthly visit routinely to prison that with exception of sudden visits for the purpose of knowing condition of captured and punished in all aspects, after sending the minor committees reports it be arranged with the major committee report and will be raised up.

Monitoring and Administrative Reformation Department

The main task of this department is:- 1) Observing decisions and performs of public sectors as to see to which degree there is integrity in their decision and performance. 2) Monitoring the way of spending and the way of using Kurdistan region income in coordination with divan of financial observation. 3) Publishing reports from time to time about those spending. 4) Following the works of those committees which has been composed in commission or those that has a relation to the works of our commission. 5) Renewing information about the facts of region, all public entity, and privates, incomes, and employees, head of the office and performance administration.

This department consists of 4 rooms

1) Integrity and Administrative Reformation room Pursuing these decisions, orders and contracts which has been performed by an officials of Region Government, and collecting information about those actions which has doubts that is against legal laws or integrity can’t be displayed, and also comparing with those statistics which are needed to have in commission of integrity, and also comes up by receiving expert thoughts and collecting those evidence so

they can perform it in accurate and right manner.

2) Committees Room:- Their work is to organize and documenting investigation committee’s work which has been composed in our commission, and also organizing committee’s work of (inclusion) and external committees (foreign) and executing the suggestions of these committees.

3) Monitoring of Region Income Room:- Their duty is to monitor the behavior of how region’s income is spent and the way of managing and showing financial rebellion and identifying the violation and noting about them in coordination with Divan of financial observation and rising rounded reports to the honored Head of Commission.

Division of disclosure financial interests

According to article (48) from the law of commission of integrity in Kurdistan region-Iraq No (1) for the year 2016. This division is revealing the illegal gain that includes houses, auto mobiles, economical incomes and bank credits inside and outside the region. This division follows up every step of filling the forms and checking the information and when they return it back. According to the same article this division is consist of subdivisions (documenting, following up, searching for the readability). The first six months of 2018 this division has done some assignments and activities: 1. Sending the forms of revealing financial interest : as to article (Fifth.Eighth.3) from the law of the commission of integrity in Kurdistan region-Iraq, No (3) for the year 2011 and article (2) from the principle of revealing illegal gain economical level No (2) for the year 2016, our department has sent the forms of disclosure all the types (First form - periodical form - last form) for all those who are responsible to fill it in Kurdistan’s offices and receiving back the filled forms , some of those didn’t send it at the dead time so we sent them official written document to remind them. It is worth to be mentioned that region’s offices were helpful with this process except (Meen Foundation, ministry of peshmarga, safety) till now they didn’t send us the forms although we sent them more than one official written document reminder and phone calls but no answer from them. Below a table that shows the number of the forms that have been sent andhow much have returned back returned back :

2. Internal audit for disclosure of financial interest tracking article (10) of the principle of disclosure financial interests No (2) for the year 2016 our division has an internal auditing for most of the forms that have returned to the commission, in purpose of determining any mistake in filling the forms to return it back to the candidates to refill the missing field. 3. External auditing for disclosure of financial interests. In purpose of investigating about the reliability of the information of the forms that have been provided by the candidate themselves, a committee was formed to verify the information this committee was formed of the responsible of this division and some other employees of this division visited each of:  Ministry of justice/ general directorate of recording real Estate.  Ministry of interior/general directorate of traffic  Ministry of finance /the branch of central bank in Kurdistan region/Erbil.  Ministry of trade and industry/general directorate of recording companies. To collect information about the candidates who filled the form and compared with the forms that have been filled by them till now we have investigated about some of the returned forms and we got different results but because of the secrecy we can’t mention it in this report. It is

worth mentioning that this process’s going on so negligent cause the directorates take too much time to answer our request and that is may be because they don’t have enough information or lack of progressed database, or any other reason that in linked to keep the secrecy of the information according to the result of this auditing we have connected to many candidates to clarify the reason behind not writing their property in the forms according to the reports we received in the mentioned offices. 4. Protecting the disclosure of financial assets forms. In purpose of protecting the forms our division have been provided by its need, started the process of scanning all the returned forms in all it’s types (first form-periodical-last form) have been organized on the base of type of the form, name of the candidates, code of the form, place of the posts.

1 . Collecting data about Kurdistan region’s offices. Their offices name, their address, their phone number and the representative of the offices and his number and saving all this date in a guide book and then we share it in commission’s website and many other websites and popularizing it in a written form to all region’s offices in a formal written letter No 3/83 in 19/12/2018.

2 Our division’s staff have participated in many courses like (Gender) and (learning English language). 3 Participating in a seminar of ministry of interior that was about quality system in Kurdistan region’s offices. 4 According to paragraph No (7) of article (5) from the law of commission of integrity in Kurdistan region No(3) for the year 2011(changed law)36 of instruction and article No(1) for the year 2016 (behavioral instruction for the public sector’s employees in Kurdistan Region that have been issued by commission of integrity and have been published in No (204) for the year 2016 in (Waqaea Kurdistan) and in 26/11/2018 we sent the pledge that we prepared for all the region’s offices in a formal letter No(75/3) in order to be signed by all the region’s employees on a copy of that pledge and to be saved in their self-file . 5 Because now it’s time for the new cabinet in Kurdistan regional government, so we sent letter to the presidency of the parliament and all parliament parties we wanted them to work on the principle of (the right person in the right place) for all the posts below the

Assignments and activities of division of relation with NGO

In February we had arranged a survey about the effect of saved salary on corruption in Kurdistan region’s offices in Erbil, Sulaimania, Duhok. In April all the media have shared the result of this survey, and many offices have been developed depending on the result of this survey. Our division participated in a conference about sharing reports of observing how they apply the law of getting information(data) In Kurdistan region, this conference have been prepared by (Media Target) depending on (National Endowment for Democracy in Erbil). In 17/03/2018 we participated in Public participation platform conference in Erbil, the participant were some private sectors organization, parliament memberships, the representative of commission of human rights and many other participants, this conference have been arranged by Reform institution for development. Conference’s is main goal was to maintaining freedom and cooperation between organizations. The responsible of this division was the representative of commission of integrity. Participating in a meeting that has been arranged by Reform Institution for development, the participant was some organizations and region’s offices. Participating in a conference of living together in peace between region’s different religious that have been prepared by Zhyan Foundation for human rights in cooperation with ministry of Awqaf in 17/10/2018 in Erbil Quartz Hotel arranged in Erbil.

 Local governmental sector: this workshop done in 11/07/2018 at Chwarchra Hotel at 10:00am, with the participant of the head of our commission and the head of RID foundation, the representative of the governments and the administrative of Garmyan, Raparin and the council of Governments.  Specialist foundation in applying law(justice, public prosecution, commission of integrity, police, security) this workshop done in 18/07/2018 at Chwarchra Hotel at 10:00am,with the participant of the head of our commission, director general and division representatives and the head of RID foundation and the representative of public prosecution, council of justice, director general of police in the region, director general of police in Erbil, Sulaimania, Dohuk, Halabja, and the administrative of Garmyan and Raparin also participated.  General economic sector: done in 25/7/2018 at commission of integrity at 10:00 am with the participant of the head of our commission, director general, division representatives, the head of RID foundation, some civil organization and office of financial supervision, ministry of finance and department of finance, administrative in the council of ministers and finance committee of Kurdistan parliament.  International and regional relation and cooperation sector: done in 25/7/2018 at commission of integrity at 10:00 am with the participant of the head of our commission, director general, division representatives, the head of RID foundation and the representative of each (department of relation, ministry of planning , department of NGOs)

Political sector: done in 31/10/2018 at commission of integrity at 10:00 am, with the presence of the head of the commission, director general, representative of the divisions, the head of RID and the representative of the office of financial supervision, ministry of finance, ministry of trade and business and construction authority, trade committee and director general of investment in Erbil. Regional offices sector: done in 27/11/2018 at our commission at 10:00am with the presence of head of commission, the director generals, division’s representative, the head of RID foundation, the secretary of council of ministers, department of cooperation and following up, the director general of the divan of Kurdistan parliament, the representative of Kurdistan regional government and department of cooperation and following up at the ministry of councils. At the meeting all the ideas and suggestion have been presented and RID foundation and commission of integrity are reviewing this idea and suggestion as have been mentioned in the meetings that the latest amendment on this strategy a copy of it will be given to all those who participated in the meetings and at the end it has been decided that it will be talked about in a press conference.

The survey contents seven questions:

 96.9% participant’s answer was yes.  Corruption is found in governmental offices (30.5% private sector) (1.6% NGOs).  Percentage of corruption in normal employees 20%, director general 3.8%, high posts 30.9%.  Statistic if this salary saving is legal or not the answer was 90.3% is illegal.  Statistic of how was corruption’s level before this salary saving was 70.4%.  Statics shows that corruption after salary saving was 74.1%.  Statics shows that the effect of salary saving 65.5% percentage shows that salary saving effect on corruption level and 28.4% answered with NO and 5.0% answered we don’t know.

Finance division

This division’s responsibility is to formulate yearly budget and arranging all the enrolment maintenance, getting and disbursements of payments, and arranging monthly budget, financial reports,employess salary and recording all the financial issues in recordings and disbursements contract’s payments in cooperation with legal department in our commission As to the account we do have in Brayati Bank is: 1. Account No (129) for usual use. 2. Account No (122) for the salary of commission’s employees and contract ones. 3. Account No (173) a closed account for our commission.

 Because of the financial situation of not having a budget in Kurdistan region , so the commission also didn’t have its own budget so it had its effect on our plan of working and fighting corruption although we tried our best to have less expenses which is (10,000,000) per month.

Engineering division The core assignment of this division:  Collecting personal information about commission’s employees  Designing building architecture of the commission in cooperation with ministry of construction and housing.  Arranging statistic issues.

1. Maintenance and fixing commission’s camera system. 2. Adding more cameras for commission’s parking. 3. Fixing all commission’s computer and internet problems. 4. Working on HR system with Patris Company is going on till now. 5. We completed employees system of shift attendance. 6. We successfully finished the system of requesting leaves. 7. Starting the process of staff electronic. 8. Working on integrity generation booklet in cooperation with division of training and development. 9. Designing some art and book cover for the commission. 10. Designing document database for the office of the head of commission of integrity. 11. Visiting Sulaimania and Dohuk in order to add employees to the HR system.

Division of interior auditing Assignment of interior auditing 1. Auditing the salary’s registration and list of salary. 2. Auditing daily registration, provisions, and simple expenses. 3.
