Background 1.1 The Air Weapons and Licensing (Scotland) Act 2015 amended the Licensing (Scotland) Act 2005 (“the Act”) to introduce a requirement that Licensing Boards produce and publish annual functions reports. 1.2 As a consequence, section 9A was inserted into the Act and came into force on 20 December 2017. 1.3 Section 9A of the Act states that the Board’s annual functions report must be prepared and published not later than 3 months after the end of each financial year. This means that the Board’s report for the financial year 2019-20 must be published, under normal circumstances, by no later than the end of June 2020. It is noted that under schedule 5 of the Coronavirus (Scotland) Act 2020 that a further 9 months is available to the Board if they are unable to publish their annual functions report by the end of June, due to a reason relating to coronavirus, but that is not required in this case. 1.4 The functions report must include- (a) a statement explaining how the Board has regard to- (i) the licensing objectives, and (ii) their licensing policy statement and any supplementary licensing policy statement (including the Board’s statement under section 7(1) (duty to assess

    . 2 Chairman’s Ramblings Winter is approaching fast and another biking season draws to a close and it seems as you get older the months fly past, or is the same for you younger ones also? We have had quite an eventful year with a steady growth in New Associates and test passes, although on the negative side, we have seen one or two test failures, which always leads to the inquest afterwards whereby the Observers involved cannot understand the reasons why. Test failures can be attributed to many factors as no two people react to test situations in the same manner. To some it is simply another ride-out and to others it is a major ordeal. Test nerves are probably the most common reason, which in themselves can trigger a break down in concentration, causing the candidate to make silly mistakes that they would not normally make. It should always be remembered that the Associate is only as good as the hour or so he is under the microscope during a test and may have ridden perfectly whilst under guidance but falls apart under test conditions. It stresses the need for an Associate to not only take guidance from his Observer, but to supplement this guidance with knowledge from Roadcraft as well as practical riding experience to perfect the new skills. The important thing is to put it down to experience, not lose heart and focus on getting the next one right. I have some changes to announce: Malcolm Lonsdale has been appointed Regional Motorcycle Adviser by the I.A.M and has relinquished his position as Team Leader (Northumberland) to Nick Maddison.

Their purpose is to guide aquaculture development to appropriate locations and to help minimise conflicts of interest. This updated plan for Loch Inchard replaces the version prepared in 1988 and is one of a second generation of plans designed for the current decade. Like its predecessor, the plan’s status is at present advisory rather than statutory. However, the Crown Estate’s planning role is in the process of being transferred to local authorities. Marine aquaculture installations are therefore likely to come within the scope of statutory planning control during the lifetime of this plan. Another key change is that the EU’s Environmental Assessment regulations, updated in March 1999, now embrace aquaculture developments to a much greater extent than before.

    Issue No 73 January/February 2001 The Magazine of the Associated Presbyterian Churches in Scotland The Tay Bridge Disaster Every now and again, the citizens of Dundee are reminded of the area’s worst disaster – the collapse of the Tay Rail Bridge as a train was crossing over it in 1879. The disaster is more memorable because it happened in the middle of the festive season. Everyone on board was killed, both passengers and crew – 75 people in all. Letters still appear in the local press about memories from grandparents and relatives of those who lost their lives. The incident below however, is quite unique!     The Highland Licensing Board Agenda 10 Item Meeting – 26 June 2018 Report HLB/078/18 No Highland Licensing Board Consultation Draft Policy Statement 2018-2023 Report by the Clerk to the Licensing Board Summary This report invites the Board to agree the terms of a draft policy statement 2018- 2023 to be published for consultation. 1. Background 1.1 On 27 March 2018 the Board agreed its timetable for preparation of its next statement of licensing policy which will apply from 4 November 2018 to 3 November 2023. 1.2 The first stage in this process was the initial evidence-gathering exercise, where various parties were invited to submit relevant evidence to inform the preparation of a consultation draft statement. This has now been completed and a proposed consultation draft prepared by the Clerk is attached at Appendix 1. 1.3 The principal submission received was from the Directorate of Public Health and Health Policy, NHS Highland, May 2018. This focuses on evidence related to the assessment of overprovision of licensed premises in the Board’s area and is attached at Appendix 2. It concludes with a recommendation that the Board consider four separate options put forward by NHS Highland in respect of the Board’s overprovision policy. 1.4 A number of submissions were also received from the Highland Licensing Forum, inviting the Board to consider amending or adding various policies and supplementary guidance into the policy statement.
